The removal of life-sustaining treatment often brings physicians into conflict with patients. Because of their moral beliefs physicians often respond slowly to the request of patients or their families. People in bioethics have been quick to recommend that in cases of conflict the physician should simply sign off the case and “step aside”. This is not easily done psychologically or morally. Such a resolution also masks a number of more subtle, quite trouble some problems that conflict with the commitment to (...) toleration and moral diversity that it is intended to support. Contrary to the ecumenical spirit of our time, the differences among the Christian religions bring into question what one can say or do in common with fellow Christians. This issue, echoing the program of this journal, accentuates those differences, specifically when we focus on the Christian who is ill and suffering. At the bedside, it is the specifics of a religion, including not only its doctrines, but its informing and sustaining narratives, that must particularly be brought into play for the (...) sake of the patient. Given this, our focus in this article regards what such a view implies for the clinician who is caring for a Christian patient whose religion he mayor may not share, in general or in its specifics. Our basic conclusion is that the tendency for the clinician to act as both the patient's spiritual counselor, as well as his clinician, is generally neither prudent nor appropriate. Both hats should not be worn concurrently. This view is advanced not only because of concerns regarding patient vulnerability and the possible abuse of power, but also because the two roles may collide with or undermine each other. (shrink)

The purpose of this paper is to offer a conceptual analysis of the space created by the Willing Workers on Organic Farms host as a part of the organic farming movement and how that space now collides with the idea of tourism heterotopias as the changing market sees WWOOFers who may be less motivated by organic farming and more by a cheaper form of holiday. The resulting contested space is explored looking at the role and delicate balance of WWOOFing as (...) a form of sustainable tourism in the context of socially constructed understandings of space. Poststructural concepts of space suggest that it is impermanent, fragile and under constant threat of change. Space is constantly produced and reproduced in the process, spaces become sites where struggle and contestation occur, in this instance as one discourse or discursive practice, namely WWOOFing, intersects with and is influenced by the more dominant capital centric discourse of mass tourism. The randomization ingredient in double-blind controlled experiments may be objectionable to patients who, in their desperation, come to such trials seeking a last chance of cure. Minogue et al., who view such a situation as inherently exploitive and undermining of patient autonomy, propose that such “desperate volunteers” instead be enrolled in the active arm, while other patients, less desperate and more committed to medical progress, continue to be randomized. Their view is critiqued as destructive of medical progress, inappropriate in its (...) lack of clinical response to such patients, and fatally flawed by unrealistic notions of autonomy and voluntariness. The programmatic thrust of Thomasma and Pellegrino [5] is clarified and underscored and is interpreted as an attempt to introduce a fixed point into the ethical dimension of medicine by specifying some regulative principles for the medical profession. Two important features of this type of enterprise are noted: on the one hand, it may lead the profession to distinguish between technically identical actions on the basis of the normative principles it produces, thus excluding some morally permissible actions as duties constitutive (...) of the art. It is argued that the formulation of the grounds for this ethic given by Thomasma and Pellegrino is insufficient. In order to speak to the clinical situation, medical ethics must not be based on merely the living human body alone, but on the patientqua person. (shrink)

In this article, we take a novel approach to analysing English sentencing remarks in cases of women who kill. We apply computational, quantitative, and qualitative methods from corpus linguistics to analyse recurrent patterns in a collection of English Crown Court sentencing remarks from 2012 to 2015, where a female defendant was convicted of a homicide offence. We detail the ways in which women who kill are referred to by judges in the sentencing remarks, providing frequency information on pronominal, nominative, and (...) categorising naming strategies. In discussion of the various patterns of preference both across and within these categories, we remark upon the identities constructed through the references provided. In so doing, we: quantify the extent to which members of the judiciary invoke patriarchal values and gender stereotypes within their sentencing remarks to construct female defendants, and identify particular identities and narratives that emerge within sentencing remarks for women who kill. We find that judges refer to women who kill in a number of ways that systematically create dichotomous narratives of degraded victims or dehumanised monsters. We also identify marked absences in naming strategies, notably: physical identification normally associated with narrativization of women’s experiences; and the first person pronoun, reflecting omissions of women’s own voices and narratives of their lived experiences in the courtroom. Although long touted as an ethical and legal requirement, some clinicians still seem to offer less than fully adequate informed consent processes; similarly the counseling of patients and families, particularly about post-intervention scenarios, is often perfunctory at best. Keyed to a narrative of a patient's experience with surgery for a deviated septum, this article reflects on why such less than adequate clinician behaviors tend to occur and what might be done about them. Certain legal misconceptions about informed consent are highlighted (...) in this reflection, as well as why certain clinicians seem to take such a narrow view of their responsibilities to patients. Further reference in this regard is also made to a recently constructed module on informed consent for medical residents. In it, though legal requirements for informed consent are reviewed, the basic perspective taken regards informed consent as a clinical intervention that pursues certain basic goods and values, only one of which lies in determining when legal closure for such processes has occurred. The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)

In recent work, Judith Butler has sought to develop a ‘new bodily ontology’ with a substantive normative upshot: recognition of our shared bodily condition, they argue, can support an ethic of nonviolence and a renewed commitment to egalitarian social conditions. However, the route from Butler’s ontological claims to their ethico-political commitments is not clear: how can the general ontological features of embodiment Butler identifies introduce constraints on behaviour or political arrangements? Ontology, one might think, is neutral on questions of politics. (...) In this paper I reconstruct Butler’s response to this challenge, arguing that there is an interesting and plausible path from ontology to politics. I draw on Heidegger’s ontological/ontic distinction to elucidate the central concepts of Butler’s ontology: vulnerability, precariousness, and interdependency. I argue that one of Butler’s central attempts to derive an ethic of nonviolence from ontology is unpersuasive, resting on a conflation of the ontological and ontic senses of ‘interdependency’. Nonetheless, I contend that Butler is right that genuinely acknowledging our vulnerability is likely to make us more responsive to the claims of others, loosening the grip of ideals of invulnerability and sovereign independence. Based on a reading of Basil’s Ad Adulescentes and the epistles, it is clear that Basil finds moral value in Homer and Hesiod. The trickier issue is to what extent Basil uses Homer and Hesiod in his homilies. It seems that Basil does not abandon his respect for the utility of Hellenic paideia for the Christian in his homilies. Rather, he must approach Homer and Hesiod more gingerly because he fears that his uncultivated audience will have difficulty with reading texts (...) allegorically; at the literal level, Homer and Hesiod can potentially corrupt the unsophisticated listener. What we have in the homilies are less explicit references to Homer and Hesiod—they are the source of literary flourish, the origins of which probably went over the heads of Basil’s audience. As seen above, Basil also uses the poets—when read at the literary level—as counter-examples to Christian conduct. Basil in no way, then ‘lies’ or ‘changes his view’ on Greek paideia, as is oftentimes argued by scholars, but, rather, he adjusts his use of paideia depending on what his audience can handle at any given time. Since the early 1970s humanistic psychology has struggled to remain a relevant force in the social and psychological sciences, we attribute this in part to a conceptualisation of the self rooted in theoretically outmoded thinking. In response to the issue of relevancy a sociocultural turn has been called for within humanistic psychology, which draws directly and indirectly on the conceptual insights of Michel Foucault. However, this growing body of research lacks a unifying conceptual base that is able to encompass its (...) new perspectives and the movement’s theoretical antecedents. This analysis suggests a way forward by offering a potential reconceptualisation of the self in humanistic psychology through the existential-phenomenology of Martin Heidegger. We argue that Heidegger’s conception of the self takes account of subjectivities produced in discourse and institutional practice, while acknowledging the human capacity for actualisation in his concept of the authentic-self. It's funny, now reading these narratives written by Certified Nursing Assistants (CNAs), that I can't picture him without Gloria, the CNA who worked the 7-3 shift, floating quietly in and out of his room, tending to him, tending to us, speaking quietly (...) to Dad even when he was no longer conscious, offering us conversation, often her affectionate observations of Dad and curiosity about his life, sometimes about life on the "outside," a kind of respite from total attention on Dad and our grieving. I remember the smell of the lotion she rubbed on his body. I remember no other caregivers in his room; there obviously were, but I can't picture them now, only Gloria. We never spoke directly to the medical director of the hospice. He was a phantom, rounding at 5 or 6 a.m.; we came to believe he did so to avoid speaking to families.Those three weeks led to my conceptions about CNAs—the nature of the work they do, the kinds of people who do such work, the awesome responsibilities involved in such work, and not least, the physical and emotional resiliency of those who undertake such work. My and my family's often recited, "How does she do this every day?" was answered time and again in the narratives written by CNAs in this issue of the journal.But before moving forward, I want to make note of how I will refer to the authors of these narratives. The name of one's occupation, the title one uses, and how others refer to your occupation, is obviously meaningful. If the snapshots of CNAs provided in these narratives are somewhat representative, we find those who refer to themselves and their occupation as nursing assistants, nurse assistants, Certified Nursing Assistants (CNAs), State Licensed Nursing Assistants (SLNA), or simply aides, to name a few. While it is beyond the space offered here, I want to make note of this, recognizing that titles/labels matter, and to acknowledge that status. As CNA Nanci Robinson notes, "most of us are certified... I wouldn't call an LPN a PN and leave out she's licensed." Passage of the Omnibus Budget Reconciliation Act of 1987 (OBRA 87), required each State to establish State-approved nurse aide training programs and establish requirements for nurse aide competency. Thus, I will refer to all the authors here as Certified Nursing Assistants (CNAs). I do wonder how significant of an issue these variations of titles are within the larger nursing assistant culture, and how it may contribute to disparities regarding pay schedules, duties, status, training and other relevant issues among all nursing assistants.In spite of problems, stressors, and other quality of life issues for CNAs, most of them spoke with pride and meaning regarding what was for many their "life's work," similar to what one might expect to find in other care giving occupations. Some spoke of a "love of the work," its "rewards" and "joys," [End Page 165] and the intense satisfaction of "making a difference" in patients' or residents' lives. These attitudes were not vague abstractions but were grounded throughout the narratives in rich examples of the affirming aspects of their work.It appears that much of the pleasure comes from what many refer to as the "hands on," "direct care," or "front line" nature of the work—often what other health professionals might view as things they would not want to do. And of course these other professionals—registered nurses, occupational therapists, and physicians—could make the same claim when describing the "hands-on" joys of their work. But the differences, it would seem, are profound between these other caregivers and CNAs. The CNA narratives report fundamentally intimate and often daily relationships with their clients/residents/patients. Danny Reed describes the "delight" he feels "in restoring dignity to every human in need of it regardless of cause," referring to himself as a "participant observer in a caring relationship," not as a "detached clinician." This dissertation examines how the distinction between what is said and what is implicated should be applied to metaphorical language. I claim that metaphor has been incorrectly held to belong to the domain of pragmatics---what is implicated by an utterance---and I argue that metaphorical interpretations can and should be regarded as constituting what is said. ;The first two chapters develop the case against two implicature accounts of metaphor: Grice's account of metaphor as conversational implicature, and the relevance-theoretic account of metaphor (...) as 'loose talk' developed by Dan Sperber and Deirdre Wilson. Two reasons to dispute these characterizations of metaphor as implicature are developed by examining dissimilarities between alleged metaphorical implicatures and more typical cases of implicature. The third chapter focuses on the notion of what is said in cases of literal language, and explores where and how the line between what is said and what is implicated should be drawn for several controversial cases. I argue for a view of such cases according to which considerable contextual variation is taken to fall within the realm of what is said. With this view of what is said in place, the final two chapters of the dissertation explore how a semantic account of metaphor might go. Two existing semantic accounts are examined, and difficulties with each are discussed. Finally, a characterization of metaphorical content is proposed, and an alternative semantic account is developed. (shrink)

Health professionals faced with refusal of life-saving treatment may wish to override a person's wishes, especially if that person suffers from a mental disorder. Mental illness does not automatically mean a patient is incapable of making decisions of this nature. It is not always clear whether an individual is legally competent to decide whether to undergo treatment or not. This article discusses a clinical example and analyses some of the moral implications.

Others have suggested that there is no such principle at all to be found in Aristotle's works. But few know of the first Untouchable to attend college, who went on to earn advanced degrees in the social sciences and law at Columbia University, the London School of Economics, and Grays Inn, who returned to India in the 1920s to launch a civil rights movement for Untouchables, [End Page 168] who drafted the constitution for the Republic of India as its first law minister, and who led a mass conversion to Buddhism weeks before this death.Dr. B. R. Ambedkar (1891–1956) is venerated by millions of Buddhist and low-caste followers in India today, and at the same time feared by politicians determined to preserve the Hindu caste system he vowed to destroy. Admirers call him Babasaheb Ambedkar or simply Baba, using a traditional term of respect for a guiding elder, and many use the greeting Jai Bhim (“Victory to Bhimrao”) within the Untouchable communities. Ambedkar is portrayed on ubiquitous wall calendars, public statues, and home altars alongside that of the Buddha, wearing a Western suit and tie, with the horn-rimmed glasses and pocket pens of a scholar and diplomat. Although widely regarded as a bodhisattva or Buddhist saint, he is never pictured in the robes of a holy man or entreated in prayer by his devotees. And while most of his campaigns for Untouchable human rights were driven back by the Hindu nationalists, many of the provisions of his path-breaking legislation were eventually adopted after his death. In the intervening decades, amid deepening polarization over his legacy, the state government of Maharashtra has published eighteen volumes of Ambedkar’s collected works and the government of India has bestowed on him its highest civilian honor, the Bharat Ratna.Given the dearth of Western scholarship on Ambedkar’s place in the history of modern India and the emergence of socially engaged Buddhism, I welcome Chris-tophe Jaffrelot’s Dr. Ambedkar and Untouchability: Fighting the Indian Caste System. As a social scientist and director of the Centre d’Études et de Recherches Internatio-nales (CERI) who has published more than a dozen books on South Asian politics, Jaffrelot is well qualified to assess Ambedkar’s life and thought. Drawing on a wide range of materials on the social reform movements of the nineteenth and twentieth centuries and Ambedkar’s contributions to sociology and politics, the author aims to redress Ambedkar’s neglect by Indian scholars before the 1990s, when the low-caste movement began finally to gain traction. However, he does not address the anomaly of Ambedkar’s neglect by all but a small circle of Western authors.1The strength of Dr. Ambedkar and Untouchability is its concise analysis of the geographical, political, and social context of Ambedkar’s career. Jaffrelot shows how British recruitment of the Mahars, members of Ambedkar’s lowly but numerous caste, for service in the colonial army resulted in disproportionate levels of literacy. Ambedkar was the fourteenth child in such a military family, whose father held the rank of major and served as a school master for the barracks. Both parents and all of Bhimrao’s uncles could read and write, compared to less than one percent of Mahars in village life. RichardsonReview: Philip Kitcher, Science in a Democratic Society, Prometheus Books, 2011In examining the place of science in a democratic society, Philip Kitcher is ultimately asking what standards scientific activity is answerable to. Here, as in Science, Truth, and Democracy (Oxford University Press, 2001), he rejects two extreme possibilities: first, the suggestion that science is autonomous, in the sense that (...) it is answerable only to its own standards; and, second, the suggestion that it is answerable to “vulgar democracy”—that is, to unconstrained majority rule by untutored citizens. In this book, as in the earlier book, he deploys the idea of “well-ordered science,” which he seeks to characterize in part by leaning on the idea of a hypothetical, ideal conversation. Crucially informing this newer book is a much fuller account of nonvulgar democracy. Underlying that account is a much broader picture of “the ethical project”—the title idea of another important Kitcher book from 2011 (Harvard University Press).In order to motivate the friends of science to turn to these broader ethical ideas, Kitcher persuasively rehearses the case against value neutrality in science. Much current distrust of science and scientists, he argues, derives from scientists falsely pretending—whether deludedly or cynically—that science can proceed in a value-neutral way. It cannot do so in resolving competitions among theories, let alone in setting the research agenda or weighing in on practical problems of public concern. By wearing a false mask of value neutrality, scientists succeed only in convincing the public that they are ideologically driven. This, in turn, gives an opening for dissenters motivated by religion or by their own ideologies to develop supposedly scientific counter-claims of their own, such as those that assert creationism or deny the reality of climate change. Better, then, for science and scientists to be frank about its lack of value neutrality. [End Page E-106]What values ought to inform science? To answer this question, Kitcher turns to his conception of the ethical project, of which Chapter 2 gives a summary. As he conceives of ethics, it arose pre-historically as a set of mechanisms helping us to deal with deficiencies in altruistic motivation. Although inspired by evolutionary theory, Kitcher spurns the sociobiologist’s identification of the good with the adaptive. Instead, while giving an elaborate reconstruction of how our ethical practices may actually have arisen, he gives pride of place to the idea of conversation. On his reconstruction, the “egalitarian plateau” touted by Will Kymlicka (Contemporary Political Philosophy [Oxford University Press, 1990], p. 5) and others as the great achievement of the Enlightenment was merely a delayed philosophical echo of the ethical project’s initial feature, one that would have been found in the ethical discussions of human hunter-gatherer bands of forty-thousand years ago. Being more focused on how life is lived than on philosophy, Kitcher, fairly enough, is unwilling to see the Enlightenment as an egalitarian age. Rather, most recent incarnations of the ethical project have been distorted by hierarchies and inequalities. Emphasizing the word, Kitcher writes, “I propose... that we undo the distortion,” and model the ethical project, going forward, as involving an egalitarian conversation. This frankness disarms any worry about the move from ‘was’ to ‘ought’ that might have arisen in the minds of those already puzzled by the current popularity of the cave-man diet; and in any case, since Kitcher’s account of the ethical project is defended at length in his contemporaneous book of that title, doubts about it would be better addressed in that context. Rhetorically, since the ideal of treating persons fundamentally as equals is even more popular than eating meat, he is on strong ground here.The book develops this core egalitarian proposal in three distinct ways, thereby gaining a rich evaluative basis for considering the place of science in society. The last decade has seen a rise in big data approaches, including in the humanities, whereby large quantities of data are collected and analysed. In this paper, we discuss long-form audio recordings that result from individuals wearing a recording device for many hours. Linguists, psychologists and anthropologists can use them, for example, to study infants’ or adults’ linguistic behaviour. In the past, recorded individuals and communities have resided in high-income countries (HICs) almost exclusively. Recognising the need for better representation of (...) all cultures and linguistic experiences, researchers have more recently started to collect long-form audio recordings in low- and middle-income countries (LMICs). We aim to help researchers to collect, analyse and use these recordings ethically. To do so, we identify four main ethical challenges linked to research that relies on long-form recordings in LMICs. We provide recommendations to overcome these challenges. These considerations should be useful to researchers employing other big data techniques collected via wearables. (shrink)

Many individuals with disabling conditions have difficulty with gait and balance control that may result in a fall. Exoskeletons are becoming an increasingly popular technology to aid in walking. Despite being a significant aid in increasing mobility, little attention has been paid to exoskeleton features to mitigate falls. To develop improved exoskeleton stability, quantitative information regarding how a user reacts to postural challenges while wearing the exoskeleton is needed. Assessing the unique responses of individuals to postural perturbations while wearing an (...) exoskeleton provides critical information necessary to effectively accommodate a variety of individual response patterns. This report provides kinematic and neuromuscular data obtained from seven healthy, college-aged individuals during posterior support surface translations with and without wearing a lower limb exoskeleton. A 2-min, static baseline standing trial was also obtained. Outcome measures included a variety of 0 dimensional measures such as center of pressure RMS, peak amplitude, velocities, pathlength, and electromyographic RMS, and peak amplitudes. These measures were obtained during epochs associated with the response to the perturbations: baseline, response, and recovery. T-tests were used to explore potential statistical differences between the exoskeleton and no exoskeleton conditions. Time series waveforms of the COP and EMG data were also analyzed. Statistical parametric mapping was used to evaluate the 1D COP and EMG waveforms obtained during the epochs with and without wearing the exoskeleton. The results indicated that during quiet stance, COP velocity was increased while wearing the exoskeleton, but the magnitude of sway was unchanged. The OD COP measures revealed that wearing the exoskeleton significantly reduced the sway magnitude and velocity in response to the perturbations. There were no systematic effects of wearing the exoskeleton on EMG. SPM analysis revealed that there was a range of individual responses; both behaviorally and among neuromuscular activation patterns. Using both the OD and 1D measures provided a more comprehensive representation of how wearing the exoskeleton impacts the responses to posterior perturbations. This study supports a growing body of evidence that exoskeletons must be personalized to meet the specific capabilities and needs of each individual end-user. (shrink)
