Rights of and duties to non‐consenting patients–informed refusal in the developing world.Louis-Jacques van Bogaert - 2006 - Developing World Bioethics 6 (1):13-22.
ABSTRACTThe principle of informed refusal poses a specific problem when it is invoked by a pregnant woman who, in spite of having accepted her pregnancy, refuses the diagnostic and/or therapeutic measures that would ensure the well‐being of her endangered fetus. Guidelines issued by professional bodies in the developed world are conflicting: either they allow autonomy and informed consent to be overruled to the benefit of the fetus, or they recommend the full respect of these principles. A number of medical ethicists (...)

Sentience and Moral Standing.Louis-Jacques van Bogaert - 2004 - South African Journal of Philosophy 23 (3):292-301.
This article deals with the concept of sentience, and more specifically with the argument from sentience as it is used by utilitarians in the abortion debate and in the advocacy of animal rights. It is argued that sentience is more than feeling pleasure and pain (with empha sis on pain), and that pain is an inborn protection required to fit into the world rather than the substance of evil. S. Reflection on euthanasia: Western and african ntomba perspectives on the death of a chief.Deogratias Biembe Bikopo & Louis-Jacques van Bogaert - 2009 - Developing World Bioethics 10 (1):42-48.
Largely, the concept of energy or vital force, as first analysed by Placide Tempels in Bantu Philosophy, permeates most African ontology systems, worldviews and life views. The Ntomba Chief is chosen because of his above average vital force. This puts him in the position of intermediary between the Supreme Being, the ancestors, and his subordinates. The waning of his energy is incompatible with his position because his energy is that of his tribe. When installed, he takes an oath that, when (...)

The limits of conscientious objection to abortion in the developing world.Louis–Jaqcues Van Bogaert - 2002 - Developing World Bioethics 2 (2):131–143.
The South African Choice on Termination of Pregnancy Act 92 of 1996 gives women the right to voluntary abortion on request. The reality factor, however, is that five years later there are still more ‘technically illegal’ abortions than legal ones. Amongst other factors, one of the main obstacles to access to this constitutionally enshrined human right is the right to conscientious objection/refusal. Although the right to conscientious objection is also a basic human right, the case of refusal to provide abortion (...)

Moving from faith-based concerns to demarginalising youths through the Circle of Courage.Jacques Beukes & Marichen van der Westhuizen - 2018 - HTS Theological Studies 74 (3):9.
Although the demarginalisation of youths is an international concern, South African youths are viewed by various scholars and policy documents as a particularly vulnerable and marginalised group. It becomes essential to understand what characterises their marginalisation in order to find innovative ways to work towards their demarginalisation. In this article we reflect on current faith-based concerns and compare this with the specific characteristics of the marginalisation of young people. In an effort to contribute to the development of a strategy towards (...)

Le present volume poursuit l'edition dudit commentaire dans la meme traduction arabo-latine et porte, non sur la premiere uvre de la trilogie: l'Isagoge, mais sur la deuxieme: les Categories ou Predicaments. Socially Structured Games.P. Jean-Jacques Herings, Gerard Van Der Laan & Dolf Talman - 2007 - Theory and Decision 62 (1):1-29.
We generalize the concept of a cooperative non-transferable utility game by introducing a socially structured game. In a socially structured game every coalition of players can organize themselves according to one or more internal organizations to generate payoffs. Each admissible internal organization on a coalition yields a set of payoffs attainable by the members of this coalition. The strengths of the players within an internal organization depend on the structure of the internal organization and are represented by an exogenously given (...)

Are University Students Ready to Dump Their Textbooks?Mark van Heerden, Jacques Ophoff & Jean-Paul Van Belle - 2012 - International Journal of Cyber Ethics in Education 2 (3):15-44.
Today’s students are accustomed to a world where information is available on-demand, anywhere and anytime. They bring this expectation to their academic world where they want to work cooperatively and flexibly, using the modern information processing tools and access with which they are familiar. New hardware platforms such as e-Readers and tablet computers have made substantial inroads in the consumer market. E-Readers are becoming more prevalent in universities – replacing the need for physical textbooks, lecturing notes and other academic documents. (...)

La contrainte faite vertu. Sens et enjeux du mot coactus chez Spinoza.Jacques-Louis Lantoine - forthcoming - Dialogue:1-16.
The opposition between constraint and free necessity leads Spinoza's commentators to conceive of ethical liberation as a reconciliation with one's self against alienations due to external causes, and to confuse constraint with contrariety. Analysis of the word coactus in Spinoza's works shows that finite modes can't exist and can't free themselves without constraints, which are not always a source of contrariety. Such an analysis is close to those of Émile Durkheim and Pierre Bourdieu.
