One of the most potent motivations for retributivist approaches to punishment has been their apparent connection to an ethical background shaped by the Kantian notion of morally autonomous and rational human agency. The present article challenges the plausibility of this connection. I argue that retributivism subverts, rather than embodies, the normative consequences of moral autonomy, justifying a social practice that conflicts with the considered judgments that the proper recognition of moral autonomy would authorize. The core of my case is the (...) analysis of whether a punishment should be understood as a restriction of a criminal's freedom properly understood. I argue that the affirmative view faces serious difficulties that have not been, and are not likely to be, resolved by retributivist justifications that draw their support from Kantian moral theory. We develop a theory of joint intention in contexts in which participants have mixed motives that can manifest in all-things-considered reasons to deviate from contributing to the desired project, e.g., contexts with collective action problems. Our theory is based on strategic equilibrium-based reasoning, which links the characterization of joint intention in terms of individual intentions with conditions on strategy profiles of the underlying strategic games. We use elements of equilibrium reasoning to construct a counterfactual account of joint intention in the (...) mixed-motive contexts, which extends the reach of the notion of joint intention considerably beyond that of previous formulations. We re-examine the relationship between coordination, legal sanctions, and free-riding in light of the recent controversy regarding the applicability of the coordination problem paradigm of law-making. We argue that legal sanctions can help solve coordination problems by eliminating socially suboptimal equilibrium outcomes. Once coordination has taken place, however, free-riding can not lead to the breakdown of coordination outcomes, even if sanctions may still be effective at increasing the equity of such outcomes. Finally, we argue that it is the choice of (...) a legal or constitutional system rather than the choice of law that is paradigmatic of the coordination problem. This view requires a re-assessment of the normative status of sanctions attached to individual laws. (shrink)

Causal mechanisms' portability and their predictions in sometimes counterfactual settings point to the value of studies with details of interactions and/or convenience samples that depart from those in the proximate contexts of the phenomena of interest. The proper role of such contexts must be construed within an explanatory framework attentive to the nature and properties of relevant causal mechanisms.

Heidegger and Sartre developed the projects of their fundamental ontologies within the framework of the phenomenological approach. The traditional view of reality is based on dualistic oppositions of ideal and material, spirit and body, reality and possibility, and visibility and essence. According to both authors, phenomenology enables elimination of the above-mentioned dualisms and restoration of the world’s ontological unity on a reliable foundation. A special attention is paid to a problem of authenticity and transcendence from the point of view of (...) above-mentioned ontological concepts. The problem of authenticity is one of the main issues of human life: the person can come up against a situation of a tough choice and get to a special paradigm of submission that it is practically similar to loss of own authenticity. Method of a research is the comparative analysis of approaches of Sartre and Heidegger to phenomena of freedom, authenticity, the truth and being. In addition, the analysis of a modern discussion on this subject is carried out. The main conclusion of this research is that though Sartre's existentialism was exposed to criticism both from right, and from the left intellectuals, and is not a "fashionable" current at present, and the fundamental ontology of Heidegger was estimated by Levinas as ontology of the power subject-centered line, nevertheless the author considers that attention which is paid in these concepts to such phenomena as the voice of conscience, care and freedom represents the most urgent philosophical value nowadays; the author in this regard points to insufficient validity of modern criticism of approaches of Heidegger and Sartre, in particular - reproaches in a subject-centered line from adherents of "ontology of the Other". The present paper aims at highlighting some of the main characteristics of a descriptive contextual approach to philosophy. Descriptive, in the sense that it centers not on the question of what philosophy should be, but on what philosophy is, has been, or may be. And contextual, in the sense that it treats philosophy as human praxis situated in and interacting with certain social and historical settings. In order to develop such an account, we engage closely with Kuhn’s paradigm-centered contextual approach (...) to science and examine, following Rorty, how it could be regarded in connection to philosophy. The paper concludes with a brief discussion of two concrete cases to which such an approach may be applied, the division between analytic and continental philosophy at the level of philosophical traditions, and the case of Wittgenstein’s life and thought at the level of individual philosophers. Computational perspectivalism has been recently proposed as an alternative to mainstream accounts of physical computation, and especially to the teleologically-based mechanistic view. It takes physical computation to be partly dependent on explanatory perspectives and eschews appeal to teleology in helping individuate computational systems. I assess several varieties of computational perspectivalism, showing that they either collapse into existing non-perspectival views or end up with unsatisfactory or implausible accounts of physical computation. Computational perspectivalism fails, therefore, to be a compelling alternative to perspective-independent (...) theories of computation in physical systems. In The Principles of Art, R. G. Collingwood pursues, on the one hand, a ‘definition’ of art, and, on the other, a ‘metaphysics’. The Principles is divided into three Books. Book I is devoted mostly to craft, while Book II pertains largely to metaphysics. The fact that Book II is twice the size of Book III, where the discussion of ‘art proper’ takes place, is proof enough that the metaphysical part of the Principles is not a mere excursus. Collingwood’s ontology (...) is indispensable for understanding his aesthetics, and vice versa. The crucial link is the imagination. What Collingwood calls ‘total imaginative experience’ is described in the Principles as the sine qua non of both thought and sensibility. This paper undertakes an analysis of the narrativity of a form of discourse which has appeared recently (blogs) within the framework of an emergentist theory of narrativity and its discursive modes. The narrative/discursive characteristics of blogs emerge from a preexistent ground of more basic or less specific communicative practices; and narrative discursivity itself is an emergent phenomenon with respect to other cognitive and experiential phenomena. This paper proposes a methodological synthesis in order to study multimodal media discourse and argumentation in the context of the so-called ‘refugee crisis’ in Greece. It follows the framework of Multimodal Critical Discourse Analysis, integrating this with argumentation studies, with a particular emphasis on the analysis of inference. Our data come from the Greek newspapers Kathimerini and Ta Nea. We contend that the proposed methodological synergy enables scrutiny of (a) racist conceptualizations cultivated by the representation of migrants and refugees in (...) headlines and photographs in newspaper articles along with (b) the argumentative potential that is implicitly sustained in these multimodal representations. In this article, moving from being to becoming, we construe the ‘self’ as a dynamic process rather than as a static entity. To this end we draw on dialectics and Bayesian accounts of cognition. The former allows us to holistically consider the ‘self’ as the interplay between internalization and externalization and the latter to operationalize our suggestion formally. Internalization is considered here as the co-construction of bodily hierarchical models of the world and the organism, while externalization is taken as the (...) collective transformation of the world. We do not consider these processes as sequentially linked, but rather as a dialectic between the collective and the individual. This leads us to the suggestion of the self as a historical product of dialectical attunement across multiple time scales, from species evolution and culture to individual development and everyday learning. Subsequently, we describe concrete means for empirically testing our proposal in the form of two-person psychophysiology and multi-level analyses of intersubjectivity. Taken together, we suggest that a fine-grained analysis of social interaction might allow us to reconsider the ‘self’ beyond the static individual, i.e. how it emerges and manifests itself in social relations. Such an approach, we believe, could be relevant in multiple fields, from ethics and psychiatry to pedagogy and artificial intelligence. (shrink)

I examine a major objection to the mechanistic view of concrete computation, stemming from an apparent tension between the abstract nature of computational explanation and the tenets of the mechanistic framework: while computational explanation is medium-independent, the mechanistic framework insists on the importance of providing some degree of structural detail about the systems target of the explanation. I show that a common reply to the objection, i.e. that mechanistic explanation of computational systems involves only weak structural constraints, is not enough (...) to save the standard mechanistic view of computation—it trivialises the appeal to mechanism, and thus makes the account collapse into a purely functional view. I claim, however, that the objection can be put to rest once the account is appropriately amended: computational individuation is indeed functional, while mechanistic explanation plays a role in accounting for computational implementation. Since individuation and implementation are crucial elements in a satisfying account of computation in physical systems, mechanism keeps its central importance in the theory of concrete computation. Finally, I argue that my version of the mechanistic view helps to provide a convincing reply to a powerful objection against non-semantic theories of concrete computation: the argument from the multiplicity of computations. Debate on the nature of representation in cognitive systems tends to oscillate between robustly realist views and various anti‐realist options. I defend an alternative view, deflationary realism, which sees cognitive representation as an offshoot of the extended application to cognitive systems of an explanatory model whose primary domain is public representation use. This extended application, justified by a common explanatory target, embodies idealisations, partial mismatches between model and reality. By seeing representation as part of an idealised model, deflationary realism avoids (...) the problems with robust realist views, while keeping allegiance to realism. (shrink)

Vardoulakis examines the connection between the political and aesthetic commitments of the philosophies of Martin Heidegger and Walter Benjamin. He compares "The Origin of the Work of Art" to "The Work of Art in the Age of Technological Reproducibility.".

ABSTRACT Kant regarded ecosphere as having the highest degree of beauty, as opposed to other aesthetical objects such as painting, sculpture, buildings, and we could infer, the built environment. His arguments hinges heavily on his transcendental philosophy, where he stressed that pure beauty could only be achieved through disinterested judgement, without concept, and others. Though his proposition for ecosphere is valid, it could not be used to justify other cases, such as determining the degree of beauty of the built environment. (...) Thus, a modified version of Kant's aesthetics needs to be adopted, as it opens space for the built environment. This research uses Kant's overarching aesthetical arguments to justify the degree of beauty of the built environment. It is found that the built environment could have similar, if not same to, the degree of beauty of ecosphere by way of bioregionalism and ecomimicry, where the totality of the built environment encompases the natural law of local environment, making its degree of beauty as high as ecosphere. Penelitian ini menggunakan teori estetika Kant untuk menjustifikasi derajat keindahan lingkungan buatan alam. Dipertahankan bahwa lingkungan buatan manusia memiliki derajat keindahan yang sangat mendekati, bahkan sama, dengan lingkungan buatan alam jika, dan hanya jika, lingkungan buatan tersebut mengadopsi konsep bioregionalisme dan ecomimicry, di mana totalitas dari lingkungan buatan manusia mencakupi hukum alam yang terdapat di daerah lokal, meningkatkan derajat keindahan lingkungan buatan tersebut. The present article aims at investigating the political aspects of Wittgenstein’s later philosophy, focusing mainly on the Philosophical Investigations. This theme remains rather marginal within Wittgensteinian scholarship, facing the key challenge of the sparsity of explicit discussions of political issues in Wittgenstein’s writings. Based on the broader anthropological and synecdochic character of Wittgenstein’s later philosophy, the main objective of the article is to make explicit the implicit political import of some of the main themes of the Philosophical Investigations. This is (...) done by correlating them with certain political concepts and issues, such as reification, mystification, emancipation, self-institution and the common. Dimitris Vardoulakis asks how it is possible to think of a politics that is not commensurate with sovereignty. For such a politics, he argues, sovereignty is defined not in terms of the exception but as the different ways in which violence is justified. Vardoulakis shows how it is possible to deconstruct the various justifications of violence. Such dejustifications can take place only by presupposing an other to sovereignty, which Vardoulakis identifies with agonistic democracy. Economics has become a monolithic science, variously described as formalistic and autistic with neoclassical orthodoxy reigning supreme. So argue Dimitris Milonakis and Ben Fine in this new major work of critical recollection. The authors show how economics was once rich, diverse, multidimensional and pluralistic, and unravel the processes that lead to orthodoxy’s current predicament. The book details how political economy became economics through the desocialisation and the dehistoricisation of the dismal science, accompanied by the separation of economics from the other (...) social sciences, especially economic history and sociology. It is argued that recent attempts from within economics to address the social and the historical have failed to acknowledge long standing debates amongst economists, historians and other social scientists. This has resulted in an impoverished historical and social content within mainstream economics. The book ranges over the shifting role of the historical and the social in economic theory, the shifting boundaries between the economic and the non-economic, all within a methodological context. Schools of thought and individuals, that have been neglected or marginalised, are treated in full, including classical political economy and Marx, the German and British historical schools, American institutionalism, Weber and Schumpeter and their programme of Socialökonomik, and the Austrian school. At the same time, developments within the mainstream tradition from marginalism through Marshall and Keynes to general equilibrium theory are also scrutinised, and the clashes between the various camps from the famous Methodenstreit to the fierce debates of the 1930s and beyond brought to the fore. The prime rationale underpinning this account drawn from the past is to put the case for political economy back on the agenda. This is done by treating economics as a social science once again, rather than as a positive science, as has been the inclination since the time of Jevons and Walras. It involves transcending the boundaries of the social sciences, but in a particular way that is in exactly the opposite direction now being taken by "economics imperialism". Drawing on the rich traditions of the past, the reintroduction and full incorporation of the social and the historical into the main corpus of political economy will be possible in the future. This study recapitulates basic developments in the tradition of hermeneutic and phenomenological studies of science. It focuses on the ways in which scientific research is committed to the universe of interpretative phenomena. It treats scientific research by addressing its characteristic hermeneutic situations, and uses the following basic argument in this treatment: By demonstrating that science's epistemological identity is not to be spelled out in terms of objectivism, mathematical essentialism, representationalism, and foundationalism, one undermines scientism without succumbing scientific research to "procedures (...) of normative-democratic control" that threaten science's cognitive autonomy. The study shows that in contrast to social constructivism, hermeneutic phenomenology of scientific research makes the case that overcoming scientism does not imply restrictive policies regarding the constitution of scientific objects. Gender researchers have only recently begun to identify how women perceive and explain the costs and benefits associated with different femininities. Yet status hierarchies among historically white college sororities are explicit and cannot be ignored, forcing sorority women to grapple with constructions of feminine worth. Drawing on interviews with women in these sororities, we are able to capture college women’s attitudes toward status rankings that prioritize adherence to narrow models of gender complementarity. Sorority chapters were ranked according to women’s perceived (...) heterosexual appeal to elite men. Women believed that top-ranked sororities conferred social power whereas middle- and bottom-ranked sororities offered greater freedom from policing over members’ bodies, fashion, and socializing. However, middle- and bottom-ranked sororities sometimes sought to rise in the rankings. When this occurred, existing members were marginalized, and a new pledge class with a greater tolerance for socializing with high-status “rapey” fraternities was sought. Women’s discussions of sorority rankings show evidence of a hybrid femininity that fuses practices from traditional models of gender complementarity and more recent models of women’s empowerment. In the literature on the nature and role of cognitive representation, three positions are taken across the conceptual landscape: robust realism, primitivism, and eliminativism. Recently, a fourth alternative that tries to avoid the shortcomings of traditional views has been proposed: content pragmatism. My aim is to defend pragmatism about content against some recent objections moved against the view. According to these objections, content pragmatism fails to capture the role played by representation in the cognitive sciences; and/or is an unstable view (...) that ends up collapsing into one of the traditional alternatives. I argue that those arguments fail. I show that content pragmatism has as much claim to descriptive adequacy as the traditional theories. Moreover, I defend the robustness of the view by arguing that it does not collapse into any of the traditional positions. Content pragmatism therefore offers a valid and coherent account of the nature of representational content. (shrink)

We characterize Morita equivalence of theories in the sense of Johnstone in terms of a new syntactic notion of a common definitional extension developed by Barrett and Halvorson for cartesian, regular, coherent, geometric and first-order theories. This provides a purely syntactic characterization of the relation between two theories that have equivalent categories of models naturally in any Grothendieck topos.
