First published in 1969, The Elusive Mind argues that the mental processes are of a quite different nature from physical ones and belong to an entity which is elusive in the sense that it can only be known, in the first instance, by each person in his own case in the course of having any kind of experience. This 'elusive' self is much involved with the body in any conditions we know, but it could also survive the dissolution of the (...) body. The views of thinkers like Ryle, Hampshire, Malcolm, Feigl, and Ayer are subjected to an exceptionally close and critical scrutiny. Capital "H" Humanism is the moving spirit behind this book, complete with its quaint, crusading anti-supernaturalism. What starts out as a propagandistic apologia for this "movement" manages to come up with some solid essays on various aspects of ethics and ethical theory. There is a star studded cast including H. J. Blackham, Marvin Farber, Hebert Feigl, Rollo Handy, Sidney Hook, A. H. Maslow, Ernest Nagel, Carl Rogers, and B. F. Skinner covering topics dealing with ethics and religion; the good life (...) ; law, the individual, and social organization; justice and society; and death. Many of the essays are reprinted from The Humanist. Some of them over-simplify the problems of philosophical ethics. Although there are some strong and interesting essays, the usefulness of the book is limited by its effort to advocate the Humanist position.--S. O. H. (shrink)

THE Identity Theory of Herbert Feigl is an elaborate and painstaking attempt to overcome the perplexities of the mind-body problem which Anglo-Saxon philosophers have inherited from Descartes and which has been compounded by the empiricist heritage of Hume. In common with influential contemporaries such as Russell, Ryle, Strawson and Hampshire, Feigl believes that the substance dualism of Descartes is an incoherent doctrine. There can be no adequate account of the nature and status of the person if mind and body, conscious (...) immaterial self and extended corporeal substance are regarded as distinct and disparate entities. It is paradoxical however and indicative of the pervasive influence of the Cartesian framework, that the Identity Theory combines an explicit rejection of dualism with an uncompromising acceptance and even extension of another feature of that framework, in that it hinges on a more comprehensive reliance on the knowledge claims of science than even Descartes was prepared to sanction. In the 19th century, "Psychophysical Parallelism" was the most popular solution of the mind-body problem among physiologists, psychologists and philosophers. (This is not to be mixed up with Leibnizian and other cases of "Cartesian" parallelism.) The fate of this non-Cartesian view, as founded by Gustav Theodor Fechner, is reviewed. It is shown that Feigl's "identity theory" eventually goes back to Alois Riehl who promoted a hybrid version of psychophysical parallelism and Kantian mind-body theory which was taken up by Feigl's teacher (...) This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. The paper defends the position that phenomenological interviews can provide a rich source of knowledge and that they are in no principled way less reliable or less valid than quantitative or experimental methods in general. It responds to several skeptic objections such as those raised against introspection, those targeting the unreliability of episodic memory, and those claiming that interviews cannot address the psychological, cognitive and biological correlates of experience. It argues that the skeptic must either heed the methodological and epistemological (...) justification of the phenomenological interview provided, or embrace a more fundamental skepticism, a “deep mistrust”, in which scientific discourse can have no recourse to conscious processes as explananda, with ensuing dire consequences for our conception of science.
