Politics and Modernity provides a critical review of the key interface of contemporary political theory and social theory about the questions of modernity and postmodernity. Review essays offer a broad-ranging assessment of the issues at stake in current debates. The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

During the course of this article we examine data gathered from two research meetings in which coding issues and data organization are being discussed in relation to the use of the software package Atlas.ti. The meetings were concerned with the organization and coding of semi-structured interviews carried out by three different groups as part of a wider collaborative research project. A number of papers have considered aspects of coding practice in teams or small groups; however, little work exists on the (...) analysis of first order collaborative CAQDAS coding interaction. In doing so, this article re-specifies formal coding and collaboration models through the examination of practical methods of situated interaction and data sense-making in the course of producing social scientific facts and explanation. In this sense, the analysis reveals the way in which the professional argot of social science codes can be understood to rely on everyday methods of sense-making within team based contexts. These methods can be understood to be realized through the fine-detailed ‘granular’ categorical and sequential specifics of talk-in-meetings where matters relating to social scientific reasoning, accountability, stakeholders’ interests, defeasible and defensible reasoning protocols, disciplinary rights and the ‘search for underlying patterns’ are salient features and recognizable and accountable concerns for team members as a routine aspect of doing qualitative social science. This article proposes an analytical approach to algorithms that stresses operations of folding. The aim of this approach is to broaden the common analytical focus on algorithms as biased and opaque black boxes, and to instead highlight the many relations that algorithms are interwoven with. Our proposed approach thus highlights how algorithms fold heterogeneous things: data, methods and objects with multiple ethical and political effects. We exemplify the utility of our approach by proposing three specific operations of folding—proximation, universalisation and (...) normalisation. The article develops these three operations through four empirical vignettes, drawn from different settings that deal with algorithms in relation to AIDS, Zika and stock markets. In proposing this analytical approach, we wish to highlight the many different attachments and relations that algorithms enfold. The approach thus aims to produce accounts that highlight how algorithms dynamically combine and reconfigure different social and material heterogeneities as well as the ethical, normative and political consequences of these reconfigurations. Cannabis use in some individuals can meaningfully introduce de novo risk for the initiation of opioid use and development of opioid use disorder. These risks may be particularly high during adolescence when cannabis use may disrupt critical periods of neurodevelopment. Current research studying the combination of genetic and environmental factors involved in substance use disorders is poorly understood. More research is needed, particularly to identify which adolescents are most at risk and to develop effective interventions addressing contributing factors such as (...) trauma and psychiatric comorbidity. Current methods of forensic DNA profiling, based on Polymerase Chain Reaction amplifications of a varying number of Short Tandem Repeat loci found at different locations on the human genome, are regularly described as constituting the “gold standard for identification” in contemporary society. At a time when criminal justice systems in Europe and North America increasingly seek to utilize the epistemic authority of a variety of sciences in support of the apprehension and prosecution of suspects and offenders, genetic science and recombinant (...) DNA technology are often singled out for particular approbation. Indeed, the development and application of DNA profiling has been widely described as the “greatest breakthrough in forensic science since fingerprinting.”. (shrink)

Recent critics have called attention to the alienation of contemporary academics from broad currents of intellectual activity in public culture. The general complaint is that intellectuals are finding a professional home in institutions of higher learning, insulated from the concerns and interests of a wider reading audience. The demands of professional expertise do not encourage academics to work as public intellectuals or to take up social, literary, or political matters in imaginative and perspicuous ways. More problematic is the relative absence (...) of religion in the writings of those who aspire to work as public intellectuals. This essay reviews recent attempts by William Dean, Cornel West, Jean Bethke Elshtain, Stephen Carter, and Robin Lovin to remedy the problem of academic alienation and to address the place of religion in American life. Last year marks the first year of implementation for both the Patient Protection and Affordable Care Act and the Mental Health Parity and Addiction Equity Act in the United States. As a result, healthcare reform is moving in the direction of integrating care for physical and mental illness, nudging clinicians to consider medical and psychiatric comorbidity as the expectation rather than the exception. Understanding the intersections of physical and mental illness with autonomy and self-determination in a system realigning its values (...) so fundamentally therefore becomes a top priority for clinicians. Yet Bioethics has missed opportunities to help guide clinicians through one of medicine's most ethically rich and challenging fields. Bioethics' distancing from mental illness is perhaps best explained by two overarching themes: 1) An intrinsic opposition between approaches to personhood rooted in Bioethics' early efforts to protect the competent individual from abuses in the research setting; and 2) Structural forces, such as deinstitutionalization, the Patient Rights Movement, and managed care. These two themes help explain Bioethics' relationship to mental health ethics and may also guide opportunities for rapprochement. The potential role for Bioethics may have the greatest implications for international human rights if bioethicists can re-energize an understanding of autonomy as not only free from abusive intrusions but also with rights to treatment and other fundamental necessities for restoring freedom of choice and self-determination. Bioethics thus has a great opportunity amid healthcare reform to strengthen the important role of the virtuous and humanistic care provider. (shrink)

This article describes a project which involved an attempt to integrate an expert system with a hypertext database of primary and secondary text materials. Our chosen legal domain was that of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters (The Brussels Convention 1968). In this article, we address three dimensions of system design. With regard to the legal dimension, we consider the choice of domain and the representation of both knowledge and data in the (...) system. On the technological dimension, we discuss the selection of software development tools and problems associated with keeping knowledge bases and databases up-to-date. Finally, we pay particular attention to the Cinderella dimension of legal expert system development — the user interface. (shrink)

The authors relate the major groups involved in the desegregation of Boston's public schools to divergent understandings of rights in America's political and religious traditions. After an initial historical review, the authors suggest that the desegregation controversy may be understood as a conflict between a natural law theory of rights which requires remedial action to correct injustices and a traditionalist theory which sanctions prevailing liberties. In Boston, one natural law position is represented by black parents and the Federal court's desegregation (...) orders. Another position is represented by many white parents, who base their opposition to desegregation on a traditionalist notion of natural law. The authors suggest that any permanent resolution of the conflict must address these divergent understandings of natural law, as well as the political realities peculiar to Boston. (shrink)

Like some other human sciences, sociology has had a recurrent concern to clarify the ambivalent relationship between its professional accounts of social reality on the one hand and lay understandings of social reality on the other. Sociological ethnographers have claimed to accomplish this clarification by including in their accounts both direct representation and responsive interpretation of the vernacular voice of those human subjects whose actions and understandings comprise the focus of their inquiries. I briefly examine some of the practical and (...) textual strategies by which studies have accomplished this. I go on to note that the authenticity of ethnographic work has itself become a matter of dispute on the grounds of the ineradicable asymmetry between the professional voice of the researcher and the vernacular voice of research subjects. Drawing on work in literary theory, anthropology and feminist scholarship, a favoured solution to this problem has argued for the necessity of acknowledging the essentially dialogical character of the relationship between researchers and subjects and also of finding ways to make ethnographic texts reflect this character. This article draws attention to an alternative set of professional practices that prefer ‘co-construction’ to ‘dialogue’ as a term of art. Its use encourages and facilitates the close and detailed examination of the multiple ways in which subjects already speak of and for themselves and others within the local sites of their real-world activities. Studies of these matters accord the vernacular voice of human subjects renewed significance for sociological investigation as part of a radical ‘respecification’ of prior understandings of the proper relationship between vernacular and professional accounts of social reality. The article assesses the upshot of these claims for the current practice and future prospects of sociology as one of the human sciences. (shrink)

This study examines the effect of a business ethics course on undergraduates’ attitudes toward the importance of corporate ethics and social responsibility, as measured by the PRESOR scale. It employs a survey approach, adopting a pretest/posttest methodology in the data collection. A total of 132 undergraduate students were surveyed over a period of four semesters during 2006 and 2007. To test the effects of individual personality characteristics and examine their potential interaction with ethical education, participants’ personal values and degree of (...) Machiavellianism were also assessed. The business ethics course resulted in significantly less support for the traditional “stockholder view” of business, providing backing for the inclusion of a stand-alone business ethics course in the business studies curriculum. In addition, among nonbusiness majors, the course resulted in significantly greater support for the “stakeholder view,” suggesting that it would be especially beneficial to open such a course to nonbusiness students. The increasing importance of computational techniques in post-genomic life science research calls for new forms and combinations of expertise that cut across established disciplinary boundaries between computing and biology. These are most marked in large scale gene sequencing facilities. Here new ways of organising knowledge production, drawing on industrial models, have been perceived as pursuing efficiency and control to the potential detriment of academic autonomy and scientific quality. We explore how these issues are played out in the case of BGI (...) (Beijing Genomics Institute prior to 2008). BGI (in Pinyin, Hua Da Jiyin– Big China Genome) is today the world’s largest centre for gene sequencing research. Semi-detached from traditional academic institutions, BGI has developed distinctive models for organising research and for developing expertise, informed by practices in US Information Technology and Life Science Laboratories, that differ from existing models of interdisciplinary research in academic institutions. Within any organization (e.g. a hospital or clinic) the perception of the way things operate may vary dramatically as a function of one’s location in the organizational hierarchy as well as one’s professional discipline. Interorganizational variability depends on organizational coherence, safety, and stability. In this four-nation (Canada, Ireland, Australia, and Korea) qualitative study of 42 nurses, we explored their perception of how ethical decisions are made, the nurses’ hospital role, and the extent to which their voices were heard. These nurses (...) suggested that their voices were silenced (often voluntarily) or were not expressed in terms of ethical decision making. Finally, they perceived that their approach to ethical decision making differed from physicians. (shrink)

This volume brings together eminent theologians, philosophers and political theorists to discuss such questions as how religious understandings have shaped the moral landscape of contemporary culture; the possible contributions of theology and theologically informed moral argument to contemporary public life; the problem of religious and moral discourse in a pluralistic society; and the proper relationship between religion and culture.

The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.

We report on our experiences in a participatory design project to develop ICTs in a hospital ward working with deliberate self-harm patients. This project involves the creation and constant re-creation of socio-technical ensembles that satisfy the various, changing and often contradictory and conflicting needs in this context. Such systems are shaped in locally meaningful ways but nevertheless reach beyond their immediate context to gain wider importance and to be integrated with the larger environment.

Over the course of a fifty-year scholarly career, Frank M. Oppenheim, SJ, has devotedly studied and encouraged others to study the American philosopher Josiah Royce. Early in my own study of Royce, I read and learned a great deal from Oppenheim’s book Reverence for the Relations of Life. I met Oppenheim at a 2007 conference at Harvard on Royce and William James, and he encouraged my continued study. Thus, I am honored to participate in this issue of The Pluralist celebrating (...) The papers given at the conference led to this new book, Josiah Royce: Pragmatist, Ethicist, Philosopher (...) of Religion. Edited by the German scholars Christoph Seibert and Christian Polke, the volume includes eleven essays, nine delivered at the 2015 conference, together with additional contributions by Seibert and Polke, the conference organizers.It is valuable to see contemporary German scholars engaging with Royce and to compare their approach with that of American scholars. Americans tend to approach Royce through the tradition of pragmatism in the company of William James, Charles Peirce, and John Dewey, and to minimize the metaphysics in Royce's thought and its idealistic influences. [End Page 116]The book has the goal of developing Royce's thought to show how its insights and concerns may be valuable for contemporary life, not only for scholars of differing philosophical traditions. In their Introduction, Seibert and Polke describe Royce as a "pragmatist of his own kind" (3) and identify three themes in his philosophy. The first is community, which was central to Royce from the beginning and, following his serious study of Peirce, "became the ultimate principle of both his metaphysics and his philosophy of life" (3). The second theme is religion, which, for Royce, involved the "search for the ultimate meaning of his own life, as well as that of his fellows' lives" (3). The third broad theme in Royce is ethics and a lifelong concern with the nature of the examined life. Royce developed his ethical philosophy from an original critique of moral skepticism to the "never-ending task of building communities within and through mankind by way of a critical spirit of true and mutual loyalty" (3). Among these three, the editors consider religion as the most important. They state: "[R]eligion is a very important theme of Royce's philosophy: one may even assume that it is the central subject, which implies that his philosophy may be properly understood only if it is regarded as a philosophy of religion" (8). The centrality of religion is apparent in the essays. Consideration here must be brief.The book's first section, "Bridging Two Continents: Royce between Pragmatism and Idealism," includes three broad-ranging essays that work toward a synthesis between pragmatism and idealism in the thought of Royce. Ludwig Nagl's contribution, "Toward a Global Philosophical Discourse on Religion," discusses Royce's posthumously published "Lectures on Modern Idealism." Nagl uses this work, together with Royce's adaption of Peirce, to help create a bridge between pragmatism and idealism. He further explores Royce's interest in Eastern religion to suggest how Royce's thought might support a broad philosophical study of religion, not restricted to Christianity. Co-editor Seibert's article, "The Ethical Nucleus of Reality," focuses on Royce's epistemology and his ethics, while touching briefly on religion. The essay shows how Royce combined pragmatic and idealistic threads from his earliest writings, with particular attention to his book The Spirit of Modern Philosophy (SM). Royce's SM is also central to the American philosopher Douglas Anderson's essay "What Philosophy Meant to Josiah Royce." In SM, Royce argues that philosophy constitutes a critical reflection on experience that may be practiced by every person, not only by professional philosophers. Anderson, however, also identifies and criticizes a more elitist, professional aspect in Royce's conception of philosophy. For Anderson, Royce's thought had a pragmatist dimension in that philosophy was a "voluntarily chosen attitude toward conducting our lives" (80). ABSTRACTRecent studies of Reinhold Niebuhr's life and work demonstrate his continued importance in theology, ethics, and political thought. Historical studies by Heather Warren, Mark Kleinman, and Normunds Kamergrauzis provide new assessments of Niebuhr's role as a political and religious leader in his own time and trace the consequences of the movements in which he participated. They also show us more clearly how his work was connected to the ideas and programs of his contemporaries. Colm McKeogh offers a more systematic treatment (...) of Niebuhr's political realism in relation to just war theory. Niebuhr's intellectual legacy remains disputed, with Stanley Hauerwas and Langdon Gilkey offering radically different assessments of his theology. Hauerwas sees in Niebuhr a close connection to the religious liberalism of William James that precludes any authentic Christian witness. Niebuhr's empiricism reduces God to a necessary feature of human consciousness. Gilkey notes Niebuhr's early use of James' psychology, but discerns a theology of history that is central to Niebuhr's mature work. In that theology, the ground of hope necessarily lies beyond human consciousness, and indeed beyond history itself. (shrink)

I distinguish between the nineteenth- to twentieth-century (modernist) tendency to rehabilitate (white) femininity from the abject popular, and the twentieth- to twenty-first-century (postmodernist) tendency to rehabilitate the popular from abject white femininity. Careful attention to the role of nineteenth-century racial politics in Nietzsche's Gay Science shows that his work uses racial nonwhiteness to counter the supposedly deleterious effects of (white) femininity (passivity, conformity, and so on). This move—using racial nonwhiteness to rescue pop culture from white femininity—is a common twentieth- and (...) twenty-first-century practice. I use Nietzsche to track shifts from classical to neo-liberal methods of appropriating “difference.” Hipness is one form of this neoliberal approach to difference, and it is exemplified by the approach to race, gender, and pop culture in Vincente Minnelli's film The Band Wagon. I expand upon Robert Gooding-Williams's reading of this film, and argue that mid-century white hipness dissociates the popular from femininity and whiteness, and values the popular when performed by white men “acting black.” Hipness instrumentalizes femininity and racial nonwhiteness so that any benefits that might come from them accrue only to white men, and not to the female and male artists of color whose works are appropriated. Are there difficulties raised by the idea of backwards time travel—travel to earlier times—that are peculiar to objects? By ‘object’ in this context I mean something that takes up space, that typically prevents other items in the same category from occupying the same space, and for which it is generally thought appropriate to talk in terms of persistence conditions. One such problem is raised in H. G. Wells’ The Time Machine, but highlighted in the philosophical literature only very recently, by (...) William Grey. Consider Tim, who boards his time machine and, at 12 noon precisely, presses the button to send him back into the past. At any moments after noon, both Tim and the machine have ceased to exist. In the 1920s, scientists at the University of Cambridge’s Sir William Dunn Institute of Biochemistry made major contributions to the emerging discipline of biochemistry while also devoting considerable time and energy to the production of a humor journal entitled Brighter Biochemistry. Although humor is frequently regarded as peripheral to the work of science, the journal provides an opportunity to understand how it contributes to the social infrastructure of scientific communities as modern workplaces. Taking methodological cues from cultural history, ethnography, and (...) humor studies, this essay conducts a close and contextual reading of Brighter Biochemistry. This reading demonstrates how humor served as a central means through which members of the Dunn confronted workplace issues, including creating cooperative work teams, responding to gender discrimination, addressing funding anxiety, and defining professional identity. These conclusions provide a new perspective on the well-documented history of the Dunn and also offer a model for how historians of science can approach humor when its traces are encountered in other settings. In the first section I present a disagreement between a number of scholars (including T.H. Huxley, G.J. Romanes, George C. Williams and Holmes Rolston) concerning the goodness, indifference, evil or even wickedness both of nature and of nonhuman creatures. Section 2 examines and rejects the response to these diverse judgements that values are generated by human valuers employing different perspectives. In Section 3, the thesis that nonhuman animals are commonly either wicked or immoral is considered. The next two sections (...) address the value or disvalue of predation and parasitism, and then of waste, selfishness and suffering. In the Section 6 I conclude that the evolutionary system of nature has vast overall value, and that although there are widespread evils within it, the only significant alternatives are a lifeless world, a world without sentient life, and a world of constant supernatural intervention, all probably worlds without such a positive balance of value as the actual world. A global ethic needs to be cosmopolitan in a sense which is explained; this excludes certain kinds of communitarian ethic. Contracttheories, Kantianism, basic-rights theories, Ross-type deontology and theories of virtue ethics are reviewed and found to encounter severe problems. Consequentialist theories, however, are found capable of coping with Williams’ objections, and practice-consequentialist theories capable of coping with right-making practices and with Lenman's unpredictability objection. Variants that exclude from consideration unintended consequences, the results of omissions, or impacts on possible people, (...) or which prioritize average over total outcomes, fail to improve on the Total View, which is argued to overcome objections based on population numbers and on good procedures, but which needs to be biocentric in scope. Theories of this kind are capable of coping with global problems, while also favouring alliances between global citizens of diverse normative outlooks.
