This article concerns the conflict between copyright and museums’ digitisation and online sharing of collections. This issue has recently become particularly important in connection with the COVID-19 pandemic. The authors outline the concept of a virtual museum and present the most important copyright provisions in EU law that may create obstacles for cultural institutions in realising virtual counterparts. To perceive copyright as the main obstacle in the process of digitisation and online sharing of collections is not unusual. Hence, the article (...) briefly presents legal framework of the European copyright applicable to such situations. The authors argue that although copyright offers a range of possibilities for museums interested in digitising their collections, at the same time it is responsible for a _chilling effect_, resulting in fear of potential infringement and liability. The authors conclude that the EU’s development of new legislation, coinciding with the need for digitisation and online sharing of cultural heritage caused by the pandemic, has favoured public interest at the expense of creators’ rights, but still lacks satisfactory legal tools for effectively allowing cultural institutions to digitise and share their collections. Branching is a set-theoretical model of reality that is in accord with contemporary physics. This structure is also a model for some logical calculi. However, if the formal language defined on the basis of branching is to correspond to our ways of speaking about possible events, a number of issues must be clarified. All of them are connected with the notion of possibility that is employed in this language. Yet the apparent need to supplement this language with an additional notion (...) of possibility means that branching ceases to be attractive as a candidate for a model of physical reality, as it contains considerably more elements than we would like to see in reality. Thus, the connection between this logical tool and ontology becomes questionable. (shrink)

In this paper, we discuss the problem of the relationship between legal concepts and legal norms. We argue that one of the widespread theories of legal concepts, which we call ‘the embedding theory’, is false. The theory is based on the assumption that legal norms are central for any legal system and that each legal norm establishes an inferential link between a certain class of facts and a certain class of legal consequences. Alf Ross’s embedding theory was presented in his (...) famous paper “Tu–Tu”. According to Ross, the sole function of legal concepts is to simplify normative information. Hence, the use of legal concepts may be a matter of convenience, rather than necessity. We criticize this approach mainly by pointing to the existence of so-called second order substantive concepts, which are not reducible to any determined set of conditional sentences (inferential links). In short, second order substantive concepts play the role of general standards, and general standards are used to provide flexibility for a particular legal system. In addition, general standards are ‘value loaded’, since they serve as a frame of reference for judges applying law to particular cases. To understand such general standards as a predefined set of conditionals means to overlook their ‘open’ content, and thus their function. In our opinion, the acceptance of the embedding theory means to misinterpret the function of general standards. We also argue that Giovani Sartor’s idea of defective legal concepts doesn’t help to clarify or defend the embedding theory. (shrink)

We present here some Boolean connexive logics (BCLs) that are intended to be connexive counterparts of selected Epstein’s content relationship logics (CRLs). The main motivation for analyzing such logics is to explain the notion of connexivity by means of the notion of content relationship. The article consists of two parts. In the first one, we focus on the syntactic analysis by means of axiomatic systems. The starting point for our syntactic considerations will be the smallest BCL and the smallest CRL. (...) In the first part, we also identify axioms of Epstein’s logics that, together with the connexive principles, lead to contradiction. Moreover, we present some principles that will be equivalent to the connexive theses, but not to the content connexive theses we will propose. In the second part, we focus on the semantic analysis provided by relating- and set-assignment models. We define sound and complete relating semantics for all tested systems. We also indicate alternative relating models for the smallest BCL, which are not alternative models of the connexive counterparts of the considered CRLs. We provide a set-assignment semantics for some BCLs, giving thus a natural formalization of the content relationship understood either as content sharing or as content inclusion. (shrink)

Recent increases in inflation rates around the world has lead to many discussions on the causes of such rapid adjustments, some suggesting that higher profits are responsible driving force behind inflation. Here we will focus on the United States case and demonstrate why quantity theory of money is relevant to explain what has been going on with inflation after 2020 rather than profit based theory of inflation. First section introduces the argument. Second section restates quantity theory of money with relevance (...) to the empirical literature. Third section shows why quantity theory despite some suggestions works to explain the current levels of inflation. Fourth section notices why increases in nominal profits during inflation are part of the natural adjustment path. Last section offers concluding comments. (shrink)

Tak przynajmniej wydaje się wielu współczesnym teologom, zwłaszcza tym, którzy są przedstawicielami szeroko rozumianego nurtu kenotycznego. Według nich Akwinata jest przykładem myśliciela, w którego teologii absolutność Boga, Jego transcendencja, niezmienność, suwerenność i potęga zostały tak mocno podkreślone, że ma to wręcz uniemożliwiać adekwatne uchwycenie zdumiewającej prawdy objawionej w Chrystusie: Bóg jest Bogiem uniżającym siebie samego. Zatem, zdaniem (...) wielu współczesnych teologów, proponowana przez Tomasza wizja Boga ma więcej wspólnego ze skonstruowaną za pomocą metafizyki filozoficzną doktryną Absolutu niż z Bogiem, który stał się człowiekiem i umarł na krzyżu dla naszego zbawienia. This book aims to present trompe-l'oeil painting as an ambigous aesthetic ideal offered by early modern theory of art. It embodies the idea of an image identical to what it represents. It is interpreted in terms of perceptual and aesthetic illusion, mimesis, diegesis, play, irony and scientific illustration.

In this paper, we focus on the development of geometric cognition. We argue that to understand how geometric cognition has been constituted, one must appreciate not only individual cognitive factors, such as phylogenetically ancient and ontogenetically early core cognitive systems, but also the social history of the spread and use of cognitive artifacts. In particular, we show that the development of Greek mathematics, enshrined in Euclid’s Elements, was driven by the use of two tightly intertwined cognitive artifacts: the use of (...) lettered diagrams; and the creation of linguistic formulae. Together, these artifacts formed the professional language of geometry. In this respect, the case of Greek geometry clearly shows that explanations of geometric reasoning have to go beyond the confines of methodological individualism to account for how the distributed practice of artifact use has stabilized over time. This practice, as we suggest, has also contributed heavily to the understanding of what mathematical proof is; classically, it has been assumed that proofs are not merely deductively correct but also remain invariant over various individuals sharing the same cognitive practice. Cognitive artifacts in Greek geometry constrained the repertoire of admissible inferential operations, which made these proofs inter-subjectively testable and compelling. By focusing on the cognitive operations on artifacts, we also stress that mental mechanisms that contribute to these operations are still poorly understood, in contrast to those mechanisms which drive symbolic logical inference. The cognitive foundations of geometry have puzzled academics for a long time, and even today are mostly unknown to many scholars, including mathematical cognition researchers. -/- Foundations of Geometric Cognition shows that basic geometric skills are deeply hardwired in the visuospatial cognitive capacities of our brains, namely spatial navigation and object recognition. These capacities, shared with non-human animals and appearing in early stages of the human ontogeny, cannot, however, fully explain a uniquely human form of geometric cognition. In the book, (...) In this paper, we present the history of and the research directions in relating logic. For this purpose we will describe Epstein's Programme, which postulates accounting for the content of sentences in logical research. We will focus on analysing the content relationship and Epstein's logics that are based on it, which are special cases of relating logic. Moreover, the set-assignment semantics will be discussed. Next, the Torunian Programme of Relating Semantics will be presented; this programme explores the various non-logical relationships (...) in logical research, including those which are content-related. We will present a general description of relating logic and semantics as well as the most prominent issues regarding the Torunian Programme, including some of its special cases and the results achieved to date. -/- . In consequence of significant social, political, economic, and demographic changes several wildlife species are currently growing in numbers and recolonizing Europe. While this is rightly hailed as a success of the environmental movement, the return of wildlife brings its own issues. As the animals arrive in the places we inhabit, we are learning anew that life with wild nature is not easy, especially when the accumulated cultural knowledge and experience pertaining to such coexistence have been all but lost. This book (...) provides a hermeneutic study of the ways we come to understand the troubling impacts of wildlife by exploring and critically discussing the meanings of 'ecological discomforts'. Thus, it begins the work of rebuilding the culture of coexistence. The cases presented in this book range from crocodile attacks to mice infestations, and their analysis consequently builds up an ethics that sees wildlife as active participants in the shaping of human moral and existential reality. This book is of interest not only to environmental philosophers, who will find here an original contribution to the established ethical discussions, but also to wildlife managers, and even to those members of the public who themselves struggle to make sense of encounters with their new wild neighbors. We introduce a principle of local collection for compositional truth predicates and show that it is arithmetically conservative over the classically compositional theory of truth. This axiom states that upon restriction to formulae of any syntactic complexity, the resulting predicate satisfies full collection. In particular, arguments using collection for the truth predicate applied to sentences occurring in any given (code of a) proof do not suffice to show that the conclusion of that proof is true, in stark contrast to the (...) case of the induction scheme. We analyse various further results concerning end-extensions of models of compositional truth and the collection scheme for the compositional truth predicate. (shrink)

In this article we investigate the relationship between legal translation and legal interpretation. The common wisdom is that these activities are closely related, but the nature of that relationship remains disputable. We adopt the perspective of legal theory—as opposed to the perspective of translation studies—which seems to be underrepresented in the literature of the subject. We start with distinguishing between the two notions of legal interpretation: the wide sense and the narrow sense. We argue that the relationship between legal translation (...) and legal interpretation changes significantly depending on the notion of legal interpretation that is assumed. The wide sense is often assumed by translation scholars and it renders legal interpretation as a necessary prerequisite for legal translation. Jurists, on the other hand, usually assume the narrow sense which renders legal interpretation and legal translation as two distinct activities with some shared features. We then focus on four issues of legal interpretation in the narrow sense: the types of legal interpretive problems, the creation of legal interpretive problems, the methods of legal interpretation, the resolution of legal interpretive problems. We conclude with a detailed comparison of legal translation and legal interpretation in the context of those four issues. (shrink)

Idea słowiańska” jest terminem ogólnym, odnoszącym się do wielu politycznych, historiozoficznych i kulturowych wątków, dla których inspiracją było językowe i kulturowe pokrewieństwo między narodami słowiańskimi. Takie ruchy jak słowianofilstwo i panslawizm miały na celu kulturalne i polityczne zjednoczenie Słowian. Idea ta wywarła silny wpływ na muzykę krajów środkowej i wschodniej Europy w XIX i XX wieku. Pod jej wpływem powstała znaczna liczba utworów muzycznych. Można utwory te podzielić na kilka grup. W jednych „słowiańskość” podkreślana była poprzez tytuł. Kompozytorzy używali również (...) typowo słowiańskich gatunków tanecznych i pieśniowych, jak polski mazurek i ukraińska dumka. Innym sposobem realizacji idei słowiańskiej były muzyczne kontakty między twórcami. Idea muzyki słowiańskiej pojawia się również w komentarzach muzykologicznych: słowiański „charakter” muzyczny bywał najczęściej łączony ze specyficznymi kategoriami emocjonalnymi, takimi jak smutek, tęsknota, szczególnie zaś żal, które to określenie stosowano do opisu przemożnego nastroju panującego w dziełach Chopina. Artykuł jest próbą analizy koncepcji minimalistycznej neurofilozofii autorstwa Henrika Waltera w kontekście dyskusji dotyczącej problemu psychofizycznego. Bezpośrednio związana z ową koncepcją teoria o „zróżnicowanej metafizyce” została w tekście powiązana z ideą pluralizmu eksplanacyjnego i ukazana jako metodologiczna alternatywa dla poszukiwania fundamentalnych teorii świadomości. Jednocześnie poza ewentualnymi zaletami metafilozoficznej refleksji podejmowanej w ramach minimalistycznej neurofilozofii zarysowane zostały jej podstawowe ograniczenia i problemy związane m.in. z uznaniem superweniencji za punkt łączący różnorodne stanowiska neurofilozoficzne.

The aim of the paper is to discuss the idea of dialogue with nature. Even though the idea of dialogue with animals, plants – even objects of inanimate nature – is well known, it has usually been treated as an expression of a naive or folk view. Yet, it has recently gained in importance as an idea that is used to describe an ecological approach to natural environment and tends to be treated as a foundation for an ecological culture. A (...) noteworthy contribution to the reconsideration of the concept of human-nature dialogue has also been given by a number of contemporary philosophers who have offered an environmental reinterpretation of phenomenology and hermeneutics based on, among other things, Martin Buber’s concept of the I-You relationship. The paper will focus on two aspects of the concept of dialogue, namely on its epistemological and ethical implications. Following Erazim Kohák’s theory, which will be presented as a key figure of a particular manner of speaking about nature, one that leads to ecological personalism. (shrink)

This paper is a follow-up to [4], in which a mistake in [6] was corrected. We give a strenghtening of the main result on the semantical nonconservativity of the theory of PT−with internal induction for total formulae${$, denoted by PT−in [9]). We show that if to PT−the axiom of internal induction forallarithmetical formulae is added, then this theory is semantically stronger than${\rm{P}}{{\rm{T}}^ - } + {\rm{INT}}\left$. In particular the latter is not relatively truth definable in the former. Last but not (...) least, we provide an axiomatic theory of truth which meets the requirements put forward by Fischer and Horsten in [9]. The truth theory we define is based on Weak Kleene Logic instead of the Strong one. (shrink)

The paper explores the link between contemplation of the One and happiness in Plotinus and challenges the traditional interpretation according to which a contemplative or mystical experience of the One is by necessity brief and transitory, while the experience of Intellect can become a stable state in this life. Were it so, it would not serve as a ground for the good or happy life. In order to reconcile this point with Plotinus’s other claim about contemplation, his doctrine of the (...) double activity of Intellect is invoked. (shrink)

The current paper studies the formal properties of the Global Reflection Principle, to wit the assertion “All theorems of$\mathrm {Th}$are true,” where$\mathrm {Th}$is a theory in the language of arithmetic and the truth predicate satisfies the usual Tarskian inductive conditions for formulae in the language of arithmetic. We fix the gap in Kotlarski’s proof from [15], showing that the Global Reflection Principle for Peano Arithmetic is provable in the theory of compositional truth with bounded induction only ($\mathrm {CT}_0$). Furthermore, we (...) extend the above result showing that$\Sigma _1$-uniform reflection over a theory of uniform Tarski biconditionals ($\mathrm {UTB}^-$) is provable in$\mathrm {CT}_0$, thus answering the question of Beklemishev and Pakhomov [2]. Finally, we introduce the notion of a prolongable satisfaction class and use it to study the structure of models of$\mathrm {CT}_0$. In particular, we provide a new model-theoretical characterization of theories of finite iterations of uniform reflection and present a new proof characterizing the arithmetical consequences of$\mathrm {CT}_0$. The aim of the article is to analyze the relationship between Singapore and the People’s Republic of China in the light of the current policy of the President of the United States Donald Trump. The point of reference for the presented analysis is the foreign policy of the former President Barack Obama, based on the strategy known as “pivot to Asia” – the strategic turnabout of the United States to the Asia-Pacific region. One of its main objectives was the signing (...) of a multilateral agreement on the establishment of a free trade zone, the Trans-Pacific Partnership (TPP), bringing together 12 countries. The main subject of the present analysis is to examine the impact of Donald Trump’s decision of January 2017 to withdraw from the TPP trade agreement on the relations between the remaining signatories of the agreement, as well as to examine Beijing’s actions, which may seek to increase its sphere of influence in Asia through the breakdown of TPP. The main part of the research is focused on the triangle politics concept in international politics, which will include China, Singapore and the United States. Besides the two largest economic powers, Singapore is included because of its membership in the TPP and ASEAN, and due to its strong economy and its population (predominantly) of Chinese origin it can be viewed as the “fifth column” or may otherwise play a role in the Greater China concept. Celem artykułu jest prezentacja i krytyczna analiza koncepcji uczuć egzystencjalnych, autorstwa współczesnego filozofa psychiatrii o orientacji fenomenologicznej — Matthew Ratcliffe’a. Uczucia egzystencjalne są specjalną klasą stanów afektywnych, nadającą emocjonalnego zabarwienia subiektywnemu doświadczeniu rzeczywistości. Mają one charakter przedrefleksyjny i stanowią niejawne tło świadomości fenomenalnej, które w potocznym doświadczeniu pozostaje poza polem uwagi. Uczucia te mają ścisły związek z emocjami, determinując typy przedmiotów intencjonalnych zawartych w stanach emocjonalnych i wyznaczając repertuar możliwych do doświadczenia emocji. Najważniejsze uczucia egzystencjalne, które wyróżnia Ratcliffe, to: (1) (...) poczucie rzeczywistości, czyli przedrefleksyjne i fenomenalne wrażenie o realnym istnieniu świata jako takiego; (2) poczucie przynależności, czyli przedrefleksyjne i fenomenalne wrażenie własnego istnienia i osadzenia w świecie pośród osób i rzeczy. Te dwie kategorie stanowią fundamentalne składowe pierwszoosobowego doświadczenia podmiotu, wyznaczając tym samym jego relację do innych ludzi oraz rzeczywistości w jej najbardziej ogólnym sensie. W artykule przedstawiam główne cechy i typy uczuć egzystencjalnych. Zwracam także uwagę na szczególną rolę psychopatologii w analizie i uzasadnianiu istnienia tego zjawiska. W związku z tym, za Ratcliffem, opisuję w jaki sposób określone aspekty uczuć egzystencjalnych ulegają dezintegracji w przebiegu epizodów zaburzeń psychicznych, takich jak depresja czy schizofrenia. Pokazuję także różnicę pomiędzy fenomenologicznym i poznawczo-behoawioralnym podejściem do zaburzeń psychicznych. Powołując się na badania neurobiologiczne staram się wskazać potencjalne neuronalne korelaty uczuć egzystencjalnych. Tekst wieńczą krytyczne uwagi na temat koncepcji uczuć egzystencjalnych w ujęciu Matthew Ratcliffe’a. Rozwiązanie zidentyfikowanych wad i niedociągnięć tej teorii filozoficznej zarazem nakreśla przyszłe perspektywy jej rozwoju. (shrink)

Although implicit commitment is often associated with highly technical studies, it remains an elusive notion. In particular, it is often claimed that the acceptance of a mathematical theory implicitly commits one to the acceptance of a Uniform Reflection Principle for it. However, philosophers agree that a satisfactory analysis of the transition from a theory to its reflection principle is still lacking. We (...) provide an axiomatization of the minimal commitments implicit in the acceptance of a mathematical theory. The theory entails that the Uniform Reflection Principle is part of one’s implicit commitments, and sheds light on why this is so. We argue that the theory has significant epistemological consequences in that it explains how justified belief in the axioms of a theory can be preserved to the corresponding reflection principle. The theory also improves on recent analyses of implicit commitment based on truth or epistemic notions. (shrink)

Aphasia is an acquired impairment of language functions resulting from a brain lesion. It is usually accompanied by deficits in non-linguistic cognitive processes. This study aimed to investigate in patients with aphasia the complex interrelationships between selected cognitive functions: auditory speech comprehension, working memory, and temporal information processing in the millisecond time range. Thirty right-handed subjects aged from 27 to 82 years suffering from post-stroke aphasia participated in the study. Verbal working memory and spatial working memory were assessed with: a (...) receptive verbal test and the Corsi Block-Tapping Test, respectively. Both these WM tests used the forward tasks and backward tasks. Auditory comprehension was assessed by receptive language tests, and TIP efficiency was assessed by auditory perception of temporal order in the millisecond time range. We observed better performance of forward WM tasks than backward ones, independently of the type of material used. Furthermore, the severity of auditory comprehension impairment correlated with the efficiency on both forward and backward VWM tasks and the backward SWM task. Further analysis revealed that TIP plays a crucial role only in the latter task. These results indicate the divergent pattern of interactions between WM and TIP depending on the type of WM tasks. Level of verbal competency appeared to play an important role in both VWM tasks, whereas TIP appeared to be important for SWM, but only on the backward task. (shrink)

Dotyka w swojej analizie m.in. pytań z zakresu etyki środowiska dotyczących ludzkiej ingerencji w strukturę świata i stara się wspierać refleksję i wynikającą z niej postawę pełną wrażliwości na związek człowieka ze środowiskiem. Ekofilozofia, jako dyscyplina podejmująca wieloaspektową problematykę ochrony środowiska z perspektywy filozoficznej refleksji, w centrum zainteresowania stawia również badanie samej relacji łączącej człowieka ze środowiskiem przyrodniczym. Celem artykułu jest wskazanie, iż refleksja oikologiczna może okazać się pomocną perspektywą dla szeroko pojętej ekofilozofii, a więc właśnie dla rozważań skupiających się na odpowiednim ułożeniu wspomnianej interakcji. Przykładem praktycznego problemu, w którym tego typu spojrzenie zostanie zaprezentowane, jest kwestia przestrzeni miejskiej, a konkretniej jej rewitalizacji, ze szczególnym naciskiem na obszary poprzemysłowe, którą w omawianym kontekście ekofilozofii wiąże się przede wszystkim z ideą zrównoważonego rozwoju. The subject embodied in the designed environment. Analysis of the use of the affordance concept in architecture: James Gibson’s ecological psychology is considered as one of the research subtraditions within embodied cognition. Gibson emphasizes the nature of the agent-environment interaction through the development of the theory of affordances. According to this idea, affordances are relational properties of the environment that enable a specific action for the agent. Currently this concept is being applied in many different contexts. This paper considers the (...) application potential of affordance in architectural studies as a tool that analyses the agent’s interaction with the environment. In this context, the affordance category can be a tool that allows one to take into account the importance of space for the shaping of behavior and interactions between its users, without falling into architectural determinism. The main aim of this study is to analyze affordances as a category that, despite its diversity and vagueness, can play an important role in the embodied view of architecture. The first part of the article is an attempt to synthetically place affordances in the context of embodied cognition and to point out the basic philosophical interpretations and discussions related to Gibson’s concept. In the next part, we situate the concept of affordances in the context of design practice. We also present the pros and cons of applying affordances to this ground. The last section in presenting the concept of affordances is considered within the background of the embodied current in architecture. (shrink)

The modeling of the human mind based on quantum effects has been gaining considerable interest due to the intriguing possibility of applying non-local interactions in the studies of consciousness. Inasmuch as the majority of the pertinent studies are restricted to the exclusive analysis of mental phenomena, the quantum model of mind proposed by Roger Penrose constitutes a part of a much larger scheme of the ultimate unification of physics. Penrose's efforts to find the 'missing science of consciousness' presuppose the non-algorithmic (...) character of human thinking inferred from Gödel's incompleteness theorem. This is supposed to combine with the anticipated non-algorithmic character of the future quantum gravity theory involving the objective reduction of a quantum mechanical state vector. By surveying contemporary achievements of cognitive sciences as well as the development of Penrose's conjectures, presented in his recent work The Road to Reality, we wish to show that his non-algorithmic quantum model of human mind is contingent upon the fundamental philosophical assumption of the mathematicity of the Universe.
