This book is a Festschrift offered by twelve Catholic theologians and philosophers to the great Jewish theologian David Novak. Each of the twelve essays is followed by a response by David Novak, and it thereby represents a significant addition to his oeuvre. The book includes an introduction by Matthew Levering surveying Novak's many contributions to Jewish-Christian dialogue, as well as a transcribed conversation between Robert George and David Novak that encapsulates Novak's sense of the present (...) situation for Jews and Christians. Among the topics treated by the authors are religious engagement in a pluralist and secular culture, the question of whether Jews and Christians worship the same God, the morality of suicide, the role of divine commandments in Catholic moral theology, the question of whether classical versions of natural-law doctrine are susceptible to the critiques proffered by Novak, the pedagogical impact of Dabru Emet, religious freedom, the recent debate about Pope Pius IX and Edgardo Mortara, the nature of justice, the relationship of reason and revelation, the sanctity of human life and the death penalty, and supersessionism. Institutional review board delays may hinder the successful completion of federally funded research in the U.S. military. When this happens, time-sensitive, mission-relevant questions go unanswered. Research participants face unnecessary burdens and risks if delays squeeze recruitment timelines, resulting in inadequate sample sizes for definitive analyses. More broadly, military members are exposed to untested or undertested interventions, implemented by well-intentioned leaders who bypass the research process altogether. To illustrate, we offer two case examples. We posit that IRB delays often appear in (...) the service of managing institutional risk, rather than protecting research participants. Regulators may see more risk associated with moving quickly than risk related to delay, choosing to err on the side of bureaucracy. This paper first reviews key Buddhist concepts of time anicca , khanavada and uji and then describes the way in which a particular form of Bhuddist meditation, vipassana, may be thought to actualize them in human experience. The chief aim of the paper is to present a heuristic model of how vipassana meditation, by eroding dispositional tendencies rooted in the body-unconscious alters psychological time, transforming our felt-experience of time from a binding to a liberating force.

Mental Symbols is an essay on mind and meaning, on the biological implementation of mental symbols, on the architecture of mind, and on the correct construal of logical properties and relations of symbols, including implication and inference. The book argues against the main contemporary trends in the cognitive sciences, preferring rather the classical early-modern tradition. The author looks at some logical paradoxes in the light of that tradition, and offers a novel answer to the problem of the biological implementation of (...) the mind in the brain. (shrink)

P. Sousedík and D. Svoboda, in their paper “Různá pojetí matematiky u vybraných autorů od antiky po raný novověk: Je matematika teoretická věda nebo pouhá technika?”, proposed an interpretation of Aquinas’s understanding of the nature of mathematics which the author regards as unsatisfactory. The purpose of this review article is to point out its problems and to suggest in its stead an adequate interpretation of Aquinas’s mind, on the basis of a detailed analysis of his texts. The author shows that (...) Aquinas was by no means an instrumentalist in mathematics but considered mathematical truths to be directly applicable to “physical matter”. Such an application takes place in sciences like astronomy, harmonics or optics, which, although sometimes subsumed under mathematics broadly conceived, nevertheless form a special category qua the so-called “middle sciences” (viz. situated between mathematics and physics) and are thus no true species of mathematics. The fact that these sciences are also regarded as “arts” does not preclude their scientific character at all, since the two categories are not mutually exclusive, according to St. Thomas. (shrink)

Responding to the rash of books supporting a "new atheism" in recent years, some excellent rebuttals and refutations by Berlinski, Novak, Hart, Day, and others have also been published. The present book, however, is not a continuation of these critical salvos against the likes of Dawkins, Hitchens, Dennett, and Harris, but engages in a fresh reexamination of several important aspects of the "God-question," along with an exploration of the theory of the "faith-instinct"---a theory that emerges from a respectably long (...) tradition, but in recent years has been largely relegated to the sidelines in theology and philosophy. In the first chapter, scientific, metaphysical, and theological approaches are utilized and integrated in relationship to the question of God's existence. The second chapter is devoted to the "problem of evil," differentiated into the special categories often lumped into that all-too-generic term---moral evils, natural evils, suffering as an evil. Chapter 3 concerns the obvious follow-up question concerning what sort of characteristics, personal or otherwise, we can attribute to God---going beyond the question of God's mere "existence," even if and when we are intellectually convinced of this existence. In the second half of the book, the various meanings of "faith" are considered; and the apparent discrepancy of many New Testament descriptions of faith with the conventional Catholic and Protestant concepts of faith is investigated. Some "family resemblances" of supernatural faith seem to emerge. Then a monograph by Tubingen theologian Max Seckler, Instinkt und Glaubenswille ("Instinct and the Will to Believe"), which comments on thought-provoking texts concerning a "faith-instinct" in the works of Thomas Aquinas, is considered; Seckler brings out the philosophical and theological basis for this concept, as well as its reverberations for modern theology. The theory of a faith-instinct, however, leads to the question of the proper and improper, real or substitute, "objects," of the proposed instinct. Finally, if this instinct is, as hypothesized, implanted in human nature itself, for all places and all times, what is the function of the various religions in "activating" or placing obstacles to, the activation of this instinct? How are "false prophets," who may be instrumental in redirecting or misdirecting this instinct, to be recognized? Is faith bolstered or hindered by miracles---do miracles have any important relationship to faith? The book ends with a final consideration of the probable mental outlook of the atheist confronted with claims by theists of varying persuasions. (shrink)

Gilbert's kisceral argumentation is, roughly speaking, about arguing based on intuitions. In the forefront of such a (rhetorical) model are arguers and audiences, who resolve disagreements using kisceral arguments. Intuitions as reasons were more important in pre-modern law, when the law was not as explicit, precise, and determinate as today. Law influenced by religion or religious law was a typical example. In our much more secular modern era, intuitions are more or less subordinated to the (legal) logical mode of arguing. (...) However, in tough legal cases, when logic "runs out," it is values that decide them. This volume presents a Type Theory of Law (TTL), claiming that this is a unique theory of law that stems from the philosophical understanding of Jung's psychological types applied to the phenomenon of law. Furthermore, the TTL claims to be a universal, general and descriptive account of law. To prove that, the book first presents the fundamentals of Jungian psychological types, as they had been invented by Jung and consequently developed further by his followers. The next part of the book (...) describes how the typological structure of an individual determines their understanding of law. It then addresses the way in which inclusive legal theory can be understood based on this typology. Finally, the book describes the TTL in general and descriptive terms and puts it into context. All in all, the book shows how the integral or inclusive approach to understanding the nature of law is not only in tune with our time, but also relevant for presenting a more persuasive picture of law than the older exclusivist or dualist approaches of strict natural law and rigid legal positivism did. Throughout the greater part of the twentieth century, both in the analytic and continental traditions, metaphysics was deemed to be passé. The last few decades, however, have witnessed a remarkable growth of interest among analytic philosophers in various traditional metaphysical topics, such as modality, truth, causality, etc. which resulted in the emergence of various forms of analytic metaphysics. The new forms of metaphysics differ from its traditional forms mostly in their methodology and in the range of proposed solutions to particular (...) problems. Besides these and other differences, however, there are also many similarities and there are even some who intentionally develop traditional metaphysical themes using the contemporary analytical methods. All these developments call for detailed exploration, which is the general goal of the present publication Metaphysics: Aristotelian, Scholastic, Analytic. The publication is the fruit of the conference which took place in Prague in 2010 and which had for its aim to bring together those willing to explore relations between the traditional and contemporary concerns, both from among the leading analytic philosophers working in metaphysics and the historians of philosophy devoted to the study of the metaphysical tradition. With the passing of disputations between Jewish and Christian thinkers as to whose tradition has a more universal ethics, the task of Jewish and Christian ethicists is to constitute a universal horizon for their respective bodies of ethics, both of which are essentially particularistic being rooted in special revelation. This parallel project must avoid relativism that is essentially anti-ethical, and triumphalism that proposes an imperialist ethos. A retrieval of the idea of natural law in each respective tradition enables the constitution (...) of some intelligent common ground for ethical cooperation in both theory and practice between the traditions. This essay also suggests how the constitution of this common ground could include Muslims as well. The constitution of this common ground enables religious ethicists to present more cogent ethical arguments in secular space, but only of course, when those who now control secular space are open to arguments from members of any religious tradition. Throughout history the image of the non-Jew in Judaism has profoundly influenced the way in which Jews interact with non-Jews. It has also shaped the understanding that Jews have of their own identity, as it determines just what distinguishes them from the non-Jews around them. A crucial element in this is the concept of Noahide law, understood by the ancient rabbis and subsequent Jewish thinkers as incumbent upon all humankind, unlike the full 613 divine commandments of the Torah, which are (...) incumbent on Jews alone. The approach adopted in this now classic study is to consider the history of the idea of Noahide law, and to show how the concept is relevant to practical discussions of the halakhah pertaining to non-Jews and to relations between Jews and non-Jews. The seven chapters that make up the first part of the study examine each of the Noahide laws in turn, with a view to showing their halakhic development in the rabbinic sources, in the codes, and in the responsa literature. The discussion draws primarily on classical texts by traditional commentators as they attempt to deal with living issues from the rabbinic world as equally vital concerns in their own time. The second part deals with the theory of Noahide law, concluding with a consideration of why it is an appropriate starting point for Jewish philosophy today. (shrink)

The incredible achievements of modern scientific theories lead most of us to embrace scientific realism: the view that our best theories offer us at least roughly accurate descriptions of otherwise inaccessible parts of the world like genes, atoms, and the big bang. In Exceeding Our Grasp, Stanford argues that careful attention to the history of scientific investigation invites a challenge to this view that is not well represented in contemporary debates about the nature of the scientific enterprise. The historical record (...) of scientific inquiry, Stanford suggests, is characterized by what he calls the problem of unconceived alternatives. Past scientists have routinely failed even to conceive of alternatives to their own theories and lines of theoretical investigation, alternatives that were both well-confirmed by the evidence available at the time and sufficiently serious as to be ultimately accepted by later scientific communities. Stanford supports this claim with a detailed investigation of the mid-to-late 19th century theories of inheritance and generation proposed in turn by Charles Darwin, Francis Galton, and August Weismann. He goes on to argue that this historical pattern strongly suggests that there are equally well-confirmed and scientifically serious alternatives to our own best theories that remain currently unconceived. Moreover, this challenge is more serious than those rooted in either the so-called pessimistic induction or the underdetermination of theories by evidence, in part because existing realist responses to these latter challenges offer no relief from the problem of unconceived alternatives itself. Stanford concludes by investigating what positive account of the spectacularly successful edifice of modern theoretical science remains open to us if we accept that our best scientific theories are powerful conceptual tools for accomplishing our practical goals, but abandon the view that the descriptions of the world around us that they offer are therefore even probably or approximately true. Fowers et al. recently made a general argument for virtues as the characteristics necessary for individuals to flourish, given inherent human limitations. For example, people can flourish by developing the virtue of friendship as they navigate the inherent human dependency on others. This general argument also illuminates a pathway to flourishing during the COVID-19 pandemic, the risks of which have induced powerful fears, exacerbated injustices, and rendered life and death decisions far more common. Contexts of risk and fear call for (...) the virtue of courage. Courage has emerged more powerfully as a central virtue among medical personnel, first responders, and essential workers. Longstanding inequalities have been highlighted during the pandemic, calling for the virtue of justice. When important personal and public health decisions must be made, the central virtue of practical wisdom comes to the fore. Wise decisions and actions incorporate the recognition of relevant moral concerns and aims, as well as responding in fitting and practical ways to the specifics of the situation. Practicing courage, justice, and practical wisdom illuminates a path to flourishing, even in a pandemic. (shrink)

Compromises have played a significant role in our representative democracies and yet the nature of the relationship between compromise and democracy has generally raised tricky theoretical questions and generated ambiguous evaluations. In this paper, we provide an overview of some of the results obtained in the mathematical theory of intermediate quantifiers that is part of fuzzy natural logic. We briefly introduce the mathematical formal system used, the general definition of intermediate quantifiers and define three specific ones, namely, “Almost all”, “Most” and “Many”. Using tools developed in FNL, we present a list of valid intermediate syllogisms and analyze a generalized 5-square of opposition.

This essay presents and analyzes the recent work of four prominent contemporary Jewish ethicists: Eugene Borowitz, David Novak, Byron Sherwin, and Walter Wurzburger. These authors are united in their affirmation of covenant as the central category of Jewish moral obligation and their concern to construct a Jewish ethic out of the classical sources of Judaism. Yet, as an individual analysis of their books will show, they adopt markedly different views of the authority of traditional Jewish law , the respective (...) roles of individual and community in moral deliberation, and the degree to which changing historical circumstances alter moral truths.
