This paper examines the concepts of desert and luck, familiar in political theory but neglected by sociologists. I argue that the idea of desert is composed of both personal performance and the degree of responsibility a person has over that performance. Distribution ought to be in accordance with the indebtedness created by the person's performance. This can be compromised by luck; that is, personal desert is undermined where lack of performance scuttles the applicability of the contributory model. It is often argued that associations are intelligent organisms with minds and intentional states of their own. It is also argued that groups are merely a plurality of individuals who are related or associated only in a specific and limited sense. This paper draws on both classical and contemporary scholarship to develop an ontological account of persons which has real-world legal and ethical implications.

This article is an attempt to develop a practical politico-jurisprudential account of the corporate person, which it does by building on contemporary ideas about collective and shared intentions. It argues for a model of shared intentions, which posits a set of interlocking preferences, and other supporting attitudes. It examines the work of Bratman, Gilbert, Hurley, and Sugden and addresses issues of choice, coercion and will.

In recent years there has been a significant growth in interest of the so-called 'law in context' extending legal studies beyond black letter law. This book looks at the relationship between statute law and legal practice. It examines how law is applied in reality and more precisely how law is perceived by the general public in contrast to the legal profession. The authors look at a number of themes that are central to examining ways in which myths about law are (...) formed, and how there is inevitably a constitutive power aspect to this myth making. This chapter provides an overview of how existential phenomenology has influenced qualitative research methods across a range of disciplines across the social, health, educational, and psychological sciences. It focuses specifically on how the concepts of “existential structures,” or “existentials”—such as selfhood, temporality, spatiality, affectivity, and embodiment—have been used in qualitative research. After providing a brief introduction to what qualitative research is and why philosophers should be interested in it, the chapter provides clear, straightforward examples of how qualitative researchers have used (...) existentials to analyze qualitative data and design qualitative studies. We explore the role of episodic imagining in explaining why people both differentially report that it seems to them in experience as though time robustly passes, and why they differentially report that they believe that time does in fact robustly pass. We empirically investigate two hypotheses, the differential vividness hypothesis, and the mental time travel hypothesis. According to each of these, the degree to which people vividly episodically imagine past/future states of affairs influences their tendency to report that it seems (...) to them as though time robustly passes and to judge that time does robustly pass. According to the former, a greater degree of vividness will tend to increase the extent to which people make such reports, while according to the latter, it will tend to decrease the extent to which people make such reports. We found weak evidence in favour of the former hypothesis. We reflect on the implications of this finding for theorising about such reports. (shrink)

Matthias Steup (Steup 2008) has recently argued that our doxastic attitudes are free by (i) drawing an analogy with compatibilism about freedom of action and (ii) denying that it is a necessary condition for believing at will that S's having an intention to believe that p can cause S to believe that p . Anthony Barron explores the relationship between the philosophy of Schopenhauer and the forms and themes of Beckett's critical and creative writings. He shows that Beckett's aesthetic preoccupations are consonant with some of Schopenhauer's seminal arguments regarding the arational basis of artistic composition and appreciation and the impotence of reason in human affairs. While Beckett's critical writings are, in places, formidably opaque, this work examines the ways in which such texts can be elucidated when their intertextual affinities with Schopenhauer's arguments (...) are revealed. Using Schopenhauer's thought as a presiding interpretative framework, Barron demonstrates how the widespread presence of philosophical and theological ideas in Beckett's creative texts signifies less about his personal convictions than it does about his authorial aims. This research work examines Heidegger's (1889-1976) contention that phenomenology can inspire, illuminate, motivate, reinforce and guide (human) individual's actions. It achieves this by adapting Heidegger's phenomenological approach to analyze and interpret representative everyday factical experiences of nepotism, selfishness and mass mentality in the (Nigerian) society. Doing this helps to ascertain whether these experiences have any phenomenological link with inauthenticity. Also, it provides a close reading and interpretation of Heidegger's treatment of authentic existence, and explores the possibility of complimenting it with (...) the phenomenology of Commensality, as a mode of care and a way to authenticity. In this manner, it strategically explores possible ways of inspiring individual Daseins to authenticity, and with it engendering a positive transformation of the (Nigerian) society. Presenting and elaborating the phenomenology of Commensality, the work highlights the relationship and the differences between the phenomenology of Commensality and the ontical or sociological understanding of commensality as obtained in African traditional societies. Phenomenology of Commensality argues for the 'renaissance' of Commensality, concretely expressed as Onyenkeanyi, and not just for its 'revival'. The research work further develops the phenomenology of education for Commensality, discussing the possible content and focus of its curriculum, while differentiating it from ethics. The proper implementation of phenomenology of education for Commensality could inspire and illuminate individual Daseins to authenticity, and thereby becomes an improvement strategy for the positive transformation of the (Nigerian) society. As a phenomenology, it is appropriate that the people and places analyzed take on a definite character, which is why the Nigerian society is used. However, it is expected that the implications of the findings presented here will be general and accurate enough to allow application to any number of similar situations. (shrink)

The Politics of Well-Being argues that the relationship between well-being and ethical life has been overlooked. The more specific argument of the book is that ethical life requires political engagement, and the emergence of a society committed to critical thinking. It is argued that these conditions allow for our ordination and confirmation as ethical subjects. While well-being can be experienced in different ways, it is claimed that, after experience of ethical life, a more sustainable form of it is revealed to (...) us, a form which we would be drawn to preserve, a form which can be constituted as an object of hope. While the book draws on philosophical themes, its main focus is political. This is because its primary objective is to identify and to examine what needs to be done in order to realise ethical life. Its main focus in this respect is the identification and examination of the barriers which need to be overcome if ethical life is to be realised. It is acknowledged that this will not be an easy task. Indeed, it may be an impossible task. However, despite these barriers, and despite the dark days we are living through, the book is a call to hope rather than a surrender to despair. This book will be of interest to students of politics, psychology, cultural studies, philosophy and sociology, as well as anyone else interested in exploring new ideas about how the make the world a better place. Children are routinely treated paternalistically. There are good reasons for this. Children are quite vulnerable. They are ill-equipped to meet their most basic needs, due, in part, to deficiencies in practical and theoretical reasoning and in executing their wishes. Children’s motivations and perceptions are often not congruent with their best interests. Consequently, raising children involves facilitating their best interests synchronically and diachronically. In practice, this requires caregivers to (in some sense) manage a child’s daily life. If apposite, this management will (...) focus partly on a child’s well-being. To be ably executed, an account of children’s well-being will need to be articulated. This chapter focuses on the nature of children’s well-being. It has five sections. The first section clarifies the focus. The second section examines some hurdles to articulating a view of children’s well-being. The third section evaluates some accounts of children’s well-being. The fourth section addresses the view that children possess features essential to them that make their lives on balance prudentially bad for them. The fifth section sums things up. (shrink)

This article is written by a descendant of enslaved Africans and explores the theological significance of Black bodies. Black bodies have been commodified, controlled and coerced by White hegemony, often lacking agency and self-determination. Using personal experience and contextual analysis, this article, drawing on Black theology inspired reflections, argues that we need to rethink how we conceive of Black bodies ethically, if Black lives are to really matter. The rehabilitation of Black bodies is achieved through a theological reappraisal of holiness (...) and sacraments, underpinned by an embodied pneumatology, in which Black bodies are shown to be sacramental and worthy of mattering in a world underpinned by White supremacy. How is the Sartrean conception of phenomena of anguish connected to what we currently refer to as phenomena of anxiety? And what is the exact interrelation between anguish, fear, and anxiety?

No question, argues theologian Anthony Kelly, is more important than God and our relationship to God (individually and collectively). In this little volume, Anthony Thiselton makes an impassioned appeal for closer attention to the philosophy of hermeneutics. Emilio Betti provocatively observes that hermeneutics ought to constitute an obligatory course for most degrees in the humanities. Hermeneutics, he insists, teaches patience, tolerance, respect for other views, understanding, and humility, while holding one's own views with firmness and generosity. Thinking as described in Plato’s Sophist undergoes two basic changes: it progresses by shifting from one to many and it regresses by shifting from many to one. The change from one to many is generative; the change from many to one is reductive. These opposing changes provide a tension for thinking, and like Heraclitus’ bow string, this tension gives thinking its efficacy. Thinking would wander and accumulate endlessly unless it regresses from many to one. Yet, thinking would stagnate if it (...) could not progress from one to many. Restless Ideas is a lively new textbook of contemporary social theory that speaks directly to the anxious age in which we live today. Providing a definitive interpretation of many ideas in Aristotle’s moral and political works has proved to be a difficult task for his commentators, both ancient and modern. The relation between the individual human good and the communal good is a particularly complex problem, especially because of its association with complicated notions of human happiness, practical wisdom, and contemplative and political virtue. This chapter considers the question of the superiority of the common good over individual happiness in light of these accompanying (...) ideas. The many conflicting explanations of these doctrines are the result of Aristotle’s method of providing only general principles and a broad outline of moral concepts. That there may never be a consensus on the exact meaning of many of Aristotle’s ideas may not be a weakness in his work but rather a strength, which he himself had envisaged, since he allows the practically wise person to determine the best course of action in order to attain human goodness. Based on the communication ethics of Ptahhotep and other inclusivist communication value systems, including several additional non-Western (Confucian, Buddhist, Aborigine, Cree, San, Māori, Ubuntu, and Islamic) as well as Western ones (Stoic, Christian, Kantian, socialist, liberal, and journalistic), we propose seven principles as common ground for the future regulation of media communication on a global scale. All seven are formulated in a manner similar to Ptahhotep’s, providing a flexible range of norms allowing, for example, hate speech to be dealt with (...) by criminalization, or in civil law, or by means of ethics rules and self-regulation, depending on the severity of the involved threats to humanity, to human beings, or to other core values. We reject an often-paralyzing comparative intercultural juxtaposition of individualism versus collectivism, instead suggesting an inclusivist and interculturally principled common ground for the regulation of communication. W. E. B. Du Bois never felt so at home as when he was a student at the University of Berlin. But Du Bois was also American to his core, scarred but not crippled by the racial humiliations of his homeland. In Lines of Descent, Kwame Anthony Appiah traces the twin lineages of Du Bois' American experience and German apprenticeship, showing how they shaped the great African-American scholar's ideas of race and social identity. At Harvard, Du Bois studied with (...) such luminaries as William James and George Santayana, scholars whose contributions were largely intellectual. But arriving in Berlin in 1892, Du Bois came under the tutelage of academics who were also public men. The economist Adolf Wagner had been an advisor to Otto von Bismarck. Heinrich von Treitschke, the historian, served in the Reichstag, and the economist Gustav von Schmoller was a member of the Prussian state council. These scholars united the rigorous study of history with political activism and represented a model of real-world engagement that would strongly influence Du Bois in the years to come. With its romantic notions of human brotherhood and self-realization, German culture held a potent allure for Du Bois. Germany, he said, was the first place white people had treated him as an equal. But the prevalence of anti-Semitism allowed Du Bois no illusions that the Kaiserreich was free of racism. His challenge, says Appiah, was to take the best of German intellectual life without its parochialism--to steal the fire without getting burned. (shrink)

In 1936 Samuel Beckett wrote a letter to Sergei Eisenstein - the legendary director of such films as Battleship Potemkin - expressing his own desire to work in the lost tradition of silent film. Drawing on substantial archival material, this is the first book to examine comprehensively the full extent of Beckett's engagement with cinema and its influence on his work for stage and screen. Examining his writing on second wave modernist cinema, including the work of directors such as Eisenstein, (...) Godard, Griffith and Bresson as well as performers such as Buster Keaton, Charlie Chaplin and Greta Garbo, the book reveals film art to be central to Beckett's modernist aesthetic.
