This paper discusses whether rationality, morality or prudence impose process-requirements upon us. It has been argued that process-requirements fulfil two essential functions within a system of rational, moral or prudential requirements. These functions are considered to prove the existence of process-requirements. First, process-requirements are deemed necessary to ensure that rationality, morality or prudence can guide our deliberations and actions. Second, their existence is regarded as essential for the correctness of our ordinary explanations of why a person possesses a certain degree (...) of morality, rationality or prudence. However, I argue that these two functions are unable to show the existence of process-requirements. Instead, I propose a different essential function for process-requirements: they are necessary for attributing the correct degree of rationality, morality or prudence to a subject who is not entirely rational, moral or prudent. This function, I argue, necessitates the existence of process-requirements. (shrink)

Two or more attitudinal states are incoherent if and only if, necessarily, under conditions of full transparency, you are disposed to give up one of them. This is roughly the account of incoherence that has recently been put forward by Alex Worsnip (2018). In this paper, I argue that Worsnip’s account of incoherence is incorrect. Not only does it fail to be fully general (i.e., it does not allow us to assess the coherence of all combinations of attitudes), but it (...) also implies that an agent is necessarily incoherent just in virtue of being in one attitudinal state. The phenomenon of ‘structural irrationality’ covers a diverse range of combinations of attitudes, including (inter alia) contradictory beliefs, contradictory intentions, means–end incoherence, akratic incoherence, and cyclical preferences. This paper offers a novel, unified account of when a pattern of attitudes qualifies as structurally irrational. It begins by setting up the core of the view I will be defending: a set of attitudes is irrational if and only if it is impossible for those attitudes to be jointly successful. I show that (...) this view can account for a wide range of paradigmatically irrational combinations of attitudes. I then refine the account to make it sufficiently subjective. I argue that a set of attitudes is irrational only if the impossibility of their joint success is (i) logically transparent, (ii) subjectively inferable, and (iii) not justifiably denied. (shrink)

The requirements of rationality are fundamental in practical and theoretical philosophy. Nonetheless, there exists no correct account of what constitutes rational requirements. This paper attempts to provide a correct constitutive account of ‘rationality requires’. I argue that rational requirements are grounded in ‘necessary explanations of subjective incoherence’, as I shall put it. Rationality requires of you to X if and only if your rational capacities, in conjunction with the fact that you not-X, explain necessarily why you have a non-maximal degree (...) of subjective coherence. Can we employ the property of rationality in establishing what rationality requires? According to a central and formal thesis of John Broome’s work on rational requirements, the answer is ‘no’ – at least if we expect a precise answer. In particular, Broome argues that (i) the property of full rationality (i.e. whether or not you are fully rational) is independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. That is, (ii) by (...) replacing a wide-scope requirement with a corresponding narrow-scope requirement (or vice versa), we do not alter the situations in which a person is fully rational. As a consequence, (iii) the property of full rationality is unable to guide us in determining whether a rational requirement has a wide or a narrow logical scope. We cannot resolve the wide/narrow scope debate by appealing to a theory of fully rational attitudes. This paper argues that (i), (ii) and (iii) are incorrect. Replacing a wide- with a corresponding narrow-scope requirement (or vice versa) can alter the set of circumstances in which a person is fully rational. The property of full rationality is therefore not independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. As a consequence, the property of full rationality can guide us in determining what rationality requires – even in cases where we expect a precise answer. (shrink)

Within the debate concerning reason and rationality, instrumental incoherence was for a long time conceived of as the paradigm of irrationality. However, with the emergence of the so-called ‘bootstrapping objection’ and the debate concerning the ‘scope’ of rational requirements, the innocuous status of the normative significance of (instrumental) coherence became subject to. This led to a paradigmatic shift in how to understand the relationship between rational requirements and normativity. While there now exists considerable doubt that rational requirements are normative, it (...) is commonly agreed that one’s normative point of view is a key feature of one’s rationality. Here the question is not only if one can hold a particular normative judgement and still be rational; what is significant too is whether your normative outlook coheres appropriately with your motivation. In fact, it is now commonly agreed that rationality requires us to intend to make the world fit with our first-personal ought beliefs. Enkrasia (i.e. coherence between your normative views and your motivation) is thus seen as a rational ideal and as a source of rational requirements. Nevertheless, many elementary questions regarding the application, content, and significance of an enkrasia-requirement remain unanswered, or subject to debate. This special issue on ‘The Nature of the Enkratic Requirement of Rationality’ aims to answer some of these fundamental questions. (shrink)

Hussain claims that ethical consumers are subject to democratic requirements of morality, whereas ordinary price/quality consumers are exempt from these requirements. In this paper, we demonstrate that Hussain’s position is incoherent, does not follow from the arguments he offers for it, and entails a number of counterintuitive consequences.

Does a coherentist version of rationality issue requirements on states? Or does it issue requirements on processes? This paper evalu- ates the possibility of process-requirements. It argues that there are two possible definitions of state- and process-requirements: a satisfaction- based definition and a content-based definition. I demonstrate that the satisfaction-based definition is inappropriate. It does not allow us to uphold a clear-cut distinction between state- and process-requirements. We should therefore use a content-based definition of state- and pro- cess-requirements. However, a (...) content-based definition entails that ra- tionality does not issue process-requirements. Content-based process- requirements violate the principle that ‘rationality requires’ implies ‘can satisfy’. The conclusion of this paper therefore amounts to a radical re- jection of process-requirements of rationality. (shrink)

Suppose rationality requires you to A if you believe you ought to A. Suppose you believe that you ought to A. How can you satisfy this requirement? One way seems obvious. You can satisfy this requirement by A-ing. But can you also satisfy it by stopping to believe that you ought to A? Recently, it has been argued that this second option is not a genuine way of satisfying the above requirement. Conditional requirements of rationality do not have two ‘symmetric’, (...) but only one ‘asymmetric’ satisfaction condition. This paper explores the consequences of this argument for a theory of the requirements of rationality. I seek to show that thisview conflicts with another powerful intuition about the requirements of rationality, i.e. ‘rational consistency’: if rationality requires you to X, then it is not the case that rationality requires you to not-X. I shall conclude that ‘asymmetric’ satisfying is based on a misleading intuition, for which we should not sacrifice ‘rational consistency’. (shrink)

This paper argues that practical reasoning is a mental process which leads a person from a set of existent mental states to an intention. In Section 1, I defend this view against two other proposals according to which practical reasoning either concludes in an action itself or in a normative belief. Section 2 discusses the correctness of practical reasoning and explains how the correctness of instrumental reasoning can be explained by the logical relations that hold between the contents of the (...) mental states. In Section 3, I explore the correctness of normative practical reasoning. I conclude with the sceptical view that correct practical reasoning cannot require us to intend to do what we believe we ought to do. (shrink)

Weakness of the will remains a perplexing issue. Though philosophers have made substantial progress in homing in on what counts as a weak will, there is little agreement on whether weakness of the will is irrational, and if so, why. In this paper, we take an empirical approach towards the rationality of weakness of the will. After introducing the philosophical debate, we present the results of an empirical study that reveals that people take a “dual sensitivity”, as we shall put (...) it, towards assessing the rationality of weak-willed behavior. Put succinctly, intending X against your value judgements is assessed irrational; yet, in the same situation, intending X is assessed significantly less irrational if you judge X as something you ought to do. After discussing this result, we turn to the question of whether there is a plausible theory of rationality than can account for the dual sensitivity of the rationality assessments. We show that a success-based account can make sense of the dual sensitivity our empirical results reveal. (shrink)

This paper presents a new argument against the view that structural (or attitude-based) irrationality consists in failing to respond correctly to normative reasons. According to this view, a pattern of attitudes is structurally irrational if and only if that pattern guarantees that one has at least one attitude one ought not to have. I argue that this ought-violation view comes with three indispensable theoretical commitments. These commitments concern various relationships between normative permissions and oughts that govern beliefs and intentions, and (...) they may appear plausible when viewed in isolation. However, once they are collectively conjoined, they imply oughts that are incompatible with the ought-violation view of structural irrationality. In particular, on the ought-violation view, these oughts entail that you are necessarily structurally irrational whenever [you intend to p] and [you believe that it is not the case that you ought to p]. However, since you can rationally intend things that you believe to be normatively optional (e.g. merely permitted or supererogatory), the ought-violation view faces the following dilemma: it must either deny one of its essential commitments or accept as irrational a set of attitudes that are clearly not. Either way suffices to show that the ought-violation view cannot serve as a correct analysis of structural irrationality. (shrink)

One popular line of argument put forward in support of the principle that the right is prior to the good is to show that teleological theories, which put the good prior to the right, lead to implausible normative results. There are situa- tions, it is argued, in which putting the good prior to the right entails that we ought to do things that cannot be right for us to do. Consequently, goodness cannot (always) explain an action's rightness. This indicates that (...) what is right must be determined independently of the good. In this paper, I argue that these purported counterexamples to teleology fail to establish that the right must be prior to the good. In fact, putting the right prior to the good can lead to sets of ought statements which potentially con- flict with the principle that ‘ought’ implies ‘can’. I argue that no plausible ethical theory can determine what is right independently of a notion of value or goodness. Every plausible ethical theory needs a mapping from goodness to rightness, which implies that right cannot be prior to the good. (shrink)

Bezugnehmend auf die strategischen Optionen der beteiligten Akteure wird erklärt warum der seit 1992 bestehende Konflikt zu keiner Lösung findet.

Auf welchen normativen Grundlagen beruhte das NS-System? Mit welcher Rechtfertigung konnte der Führerwille dort zu einer Quelle des Rechts werden? Wie war es gemäß der NS-Strafgesetzgebung möglich, Handlungen zu bestrafen, die gegen kein geschriebenes Gesetz verstießen? Die in diesem Band versammelten und kommentierten Originaltexte geben Einblick in das Denken von Rechtstheoretikern, die mit dem Nationalsozialismus sympathisierten, und belegen deren Versuch, autoritäre und dem Rechtsstaat widersprechende Rechtsprinzipien zu legitimieren. Dabei zeigt sich ein überraschender und bis jetzt von der rechts- und moralphilosophischen (...) This paper argues that this objection is based on an incorrect reading of Davidson's argument. I will show that by reading 'movements', in 'all actions are bodily movements', transitively, Davidson's definition of primitive actions ceases to contradict with his thesis that all actions are bodily movements.

Suppose we morally ought to maximize social welfare. Suppose profit maxi­mization is a means to maximize social welfare. Does this imply that we morally ought to maximize profits? Many proponents of the view that we have a moral obligation to maximize profits (tacitly) assume the validity of this argument. In this paper, we critically assess this assumption. We show that the validity of this argument is far from trivial and requires a careful argumentative defence.

Wie war es möglich? Diese mit Blick auf den Nationalsozialismus und die Zeit von 1933 bis 1945 unausweichliche Frage stellt sich für jede Generation aufs Neue – und auf unterschiedlichen Ebenen. Im Gegensatz zur detaillierten historischen Aufarbeitung der NS-Zeit ist die philosophisch-theoretische Analyse der normativen Grundlagen des NS Systems ein bislang vernachlässigtes Gebietder Forschung. Die hier edierte Sammlung von Originaltextenführender Juristen, Rechtstheoretiker und Rechtsphilosophen, die dem nationalsozialistischen Regime loyal gegenüberstanden und an der rechtlichen Um- und Neugestaltung mitarbeiteten, will diese Lücke (...) schließen helfen und einen Beitrag zur Analyse des nationalsozialistischen Herrschaftssystems aus dem Blickwinkel der Rechtstheorie und Rechtsphilosophie leisten. This paper argues for a qualified version of this claim. It is qualified in two ways. First, I assume that this can be so only if ‘if you believe you ought to A’ appears within the scope of ‘you ought’. That is, you ought (...) to [if you believe you ought to A, then A.] Second, I argue that you ought to do as you believe you ought to only as far as it goes; that is, unless there are exceptional reasons not to do so. A significant part of the debate concerning the nature of rational requirements centers on disambiguating ordinary articulations of conditional requirements of rationality. Particular focus has been put on the question of whether conditional requirements of rationality take a wide or a narrow logical scope. However, this paper shows that this focus is misguided and harmful to the debate. I argue that concentrating on syntactic scope renders us more likely to arrive at incorrect formulations of rational requirements and to overlook questions (...) of greater philosophical importance. It is beyond doubt that the legal system established by the Nazi government in Germany between 1933-1945 represented a gross departure from the rule of law: the Nazis eradicated legal security and certainty; allowed for judicial and state arbitrariness; blocked epistemic access to what the law requires; issued unpredictable legal requirements; and so on. This introduction outlines the distorted nature of the Nazi legal system and looks at the main factors that contributed to this grave divergence.

In 1935, the Nazi government introduced what came to be known as the abrogation of the pro- hibition of analogy. This measure, a feature of the new penal law, required judges to stray from the letter of the written law and to consider instead whether an action was worthy of pun- ishment according to the ‘sound perception of the people’ and the ‘underlying principle’ of existing criminal statutes. In discussions of Nazi law, an almost unanimous conclusion is that a system (...) of criminal law ought not to contain legislation of this sort. This conclusion is often based on how the abro- gation relates to the normative claim that the law ought to be predictable. In particular, it has been argued that since the law ought to be predictable, and since this type of analogy legis- lation implied, caused or contributed to the diminution of the law’s predictability, this type of legislation ought to be prohibited. In this paper, we argue that this argument is not entirely correct. While we believe that the law ought to be predictable and that there is evidence for the claim that the Nazis’ intro- duction of analogical reasoning implied, caused, or contributed to a diminution of predictability, this fact is logically too weak to ground the conclusion that necessarily a penal system ought not to contain legislation of this kind. Despite the undeniable wickedness of the Nazi penal system, this type of analogical reasoning can be made consistent with the pre- dictability of the law. We argue that consistency of this sort depends on whether the use of analogy is supplemented by certain contextual background conditions. The occurrence of these conditions blocks an inference from the fact that the law ought to be predictable to the conclusion that a penal system ought not to allow for this type of analogical reasoning. Commonly, a switch between networks mediating memory encoding and those mediating retrieval is observed. This may not only be due to differential involvement of neural resources due to distinct cognitive processes but could also reflect the formation of new memory traces and their dynamic change during consolidation. We used resting state fMRI to measure functional connectivity (FC) changes during post-encoding rest, hypothesizing that during this phase, new functional connections between encoding- and retrieval-related regions are created. Interfering and reminding tasks served (...) as experimental modulators to corroborate that the observed FC differences indeed reflect changes specific to post-encoding rest. The right inferior occipital and fusiform gyri (active during encoding) showed increased FC with the left inferior frontal gyrus and the left middle temporal gyrus (MTG) during post-encoding rest. Importantly, the left MTG subsequently also mediated successful retrieval. This finding might reflect the formation of functional connections between encoding- and retrieval-related regions during undisturbed post-encoding rest. These connections were vulnerable to experimental modulation: Cognitive interference disrupted FC changes during post-encoding rest resulting in poorer memory performance. The presentation of reminders also inhibited FC increases but without affecting memory performance. Our results contribute to a better understanding of the mechanisms by which post-encoding rest bridges the gap between encoding- and retrieval-related networks. (shrink)

This paper analyses and (tentatively) rejects Julian Fink's argument for the existence of normative process-requirements. According to Fink, only process-requirements allow us to give appropriate normative credit to a subject S who violates certain state-requirements but is undergoing a process that will eventually lead to their satisfaction. I will show that Fink's argument applies, at best, only to a restricted set of cases—namely, when S's undergoing a process has not resulted in the formation of new mental (...) states. In these remaining cases, however, it is implausible to give S normative credit for undergoing the relevant process. Thus, we can assign the correct degree of the corresponding normative property solely in terms of state-requirements. To the extent that this holds, Fink's argument does not entail that there are normative process-requirements. (shrink)

The period from Plato's birth to Aristotle's death (427-322 BC) is one of the most influential and formative in the history of Western philosophy. The developments of logic, metaphysics, epistemology, ethics and science in this period have been investigated, controversies have arisen and many new theories have been produced. But this is the first book to give detailed scholarly attention to the development of dialectic during this decisive period. It includes chapters on topics such as: dialectic as interpersonal debate between (...) a questioner and a respondent; dialectic and the dialogue form; dialectical methodology; the dialectical context of certain forms of arguments; the role of the respondent in guaranteeing good argument; dialectic and presentation of knowledge; the interrelations between written dialogues and spoken dialectic; and definition, induction and refutation from Plato to Aristotle. Sie behandeln eine Vielfalt an Themen, die von der Menschwerdung, über die Kulturen des Altertums bis hin zu aktuellen politischen und sozialen Fragestellungen reichen. Schließlich sind auch Studien zur Spenglerforschung im engeren Sinne vertreten.

Eugen Fink is considered one of the clearest interpreters of phenomenology and was the preferred conversational partner of Edmund Husserl and Martin Heidegger. In Play as Symbol of the World, Fink offers an original phenomenology of play as he attempts to understand the world through the experience of play. He affirms the philosophical significance of play, why it is more than idle amusement, and reflects on the movement from "child's play" to "cosmic play." Well-known for its non-technical, literary (...) style, this skillful translation by Ian Alexander Moore and Christopher Turner invites engagement with Fink's philosophy of play and related writings on sports, festivals, and ancient cult practices. For the last 40 years or so the is/ought gap, the fact/value distinction and the naturalistic fallacy have figured prominently in ethical debates. This longevity, however, has had an adverse side effect. So familiar have they become that they—and their respective rationales—have tended to become blurred. It is the purpose of this paper to explain why they should be kept distinct.

Van Inwagen proposes that besides simples only living organisms exist as composite objects. This paper suggests expanding van Inwagen’s ontology by also accepting composite objects in the case that physical bonding occurs (plus some extra conditions). Such objects are not living organ-isms but rather physical bodies. They include (approximately) the complete realm of inanimate ordinary objects, like rocks and tables, as well as inanimate scientific objects, like atoms and mol-ecules, the latter filling the ontological gap between simples and organisms in (...) van Inwagen’s origi-nal picture. We thus propose a compositional pluralism claiming that composition arises if and on-ly if bonding or life occurs. (shrink)

Die vorliegende Abhandlung ist die erste systematische Darstellung einer wissenschaftstheoretischen Konzeption, die ich in den Jahren 1976-1978 an der Fakultat fur Linguistik und Literaturwissenschaft der Universitat Biele­ feld entwickelt habe. Zweck dieser Arbeit war es, die Konstruktionsphase einer empirischen Theorie der Literatur, und damit einer empirischen Wis­ senschaft liber Literatur, von einer Reihe von Inadaquatheiten, Vorurteilen und Irrationalismen zu befreien, die nach meiner Ansicht den bekannten Grundlagenstreit der Literaturwissenschaftler belasten, aber auch in man­ chen Arbeiten zur konzeptionellen Innovation der Literaturwissenschaft (...) zu finden sind. Ich wlirde es als Erfolg ansehen, wenn es mir gelungen ware zu zeigen, daB die Entwicklung des empirischen Paradigmas der Literatur­ wissenschaft tatsachlich mit jenem "Gestalt-Switch" einhergeht, den Thomas Kuhn fur die Struktur einer die normalen Pfade wissenschaftlicher Ent­ wicklung verlassenden Forschung beschrieben hat. Das Maa an wissenschaft­ licher Toleranz, das dabei der Mehrheit der Literaturwissenschaftler abver­ langt wird, ist ohne Zweifel ganz erheblich. Der zentrale Gedanke dieser Abhandlung ist der, daB die wissenschaftstheo­ retische Rationalitat nirgends so gebraucht wird wie in den fruhen, vorpara­ digmatischen Phasen der Entwicklung einer neuen Konzeption, und daa die libliche Wissenschaftstheorie nirgends so versagt wie gerade dort. Ich ver­ suche daher, die Grundlagen einer Konzeption zu umreiBen, die ich einen "Konstruktiven Funktionalismus" nenne, und ihre Brauchbarkeit als eine intradisziplinare Wissenschaftstheorie der empirischen Literaturwissen­ schaft zu demonstrieren.
