The twenty-first century has brought a renewed interest in democratic theory and practices, creating a complicated relationship between time-honoured democratic traditions and new forms of political participation. Reflecting on this interplay between tradition and innovation, Aletta J. Norval offers fresh insights into the global complexities of the formation of democratic subjectivity, the difficult emergence and articulation of political claims, the constitution of democratic relations between citizens and the deepening of our democratic imagination. Aversive Democracy draws inspiration from a (...) critical engagement with deliberative and post-structuralist models of democracy, whilst offering a distinctive reading inspired by contemporary work on the later Wittgenstein. This article explores the formation of democratic subjectivity and its connection to change. Drawing on Wittgenstein's account of aspect seeing, it seeks to elucidate the processes through which political grammars change. More specifically, it illuminates two dimensions of the formation of democratic political subjectivity: the initial " identification as" a democratic subject and its repeated renewal, necessary to the maintenance of a democratic ethos. I argue that by drawing a distinction between "aspect dawning" and "aspect change," it is possible to (...) capture the key characteristics of these two dimensions. This account is developed in contrast to existing democratic theory, which either does not deal sufficiently with the formation of subjectivity or does not give full attention to the specific requirements of the formation of democratic forms of identification. Starting from existing interpretations of Cavell’s account of moral perfectionism, this article seeks to elaborate an account of democratic responsiveness that foregrounds notions of ‘turning’ and ‘manifesting for another’. In contrast to readings of Cavell that privilege reason-giving, the article draws on the writings of Cavell as well as on Foucault’s work on parreēsia to elaborate a grammar of responsiveness that is attentive to a wider range of practices, forms of embodiment and modes of subjectivity. The article suggests that a (...) focus on the notions of ‘turning’ and ‘manifesting for another’ is crucial if we are to account for the processes through which political imagination is opened up so as to bring about novel ways of being and acting. The shift from government to governance has become a starting point for many studies of contemporary policy-making and democracy. Practices of Freedom takes a different approach, calling into question this dominant narrative and taking the variety, hybridity and dispersion of social and political practices as its focus of analysis. Bringing together leading scholars in democratic theory and critical policy studies, it draws upon new understandings of radical democracy, practice and interpretative analysis to emphasise the productive role of actors and political (...) conflict in the formation and reproduction of contemporary forms of democratic governance. This article explores different theoretical and political dimensions of voice in democratic theory. Drawing on recent developments in political theory, ranging form James Bohman’s work on the movement from demos to demoi in transnational politics, to William Connolly’s writings on pluralization, it develops a critical account of the emphasis within conventional pluralism on the representation of extant identities. Instead, it foregrounds the need to engage with emerging identities, demands, and claims that fall outside the parameters of dominant discursive orders. Building (...) on the works of Rancie`re and Cavell, it highlights the importance of an analytical engagement with the emergence and articulation of new struggles and voices*the processes through which inchoate demands are given political expression*so as to counter the ongoing possibilities of domination, understood here as a ‘deprivation of voice.’ The article develops an account of the centrality of the category of responsiveness to such claims and demands for democratic theory, especially in relation to a range of democratic struggles in our contemporary world. In so doing, it contributes to a growing body of work that questions the taken for granted character and status of the institutional forms of liberal democaracy. This paper examines patterns of metaphor in usage. Four samples of text excerpts of on average 47,000 words each were taken from the British National Corpus and annotated for metaphor. The linguistic metaphor data were collected by five analysts on the basis of a highly explicit identification procedure that is a variant of the approach developed by the Pragglejaz Group (Metaphor and Symbol 22: 1–39, 2007). Part of this paper is a report of the protocol and the reliability of the (...) procedure. Data analysis shows that, on average, one in every seven and a half lexical units in the corpus is related to metaphor defined as a potential cross-domain mapping in conceptual structure. It also appears that the bulk of the expression of metaphor in discourse consists of non-signalled metaphorically used words, not similes. The distribution of metaphor-related words, finally, turns out to be quite variable between the four registers examined in this study: academic texts have 18.5%, news 16.4%, fiction 11.7%, and conversation 7.7%. The systematic comparative investigation of these registers raises new questions about the relation between cognitive linguistic and other approaches to metaphor. (shrink)

The mystery does not always end when the crime has been solved. Indeed, the most insolvable problems of crime and punishment are not so much who committed the crime, but how to see that justice is done. Now, in this illuminating volume, one of America's great legal thinkers, Norval Morris, addresses some of the most perplexing and controversial questions of justice in a highly singular fashion--by examining them in fictional form, in what he calls "parables of the law." The (...) protagonist of these stories, the figure who must see that justice is done, is Eric Blair, a name familiar to most readers: it's the real name of George Orwell. In fact, Morris has set his tales in the time and place of Orwell's famous essay, "Shooting an Elephant," in Moulmein, Burma, in the 1920s. What might seem a curious strategy at first glance--borrowing Orwell's persona to narrate these tales--is actually a brilliant stroke. For in Eric Blair we have an ideal narrator to highlight the complexities of justice: an untrained police lieutenant and junior magistrate, uncertain of judgement--and all the more likely to anguish over judgement, and to examine every facet of a case before deciding. And in 1920s Moulmein we have a neutral time and space in which to consider--free of our own political, religious, or social prejudices--a set of contemporary legal and moral questions that rarely find so calm an arena. And these stories certainly address some highly charged issues--capital punishment, insanity as a murder defense, the "battered wife syndrome" as a murder defense, child custody, "parental neglect" due to religious conviction--to name a few. In each tale, Norval Morris excels at placing Blair at the center of a controversy that has no easy answer, and that he and he alone must decide. In the title story, for instance, a retarded boy, whose only understanding of sex comes from the brothel in which he works, accidentally murders a young girl while raping her, his only defense being "Please sir, I paid her." Blair can see that the boy doesn't realize that he has committed a crime, but both the Burmese and the European community of Moulmein demand the boy's execution. Does capital punishment make sense in such an instance? Does it ever make sense? To broaden our understanding of these intricate cases, Morris concludes each story with a perceptive and often provocative commentary on each issue. After "Brothel Boy," for instance, Morris points out that no reputable study has ever shown capital punishment to be an effective deterrent to future murders, and more surprisingly, that paroled murderers commit proportionately fewer homicides than paroled felons who used a firearm in the commission of their crime. Norval Morris is one of America's foremost experts on crime and punishment, and the stories collected here represent the culmination of a lifetime of thought on the major criminal law debates of our time. A reader of these tales will come away with a deeper understanding of these debates and with a profound respect for the intricacies of justice and the complexity of the law. (shrink)

Likert scales are useful for collecting data on attitudes and perceptions from large samples of people. In particular, they have become a well-established tool in soundscape studies for conducting in situ surveys to determine how people experience urban public spaces. However, it is still unclear whether the metrics of the scales are consistently interpreted during a typical assessment task. The current work aims at identifying some general trends in the interpretation of Likert scale metrics and introducing a procedure for the (...) derivation of metric corrections by analyzing a case study dataset of 984 soundscape assessments across 11 urban locations in London. According to ISO/TS 12913-2:2018, soundscapes can be assessed through the scaling of 8 dimensions: pleasant, annoying, vibrant, monotonous, eventful, uneventful, calm, and chaotic. The hypothesis underlying this study is that a link exists between correlations across the percentage of assessments falling in each Likert scale category and a dilation/compression factor affecting the interpretation of the scales metric. The outcome of this metric correction value derivation is introduced for soundscape, and a new projection of the London soundscapes according to the corrected circumplex space is compared with the initial ISO circumplex space. The overall results show a general non-equidistant interpretation of the scales, particularly on the vibrant-monotonous direction. The implications of this correction have been demonstrated through a Linear Ridge Classifier task for predicting the London soundscape responses using objective acoustic parameters, which shows significant improvement when applied to the corrected data. The results suggest that the corrected values account for the non-equidistant interpretation of the Likert metrics, thereby allowing mathematical operations to be viable when applied to the data. What happens when someone acts? A familiar answer goes like this. There is something that the agent wants, and there is an action that he believes conducive to its attainment. His desire for the end, and his belief in the action as a means, justify taking the action, and they jointly cause an intention to take it, which in turn causes the corresponding movements of the agent's body. I think that the standard story is flawed in several respects. This article is a report on ongoing field research and the exponential growth of the environment in which sex workers, prostitutes, call girls, and escorts operate. We look at the complexity of the conditions of such work and consider the socio-psychological and media vectors that make up the context from which its actors and stereotypes emerge. With the explosion of websites offering virtual or real sex, there is also a continuation of oppressive and violent male practices in this sector, restricting (...) the freedom of choice for women who work professionally in this field. These practices reproduce the power relations and the exclusion that has always been present in society, and are also now more diffuse as virtual reality has come to play an important role in social practice. O artigo aponta que o estudioso das imagens alemão Aby Warburg (1866-1929) pode ter sido vítima de um mal provocado pelo envolvimento com suas coleções de fotos e recortes de jornais e revistas sobre a guerra: algo próximo do que é hoje conhecido como Síndrome de Estresse Pós-Traumático (PTSD, na sigla em inglês). As emoções concentradas em fotografias de cenas de guerra que ele colecionou e manipulou durante toda a Primeira Guerra Mundial (1914-18), teriam sido um fator importante para a (...) ocorrência de surtos psicóticos que o levaram a uma longa internação. Tal hipótese permitiria explicar o quadro de esgotamento emocional, com aceleração maníaca e exaltação do psiquismo, que acometeu Warburg logo após o final da guerra. Pretendemos, a partir desse exemplo clínico, levantar elementos para compreender o conceito central de seu pensamento sobre a força das imagens, o conceito de “fórmula de emoção” ou “fórmula de pathos”. Abstract I argue that meaning in life is importantly influenced by bioloical ties. More specifically, I maintain that knowing one's relatives and especially one's parents provides a kind of self-knowledge that is of irreplaceable value in the life-task of identity formation. These claims lead me to the conclusion that it is immoral to create children with the intention that they be alienated from their bioloical relatives?for example, by donor conception.

Supervaluationism is often described as the most popular semantic treatment of indeterminacy. There’s little consensus, however, about how to fill out the bare-bones idea to include a characterization of logical consequence. The paper explores one methodology for choosing between the logics: pick a logic thatnorms beliefas classical consequence is standardly thought to do. The main focus of the paper considers a variant of standard supervaluational, on which we can characterizedegrees of determinacy. It applies the methodology above to focus ondegree logic. (...) This is developed first in a basic, single-premise case; and then extended to the multipremise case, and to allowdegreesof consequence. The metatheoretic properties of degree logic are set out. On the positive side, the logic is supraclassical—all classical valid sequents are degree logic valid. Strikingly, metarules such as cut and conjunction introduction fail. (shrink)

Retributive theories of punishment argue that punishing a criminal for a crime she committed is sufficient reason for a justified and morally permissible punishment. But what about when the state gets lucky in its decision to punish? I argue that retributive theories of punishment are subject to “Gettier” style cases from epistemology. Such cases demonstrate that the state needs more than to just get lucky, and as these retributive theories of punishment stand, there is no anti-luck condition. I’ll argue that (...) Gettier-style cases demonstrate an impermissible instance of punishment, even though they meet the conditions of retributive theories of punishment. Retributive theories are, therefore, too weak. The safety condition from epistemology provides the anti-luck condition needed for permissible punishment. I argue that two forms of retributivism, rights-forfeiture and what I call standard retributivism, are both subject to Gettier-style cases. Unlike the literature on standards of proof, this paper argues that safety is a condition on punishment itself, i.e., in all nearby possible worlds, the accuser must correctly accuse the convicted for the crime they actually committed.
