The tradition of natural law is one of the foundations of Western civilization. At its heart is the conviction that there is an objective and universal justice which transcends humanity’s particular expressions of justice. It asserts that there are certain ways of behaving which are appropriate to humanity simply by virtue of the fact that we are all human beings. Recent political debates indicate that it is not a tradition that has gone unchallenged: in fact, the opposition is as old (...) as the tradition itself. By distinguishing between philosophy and ideology, by recalling the historical adventures of natural law, and by reviewing the theoretical problems involved in the doctrine, Simon clarifies much of the confusion surrounding this perennial debate. Yves R. Simon (1903-1961) was one of this century’s greatest students of the virtue of practical wisdom. Simon’s interest in this virtue ranged from ultimate theoretical and foundational concerns, such as the relationship between practical knowledge and science, to the most concrete and immediate questions regarding the role of practical wisdom in personal and social decision-making. These concerns occupied Simon from his earliest published writing to the final notes and correspondence he was working on at the (...) moment of his untimely death. Throughout his life, practical wisdom and its related philosophical ramifications emerge time and again at critical junctures, throwing into bold relief some of the deeper dimensions of questions as diverse as the nature of democracy, the concept of law, and the theory of work. Practical knowledge constitutes a unifying motif of Simon’s entire encyclopedic effort. This volume reconstructs what would have been Simon’s final sustained writing on practical knowledge. It includes reworking of some previously published material, especially the landmark 1961 essay, "Introduction to the Study of Practical Wisdom," possibly the best treatment of the concept of "command" in recent philosophical writing. But it also reproduces, in a form closely corresponding to Simon’s intention, material drawn from notes and schemata, concerning issues such as the relationship between moral science and wisdom, the nature of practical judgment, and the relationship between practical knowledge and Christian moral philosophy. Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Woolf's The Waves as a Textbook CaseSimon De Keukelaere (bio)The Waves, more than any of Virginia Woolf's other novels, conveys the complexities of human experience.—Kate FlintHumankind—according to mimetic theory—is not (as Marx thought) homo economicus but rather homo religiosus. Mensonge Romantique et Vérité Romanesque, Girard's first essay (1961), evocatively opens with a saying by Max Scheler: "L'homme possède ou un Dieu ou une idole" (Man (...) has either a God or an idol). If we may believe Girard, the Enlightenment profoundly misunderstood human beings because it naively assumed that doing away with "ancient superstitions" would fully liberate them: "denial of God does not eliminate transcendency but diverts it from the au-delà to the endeçà " (Girard 1965, 59).What has all this to do with Virginia Woolf's secular art? René Girard's "transcendance déviée," the diverted or deviated transcendency––which we may also want to term idolatry––is beautifully and transparently depicted in one of Woolf's most enigmatic and experimental novels. In The Waves, the portrayal of human desire as mimetic, imitated, is so crystal clear that––once noticed—it can hardly be overlooked any longer. Perhaps even more interesting for mimetic theory is the fact that Woolf (just as Proust did before her) brings into play the language of the sacred when rendering the mimetic nature of human longing. Neither of these two aspects of The Waves (the obsessively mimetic nature of desire and the use of the religious metaphor) have been fully unraveled by Woolf's critics.The purpose of this article is to make obvious the value of Virginia Woolf's (poetic) language for mimetic scholars and to show how deviated transcendency can be made visible and (above all) intelligible through great secular literature. The study of literature is vital to the humanities, not for some frivolous, outdated reasons, but because great literature can, sometimes [End Page 195] more effectively than many erudite studies, convey the complexities of human experience.It would no doubt be unjustifiable to foist Girard's mimetic thesis on Woolf's novel without clear support from the text, but I believe The Waves provides such backing. The outline of the present article is as follows. I first argue that the characters in Woolf's novel really are interdividuals rather than individuals, since mimetic desire plays an important role in them. I subsequently focus on a typically metaphysical illusion that goes along with mimetic desire, that is, the apparent self-sufficiency or divine autonomy of the Other. Then I show how the religious metaphor is consistently linked with the first-mentioned issue and that a form of distorted mysticism is to be recognized throughout the novel. Finally I examine how in The Waves deviated transcendency is depicted as a road toward Death in exactly the same way as Girard does in his Mensonge Romantique et Vérité Romanesque (1961).The Interdividual and Her Mimetic DesireMimetic theory is deeply involved with the problem of selfhood, the paradoxical nature of subjectivity. According to René Girard we are not individuals but interdividuals. The ambiguous nature of the Self is a recurrent theme in Woolf's novels too, and especially in The Waves, it seems. As Lisa Marie Lucenti remarks: "Many critics seem to agree that subjectivity, for Woolf, is no simple matter, but they disagree on the significance, expression and forms of its intricacies. The most productive theories for reading Woolf are those which allow for a large measure of variation and ambiguity both between and within individual subjects" (1998, 34). The problematic nature of the Self challenges the critic, since the very concept of character is turned into a conundrum, rather than a useful instrument with which to analyze the novel. To speak of separated characters, of individuals (in-divisus) with regard to The Waves is particularly difficult. So, for example, at the end of the novel Bernard (one of the six "voices" or "characters" whose lives are recounted) states: "I am many people; I do not altogether know who I am—Jinny, Susan, Neville, Rhoda or Louis; or how to distinguish my life from theirs... This article discusses plant-closing decisions by multinational enterprises applying a stakeholder theory approach. In particular, we focus on the emergence of “intra-stakeholder alliances,” that is, alliances among the various stakeholder groups of a specific corporation. We analyze the emergence of stakeholder alliances in reaction to MNEs' decisions to terminate production locally and discuss their influence on the outcomes of such decisions. Our research is inspired by two exceptional case studies of two multinational breweries that announced their decisions to close niche (...) breweries in small towns in Italy and Belgium. In both cases, the initial decision was ultimately reversed through the actions of intra-stakeholder alliances. We combine insights from stakeholder theory and the social movement literature to analyze the action and influence of intra-stakeholder alliances in seven cases of plant-closing decisions. We conclude by formulating four general propositions that can provide guidance to MNE management in plant-closing decisions. Our findings extend managerial stakeholder theory, show how this approach can improve strategic management analysis, emphasize the importance of the relationships among stakeholders in the value-creation process, and shed light on the collective action and influence of intra-stakeholder alliances. Modern Visual Poetry, by Willard Bohn; 321 pp. Newark: University of Delaware Press, 2000, $47.00. The situation of French poetry at the turn (...) of the twenty-first century is far different from what it was during the last fin de siècle. In 1900, poetry was a booming art, and France was home to numerous poets of varied inspiration and expression. The religious verse of Claudel and Péguy shared the attention of the reading public with the philosophical poetry of Valéry and the futuristic celebrations of Paris and modern life found in Apollinaire's Alcools and Calligrammes. Long poems, short poems, poems written in standard verse, free verse, prose, and even published as drawings, suggested that the golden age of poetry begun in the early nineteenth century by the Romantics and continued after 1850 by Baudelaire, Verlaine, Rimbaud, and Mallarmé, would not soon come to an end. This indeed proved to be the case, for the heirs of the Symbolist tradition of the first decade of the twentieth century were soon followed by the Surrealist revolutionaries of the 1920s and 1930s, many of whom directed their talents to the composition of political verse at the time of the Second World War. Political poetry by and large disappeared from France after 1950, only to be [End Page 142] succeeded over the next two decades by two very different types of verse. On the one hand, writers like St. John Perse and Pierre Jean Jouve produced difficult works whose appeal was limited to a sophisticated audience, while lyricists, such as Jacques Prévert and even the songwriter Georges Brassens, made poetry more accessible to the general public, often through popular songs. The fact that, during the days of May 1968, students scrawled verses of the Surrealist-Communist poet Paul Eluard on the walls of the Sorbonne to encourage efforts to bring down the social order attests to the power exerted by poetry on the intellectual life of France well into the second half of the twentieth century. Such, however, is no longer the case today. There are only two well-known living French poets, Francis Ponge and Yves Bonnefoy. While reviews dedicated to original poetry do still exist, especially in the south of France where the poetic arm of the French Resistance was most active in the 1940s, poetry attracts many fewer readers--and fewer writers--than it did even fifty years ago.Such a radical change merits some reflection. What has happened to French poetry since the mid-twentieth century? In a sense, all good things must come to an end sometime, and a century and a half of inventiveness and poetic energy may simply have run its natural course. In his Brouillon Project on conic sections, Girard Desargues studies the notion of traversale, which generalizes that of diameter introduced by Apollonius. One often reads that it is equivalent to the notion of polar, a concept that emerged in the beginning of 19th century. In this article we shall study in great detail the developments around that notion in the middle part of the Brouillon project. We shall in particular show, using the notes added by Desargues after the first draft (...) was written, how here arises a new theory, that of the polarity associated to a conic section. We shall show that besides a natural correspondance between points and lines, Desargues has understood that a conic induces on every line in its plane an involution, and how he progressively handles the considerable conceptual difficulties he has to deal with when trying to explain clearly his novative ideas. In the middle part of his Brouillon Project on conics, Girard Desargues develops the theory of the traversale, a notion that generalizes the Apollonian diameter and allows to give a unified treatment of the three kinds of conics. We showed elsewhere that it leads Desargues to a complete theory of projective polarity for conics. The present article, which shall close our study of the Brouillon Project, is devoted to the last part of the text, in which Desargues puts his theory (...) of the traversal into practice by giving a very elegant tratment of the classical theory of parameters and foci. This will lead us to show that Desargues’ proofs can only be understood if one accepts that he reasons in a resolutely projective framework, completely assimilating elements at infinity to those at finite distance in his proofs. Medicine is often thought of as a science of the body, but it is also a science of data. In some contexts, it can even be asserted that data drive health. This article focuses on a key piece of data technology central to contemporary practices of medicine: the medical record. By situating the medical record in the perspective of its history, we inquire into how the kinds of data that are kept at sites of clinical encounter often depend on informational (...) requirements that originate well outside of the clinic, in particular in health insurance records systems. Although this dependency of today's electronic medical records on billing requirements is widely lamented by clinical providers, its history remains little studied. Following the archaeology of medicine developed by Michel Foucault in The Birth of the Clinic and expanding his methodology in light of more recent contributions to the field of media archaeology, this article excavates some of the underexplored technological conditions that help constitute today's electronic medical record. If in some contexts, it is true that data drive health, then an archaeology of medical records helps reveal how health insurance records often impact clinical care and, by extension, health and disease. The integrative memory model formalizes a new conceptualization of memory in which interactions between representations and cognitive operations within large-scale cerebral networks generate subjective memory feelings. Such interactions allow to explain the complexity of memory expressions, such as the existence of multiples sources for familiarity and recollection feelings and the fact that expectations determine how one recognizes previously encountered information.

The concept of community of persons, which focuses on both persons and the whole, helps understand solidarity. The latter is based on the social nature of persons. Community of persons and solidarity seems to be able to move away from the individualist perspective or the individualism-collectivism dichotomy. Using autopraxeography in a pragmatic constructivism epistemological paradigm, this article aims to explore how organizations can develop solidarity in a workplace. The experience presented takes place in a bank. It shows that communities of (...) persons with employees and customers are both ethical and financially efficient. These communities build a dialogue between persons and organizations. Nevertheless, it is impossible to force solidarity because it could generate derision that is contrary to the wished goal. Finally, while this model is based on solidarity, it focuses solely on internal solidarity. (shrink)

L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

Education as identity formation in Western-style liberal-democracies relies, in part, on neutrality as a justification for the reproduction of collective individual identity, including societal, cultural, institutional and political identities, many aspects of which are problematic in terms of the reproduction of environmentally harmful attitudes, beliefs and actions. Taking a position on an issue necessitates letting go of certain forms of neutrality, as does effectively teaching environmental education. We contend that to claim a stance of neutrality is to claim a position (...) beyond criticism. In the classroom this can also be an epistemically damaging position to hold. To further explore the problem of neutrality in the classroom, and to offer a potential solution, we will look to the philosophical community of inquiry pedagogy, and advocate for the addition of place-based education; a form of experiential education that promotes learning in local communities in which the school is situated, each with its own history, culture, economy and environment. However, how we understand ‘place’ is fundamental to understanding the potential of place-based education in giving students a ‘sense of place’—how they perceive a place, which includes place attachment and place meaning. To this end, we look to Indigenous understandings of Place and social reconstruction learning to inform place-based pedagogies. Doing so, we hold, opens a pathway to ethical education. (shrink)

The purpose of this text is to tell the story of the implementation of the _Act Respecting End-of-Life Care,_ referred to hereafter as _Law 2_ (Gouvernement du Québec, 2014) with an emphasis on the ambiguous role of ethics in the Interdisciplinary Support Groups (ISGs), created by Quebec's _Ministère de la santé et des services sociaux_ (MSSS). As established, ISGs provide “clinical, administrative and ethical support to health care professionals responding to a request for Medical aid in dying (MAiD)” (Gouvernement du (...) Québec, 2015). It is suggested that their composition includes the participation of a person with an expertise in ethics. These ISGs represent an important innovation for stakeholders involved in MAiD. To date, no scientific research has specifically addressed ISGs and little research has been conducted in other jurisdictions on the roles, operations and practices of MAiD support structures, especially the implication of ethics. Several ISGs have certainly developed promising practices that could benefit all stakeholders in the wider field of ethics and end of life. We will explore the development of ISGs in Quebec as a support structure for MAiD by highlighting the role that ethics has played (and should play) in these morally and humanly challenging situations. Contemporary socio-political issues often seen as socially controversial and highly politicised topics, such as anthropogenic climate change, public scepticism over preventive public health measures during pandemics such as COVID-19, and Indigenous sovereignty, lands rights, and ways of knowing, being and doing, highlight the need for education to address such issues more effectively. Controversial issues do not exist in isolation. They are connected to questions of order, interpretation, meaning-making, ethics, and why and how we live, i.e., to philosophical questions. We argue (...) that philosophical inquiry is essential for dealing with controversial topics in the classroom. However, we point to the need for teachers to understand the role of the community of inquiry in addressing such topics. This has implications for teacher preparation. We, therefore, examine John Dewey’s use of experiential education to argue for rethinking teacher preparation, especially when dealing with controversial topics which point to the need for greater emphasis on how best to engage with them philosophically. To this end, we will argue in favour of a reconstruction of educational philosophy, specifically the community of inquiry, by integrating a Deweyan inspired place-based education that emphasises environment, experience, and social reconstruction learning. Barely seventeen years into the twenty-first century, our world continues to be plagued by endless wars and violence. Africa is not immune from these crises. As many countries in Africa celebrate more than fifty years of independence from colonial rule, Africa is still the poorest continent in the world. Religious wars, genocides, ethnic and tribal cleansings have come to define the continent’s contemporary history. Corruption, nepotism, dictatorship, disregard for human life, tribalism, and many social vices are normalized realities in many (...) parts of the continent. Rather than despair, a radical refocusing on Africa’s rich history of hospitality that affirms the flourishing of all life ought to be embraced. This article aims to do exactly this by exploring Africa’s role and place in the history of three Abrahamic religions; Judaism, Christianity, and Islam. While celebrating Africa’s unique role as the gateway for the realization of divine hospitality, this article aims to serve as a witness to an ethic of life that is relevant for the global church’s vision and mission to a pluralistic world and for the mission of the churches of Africa to addressing the social, cultural, and political crises faced by the continent. To achieve these, this work appropriates a comparative theological method that sheds light on the centrality of Africa in these three Abrahamic religions with a bias for the flourishing of life. Economic inequality is a pressing issue that the global community must address in an urgent and detailed manner if global peace is to be sustained. This paper makes the claim that viable alternative solutions to global economic inequality can be found outside the boundaries of western capitalism. This claim is defended via three movements: first, a critique of Christian teachings on the common good is presented as a pathway to this economic alternative. Second, insights from Dr. Martin Luther King, Jr. (...) that call for strategic solidarity to help undo structures of inequality in our world are appropriated. Third, a cultural and philosophical notion of what it means to be human in African thought is presented as a means for justifying the relevance of the African ethic of Ubuntu as a global economic alternative; one that grounds cosmic flourishing in a vision and praxis of relationality and shared identity for all.
