ABSTRACTThe principle of informed refusal poses a specific problem when it is invoked by a pregnant woman who, in spite of having accepted her pregnancy, refuses the diagnostic and/or therapeutic measures that would ensure the well‐being of her endangered fetus. Guidelines issued by professional bodies in the developed world are conflicting: either they allow autonomy and informed consent to be overruled to the benefit of the fetus, or they recommend the full respect of these principles. A number of medical ethicists (...) advocate the overruling of alleged irrational or unreasonable refusal for the benefit of the fetus. The present essay supports the view of fetal rights to health and to life based on the principle that an ‘accepted’ fetus is a ‘third person’. In developing countries, however, the implementation of the latter principle is likely to be in conflict with a ‘communitarian’ perception of the individual – in this case, the pregnant woman. Within the scope of the limitations to the right to autonomy of J.S. Mill's ‘harm principle’, the South African Patients’ Charter makes provision for informed refusal. The fact that, in practice, it is not implemented illustrates the well‐known difficulty of applying Western bioethical principles in real life in the developing world. (shrink)

This article deals with the concept of sentience, and more specifically with the argument from sentience as it is used by utilitarians in the abortion debate and in the advocacy of animal rights. It is argued that sentience is more than feeling pleasure and pain (with empha sis on pain), and that pain is an inborn protection required to fit into the world rather than the substance of evil. S. Largely, the concept of energy or vital force, as first analysed by Placide Tempels in Bantu Philosophy, permeates most African ontology systems, worldviews and life views. The Ntomba Chief is chosen because of his above average vital force. This puts him in the position of intermediary between the Supreme Being, the ancestors, and his subordinates. The waning of his energy is incompatible with his position because his energy is that of his tribe. When installed, he takes an oath that, when (...) this happens, he has to accept mohilo, the ‘hastening of death’. In the Chief's case, the hastening of death is not intended to relieve his pain, as it would be with other creatures. The Chief's dying a natural death would result in the loss of the entire community's vital force. Therefore, he has to be killed ritually to avoid that risk. That the Chief agrees to be killed – via a form of advanced directive – poses an ethical dilemma for a Western observer. Although the demarginalisation of youths is an international concern, South African youths are viewed by various scholars and policy documents as a particularly vulnerable and marginalised group. It becomes essential to understand what characterises their marginalisation in order to find innovative ways to work towards their demarginalisation. In this article we reflect on current faith-based concerns and compare this with the specific characteristics of the marginalisation of young people. In an effort to contribute to the development of a strategy towards (...) demarginalisation, we will explore the key features of the Circle of Courage in terms of the principles of belonging, mastery, independence and generosity. We will further propose the inclusion of Ubuntu principles in the practical application of the Circle of Courage for churches and faith-based organisations in demarginalising youth in the South African context. La traduction arabo-latine attribuee a Guillaume de Luna du commentaire moyen d'Averroes sur la Logica vetus a fait l'objet en 1996 d'un premier volume: curieusement peut-etre, il proposait l'edition du texte de la troisieme uvre concernee, le Peri Hermeneias ou De interpretatione. Le present volume poursuit l'edition dudit commentaire dans la meme traduction arabo-latine et porte, non sur la premiere uvre de la trilogie: l'Isagoge, mais sur la deuxieme: les Categories ou Predicaments. A peine impliquee dans des citations d'auteurs, l'oeuvre (...) n'est plus connue que par six manuscrits; s' y ajoutent douze editions des XVe et XVIe siecles. La presente edition ressemble a la precedente du commentaire du Peri Hermeneias au moins sous quatre rapports: 1. une comparaison systematique de la version latine medievale du commentaire d'Averroes avec la version hebraique correspondante a ete exclue, ces deux versions ne pouvant etre qu'independantes l'une de l'autre; 2. dans l'apparat comparatif de la version latine avec l'original arabe, les mots arabes sont imprimes en arabe, puis retraduits en latin dans la langue meme du traducteur, sur base d'une etude systematique de la terminologie utilisee dans la traduction; 3. les lexiques sur lesquels s'appuie cette etude de la terminologie, rendent compte d'a peu pres toutes les equivalences arabo-latines etablies par le traducteur, et non, parmi celles-ci, d'une categorie particuliere ne reprenant, par exemple, que les concepts philosophiques; 4. dans les lexiques, les mots arabes sont transcrits en caracteres latins: certaines verifications sont ainsi accessibles aux lecteurs non arabisants; quant aux arabisants, la vocalisation qu'implique la transcription leur signale comment, en fonction de l'interpretation supposee avoir ete celle du traducteur medieval, le referent arabe a de nouveau ete relu et compris. We generalize the concept of a cooperative non-transferable utility game by introducing a socially structured game. In a socially structured game every coalition of players can organize themselves according to one or more internal organizations to generate payoffs. Each admissible internal organization on a coalition yields a set of payoffs attainable by the members of this coalition. The strengths of the players within an internal organization depend on the structure of the internal organization and are represented by an exogenously given (...) power vector. More powerful players have the power to take away payoffs of the less powerful players as long as those latter players are not able to guarantee their payoffs by forming a different internal organization within some coalition in which they have more power.We introduce the socially stable core as a solution concept that contains those payoffs that are both stable in an economic sense, i.e., belong to the core of the underlying cooperative game, and stable in a social sense, i.e., payoffs are sustained by a collection of internal organizations of coalitions for which power is distributed over all players in a balanced way. The socially stable core is a subset and therefore a refinement of the core. We show by means of examples that in many cases the socially stable core is a very small subset of the core.We will state conditions for which the socially stable core is non-empty. In order to derive this result, we formulate a new intersection theorem that generalizes the KKMS intersection theorem. We also discuss the relationship between social stability and the wellknown concept of balancedness for NTU-games, a sufficient condition for non-emptiness of the core. In particular we give an example of a socially structured game that satisfies social stability and therefore has a non-empty core, but whose induced NTU-game does not satisfy balancedness in the general sense of Billera. Today’s students are accustomed to a world where information is available on-demand, anywhere and anytime. They bring this expectation to their academic world where they want to work cooperatively and flexibly, using the modern information processing tools and access with which they are familiar. New hardware platforms such as e-Readers and tablet computers have made substantial inroads in the consumer market. E-Readers are becoming more prevalent in universities – replacing the need for physical textbooks, lecturing notes and other academic documents. (...) Many universities are now running pilot programs, while some are already using e-Readers. Tablet computers, apart from their ability to read, edit or create various types of information documents, also offer additional features such as collaborative and social networking services. This empirical research project investigated student perspectives on the educational use of e-Readers and tablets within the University of Cape Town. A questionnaire was distributed to a significant portion of the student population and stratified according to seniority and faculty. Quantitative data was gathered and analysed on themes ranging from awareness to preferences to facilitating conditions around e-Readers within the academic environment. The students sent a clear signal: that they are keen to embrace these new technologies and the advantages they offer. E-Books can be updated automatically and downloaded to e-Readers instantly from almost anywhere in the world. Students feel they would benefit greatly through the use of e-Readers and many believe they are set to replace books completely. Having access to a portable library of information in their backpacks would benefit both students and the environment. However, there are a number of barriers to the comprehensive introduction of these technologies, including the cost of the devices; cost, rights and file format of e-books; the need for a critical mass of textbooks available in digital format and device characteristics such as battery life, and ubiquitous Wi-Fi access. The opposition between constraint and free necessity leads Spinoza's commentators to conceive of ethical liberation as a reconciliation with one's self against alienations due to external causes, and to confuse constraint with contrariety. Analysis of the word coactus in Spinoza's works shows that finite modes can't exist and can't free themselves without constraints, which are not always a source of contrariety. Such an analysis is close to those of Émile Durkheim and Pierre Bourdieu.
