The concept of brain death — first defined decades ago — still presents medical, ethical, and legal challenges despite its widespread acceptance in clinical practice and in law. This article reviews the medicine, law, and ethics of brain death, including the current inconsistencies in brain death determinations, which a lack of standardized federal policy promotes, and argues that a standard brain death policy to be used by all hospitals in all states should be created.

The concept of brain death evolved because advancements in medical science permitted unprecedented artificial maintenance of vital body functions by external means. Although the concept of brain death is accepted clinically, ethically, and legally in the United States, there is no national standard for the determination of brain death. There is evidence that variability and inconsistency in the process of determining brain death exist both in clinical settings and in State statutes. Several studies demonstrate that medical personnel determine brain death (...) in variable ways, and have variable understandings of the definition of brain death. The declaration of death has significant legal consequences such as probate proceedings and liability issues for wrongful death. Inconsistencies in the determination of death may therefore be medically, ethically, and legally problematic. (shrink)

Philosopher, theologian, educational theorist, feminist and political pamphleteer, Mary Astell was an important figure in the history of ideas of the early modern period. Among the first systematic critics of John Locke's entire corpus, she is best known for the famous question which prefaces her Reflections on Marriage: 'If all men are born free, how is it that all women are born slaves?' She is claimed by modern Republican theorists and feminists alike but, as a Royalist High Church Tory, the (...) peculiar constellation of her views sits uneasily with modern commentators. Patricia Springborg's study addresses these apparent paradoxes, recovering the historical and philosophical contexts to her thought. She shows that Astell was not alone in her views; rather, she was part of a cohort of early modern women philosophers who were important for the reception of Descartes and who grappled with the existential problems of a new age. In the early years of the twentieth century, Gottlob Frege and David Hilbert, two titans of mathematical logic, engaged in a controversy regarding the correct understanding of the role of axioms in mathematical theories, and the correct way to demonstrate consistency and independence results for such axioms. The controversy touches on a number of difficult questions in logic and the philosophy of logic, and marks an important turning-point in the development of modern logic. This essay contrasts Damaris Masham and Catharine Trotter Cockburn’s respective moral philosophies. It argues that their views are both remarkably innovative, yet strikingly similar. By focusing on Masham and Cockburn’s accounts of agency and virtue, it is demonstrated that both thinkers take human nature as a sort of guide to moral behavior – i.e., it shows that the moral agent operates under the perception of moral principles as arising from human nature. While both thinkers are known to have been directly (...) influenced by John Locke, it is also argued that both of their moral philosophies bear significant dissimilarities to Lockean morality. The history of the recovery movement began with a pushback against treatment, and the philosophies that it was founded upon still have relevant applications to contemporary social work practice. Financial aspects of service provision for people with serious mental illnesses have enabled other actors in the medical model of psychosis treatment to benefit, while disempowering and dehumanizing the consumers of those services. Since then, other movements like Psychopolitics and the Mad Movement have helped empower psychosis survivors to advocate for their (...) right to self-determination amid the epistemological pressure to identify as disabled. Social workers would like to believe that the field has moved beyond the philosophies that perpetuated institutionalization of people with serious mental illnesses. Some of the ways in which the individuality of each clone comes out are found in the alterations they make to their alphanumeric designations, uniforms, and living environments. In his important article “Freedom of the Will and the Concept of a Person,” Harry G. Frankfurt explains that what makes humans unique according to his concept of personhood is their “capacity for reflective self‐evaluation.” The (...) activation of the Fett clones' inhibitor chips with Order 66 represents the intention of the Empire to deprive all the chipped clones of their freedom of action and will. As Frankfurt states, “Suppose, however, that he enjoys both freedom of action and freedom of the will. Zachariah's description of a wonderful fornicating life for Sam and Dean captures some truth but it also misses the importance women play in shaping the Winchesters' moral decisions. In general, important women in the lives of Sam and Dean fall into three broad categories: mothers, lovers, and monsters. Sam and Dean are all too familiar with this philosophy of utilitarianism. Many times they have sacrificed relationships with women for the sake of their mission. Throughout Supernatural the objectification of the Winchesters (...) is contrasted with a happy domestic life. Sam and Dean are mistaken in thinking that their only value resides in the roles they play in the larger battles of good and evil; if they looked deeper they would see that they both would prefer a loving relationship with a woman. My comments focus on Proops’s treatment of the Paralogisms. I agree with many aspects of his discussion, including his views about the project of Rational Psychology and his analyses of how, exactly, the arguments of the Paralogisms are defective in form, but I disagree with his interpretation of the First Paralogism. I argue that the source of confusion that Kant diagnoses is not the grammatical distribution of ‘I’ as singular, but the fact that the I-representation is both empty and necessary (...) for cognition. In this innovative study Patricia Kitcher argues that we can only understand the deduction of the categories in Kant's Critique of Pure Reason in terms of his attempt to fathom the psychological prerequisites of thought. Thus a consideration of his conception of psychology is essential to an understanding of his philosophy. Kitcher specifically considers Kant's claims about the unity of the thinking self; the spatial forms of human perceptions; the relations among mental states necessary for them to have content; (...) the relations between perceptions and judgment; and the limits of philosophical insight into psychological processes. We propose that people typically reason about realistic situations using neither content-free syntactic inference rules nor representations of specific experiences. Rather, people reason using knowledge structures that we term pragmatic reasoning schemas, which are generalized sets of rules defined in relation to classes of goals. Three experiments examined the impact of a “permission schema” on deductive reasoning. Experiment 1 demonstrated that by evoking the permission schema it is possible to facilitate performance in Wason's selection paradigm for subjects who have had (...) no experience with the specific content of the problems. Experiment 2 showed that a selection problem worded in terms of an abstract permission elicited better performance than one worded in terms of a concrete but arbitrary situation, providing evidence for an abstract permission schema that is free of domain-specific content. Experiment 3 provided evidence that evocation of a permission schema affects not only tasks requiring procedural knowledge, but also a linguistic rephrasing task requiring declarative knowledge. In particular, statements in the form if p then q were rephrased into the form p only if q with greater frequency for permission than for arbitrary statements, and rephrasings of permission statements produced a pattern of introduction of modals totally unlike that observed for arbitrary conditional statements. Other pragmatic schemas, such as “causal” and “evidence” schemas can account for both linguistic and reasoning phenomena that alternative hypotheses fail to explain. (shrink)

In this article, we attempt to shed light on how, placed by the law in a situation of identity suspension that is "impossible to bear," unaccompanied minors (UAMs) can construct themselves, caught as they are between a unique personal identity that they know they must mourn in order to be able to stay in the territory, and a projected identity, also constructed by and within the fantasy of the Other. In this context, we consider the possible scope for a relationship (...) between UAMs and social workers or volunteers, and how the understanding of the topology of the Borromean knot can be used in the training of social workers and volunteers. Teachers usually consider their work as the opportunity to transmit knowledge. A recent research conducted with secondary education teachers, before they start teaching and after a teaching experience, shows an evolution where the necessity of maintaining some fulfilling teacher-pupil relationships surfaces, in which feelings of mutual trust would be key. In addition, pedagogical methods are undergoing a tremendous change in which digital technologies play a key role. This research investigates the possibility of assessing teaching satisfaction today in view of the (...) teachers’ professional development who face unpredicted socio-educational issues when they enter the career. Therefore, the manner the professional identity is submitted to a subjectivation process depends on the sense granted to the teaching activity, based upon its usefulness.
