In this essay the author examines the burgeoning industry of ecotourism, analyzing definitions of "ecotourism" and exploring a number of compelling issues raised by the recent trend in worldwide tourism. She then examines three sample codes of ecotourism: one site-specific (Antarctic Traveller's Code), one from a major environmental group (National Audubon Society), and one developed by a consultant for a travel research firm (Code for Leisure Destination Development). The presuppositions, value, and limitations of these codes are then analyzed. On the (...) basis of this analysis, the author proceeds to a discussion of the frameworks for negotiating discourses about ecotourism. Stark argues that the limitations detected in the sample codes of ethics for ecotourism would be fruitfully addressed by J rgen Habermas's discourse ethics augmented by the feminist ethical and political theories of Seyla Benhabib who draws on the work of Hannah Arendt. While bracketing the debates surrounding the justification of Habermas's principle of universalizability, the author argues that the overemphasis on the rational aspects both of the principle itself and on the notion of "rational trust" stand in need of a corrective if discourse ethics is to be used successfully in negotiating real-life conflicts. Stark argues for a kind of "application discourse" using the feminist ethical and political theories of Benhabib drawn from Arendt's work in which "associational public spaces" are created through relational processes in the acts themselves of meeting and discourse. The author claims that Benhabib and Arendt's works contain fruitful theoretical approaches that also leave room to deal with policies and practical applications as debates about ecotourism increase around the world. Far from exhausting the possibilities, this essay opens up the connections between these theoretical approaches and a new area of environmental concern-- ecotourism. (shrink)

The results of his enterprise continue to be felt, especially with regard to the contested topics of human embodiment, sexuality, and the nature and roles of women. As a result, few thinkers have (...) been as problematic for feminists as he has been. He is the thinker that a number of feminists love to hate. What do feminist thinkers make of this problematic legacy? The twentieth century was unprecedented in the scope and enormity of the terrible deeds that human beings perpetrated against their fellows. Oftentimes, the unjust detention, imprisonment, tortures, and executions were set in motion by the event of the arrest. This paper examines the phenomenon of the arrest as it is depicted in two of the century’s literary giants -- Franz Kafka and Alexander Solzhenitsyn. Uncanny correspondences can be detected particularly between Kafka’s novel The Trial and Solzhenitsyn’s memoir The Gulag Archipelago. (...) Moreover, through Kafka’s powerful literary imagination, he created works containing many features that were later to stand at the heart of the terror of totalitarian regimes. This paper analyzes and explores the arrest and, as a result, a philosophical typology of the arrest emerges. Due to the power and scope of Kafka’s genius, his work both prefigures and expresses many of the essential characteristics of totalitarian regimes that come to be enacted in flesh and blood later in the century. In The Trial, the arrest may be seen as an eerie and surreal foreshadowing of the millions of morally outrageous and legally spurious arrests that were to come in the twentieth century. (shrink)

After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. Judith Butler’s recent work is exemplary of the trend in contemporary theory to consider ethics. Her deliberation over ethical questions, and the place of ethics in intellectual work, has undeniably intensified since September 11. This article will demonstrate, however, that this is a rendering explicit of what has always been implicit in her work. Rather than perceiving the ethical dimension of Butler’s writings in her increasing interest in thinkers such as Emmanuel Levinas and Hannah Arendt, I contend that it (...) is in her sustained interest in Hegel, and specifically in Hegelian recognition, that her work can be read as engaged with ethical concerns. This article highlights the growing critical concern with the prevalence of recognition in ethical theory and questions the possibility of theorising ethics outside of the recognition-paradigm. This article presents evidence regarding aspects of the gendered nature of care women with gynaecological cancer receive from their (usually) male surgeons and oncologists in Australia. We argue that despite women’s general preference for female gynaecologists, those with a gynaecological cancer develop a strong therapeutic relationship with their male medical specialist, not extended to their (usually) female nurses and other allied health professionals. Given the highly sensitive and sexualized nature of gynaecological cancer, this requires explanation. These findings can be partly (...) explained by examining the division of labour between nurses and doctors, specifically issues of control over this process and the development of specializations. The findings also bring into stark relief the way in which power and status differences can be used by medicine to create a positive therapeutic relationship with patients while simultaneously de-eroticizing the intimate procedures necessary in assisting women throughout their cancer treatment. Importantly, this relationship also has relevance for policy makers, particularly those concerned with the highly gendered division of labour of the medical specialty workforce in Australia. Judith Shklar wrote about Hannah Arendt throughout her career. However, her nuanced readings are often ignored by scholars who prefer to depict both philosophers as stark counter-images. In this paper, I offer a more complex comparison on the basis of all of Shklar’s writings about Arendt. Shklar’s critique is grounded in what she sees as the Romantic strand in Arendt’s thought, which she identifies with a metaphysical, elitist, and aestheticizing stance towards politics, a distaste for modernity, and a (...) nostalgia for Greek antiquity. For Shklar, this position comes to the fore both in what she believes to be Arendt’s purely therapeutic notion of revolution as well as the rejection of her own Jewish identity. Nevertheless, Shklar also admired Arendt’s insights about exile and her appreciation of Kant. Through her sustained critique of Arendt, Shklar developed her own conception of a realist, rights-affirming, and anti-metaphysical liberalism. (shrink)

The unlivable is the most extreme point of human suffering and injustice. But what is it exactly? How do we define the unlivable? And what can we do to prevent and repair it? These are the intriguing questions Judith Butler and Frédéric Worms discuss in a captivating dialogue situated at the crossroads of contemporary life and politics. Here, Judith Butler criticizes the norms that make life precarious and unlivable, while Frédéric Worms appeals to a "critical vitalism" as a (...) way of allowing the hardship of the unlivable to reveal what is vital for us. Care and support, in all their aspects, make human life livable, that is, "more than living." This book brings together a group of Judith Butler's philosophical essays written over two decades that elaborate her reflections on the roles of the passions in subject formation through an engagement with Hegel, Kierkegaard, Descartes, Spinoza, Malebranche, Merleau-Ponty, Freud, Irigaray, and Fanon. Drawing on her early work on Hegelian desire and her subsequent reflections on the psychic life of power and the possibility of self-narration, this book considers how passions such as desire, rage, love, and grief are bound up (...) with becoming a subject within specific historical fields of power. Butler shows in different philosophical contexts how the self that seeks to make itself finds itself already affected and formed against its will by social and discursive powers. And yet, agency and action are not necessarily nullified by this primary impingement. Primary sense impressions register this dual situation of being acted on and acting, countering the idea that acting requires one to overcome the situation of being affected by others and the linguistic and social world. This dual structure of sense sheds light on the desire to live, the practice and peril of grieving, embodied resistance, love, and modes of enthrallment and dispossession. Working with theories of embodiment, desire, and relationality in conversation with philosophers as diverse as Hegel, Spinoza, Descartes, Merleau-Ponty, Freud, and Fanon, Butler reanimates and revises her basic propositions concerning the constitution and deconstitution of the subject within fields of power, taking up key issues of gender, sexuality, and race in several analyses. Existing justifications for exclusionary rules and stays of proceedings in response to pre-trial wrongdoing by police officers and prosecutors are often thought to be counter-productive or disproportionate in their consequences. This article begins to explore whether the concept of standing to blame can provide a fresh justification for such responses. It focuses on a vice related to standing—hypocrisy—and a related vice concerning inconsistent blame. It takes seriously the point that criminal justice agencies, although all part of the State, are in (...) real terms separated from each other, and analyses the so-called separation thesis (or theses). It concludes that hypocrisy and inconsistent blame arguments could plausibly justify exclusion and stays only in relation to lower-level offending, and even there only indirectly. This is in the sense that exclusion and stays are expressions of judicial frustration with other bodies for their failure to take pre-trial wrongdoing seriously. (shrink)

In this paper I propose a new theoretical framework to analyse socio‐technical epistemic practices and systems on the Web and beyond, and apply it to the topic of web‐based scientific publishing. This framework is informed by social epistemology, science and technology studies (STS) and feminist epistemology. Its core consists of a tripartite classification of socio‐technical epistemic systems based on the mechanisms of closure they employ to terminate socio‐epistemic processes in which multiple agents are involved. In particular I distinguish three mechanisms (...) of closure, integration, aggregation and selection, and argue that they correspond to three different types of epistemic sociality. Different systems can employ different mechanism of closure or combinations thereof. Yet each mechanism has its own epistemic merits, depends on specific social, technical and epistemic prerequisites, has different strengths and weaknesses, and is optimal for different epistemic tasks. The aim of my analysis is twofold. Distinguishing different modes of epistemic sociality is a way for me not only to put forward a more nuanced framework for analysing socio‐epistemic practices, such as web‐based scientific publishing and scholarly communication.
