This is a book about the education America owes to its children, why its education system is in poor condition, and what might be done to give that system both energy and quality.

A basic model of hierarchical structure, expressed by simple, linear differential equations, shows that the pattern of population growth is essentially determined by conditions of redundancy in the sub-structure of individuals. There does not exist any possible combination between growth rate and accident rate that could balance population numbers and/or the level of redundancy within the population; all possible combinations either lead to extinction or to positive population growth with a decline of the fraction of individuals with redundant substructure. Declining (...) populations, however, can be held fluctuating between certain limits by periodic phases of sub-unit repair. Volterra's (1926) equations for competition and predator-prey interactions are modified by introduction of root terms. A critical comparison with the original equations shows that the dynamic properties of the systems remain essentially alike, while the modification allows for explicit solution of the differential equations. Detailed solutions and numerical examples are given.

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. In order to do this, it is crucial to look at the transformation of Strauss' philosophical position in the USA while also placing it in perspective against the background of the conditions during the Weimar Republic. Taking Strauss' position on the sociology of knowledge, on historicism and on dialectical theology into account, Steiner shows (...) how Strauss brought a specifically German criticism of modernism to America, which he developed during his first years in New York. In a recent review essay of a two volume anthology on left-libertarianism (edited by two of us), Barbara Fried has insightfully laid out most of the core issues that confront left-libertarianism. We are each left-libertarians, and we would like to take this opportunity to address some of the general issues that she raises. We shall focus, as Fried does much of the time, on the question of whether left-libertarianism is a well-defined and distinct alternative to existing forms of liberal egalitarianism. (...) This same condition applies to a set of moral rights, where it takes the form of requiring that all the rights in that set be compossible: that their respective correlatively entailed duties be jointly fulfillable. Such joint fulfillability is guaranteed only by a set of fully differentiated individual domains. And if moral rights are to play any independent role in moral reasoning - any role logically independent of the values that (...) bring persons into conflict - those domains must be determined by rules which are not derived from those values. An anthology of writings by and about Rudolf Steiner qua economist that documents his search for a deeper understanding of modern economic life. This book throws light on many of the problems that face us today, problems that we cannot solve unless we take hold of the economic life in a conscious, human way and resist the temptation to defer to market forces alone. Though well-known as a seer, the idea of Rudolf Steiner as an economist may seem (...) surprising. Seers do not usually have much concrete to say about economic life, beyond laments about its evils and injunctions that it be guided by some moral dimension. Recent attempts by American theorists to produce a radical politics, characterized by the effort to translate the insights of Continental philosophy into a political register, remain trapped in that which they purport to transcend: the metaphysics of subjectivity. In their essential determinations, the works of William Connolly, Stephen White, Richard Ashley, etc. remain firmly anchored in a traditional liberal schema. The reason for this is that while these efforts have sought to de-center political identity by exposing its relational character they (...) have not re-thought 'rela tionality' itself. Our attempt to develop the more profound political impli cations of 'relationality' unfolds through a synthetic explication of Martin Heidegger's analysis of language, Jacques Derrida's logic of the gift, and Emmanuel Levinas' consideration of the Other. The emergent thematic of asymmetrical relationality reconfigures liberalism and provides for a rethinking of the structure of welfare. (shrink)

For many persons, ‘Holocaust‐abomination’is a fixed point on their moral compass: if anything can be evil, it was. Yet at least one of the justifications deployed by its perpetrators (the eugenics argument) invokes widely‐held values concerning human health and procreation. Hence persons endorsing many current activities based on those values (e.g. genetic counselling) have been charged with being on a morally deplorable slippery slope. This paper sketches the necessary structure of a moral position capable of consistently embracing those values without (...) placing its occupants on that slippery slope. (shrink)

Some important recent articles, including one in this journal, have sought to devise theories of rights that can transcend the longstanding debate between the Interest Theory and the Will Theory. The present essay argues that those efforts fail and that the Interest Theory and the Will Theory withstand the criticisms that have been levelled against them. To be sure, the criticisms have been valuable in that they have prompted the amplification and clarification of the two dominant theories of rights; but (...) their upshot has been to reveal the need for the improvement, rather than the abandonment, of those theories. Justice and Libertarianism The term ‘justice’ is commonly used in several different ways. Sometimes it designates the moral permissibility of political structures (such as legal systems). Sometimes it designates moral fairness (as opposed to efficiency or other considerations that are relevant to moral permissibility). Sometimes it designates legitimacy in the sense of it being morally impermissible for others to interfere forcibly with the act or omission (e.g., my failing to go to dinner with my mother may be wrong but nonetheless (...) legitimate). Finally, sometimes it designates what we owe each other in the sense of respecting everyone’s rights. Of course, these notions are closely related. What we owe each other may, but need not, be partly based on issues of fairness. Legitimacy and permissibility of political structures are largely, but perhaps not entirely, determined by what rights of non-interference individuals have. Nonetheless, these are distinct notions and we shall focus only on what we owe each other. Justice as what we owe each other is not concerned with impersonal duties (duties owed to no one, i.e., that do not correspond to anyone’s rights). If there are impersonal duties, then something can be just but nonetheless morally impermissible. For brevity, we shall often write of actions being permissible or agents having a moral liberty, but this should always be understood in the interpersonal sense of violating no one’s rights. Libertarianism is sometimes advocated as a derivative set of rules (e.g., derived from rule utilitarian or contractarian doctrines). Here, however, we reserve the term for the natural rights doctrine that agents initially fully own themselves. Agents are full self-owners just in case they own themselves in precisely the same way that they can fully own inanimate objects. Stated slightly differently, full self-owners own themselves in the same way that a full chattel-slaveowner owns a slave. Throughout, we are concerned with moral ownership and not legal ownership.. This paper tackles the problem of the nature of the space of perception. Based both on philosophical arguments and on results obtained from original experimental situations, it attempts to show how space is constituted concretely, before any distinction between the “inner” and the “outer” can be made. It thus sheds light on the presuppositions of the well-known debate between internalism and externalism in the philosophy of mind; it argues in favor of the latter position, but with arguments that are foundationally (...) antecedent to this debate. We call the position we defend enactive externalism. It is based on experimental settings which, in virtue of their minimalism, make it possible both to defend a sensori-motor/enactive theory of perception; and, especially, to inquire into the origin of the space of perception, showing how it is concretely enacted before the controversy between internalism and externalism can even take place. Proportionality in Action presents an empirical and comparative exploration of the proportionality doctrine, based on detailed accounts of the application of the framework by apex courts in six jurisdictions: Germany, Canada, South Africa, Israel, Poland and India. The analysis of each country is written and contextualized by a constitutional scholar from the relevant jurisdiction. Each country analysis draws upon a large sample of case law and employs a mixed methodological approach: an expansive coding scheme allows for quantitative analysis providing comparable (...) and quantifiable measurements, which is enriched by qualitative analysis that engages with the substance of the decisions and captures nuance, contextualizing the data and providing it with meaning. The book concludes with a comparative chapter that synthesizes some of the most interesting findings. Deliberative Transformative Moments (DTM) is a new concept that serves as an amendment to the DQI. With this new concept it is easier to get at the quick give-and-take of discussions of small groups of ordinary citizens. As an illustration, we apply the concept to discussions about the peace process among Colombian ex-combatants, ex-guerrillas and ex-paramilitaries. Specifically, we show how personal stories can transform a discussion from a low to a high level of deliberation and how they can have the (...) opposite effect. To increase the level of deliberation in the general population, we recommend that good illustrations of DTM’s should be part of the school programs from an early age on, so that children learn how to discuss with others who have different opinions and values. Macromarketing attempts to address issues that engage marketing and society and previous ethical scholarship has focused on distributive justice and on exchanges that occur in conventional markets. As our research highlights, however, the distributive justice approach alone is insufficient for managing the complexities, ethical paradoxes, and out-of-market conditions associated with wicked, cross-national social concerns. In this article, we integrate macromarketing with the theory of the common good in order to provide a foundation for framing societal change that can encompass nonmarket (...) value, stakeholder rights, collective social priorities, organizational responsibilities, and political action. This book contains the historically most important discussions of the philosophical foundations of left-libertarianism. Like the more familiar right-libertarianism (such as that of Nozick), left-libertarianism holds that agents own themselves (and thus owe no service the others expect as the result of voluntary action). Unlike right-libertarianism, however, left-libertarianism holds that natural resources are owned by the members of society in some egalitarian manner, and may be appropriated only with their permission, or with a significant payment to them.

Sum rules are derived for the quantum wave functions of the Hadamard billiard in arbitrary dimensions. This billiard is a strongly chaotic (Anosov) system which consists of a point particle moving freely on a D-dimensional compact manifold (orbifold) of constant negative curvature. The sum rules express a general (two-point)correlation function of the quantum mechanical wave functions in terms of a sum over the orbits of the corresponding classical system. By taking the trace of the orbit sum rule or pre-trace formula, (...) one obtains the Selberg trace formula. The sum rules are applied in two dimensions to a compact Riemann surface of genus two, and in three dimensions to the only non-arithmetic tetrahedron existing in hyperbolic 3-space. It is shown that the quantum wave functions can be computed from classical orbits. Conversely, we demonstrate that the structure of classical orbits can be extracted from the quantum mechanical energy levels and wave functions (inverse quantum chaology). (shrink)

François Huet (1814-1869), a French philosopher, sought to reconcile the principles of Christianity with those of socialism. He argues that each person is entitled to the wealth he/she produces and to an equal share of the wealth from natural resources and from artifacts inherited from previous generations. Unlike Colins, Huet holds that agents have the right to give and bequeath wealth that they have created, but no such right with respect to wealth they inherited or received as a gift. Deliberative democracy is now an influential approach to the study of democracy and political behaviour. Its key proposition is that, in politics, it is not only power that counts, but good discussions and arguments too. This book examines the interplay between the normative and empirical aspects of the deliberative model of democracy. Jürg Steiner presents the main normative controversies in the literature on deliberation, including self-interest, civility and truthfulness. He then summarizes the empirical literature on deliberation and proposes methods (...) by which the level of deliberation can be measured rather than just assumed. Steiner's empirical research is based in the work of various research groups, including experiments with ordinary citizens in the deeply divided societies of Colombia, Bosnia-Herzegovina and Belgium, as well as Finland and the European Union. This essay advances and defends two claims: (a) that rights cannot be inalienable and (b) that even if they could be, this would not be morally justifiable.

The Global Fund is a mechanism for the global application of the Left Libertarian conception of distributive justice. As a form of luck egalitarianism, this conception confers upon each person an entitlement to an equal share of all natural resource values, since natural resources - broadly, geographical sites - are objects for the production of which no person is responsible. Owners of these sites, i.e. states, are liable to a 100% Global Fund tax on their unimproved value: that is, their (...) gross market value minus the value of the improvements added to them by human effort. It is argued that the revenue yielded by this tax would be correspondingly reduced by a further tax on the use of natural resources. (shrink)

The term “social cognition” can be construed in different ways. On the one hand, it can refer to the cognitive faculties involved in social activities, defined simply as situations where two or more individuals interact. On this view, social systems would consist of interactions between autonomous individuals; these interactions form higher-level autonomous domains not reducible to individual actions. A contrasting, alternative view is based on a much stronger theoretical definition of a truly social domain, which is always defined by a (...) set of structural norms; moreover, these social structures are not only a set of constraints, but actually constitute the possibility of enacting worlds that would just not exist without them. This view emphasises the heteronomy of individuals who abide by norms that are impersonal, culturally inherited and to a large extent independent of the individuals. Human beings are socialised through and through; consequently, all human cognition is social cognition. The article argues for this second position. Finally, it appears that fully blown autonomy actually requires heteronomy. It is the acceptance of the constraints of social structures that enables individuals to enter new realms of common meaningfulness. The emergence of social life marks a crucial step in the evolution of cognition; so that at some evolutionary point human cognition cannot but be social cognition. (shrink)
