Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

If a person is competent to consent to a treatment, is that person necessarily competent to refuse the very same treatment? Risk relativists answer no to this question. If the refusal of a treatment is risky, we may demand a higher level of decision-making capacity to choose this option. The position is known as asymmetry. Risk relativity rests on the possibility of setting variable levels of competence by reference to variable levels of risk. In an excellent 2016 article inJournal of (...) Medical Ethics(JME), Rob Lawlor defends asymmetry of this kind by defending risk relativity, using and developing arguments and approaches found in earlier work such as that of Wilks. He offers what we call the two-scale approach: a scale of risk is to be used to set a standard of competence on a scale of decision-making difficulty. However, can this be done in any rational way? We argue it cannot, and in this sense, and to this extent, risk relativity is a nonsense. (shrink)

Galen Strawson accepts that the common experience of being a social self is of something that continues through time. However, he excludes this from what ‘the self’ means in a stricter ontological sense. Here I will argue that this experience of self as enduring can be taken to be ontologically real as well. I will suggest that selfhood arises from the assimilation of cultural signs by a semiotic process that is a fundamental aspect of nature. The return of interest in panpsychism reflects a shift towards process metaphysics. To propose that qualia are present throughout nature is a radical break with the mechanistic worldview inherited from the nineteenth century. That break is much needed as it is becoming clear that the values implicit in that worldview have helped create a serious ecological crisis. Here, following Bohm and Peirce, an elaboration of process metaphysics is proposed based on a semiotic view of causation. This in turn, taken together (...) with insights from biosemiotics, is used to propose a worldview of unbroken wholeness in which consciousness is ubiquitous and exists at scales well beyond the range of human experience. It is suggested that this will help to recover some of the ecological sensitivies found in prescientific traditions, which are lost in a purely mechanistic worldview. (shrink)

Abstract Cognitivism, presently the major paradigm of psychology, presents a scientific account of mental life. Buddhism also presents an account of mental life, but one which is integral with its wider ethical and transcendental concerns. The postmodern appraisal of science provides a framework within which these two accounts may be compared without inheriting many of the assumed oppositions between science and religion. It is concluded that cognitivism and Buddhism will have complementary roles in the development of a more pluralist psychological (...) science. In a recent JME article, Guidry-Grimes, Dean and Victor offer some signal and challenging insights into the ethical analysis of covert medication and in particular when administered via food. They warn of impacts on identity likely to emerge from using food in this way. In particular, they caution against allowing families to be involved in covert medication, in the light of their central role in sustaining identity. Their analysis has particular purchase in resource rich contexts and those contexts where individual (...) identity is a central concern. But it is less clear that the article’s insights are relevant to other contexts. This article places the analysis of covert medication and identity in a wider context, arguing both that the focus on identity is equally significant when analysing potential alternatives to covert medication, such as coercion; and that the ethical analysis of covert medication offered by Guidry-Grimes, Dean and Victor lacks global applicability. It seems to lack application particularly in resource-poor contexts, and in cultures where identity and community are interconstituted. (shrink)

Thomas Szasz, the radical critic of state-supported psychiatry, and root and branch sceptic about mental illness, died in September 2012. Based on the obituary1 and editorial comment in The Lancet2 and the response his work commonly elicits, it is evident that there will be mixed reviews of his impact and of the cogency of his position.Certainly, some have seen him as a notable figure from the past. There is a sense in which, as far as Szasz's critique of psychiatry goes, (...) it did not really change at all in its essence from the time it was first explicitly expressed in his writings of the 1960s right up to his last publications and talks in the 2010s. He started his 1960 paper The Myth of Mental Illness3 with the assertion that there is no such thing as mental illness, and this has been an underlying pedal note to all his many pronouncements in this area ever since. Personally, I have always found his written interventions in debates right up to the present to be highly readable and intellectually sharp; he was adept at creating variations on the Szaszian theme. In one of his earlier book length texts, The Manufacture of Madness,4 he likens the contemporary idea that people have mental illness to the historical idea that some people were witches, and he parallels the institutions of modern state-supported psychiatry to those of the Inquisition. In articles he later published in the Journal of Medical Ethics, he likened mental illness to ‘phlogiston’—the non-existent substance that supposedly explained combustion5 and claimed the term ‘mental …. There is good neuropsychological evidence for an amodal, relational basis for perception and action. Using this idea, it may be possible to define more accurately what is meant by specificity, in the Gibsonian sense of the term. However, for complex organisms, and most especially for creative, open-ended perceivers and actors such as human beings, specification may not be relevant.

To be plausible, biorobots will need to build themselves. Such autopoietic systems will be autonomous, active learners whose functional architecture is a joint product of factors supplied by the designer and factors learned from encountering an environment. Creating such biorobots will require appropriate theories of cognition, learning, and evolution, all of which are available.

Natural mimicry is ubiquitous. Plants mimic animals, animals mimic plants, animals mimic each other and animals may even mimic counterfactual states that deceive or distract other animals. Almost all natural mimicry is based on iconicity which hence anchors it in real world resemblances. The vast majority of natural mimicry is done unconsciously but when humans mimic, they know what they are doing. As Merlin Donald suggest, mimicry may in fact have played a crucial role in the emergence of the human (...) condition, allowing new forms of cognition to emerge. Here it is suggested that the role played by mimicry may have involved the evolution of a capacity for metaphorical perception, where an object may not only be seen ‘as is’ but also ‘as if’ it was a functional mimic of something else. This new form of mimicry made possible new forms of communication, co-operation and creative engagement with the environment. Once these developed to the point where they produced symbolic systems and other cultural tools, the nature of human mimicry expanded radically. No longer anchored in resemblance, it became detached and qualitatively distinct from natural forms. The consequences of this detachment are now becoming clear. (shrink)

In this short response to Gray’s article Capacity and Decision Making we double down on our argument that risk-relativity is a nonsense. Risk relativity is the claim that we should set a higher standard of competence for a person to make a risky choice than to make a safe choice. Gray’s response largely involves calling attention to the complexities, ramifications and multiple value implications of decision-making, but we do not deny any of this. Using the notion of quality of care (...) mentioned by Gray, we construct an argument that might be used to support risk relativity. But it is no more persuasive than the arguments put forward by risk-relativists. (shrink)

Recent developments in both evolutionary theory and in our ideas about development suggest that genetic assimilation of environmental regularities may occur on shorter timescales than those considered by Shepard. The nervous system is more plastic and for longer periods than previously thought. Hence, the internal basis of cognitive-perceptual skills is likely to blend ontogenetic and phylogenetic learning. This blend is made more rich and interactive by the special cultural scaffolding that surrounds human development. This being so, the regularities of the (...) environment which have been genetically assimilated during the emergence of modern human beings may themselves be the products of human action. [Shepard]. Statutes criminalizing behavior that risks transmission of HIV/AIDS exemplify use of the criminal law against individuals who are victims of infectious disease. These statutes, despite their frequency, are misguided in terms of the goals of the criminal law and the public health aim of reducing overall burdens of disease, for at least three important reasons. First, they identify individual offenders for punishment, a paradigm that is misplaced in the most typical contexts of transmission of infectious disease and even for HIV/AIDS, (...) despite claims of AIDS exceptionalism. Second, although there are examples of individuals who transmit infectious disease in a manner that fits the criminal law paradigm of identification of individual offenders for deterrence or retribution, these examples are limited and can be accommodated by existing criminal laws not devoted specifically to infectious disease. Third, and most importantly, the current criminal laws regarding HIV/AIDS, like many other criminal laws applied to infectious disease transmission, have been misguided in focusing on punishment of the diseased individual as a wrongful transmitter. Instead of individual offenders, activities that enhance the scale of disease transmission—behaviors that might be characterized as ‘transmission facilitation’—are a more appropriate target for the criminal law. Examples are trafficking in human beings (including sex trafficking, organ trafficking, and labor trafficking), suppression of information about the emergence of infection in circumstances in which there is a legally established obligation to disclose, and intentional or reckless activities to discourage disease treatment or prevention. Difficulties remain with justifications for criminalizing even these behaviors, however, most importantly the need for trust in reducing overall burdens of disease, problems in identifying individual responsible offenders, and potential misalignment between static criminal law and the changing nature of infectious disease. Mental health legislation that requires patients to accept ‘care’ has come under increasing scrutiny, prompted primarily by a human rights ethic. Epistemic issues in mental health have received some attention, however, less attention has been paid to the possible epistemic problems of mental health legislation existing. In this manuscript, we examine the epistemic problems that arise from the presence of such legislation, both for patients without a prior experience of being detained under such legislation and for those with this experience. (...) We also examine how the doctor is legally obligated to compound the epistemic problems by the knowledge they prioritise and the failure to generate new knowledge. Specifically, we describe the problems of testimonial epistemic injustice, epistemic silencing, and epistemic smothering, and address the possible justification provided by epistemic paternalism. We suggest that there is no reasonable epistemic justification for mental health legislation that creates an environment that fundamentally unbalances the doctor–patient relationship. Significant positive reasons to counterbalance this are needed to justify the continuation of such legislation. (shrink)

This book constitutes the first volume of a projected two-volume intellectual biography of Auguste Comte, the founder of modern sociology and a philosophical movement called positivism. Volume One offers a reinterpretation of Comte's "first career," (1798-1842) when he completed the scientific foundation of his philosophy. It describes the interplay between Comte's ideas and the historical context of postrevolutionary France, his struggles with poverty and mental illness, and his volatile relationships with friends, family, and colleagues, including such famous contemporaries as Saint-Simon, (...) the Saint-Simonians, Guizot, and John Stuart Mill. Pickering shows that the man who called for a new social philosophy based on the sciences was not only ill at ease in the most basic human relationships, but also profoundly questioned the ability of the purely scientific spirit to regenerate the political and social world. We agree with Branigan & Pickering that structural priming experiments should supplant grammaticality judgments for testing linguistic representation. However, B&P overlook a vast linguistic literature that converges with – but extends – the experimental findings. B&P conclude that syntax is functionally independent of the lexicon. We argue that a broader approach to priming reveals cracks in the façade of syntactic autonomy.
