The chronic worldwide lack of organs for transplantation and the continuing improvement of strategies for in situ organ preservation have led to renewed interest in elective non-therapeutic ventilation of potential organ donors. Two types of situation may be eligible for elective intensive care: patients definitely evolving towards brain death and patients suitable as controlled non-heart beating organ donors after life-supporting therapies have been assessed as futile and withdrawn. Assessment of the ethical acceptability and the risks of these strategies is essential. (...) We here offer such an ethical assessment using the four principles of medical ethics of Beauchamp and Childress applying them in their broadest sense so as to include patients and their families, their caregivers, other potential recipients of intensive care, and indeed society as a whole. The main ethical problems emerging are the definition of beneficence for the potential organ donor, the dilemma between the duty to respect a dying patient's autonomy and the duty not to harm him/her, and the possible psychological and social harm for families, caregivers other potential recipients of therapeutic intensive care, and society more generally. Caution is expressed about the ethical acceptability of elective non-therapeutic ventilation, along with some proposals for precautionary measures to be taken if it is to be implemented. (shrink)

Christoph Jäger (2004) argues that Dretske's information theory of knowledge raises a serious problem for his denial of closure of knowledge under known entailment: Information is closed under known entailment (even under entailment simpliciter); given that Dretske explains the concept of knowledge in terms of "information", it is hard to stick with his denial of closure for knowledge. Thus, one of the two basic claims of Dretske would have to go. Since giving up the denial of closure would commit Dretske (...) to skepticism, it would most probably be better to rather give up the information-theoretic account of knowledge. But that means that one of the best externalist views of knowledge has to be given up. I argue here that Jäger is mistaken and that there is no problem for Dretske. There is a rather easy way out of Jäger’s problem. (shrink)

A moral theory is "self-effacing" if it tells one not to believe in it. Many people think that the aims of a moral theory (like utilitarianism) can be better reached if it is self-effacing. I argue here that moral theories should not be self-effacing. Except in a special case, the self-effacing character of a theory goes hand in hand with mutually incompatible intentions, practical dilemmas, or pragmatical paradoxes. Hence, if a moral (or non-moral) theory is self-effacing, one should rather give (...) it up. (shrink)

Social power is usually explained as an actor's ability to influence the behavior of other persons, e.g., by applying sanctions. This paper focuses upon a much less well-known and rather different form of social power: the power to influence the underlying motivation of other actors rather than just their behavior. Power over the motivation of another person concerns not only the goals of the other person but also her wants and preferences. Thus, in contrast to behavior-oriented power, motivation-oriented power induces (...) the development of those wants and preferences most likely to serve a given purpose, thereby reducing the likelihood of resistance and conflict from the outset. The main task of this paper is to analyze this important and hidden form of social power. (shrink)

Kant's political philosophy in general is characterized by two aspects which sometimes compete with each other and sometimes supplement each other: an individualist element on the one hand and a social or "communitarian" element on the other hand. This paper deals with Kant's theory of private property. It attempts to show something that is usually overlooked in the secondary literature: that Kant has two, not just one argument for property. One is based on his theory of freedom and expresses the (...) individualist aspect of his thinking. The other argument is based on Kant's principle of right and expresses the social aspect of his political thought. Despite some problems with his arguments the complexity of Kant's theory remains impressive. (shrink)

There is a very plausible principle of the transitivity of justifying reasons. It says that if "p" is better justified than "q" (all things considered) and "q" better than "r", then "p" is better justified than "r" (all things considered). There is a corresponding principle of rational theory choice. Call one theory "a better theory than" another theory if all criteria of theory choice considered (explanatory power, simplicity, empirical adequacy, etc.), the first theory meets the criteria better than the second (...) theory. The corresponding transitivity principle says that if theory A is a better theory than theory B and if theory B is a better theory than theory C, then A is a better theory than theory C. I argue against this principle. It turns out that whenever there are 2 or more relevant and independent criteria of theory evaluation, and whenever at least of one the criteria is "non-linear" in a certain sense, there may be violations of transitivity which do not violate any standards of rationality (of theory choice). This shows, again, that theory choice cannot be seen as merely the application of given rules of rational theory choice. (shrink)

Safety accounts of knowledge claim, roughly, that knowledge that p requires that one's belief that p could not have easily been false. Such accounts have been very popular in recent epistemology. However, one serious problem safety accounts have to confront is to explain why certain lottery‐related beliefs are not knowledge, without excluding obvious instances of inductive knowledge. We argue that the significance of this objection has hitherto been underappreciated by proponents of safety. We discuss Duncan Pritchard's recent solution to the (...) problem and argue that it fails. More importantly, the problem reaches deeper and poses a threat to any current safety accounts that require a belief's modal stability in close possibilities (as well as safety accounts that appeal to ‘normality’). We end by arguing that ways out of the problem require substantial reconstruction for a safety‐based account of knowledge. (shrink)

Hájek has recently presented the following paradox. You are certain that a cable guy will visit you tomorrow between 8 a.m. and 4 p.m. but you have no further information about when. And you agree to a bet on whether he will come in the morning interval (8, 12] or in the afternoon interval (12, 4). At first, you have no reason to prefer one possibility rather than the other. But you soon realise that there will definitely be a future (...) time at which you will (rationally) assign higher probability to an afternoon arrival than a morning one, due to time elapsing. You are also sure there may not be a future time at which you will (rationally) assign a higher probability to a morning arrival than an afternoon one. It would therefore appear that you ought to bet on an afternoon arrival. The paradox is based on the apparent incompatibility of the principle of expected utility and principles of diachronic rationality which are prima facie plausible. Hájek concludes that the latter are false, but doesn't provide a clear diagnosis as to why. We endeavour to further our understanding of the paradox by providing such a diagnosis. (shrink)

Objectives To determine the frequencies and types of limitation of medical treatment performed by physician members of the German Society for Palliative Medicine and to analyse the findings with respect to clinical and ethical aspects of end-of-life practices. Design Cross-sectional postal survey. Setting Data collection via the secretary of the German Society for Palliative Medicine using the German language version of the EURELD survey instrument. Subjects All 1645 physician members of the German Society for Palliative Medicine. Main outcome measures Types (...) and frequencies of limitation of treatment and possible determinants. Results 901 physicians participated in the study (response rate 55.8%). Participants reported limitation of treatment in 69.1% of cases. These decisions most often affected artificial nutrition (19%), chemotherapy (14%), antibiotics (11%) and medication other than antibiotics (11%). In the majority of eligible cases, physicians estimated the life-shortening effect of limitation of treatment to be <7 days. However, estimations differ depending on the medical measures in question. Bivariate statistical analysis indicated that withholding of treatment was performed significantly more frequently for patients aged ≥65 years (p=0.019). In addition, there were significant associations between the incidence of limitation of treatment and the different diseases reported by respondents as the underlying cause of death. Conclusion The findings of this study provide information on the current state of an ethically and clinically challenging aspect of clinical practice and can serve as a starting point for further interdisciplinary research on normative and empirical aspects of treatment decision-making at the end of life. Peter Baumann develops and defends a distinctive version of epistemic contextualism, the view that the truth conditions or the meaning of knowledge attributions of the form "S knows that p" can vary with the context of the attributor. The first part of the book examines arguments for contextualism and develops Baumann's version. It begins by dealing with the argument from cases and ordinary usage, and then addresses "theoretical" arguments, from reliability and from luck. The second part of the (...) book discusses the problems contextualism faces, to which it must respond, and provides an extension of contextualism beyond epistemology. The third part of the book is focused on some major objections to contextualism and alternative views, namely subject-sensitive invariantism, contrastivism and relativism. (shrink)

One of the most interesting accounts of knowledge which have been recently proposed is the safety account of knowledge. According to it, one only knows that p if one's true belief that p could not have easily been false: S believes that p ==> p (where "==>" stands for the subjunctive conditional). This paper presents a counter-example and discusses attempts to fix the problem. It turns out that there is a deeper underlying problem which does not allow for a solution (...) that would help the safety theorist. It is not the case that knowledge is safe. (shrink)

That knowledge is factive, that is, that knowledge that p requires that p, has for a long time typically been treated as a truism. Recently, however, some authors have raised doubts about and arguments against this claim. In a recent paper in this journal, Michael Shaffer presents new arguments against the denial of the factivity of knowledge. This article discusses one of Shaffer’s objections: the one from “inconsistency and explosion”. I discuss two potential replies to Shaffer’s problem: dialetheism plus paraconsistency (...) and epistemic pluralism. This is not to be understood so much as a criticism of Shaffer’s view but rather as a request to develop his very promising objection from inconsistency and explosion further. (shrink)

Voluntarism about beliefs is the view that persons can be free to choose their beliefs for non-epistemic (truth-related) reasons (cf. Williams 1973). One problem for belief voluntarism is that it can lead to Moore-paradoxality. The person might believe that -/- a.) there are also good epistemic reasons for her belief, or that b.) there are no epistemic reasons one way or the other, or that c.) there are good epistemic reasons against her belief. -/- If the person is aware of (...) the fact that she chose her belief for non-epistemic reasons, then she would believe one of the following three things (using "evidence" as a term for all kinds of epistemic reasons): -/- a.) I believe that p but not because of the good evidence in favour of it; b.) I believe that p but that has nothing to do with the evidence; c.) I believe that p but the evidence speaks against it. -/- We could add a fourth case in which the person suspends belief on the subject matter despite the evidence: -/- d.) The evidence supports "p" but I have no view on the matter. -/- All the different versions a-d are somehow Moore-paradoxical. They constitute different ways of mistrusting one's own belief (cf. Wittgenstein 1958, p.190). Given that one cannot, for conceptual reasons, mistrust one's beliefs, it follows that a person cannot be in one of the above predicaments described by a-d. Hence, voluntarism about beliefs is false, at least if we are dealing with cases in which the person is aware of the fact that she chose her belief for non-epistemic reasons. It won't help to focus on cases in which the person is not aware of that fact, either because she has forgotten the genesis of her belief or because the process of belief acquisition was unconscious. -/- Bas van Fraassen's conception of a stance (cf. van Fraassen 2002)-a mix of commitments, values, goals-gives us reason to rethink the possibility of voluntarism. Might we be free to choose our stances for non-epistemic reasons? I argue here that the answer is negative. First, it is not clear at all whether stances can be objects of choice, properly speaking. And: Can we make sense of the idea of a free choice here? Furthermore, I argue that similar problems of Moore-paradoxality would arise for voluntarism about stances. If one does not want to completely devalue the idea of a stance, one should avoid voluntarism. (shrink)

There is a sceptical puzzle according to which knowledge appears to license an unacceptable kind of dogmatism. Here is a version of the corresponding sceptical argument: (1) If a subject S knows a proposition p, then it is OK for S to ignore all evidence against p as misleading; (2) It is never OK for any subject to ignore any evidence against their beliefs as misleading; (3) Hence, nobody knows anything.I distinguish between different versions of the puzzle (mainly a ‘permissibility’ (...) version and a ‘closure’ version) and offer a solution for one version (the permissibility version) of the problem. No matter how much a subject knows, knowledge never gives one a license to ignore evidence against a proposition. Premise (1) of the argument is false and the puzzle can thus be resolved. (shrink)

One of the most recent trends in epistemology is contrastivism. It can be characterized as the thesis that knowledge is a ternary relation between a subject, a proposition known and a contrast proposition. According to contrastivism, knowledge attributions have the form “S knows that p, rather than q”. In this paper I raise several problems for contrastivism: it lacks plausibility for many cases of knowledge, is too relaxed concerning the third relatum, and overlooks a further relativity of the knowledge relation.

In this paper I respond to P.D. Magnus’ critique of an earlier paper of mine on Thomas Reid’s theory of common sense. In the earlier paper (The Scottish Pragmatist? The Dilemma of Common Sense and the Pragmatist Way Out, Reid Studies 2, 1999, 47-57) I argued that Reid faces a dilemma between dogmatism and scepticism but that there are also hints in his work towards a pragmatist way out of the problem. P.D. Magnus, in a response to this paper (Reid’s (...) Dilemma and the Uses of Pragmatism, Journal of Scottish Philosophy 2, 2004, 69-72), criticizes me for misidentifying the kind of pragmatism one can find in Reid. In this paper I defend my interpretation of Reid and spell the relevant kind of pragmatism out in more detail. (shrink)

According to subject‐sensitive invariantism (SSI), whether S knows that p depends not only on the subject's epistemic position (the presence of a true belief, sufficient warrant, etc.) but also on non‐epistemic factors present in the subject's situation; such factors are seen as “encroaching” on the subject's epistemic standing. Not the only such non‐epistemic factor but the most prominent one consists in the subject's practical stakes. Stakes‐based SSI holds that two subjects can be in the same epistemic position with respect to (...) some proposition but with different stakes for the two subjects so that one of them might know the proposition while the other might fail to know it. It is remarkable that the notion of stakes has not been discussed much in great detail at all so far. This paper takes a closer look at this notion and proposes a detailed, new analysis. It turns out that there is more than one kind of stakes, namely event‐stakes, knowledge‐stakes and action‐stakes. I discuss several issues that even plausible notions of stakes raise and propose solutions. (shrink)

This paper argues that three plausible principles are mutually inconsistent: One ought to assert only what one knows; If it is proper to assert some proposition q, then it is, barring special and not very common circumstances, proper to assert any proposition p from which q has been competently inferred; and Some propositions are both properly assertible and known by competent inference from propositions which one does not know. Each pair of two principles constitutes an argument against the remaining principle, (...) but which principle should one drop? (shrink)

Peter Baumann offers the tantalizing suggestion that Thomas Reid is almost, but not quite, a pragmatist. He motivates this claim by posing a dilemma for common sense philosophy: Will it be dogmatism or scepticism? Baumann claims that Reid points to but does not embrace a pragmatist third way between these unsavory options. If we understand `pragmatism' differently than Baumann does, however, we need not be so equivocal in attributing it to Reid. Reid makes what we could call (...) an argument from practical commitment, and this is plausibly an instance of what William James calls the pragmatic method. (shrink)

Abstract One of the most popular objections against epistemic contextualism is the so-called ?warranted assertability? objection. The objection is based on the possibility of a ?warranted assertability manoeuvre?, also known as a WAM. I argue here that WAMs are of very limited scope and importance. An important class of cases cannot be dealt with by WAMs. No analogue of WAMs is available for these cases. One should thus not take WAMs too seriously in the debate about epistemic contextualism.

Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. Most recent accounts of personal autonomy acknowledge that the social environment a person lives in, and the personal relationships she entertains, have some impact on her autonomy. Two kinds of conceptualizing social conditions are traditionally distinguished in this regard: Causally relational accounts hold that certain relationships and social environments play a causal role for the development and on-going exercise of autonomy. Constitutively relational accounts, by contrast, claim that autonomy is at least partly constituted by a person’s social environment or standing. (...) The central aim of this paper is to raise the question how causally and constitutively relational approaches relate to the fact that we exercise our autonomy over time. I argue that once the temporal scope of autonomy is opened up, we need not only to think differently about the social dimension of autonomy. We also need to reconsider the very distinction between causally and constitutively relational accounts, because it is itself a synchronic (and not a diachronic) distinction. (shrink)

Ricœur lectured and wrote for over twenty years on negation (‘Do I understand something better if I know what it is not, and what is not-ness?') and never published his extensive writings on this subject. Ricœur concluded that there are multiple forms of negation; it can, for example, be the other person (Plato), the not knowable nature of our world (Kant), the included opposite (Hegel), apophatic spirituality (Plotinus on not being able to know God) and existential nothingness (Sartre). Ricœur, working (...) on Kant, Hegel and Sartre, decided that all these forms of negation are incompatible and also fatally flawed because they fail to resolve false binaries of negative: positive. Alison Scott-Baumann demonstrates how Ricœur subsequently incorporated negation into his linguistic turn, using dialectics, metaphor, narrative, parable and translation in order to show how negation is in us, not outside us: language both creates and clarifies false binaries. He bestows upon negation a strong and central role in the human condition, and its inevitability is reflected in his writings, if we look carefully. Ricœur and the Negation of Happiness draws on Ricœur's published works, previously unavailable archival material and many other sources. Alison Scott-Baumann argues that thinking positively is necessary but not sufficient for aspiring to happiness - what is also required is affirmation of negative impulses: we know we are split by contradictions and still try to overcome them. She also demonstrates the urgency of analysing current socio-cultural debates about wellbeing, education and equality, which rest insecurely upon our loose use of the negative as a category mistake. This paper discusses two versions of reliabilism: modal and probabilistic reliabilism. Modal reliabilism faces the problem of the missing closeness metric for possible worlds while probalistic reliabilism faces the problem of the relevant reference class. Despite the severity of these problems, reliabilism is still very plausible (also for independent reasons). I propose to stick with reliabilism, propose a contextualist (or, alternatively, harmlessly relativist) solution to the above problems and suggest that probabilistic reliabilism has the advantage over modal reliabilism.

Seit über zehn Jahren moderieren die Autor*innen mit hohem Zuspruch das Ethik-Café in Einrichtungen des Sozial- und Gesundheitswesens. Menschen aus unterschiedlichen Berufen, Patient*innen, An- und Zugehörige sowie ethisch Interessierte haben im Ethik-Café die Möglichkeit, aus ihrer persönlichen und beruflichen Perspektive ethische Fragestellungen zu diskutieren, die für ihren Alltag relevant sind. Ethik-Cafés sind niederschwellig, multiprofessionell, interdisziplinär. Die Teilnehmer*innen profitieren von dieser Perspektivenvielfalt. Das Buch stellt die Konzeption sowie deren Evaluation, die theoretischen und methodischen Voraussetzungen und in vielen Beispielen die praktische Umsetzung (...) von Ethik-Cafés dar. Das entwickelte Vier-Phasen-Modell des ethischen Prozesses wird exemplarisch in 25 Ethik-Cafés zu Themen aus dem Sozial- und Gesundheitswesen angewendet und umgesetzt. Das Buch richtet sich an Mitarbeiter*innen und Führungskräfte im Sozial- und Gesundheitswesen, Lehrer*innen, Lernbegleiter*innen und Auszubildende in der generalistischen Pflegeausbildung, an Fort- und Weiterbildungsreferent*innen, Studierende, Ehrenamtliche sowie alle ethisch Interessierten.
