This essay attempts to develop a psychologically informed semantics of perception reports, whose predictions match with the linguistic data. As suggested by the quotation from Miller and Johnson-Laird, we take a hallmark of perception to be its fallible nature; the resulting semantics thus necessarily differs from situation semantics. On the psychological side, our main inspiration is Marr's (1982) theory of vision, which can easily accomodate fallible perception. In Marr's theory, vision is a multi-layered process. The different layers have filters of (...) different gradation, which makes vision at each of them approximate. On the logical side, our task is therefore twofold • to formalise the layers and the ways in which they may refine each other, and • to develop logical means to let description vary with such degrees of refinement. The first task is formalised by means of an inverse systems of first order models, with reality appearing as its inverse limit. The second task is formalised by means of so-called conditional quantifiers, a new form of generalised quantification which can best be described as resource bounded quantification. We show that the logic provides for a semantics and pragmatics of direct perception reports. In particular, direct perception reports have a possibly nonveridical, approximative semantics, which becomes veridical only by virtue of our pragmatic expectation that what is perceived would continue to be the case, were we to perceive more accurately. It is a general feature of resource bounded logics that the underlying logics are weak, but that stronger principles can be obtained pragmatically, by strengthening the resource. For the logic of vision this feature is clarified by showing how changes in the resource capture different notions of partiality, and by studying how the perception verb interacts with connectives and quantifiers in different visual contexts. The inference Veridicality, which is now viewed rather as a nonmonotonic inference, is also studied in depth. We end with an attempt to buttress the proposed model by comparing it with suggestions put forward in Cognitive or Conceptual Semantics, in the literature on evidentials, and in Husserl's philosophy of perception. Reading the Tractatus. And appreciating it The reception history of Wittgenstein’s Tractatus Logico-Philosophicus displays an impressive and persistent diversity. This paper explores possible sources of that diversity and locates them in different takes on the text and its context of origin, and in different perspectives of the readers. The article argues for a contextualised reading of Wittgenstein’s Tractatus. It analyses in detail the role that use and application play in the text and how that supports a conception of transcendentality of logic that allows for contextualisation. The article identifies a tension in the text, between the requirement that sense be determinate and the contextual nature of application, and suggests that it is this tension that is a major driver of Wittgenstein’s later ideas.

This volume presents contributions to quantifier theory and its applications and gives a good impression of the depth and diversity of recent work in the field. The book starts with a long introduction aimed at making the individual papers accessible to a wide audience of logicians and linguists.

This note is on cautious cut elimination for one of Veitman's might logics. Syntactically, the logic is presented as an extension of a sequent system for classical proposition logic . I show that this extension preserves the completeness and decidability of CPL. The proof has cautious cut elimination as a corollary. I also give a rather general syntactic proof of cautious cut elimination. It states that any ‘base’ logic which has a reflexive, monotone consequence relation that allows cautious cut to (...) be eliminated preserves cautious cut elimination when extended to a might logic. The Athenian sophist Philostratus completed a romanticised biography of Apollonius of Tyana in the second or third decade of the third century A.D. One of the most striking aspects of the presentation of this firstcentury Pythagorean sage and miracleworker in the Vita Apollonii (VA) is his role as 'politically active philosopher'. Not only does the protagonist of the VA regularly intervene in situa-tions of conflict in Greek cities and instruct their citi-zens on how they ought to live together, but (...) he also appears in contact with Parthian and Indian kings and Roman emperors. The present study deals with this promi-nent facet of Philostratus' portrait of the Tyanean sage. There are three main issues. The first is the question of the extent to which the Apollonius tradition provided support for the image of the contacts of the protagonist of the VA with cities and monarchs. The second is consideration of how the author dealt with and elaborated these elements in his source material. The third is the question of to what extent the protagonist of the VA may be regarded as a spokesman for the explicit political views of Philostratus. In other words, the aim is to analyse the image of the protagonist of the VA as a 'politically active philosopher' as the result of the interaction between the traditions associated with a sage and miracleworker who was regarded as a representative of Pythagorean wisdom, on the one hand, and the paideia, cultural baggage and mentality of a sophist, on the other. This paper deals with the questions of whether the law should be coherent and what this coherence would amount to. In this connection so‐called “integrated coherentism” is introduced. According to integrated coherentism, an acceptance set is coherent if and only if it contains everything that should rationally be accepted according to what else one accepts and does not contain anything that should rationally be rejected according to what else one accepts. Such an acceptance set is ideally a theory of (...) everything, including amongst others standards for rational aceptance. On the assumption that the law, as a social phenomenon, is what the best theory about the law says it is, the law must be coherent, because the best theory of the law is part of an integratedly coherent theory of everything. This view is compatible with Raz's view that the law stems from different sources that need not be coherent in the sense that they consistently elaborate the same underlying principles or policies. Raz's view is not a consequence of integrated coherentism, however. (shrink)

Going beyond the hype of recent fMRI "findings," this interdisciplinary collection examines such questions as: Do women and men have significantly different brains? Do women empathize, while men systematize? Is there a "feminine" ethics? What does brain research on intersex conditions tell us about sex and gender?

My main claim in this article is that lawyers should make less use of the hermeneutical method than they do. The reasons that I will adduce to support this claim are the following: law is first and foremost an answer to the question of how to act and, more in particular, the question of which rules to enforce by collective means. As such, law does not coincide with positive law. Nevertheless, positive law determines the content of the law to (...) a large extent. It does so for two reasons. The first reason is that positive law contributes to legal certainty and that legal certainty is very important for the question concerning which rules should be enforced by collective means. The second reason is that respect for positive law, which was created by democratic bodies, implies respect for democracy. However, positive law can only contribute to legal certainty if its application is predictable. If positive law can be interpreted in more than one way, its application will not be predictable. In that case, positive law is not relevant for the content of the law tout court. Theories about the interpretation of positive law are particularly relevant where positive law can be interpreted in different ways, that is where positive law is not relevant for the content of the law tout court. Therefore, hermeneutical theories are not relevant for the content of the law and lawyers should not waste their time on them. A similar argument can be given for the democratic legitimation of positive law. (shrink)

ABSTRACTThe metaphor of historical distance often appears in discussions about the study of contemporary history. It suggests that we cannot see the past in perspective if we are too near to it. According to founding fathers like Ranke and Humboldt, temporal distance is required to discern historical “ideas” or forms. The argument may have some plausibility, but the presupposition is plainly false, since we cannot see the past at all. This leaves us with the question of what to make of (...) the so‐called historical forms. This article discusses three different views. The first, historicist, view is objectivist and localizes historical forms in the past. The second, narrativist, view is subjectivist and localizes historical forms in the realm of imagination and representation. The third view goes beyond the other two in that it considers both sides. It does not use a one‐sided but a two‐sided concept of form, which hinges on the idea of a distinction. This means that historical forms occupy both sides of the subject–object distinction or the present–past distinction. Because the subject–object terminology is confusing, the essay employs an alternative distinction between first‐ and second‐order observation. With the help of this distinction, it is possible to redescribe the distance metaphor in such a way that the theoretical status of contemporary history becomes less enigmatic. (shrink)

This paper investigates how "representation" is actually used in some areas in cognitive neuroscience. It is argued that recent philosophy has largely ignored an important kind of representation that differs in interesting ways from the representations that are standardly recognized in philosophy of mind. This overlooked kind of representation does not represent by having intentional contents; rather members of the kind represent by displaying or instantiating features. The investigation is not simply an ethnographic study of the discourse of neuroscientists. (...) If there are indeed two different kinds of representations, and the non-standard ones are the ones referred to in some areas of cognitive neuroscience, then we will have to give up the idea that appealing to inner representations with intentional contents is the defining distinction between cognitive neuroscience and behaviorist psychology (Montgomery, 1995). Further, if the conclusions of this paper are correct, many general accounts of how neural states represent are either false or theoretically ill-motivated. (shrink)

Because of this, exegesis which attributes to Hume an unrestrained scepticism about the experimental method appears to attribute to him inconsistency on such a scale as to render the interpretation itselfquestionable. Nonetheless, there is, atleast on the face ofit, considerable justification for ascribing to Hume just such a scepticism. In this paper I explore sceptical features, some ofthem important but little noticed, in Hume's treatment of causality and our beliefs about the unobserved. Though I end by suggestinghow to avoidviewing Hume in this area as simply lamentably inconsistent, Hume's use of the experimental method doesremain problematic, as, I suggest, Hume himselfthought. The first three of the following sections in this paper treat connected themes in Hume's philosophy which, when taken together, present us with a very sceptical view of experimental reasoning. I. Necessity as projected impression Hume holds that our beliefs about causality in the objects are in large part the result of a projection of an internal impression of (some kind of) necessity. The thesis ofprojection is not entirely straightforward; to see this, let us ask the question, is the impression which is projected semantically simple or complex? There are excellentreasonsforregarding the impression as simple as Hume conceives of "simple" in this context. Hume himselfappears to sayitis simple (E 64, n. 1). Andmuch of Hume's discussion ofnecessity is driven by the principle that there can be no idea without a preceding impression, and this principle applies only to simple ideas. But the consequent reading is far from satisfactory. To see the problem, let us look at what seems to be the Volume XV Number 2 325 ANNE JAAP JACOBSON most entrenched understanding ofHume, one perhaps amark ofKemp Smith's influence. This is the view that Hume is saying that the impression source of our idea of necessity is a feeling of anticipation. The problem is this: ifa feeling ofanticipation is a simple impression, it is not at all clear that the impression can do the job Hume has for it. Remember that if the impression is in content itselfrelational, then it is not a simple impression on Hume's own account, since ideas of relations are for him complex (T 13). Hence, we might take the impression to be of the sort described by Stroud, according to whom the impression yielding our idea of necessity is semantically unrelated to the elements of the relation. But such a reading robs Hume of the explanatory position he so clearly thinks he has. If we have a semantically simple impression it becomes a mystery why the spreading has the effects that it does: when we transfer the determination ofthe thought to external objects, andsuppose any real intelligible connexion betwixt them. (T 168, my emphasis) Why does spreading some simple, indefinable feeling result in our supposing there is a real intelligible connection between the objects on which the mind has spread? To get this result it looks as though the mind will have tomake two mistakes: thefirstmistake is the spreading, and the second mistake consists in the mind's inferring from the experience of the impression as spread that somehow the causal inference itself is also out there in nature as an intelligible connection. But, while Hume does sometimes seem to suggest we make this sort of two-step error (T 223, for example), such a picture makes it seem that the impression spread is not really the semantic source of (that is, wholly determinate of the content of) our idea ofnecessity. Rather, on the two-step error model, our belief that there are connections enters as a result of an inference following upon the spreading; however, for Hume, an inference is not the way an impression ofX gives rise to an idea ofX... In this paper I argue that all proposals for demarcation criteria distinguishing between scientific and non-scientific knowledge, have failed. Moreover, there is not a single set of epistemic virtues that characterizes 'good' knowledge, nor is there such a set that characterizes science. There are many different epistemic virtues and no universal rules about how they are to be applied in particular cases. Different virtues may dominate in different knowledge domains. In the 'same' domain there are neither universal nor domainspecific rules (...) as to how to weigh different virtues. Different virtues may provide conflicting assessments of a knowledge claim. After glancing at contemporary epistemology in the analytic tradition, I conclude there is little interest in the question of metajustification of epistemic virtues. When it does come up, appeal is made to intuitions that are not grounded in philosophy , but in manifest life forms. Finally, I present pointers that should guide the application of the very general meta-epistemic virtues 'fitting with experience' and 'fitting with earlier knowledge': [i] rationality should be understood as bridled irrationality, [ii] knowledge should be evaluated in terms of rightness, not truth, [iii] any final grounding of epistemic virtues has to fall back on the manifest life forms. Prolonged trunk flexion is known to affect passive and active stabilization of the trunk. Previous studies have evaluated changes in spinal range of motion, muscle activity and reflex behavior induced by prolonged trunk flexion, whereas the effect on sitting postural control is vastly underexplored. In this study, we compared the effects of supported and unsupported intermittent trunk flexion on center of pressure motion during sitting on an unstable seat. Participants were exposed to 1-h intermittent trunk flexion and CoP root mean (...) square distance, velocity and frequency before and after the exposure were assessed. Contrary to our hypothesis, there were no main effects of exposure, no main effects of condition, and no interaction between exposure and condition. Our results indicate that prolonged intermittent flexion does not induce any changes in CoP motion during a seated balance task, regardless of the presence of a trunk support during prolonged intermittent flexion. This suggests a successful compensation of decreased passive stiffness by increased reflex activity. (shrink)

This book features essays that investigate the nature of legal validity from the point of view of different traditions and disciplines. Validity is a fascinating and elusive characteristic of law that in itself deserves to be explored, but further investigation is made more acute and necessary by the production, nowadays, of soft law products of regulation, such as declarations, self-regulatory codes, and standardization norms. These types of rules may not exhibit the characteristics of formal law, and may lack full formal (...) validity but yet may have a very real impact on people's lives. The essays focus on the structural properties of hard and soft legal phenomena and the basis of their validity. Some propose to redefine validity: to allow for multiple concepts instead of one and/or to allow for a gradual concept of validity. Others seek to analyze the new situation by linking it to familiar historical debates and well-established theories of law. In addition, coverage looks at the functions of validity itself. The discussion considers both international law as well as domestic law arrangements. What does it mean to say that something is valid? Should we discard validity as the determining aspect of law? If so, what does this mean for our concept of law? Should we differentiate between kinds of validity? Or, can we say that rules can be "more" or "less" valid? After reading this book, practitioners, scholars and students will have a nuanced understanding of these questions and more. This is a review of Quantifiers, Logic, and Language, edited by Jaap van der Does and Jan van Eijk, published by CSLI (Center for the Study of Language and Information) Publications, Stanford, CA, in 1996.

After a brief biography of Jaap van Brakel we set out his appropriation and use of the distinction between the manifest image and the scientific image of the world. In a certain sense van Brakel gives priority to the manifest image as the ultimate source of meaning in chemical discourses. He does not take sides in the debate about nominal and real essences, twin earths and so, but presents a compromise. As an active practitioner of the chemical arts (...) he emphasises the indispensability of models as a main tool for chemical thinking. We then turn to van Brakel’s interest in forging an intercultural point of view in which philosophy of chemistry plays an important part. (shrink)

In the Netherlands, in 2002, euthanasia became a legitimate medical act, only allowed when the due care criteria and procedural requirements are met. Legally, an Advanced Euthanasia Directive can replace direct communication if a patient can no longer express his own wishes. In the past decade, an exponential number of persons with dementia share a euthanasia request with their physician. The impact this on physicians, and the consequent support needs, remained unknown. Our objective was to gain more insight into the (...) experiences and needs of Dutch general practitioners and elderly care physicians when handling a euthanasia request from a person with dementia. We performed a qualitative interview study. Participants were recruited via purposive sampling. The interviews were transcribed verbatim, and analyzed using the conventional thematic content analysis. Eleven general practitioners and elderly care physicians with a variety of experience and different attitudes towards euthanasia for PWD were included. Euthanasia requests appeared to have a major impact on physicians. Difficulties they experienced were related to timing, workload, pressure from and expectations of relatives, society’s negative view of dementia in combination with the ‘right to die’ view, the interpretation of the law and AEDs, ethical considerations, and communication with PWD and relatives. To deal with these difficulties, participants need support from colleagues and other professionals. Although elderly care physicians appreciated moral deliberation and support by chaplains, this was hardly mentioned by GPs. Euthanasia requests in dementia seem to place an ethically and emotionally heavy burden on Dutch GPs and elderly care physicians. The awareness of, and access to, existing and new support mechanisms needs further exploration. (shrink)

This commentary discusses several problems with the target article by Ceci et al. First, the results admit of an alternative interpretation that undercuts the conclusion drawn. In addition, at a number of points, the research should be supplemented by examining situations in which there is no tenure-granting policy. Finally, 60% of the questions are concerned with whistle-blowing, but the issues involved in such cases make them much less relevant to the assessment of tenure than the authors suppose. Albert (von) Szent-Györgyi started his studies on biological oxidation processes - which also resulted in the discovery of vitamin C, for which he received the Nobel Price in 1937 - in the Laboratory of Physiology of the University in Groningen in 1922-1926. These studies were later continued in Cambridge (UK) and Szeged (Hungary). When he had already received the invitation as well as the financial means to come and work in Cambridge, he still did experiments in Groningen to find out (...) whether the adrenal extract, isolated by him and later found to be a major source of vitamin C, contained the hormone essential for the survival of cats whose adrenals were removed. He was rather upset by the negative results of this experiment, judging by the recollections of a former student of his. This history constitutes an interesting example of the difference between serendipitous discovery and planned invention. (shrink)

This article explores the radical changes in the relationship between philosophy and the study of language in early modern Europe. It describes the context in which questions concerning language were approached in early modern Europe and outlines some aspects of the disciplines traditionally concerned with language, which include logic, grammar, and rhetoric. It discusses the views of language held by some of the most influential philosophers of the period including Francis Bacon, René Descartes, and Thomas Hobbes.

Discusses the conditions of possibility for intercultural and comparative philosophy, and for crosscultural communication at large. This innovative book explores the preconditions necessary for intercultural and comparative philosophy. Philosophical practices that involve at least two different traditions with no common heritage and whose languages have very different grammatical structure, such as Indo-Germanic languages and classical Chinese, are a particular focus. Lin Ma and Jaap van Brakel look at the necessary and not-so-necessary conditions of possibility of interpretation, comparison, and other (...) forms of interaction and how we can speak of similarities and differences in this context. The authors posit that it is necessary to dissolve the question of universalism versus relativism by replacing the ideal language paradigm with a paradigm of family resemblances and that it is not necessary to share a common language to engage in comparison. Rule-applying legal arguments are traditionally treated as a kind of syllogism. Such a treatment overlooks the fact that legal principles and rules are not statements which describe the world, but rather means by which humans impose structure on the world. Legal rules create legal consequences, they do not describe them. This has consequences for the logic of rule- and principle-applying arguments, the most important of which may be that such arguments are defeasible. This book offers an extensive analysis of the (...) role of rules and principles in legal reasoning, which focuses on the close relationship between rules, principles, and reasons. Moreover, it describes a logical theory which assigns a central place to the notion of reasons for and against a conclusion, and which is especially suited to deal with rules and principles. Classroom discussion is frequently proposes as an essential part of democratic citizenship education. Literature, however, pays little attention to what kind of discussion is most effective and how teachers can facilitate a discussion. This study aims to contribute to the development of a framework for analysing the characteristics of classroom discussions and the different roles teachers can adopt in guiding a discussion on controversial issues. In addition, we investigated how the way teachers guide the discussion is related to the structure (...) and content features of the discussion. The framework was used to analyse five classroom discussions in secondary education. Our framework appeared to be useful for revealing differences in the structure and content features of the classroom discussions and in the way teachers guide the discussion. Why should interpretation of conceptual schemes and practices across traditions work at all? In this paper we present the following necessary conditions of possibility for interpretation in comparative and Chinese philosophy: the interpreter must presuppose that there are mutually recognizable human practices; the interpreter must presuppose that “the other” is, on the whole, sincere, consistent, and right; the interpreter must be committed to certain epistemic virtues. Some of these necessary conditions are consistent with the fact that interpretation is not thwarted (...) by the “danger” of relativism or of incommensurability. Some other conditions are suggestive of reorientations of methodologies of comparative and Chinese philosophy. (shrink)
