This article attempts, for the first time, to link some central motives in the thought of Jürgen Habermas with the biographical experiences of the philosopher and social theorist. What are the relations which Habermas himself thematizes in his life story by means of discursive analysis? Three elements are central: the change in significance of the nation state against the backdrop of the process of European integration, the concept of a deliberative democracy, and the timely and controversial issue of the taming (...) of world capitalism. Finally, the article discusses the question of how plausible it is that there is no alternative to capitalism and to what extent democracy can tame capitalism. (shrink)

The intellectual practice of public critique of Theodor W. Adorno and Jürgen Habermas is compared as a contribution to the sociology of the intellectual. The aim of this comparative analysis is to clarify the transformation of the function of the intellectual in the context of his social position. Here it is possible to distinguish between a ‘rescuing’ critique and a ‘consciousness-raising’ critique.

Our reply to Fabian Freyenhagen’s article “Was ist orthodoxe Kritische Theorie?” (DZPhil 65.3 [2017], 456-469) raises the question whether his proposal that Critical Theory only “be adequately and appropriately critical” without a program of justification spares the search for any general criteria. Answering negatively we conversely want to recall, particularly with regard to Horkheimers’s and Adornos’s Dialectic of Enlightment as well as Habermas‘s concept of an emancipatory interest, that such a criterion as a normative foundation of critique is crucial not (...) only for systematical purposes, but also recognised as necessary in this respect by Adorno, who Freyenhagen wants to play off against programs of justification. Critical Theory needs to be clear in this respect. Against this background we are questioning Freyenhagen‘s recourse to an “interest in abolishing social injustice” as the “only criterion for Critical Theory.” Because Freyenhagen ignores the fact that Critical Theory has been understood by its representatives in a twofold manner – as a theoretical program of justification for one and secondly as a cultural diagnosis – his plea for an orthodox Critical Theory is endangered by decisionism. The label ‘Frankfurt School’ became popular in the ‘positivism dispute’ in the mid-1960s, but this article shows that it is wrong to describe Jürgen Habermas as representing a ‘second generation’ of exponents of critical theory. His communication theory of society is intended not as a transformation of, but as an alternative to, the older tradition of thought represented by Adorno and Horkheimer. The novel and innovative character of Habermas’s approach is demonstrated in relation to three thematic complexes: (1) the public (...) sphere and language; (2) democracy and the constitutional state; and (3) system and lifeworld as categories for a theory of modernity. This is based on the assumption that such standards increase legitimacy among stakeholders. Yet, a wide variety of standards with different requirement levels exist and companies might tend to introduce the ones with low exigencies, using them as a legitimacy front. This strategy jeopardizes the reputation of social and environmental standards among stakeholders and their long-term trust in these instruments of CSR, meaning that all (...) expenses for their implementation are of no avail for the companies. Therefore, this paper highlights which criteria are important for the selection, implementation and improvement in order to achieve a company's aim, but also to strengthen the legitimacy of social and environmental standards. This research is based on conceptual thought and some existing empirical research, comparing four different social and environmental standards, revealing weaknesses and strengths. Objective: Atypical patterns of language lateralization due to early reorganizational processes constitute a challenge in the pre-surgical evaluation of patients with pharmaco-resistant epilepsy. There is no consensus on an optimal analysis method used for the identification of language dominance in MEG. This study examines the concordance between MEG source localization of beta power desynchronization and fMRI with regard to lateralization and localization of expressive and receptive language areas using a visual verb generation task.Methods: Twenty-five patients with pharmaco-resistant epilepsy, including six (...) patients with atypical language lateralization, and ten right-handed controls obtained MEG and fMRI language assessment. Fourteen patients additionally underwent the Wada test. We analyzed MEG beta power desynchronization in sensor (controls) and source space (patients and controls). Beta power decrease between 13 and 35 Hz was localized applying Dynamic Imaging of Coherent Sources Beamformer technique. Statistical inferences were grounded on cluster-based permutation testing for single subjects.Results: Event-related desynchronization of beta power in MEG was seen within the language-dominant frontal and temporal lobe and within the premotor cortex. Our analysis pipeline consistently yielded left language dominance with high laterality indices in controls. Does theorising always presuppose a programme of justification? Does the Critical Theory of Adorno and Horkheimer do so? Do they claim it does? The answer should be a resounding ‘no’ to all three questions. In regard to the second and third question, I have sketched an argument to that effect in an earlier paper in this journal. In this paper, I offer a rejoinder to the critical reply offered by Stefan Müller-Doohm und Roman Yos on behalf of (...) the Habermasian mainstream in Frankfurt School Critical Theory. This rejoinder depends on giving a negative answer also to the first question. In rejecting the Habermasian idea of a programme of justification, I stand accused of dogmatism and, consequently, decisionism. I show that this accusation itself betrays a certain dogmatism – insofar as it accepts that such a programme of justification is undeniably possible and required, without consideration of evidence or arguments to the contrary. Self-reflective and critical theorising about society can, indeed must, take other forms. (shrink)

What was once feared as ‘nihilism,’ the loss of all final certainties and absolutes, or ‘relativism,’ that everything relates to a standpoint, has become a lived reality for many people today. Especially younger generations have learned to affirm the living conditions of uncertainty and temporality by eclectically adopting ways of life, routines, and orientations in individual ways for only certain periods of time. Digital technologies, especially the smart phone, have (...) widened our horizons permitting immediate access to different cultures and orientation worlds. Never before have we lived in a world that is as multi-perspectival, fast-paced, and uncertain, while never before have there been so many opportunities for actions. At the same time, people increasingly orient themselves in similar ways to a dominant morality that abbreviates reality and narrows down opportunities of action according to the guiding values of equality and reciprocity, as Nietzsche predicted it. Under these conditions, Nietzsche’s art of living is particularly relevant in many orientation worlds today, especially those of entrepreneurship, business, and our everyday life. -/- This contribution focuses on three aspects of Nietzsche’s art of living that have become relevant today especially in the United States (but not only here): first, regarding some facets of the economic-political conditions of any contemporary art of living; second, the widespread adoption of Nietzsche’s notion of self-overcoming and artistic self-design in entrepreneurship and individual’s lives; and third, how his notion of ‘incorporation’ has been further developed in current approaches to habit design. Eventually I will show via the example of Anthony Robbins that some notions of Nietzsche’s art of living have become most popular outside of academia, namely in the commercial industries of what has been called ‘self-growth’ or ‘self-development.’. Marx’s theory of ground rent has been widely used to help understand the trinity of land, labor, and capital. However, limited attention has been paid to the role of water within the Marxian rent framework. This lack of attention proves troubling due to the role of surface waters as an essential means of production throughout capitalism. Here I restate Marxian ground rent in the form of water rent and discuss the function of water-rent in the two dominant surface water rights (...) doctrines of the United States—the riparian doctrine and the doctrine of prior appropriation. In doing so, I revise the distinction between differential rent 1 and differential rent 2 to provide more analytically useful categories. Paying special attention to issues of drought and scarcity, I fully articulate the function of Marxian rent and its four forms for both surface water rights doctrines, while clearly stating where they do and do not differ. The basic hypothesis of this book is that linguistic reference to kinds should be seen as reference to sortal concepts, i.e. cognitive categories for identifying and classifying objects. Viewed that way, kinds serve as the interface between the conceptual system and the grammatical system. Kind-level predicates differ as to whether they presuppose (e.g. to be extinct) or entail (e.g. to invent) the existence of objects, with crucial consequences for the interpretation of indefinite argument noun phrases. Moreover, object reference always involves (...) underlying kind reference, but kind reference does not always involve object reference. This asymmetry, once recognized, proves useful in solving otherwise puzzling problems in semantic composition. (shrink)

The case describes the developments of an ethics code observed in the local government of Suffolk County, New York, USA. In Suffolk County, there is now a dedicated Board of Ethics Agency (“Board”) within the local government to ensure that business operations and government operations run as ethically compliant as possible. This Board was created in 2012 in order to follow compliance with a law that established a replacement for the Ethics Commission (previously existing within Suffolk County) because this Ethics (...) Commission had been involved in a serious controversy. The former County Executive, Steve Levy, was found guilty of compromising the “integrity of an ethics commission”. Suffolk County government prescribed various measures in order to ensure that the citizens of Suffolk County were protected from business ethical violations. While readers of Euripides' Hippolytus have long regarded Phaedra's deltos as a mechanism of punitive revenge, I argue here that the tablet models itself on a judicial curse (defixio) and that its main function is to ensure victory for Phaedra in the upcoming “trial” over her reputation. In support of my thesis I examine three interrelated phenomena: first, Hippolytus' infamous assertion that his tongue swore an oath while his mind remains unsworn (612); second, Phaedra's status as a biaiothanatos; and third, (...)
