We live in a liberal, democratic, multicultural society where ideally the values of personal liberty and autonomy are paramount. In such a society the state, through the law, should not be concerned with telling people how they should live their lives. In spite of this, many of the ethical stances taken in liberal societies are paternalistic and authoritarian. This readable and balanced book is an original discussion of contemporary issues in bioethics. Max Charlesworth argues that as there can be (...) no public consensus on a set of core values – liberal societies accept a variety of religious, non-religious, political and moral stances - there should be a plurality of ethical stances as well. The study of religion by social anthropologists, as distinct from the classical philosophical approach of the Greeks and their medieval heirs, began in the late 19th century with Edward Tyler’s Primitive Culture (1871). Tyler’s approach was completely a priori in style in that it did not rest on systematic field work or empirical observation. The same approach characterized James Frazer’s famous book, The Golden Bough (1891). Baldwin Spencer, the founding father of Australian anthropology, was persuaded by Frazer to see the (...) sophisticated religious beliefs and rites of the Aboriginal groups he studied in central Australia as mere ‘magic’. By the 1960s, a new generation of anthropologists, influenced by Claude Lévi-Strauss and English thinkers like E. Evans Pritchard, had arrived on the scene. This new ‘turn’ in anthropology led a number of contemporary scholars to the radical position that Western anthropology itself is a socio-cultural phenomenon that can be investigated in a broadly anthropological way. To see what this involves, it is worthwhile examining a number of crucial misunderstandings of Australian Aboriginal beliefs and practices that have been the artefactual result of various anthropological approaches. We seem then to be left with the fourth position outlined above as the best solution we have to the problem of religious diversity. No doubt this will be far too radical for some religious believers in that, while it allows a believer to hold that his or her religion has some kind of paradigmatic status it also admits that genuine religious developments may take place in other religions. On the other hand it will not be radical enough for other (...) people who will see it as denying the integrity and autonomy of other religious ways and sanctioning some degree of religious exclusivity and intolerance in that, by seeing Christianity as having some essential core of truth that Buddhism lacks, I am claiming superiority for Christianity. And vice versa, if I claim that Buddhism is the privileged way of enlightenment, I am claiming superiority for Buddhismvisà-vis Christianity.Nevertheless, even if this position does notsolve the problem of religious diversity it does at least show which of the alternative solutions are finally untenable, both on religious and philosophical grounds. And it does provide a basis for genuine ecumenical dialogue between the world religions. Indeed, by recognising that a religious believer can hold that genuine developments of religious values may take place in other religions, it makes such dialogue absolutely necessary in much the same way as the Christian Churches have been led to see ecumenical dialogue as not merely an option but a necessity. Certain philosophical problems occur in biblical interpretations where concepts that belong to the scriptural world – full of references to demonic forces and miraculous events including raisings from the dead – have to be translated into meaningful concepts in our twenty-first-century western world. A crucial issue that arises is that any interpretation of a text can, at best, be probable and can never be absolutely final and certain. This in turn has implications for the act of faith that any believer (...) makes. Church traditions, the teachings of the Church on matters of faith and morals, and papal dictates are also subject to interpretation and are equally problematic. Attempts by Kant and others to avoid these difficulties by arguing that biblical texts are not descriptive but quasi-performative are also considered and rejected. (shrink)

We tend to think that the difficulties in bioethics spring from the novel and alarming issues that arise due to discoveries in the new biosciences and biotechnologies. But many of the crucial difficulties in bioethics arise from the assumptions we make about ethics. This paper offers a brief overview of bioethics, and relates ethical ‘principlism’ to ‘ethical fundamentalism’. It then reviews some alternative approaches that have emerged during the second phase of bioethics, and argues for a neo-Aristotelian approach. Misconceptions about (...) ethical principles and ethical reasoning not only distort our views of the business of bioethics, but they also prevent us from facing up to the formidable problems posed by ethical pluralism in so-called liberal societies. While not taking St. Anselm’s ontological argument in the Proslogion to be valid, this paper shows that the dismissal of the thesis by both St. Thomas Aquinas and Kant does less than justice to St. Anselm’s text. In Chapter II of the Proslogion Anselm defines God as ‘something than which nothing greater can be thought’, claiming that this notion ‘exists in the mind’. The question is does its subject, God, exist ‘in re’. Can one proceed from the mental existence to (...) real existence given that to exist in re is greater than to exist notionally? This paper sets out several of Anselm’s premises from which he concludes that the notional existence of God defined by Anselm entails God’s actual existence, Aquinas dismissed Anselm’s arguments – possibly not having Anselm’s full text at hand. Anselm maintains that if ‘something than which nothing greater can be thought’ can be conceived, then to deny its existence in re constitutes a self-contradiction. The present paper examines in detail the elements of which Anselm’s elegant arguments are composed: q.v. Reference is made to Anselm’s Reply to Gaunilo, and to Anselm’s ontology set out in Monologion. Much, for the modern reader, turns on the topical logic of ‘perfection’ and of ‘greatness’. Again: much turns on the Kantian question ‘Is existence a predicate?’ And on the question: what kinds of things can be the subject of predicates? The comparison which Anselm is making between real and conceptual existence is not like any other comparison. This may be the flaw in his arguments. (shrink)

This chapter offers a family perspective on Max Charlesworth, recalling aspects of his life and career through the eyes of a child.

In this essay I elaborate on the theoretical framework – that of Millian liberalism – that Max Charlesworth brought to many public issues, including that of the relation between education and religion. I will then apply this framework to a debate in which I have been recently involved myself: a debate around the provision of religious instruction in public schools. In the first section I expound Charlesworth’s rejection of secularism in education in a liberal pluralist state and his (...) defence of faith-based schooling. In the second section I uncover the religious motivations behind the Victorian government’s 1950 amendments to the apparently secularist Victorian Education Act of 1872. In section three, I explore the notion of secularism more fully and suggest that the struggle between those who espouse religious instruction in state schools and those who oppose it while advocating a more general form of education about religion is a symptom of a deeper tension between liberalism and communitarianism within the culture of modernist, liberal states. Max Charlesworth, a leading Australian philosopher and ethicist, was born in 1925 in Numurkah, the younger son of William and Mabel Charlesworth.Max obtained his B.A. in 1946 and his M.A. in philosophy in 1948. In 1950, he married Stephanie Armstrong. In the same year, Max was the first recipient of the Mannix scholarship for Catholic students to further their studies overseas. However, having contracted TB, he was forced to spend the next 2 years at the Gresswell Sanatorium.Dissatisfied with (...) what he considered the narrow-minded analytic philosophy he had been taught, Max wanted to study contemporary European philosophy. He took the advice of his professor, Alexander Boyce Gibson, to study at the University of Louvain in Belgium, instead of taking the well-trodden path to Oxford or Cambridge. Max and Stephanie spent 3 years in Louvain, where he was awarded his doctorate ‘avec la plus grande distinction’ in 1955.Max’s first academic post was as a lecturer in philosophy at the Un .. One of the more controversial uses of preimplantation genetic diagnosis (PGD) involves selecting embryos with a specific tissue type so that the child to be born can act as a donor to an existing sibling who requires a haematopoietic stem cell transplant. PGD with HLA tissue typing is used to select embryos that are free of a familial genetic disease and that are also a tissue match for an existing sibling who requires a transplant. Preimplantation HLA tissue typing occurs when (...) parents select embryos that are not at risk of a familial genetic disease to be a match for an existing sibling who requires a transplant. In Victoria, Australia, applications to use PGD with HLA tissue typing are reviewed by the Infertility Treatment Authority on a case by case basis. Preimplantation HLA tissue typing is prohibited prima facie because the embryo to be tested would not be at risk for a genetic abnormality or disease. Arguments for or against the use of PGD/HLA tissue typing are based on several key issues including the commodification and welfare of the donor child. This essay aims to show that that the same arguments apply to both PGD with HLA tissue typing and Preimplantation HLA tissue typing, and that the policy distinction between the two procedures is therefore ethically inconsistent. Max Charlesworth’s Philosophy and Religion: From Plato to Postmodernism is an erudite and scholarly work, grounded in an impressive command of the history of philosophy of religion. However, despite its many virtues, the work has some serious shortcomings, due more to what it overlooks than to what it includes. In this paper, I review Charlesworth’s taxonomy of approaches to philosophy of religion, and argue for an alternative taxonomy that does more justice to the diversity of religions and the (...) evidence produced by social scientific studies of religion. In particular, I suggest that Charlesworth pays insufficient attention to the project of articulating, comparing and assessing competing religious and non-religious worldviews. (shrink)

Maxwell John Charlesworth, cofounder with Graeme E. de Graaff, of Sophia , died suddenly and peacefully at home on the second of June 2014. Born on the thirtieth of December 1925 in Numurkah, Victoria, Max took his MA in Philosophy at the University of Melbourne in 1948. At that time, the Melbourne Department of Philosophy was the preeminent school in Australasia. He married Stephanie Armstrong in 1950. Between 1950 and 1952, he was hospitalized for TB. On his recovery, he (...) studied—1953–1955—at the University of Louvain, where he took his PhD avec la plus grande distinction. He was later to become Visiting Professor at the Katholieke Universiteit Leuven in 1972 and 2006. In 1956, he was appointed to a lectureship at the University of Auckland, New Zealand and returned to a position in his old University of Melbourne in 1959.A man of wide and deep interests, Max worked in the fields of Bioethics and Anthropology, as well as in Philosophy. The Alumni Office at Bradford University has been operating a PC based Alumni System using Dbase III Plus. This system is now breaking down due to the workload being placed upon it and a new system is required. The production of a new system has been undertaken by Martin Charlesworth, Timothy Hodgson and Ioanis Trikukis as an M.Sc. project. This report relates to that project. A system has been produced as a joint effort whereby each team member has produced (...) elements of the whole system. The result has been a system, which while not fuIIy complete, is in a state which can be used by the Alumni Office. The production of the system involved an analysis of the current system, the design of a new system and the implementation of the design. These stages are detailed in this report. The project has met its aims and its organisation has proved to be an effective method of working. (shrink)

The Protestant ethic — a moral code stressing hard work, rigorous self-discipline, and the organization of one's life in the service of God — was made famous by sociologist and political economist Max Weber. In this brilliant study (his best-known and most controversial), he opposes the Marxist concept of dialectical materialism and its view that change takes place through "the struggle of opposites." Instead, he relates the rise of a capitalist economy to the Puritan determination to work out anxiety over (...) salvation or damnation by performing good deeds — an effort that ultimately discouraged belief in predestination and encouraged capitalism. This book is a defense of the methods of analytic philosophy against a recent empirical challenge to the soundness of those methods. The challenge is raised by practitioners of “experimental philosophy” and concerns the extent to which analytic philosophy relies on intuition—in particular, the extent to which analytic philosophers treat intuitions as evidence in arguing for philosophical conclusions. Experimental philosophers say that analytic philosophers place a great deal of evidential weight on people’s intuitions about hypothetical cases and thought experiments. This (...) book argues that this view of traditional philosophical method is a myth, part of “metaphilosophical folklore.” Analytic philosophy makes regular use of hypothetical examples and thought experiments, but philosophers argue for their claims about what is true or not true in these examples and thought experiments. It is these arguments, not intuitions, that are treated as evidence for the claims. The book discusses xphi and some recent xphi studies; critiques a variety of other metaphilosophical claims; examines such famous arguments as Gettier’s refutation of the JTB theory and Kripke’s Gödel Case argument against descriptivism about proper names, and shows that they rely on reasoning rather than intuition; and finds existing critiques of xphi, the “Multiple Concepts” and “Expertise” replies, to be severely lacking. The book "Philosophical Foundations of Neuroscience" is an engaging criticism of cognitive neuroscience from the perspective of a Wittgensteinian philosophy of ordinary language. The authors' main claim is that assertions like "the brain sees" and "the left hemisphere thinks" are integral to cognitive neuroscience but that they are meaningless because they commit the mereological fallacy—ascribing to parts of humans, properties that make sense to predicate only of whole humans. The authors claim that this fallacy is at the heart of Cartesian (...) dualism, implying that current cognitive neuroscientists are Cartesian dualists. Against this claim, we argue that the fallacy cannot be committed within Cartesian dualism either, for this doctrine does not allow for an intelligible way of asserting that a soul is part of a human being. Also, the authors' Aristotelian essentialistic outlook is at odds with their Wittgensteinian stance, and we were unconvinced by their case against explanatory reductionism. Finally, although their Wittgensteinian stance is congenial with radical behaviorism, their separation between philosophy and science seems less so because it is based on a view of philosophy as a priori. The authors' emphasis on the a priori, however, does not necessarily commit them to rationalism if it is restricted to conceptual or analytical truths. (shrink)

Advocates of conceptual engineering as a method of philosophy face a dilemma: either they are ignorant of how conceptual engineering can be implemented, or else it is trivial to implement but of very little value, representing no new or especially fruitful method of philosophizing. Two key distinctions frame this dilemma and explain its two horns. First, the distinction between speaker’s meaning and reference and semantic meaning and reference reveals a severe implementation problem for one construal of conceptual engineering. Second, the (...) distinction between stipulating meanings and conceptually analyzing allows us to see why, on another construal of what conceptual engineering involves, the practice is neither a new nor neglected philosophical methodology. The article also argues that semantic externalism is not the root of the implementation problem for conceptual engineering, and that the usual rationale for adopting the practice, one that ties its value to the amelioration of “conceptual defects”, is unsound. I explore physics implications of the External Reality Hypothesis (ERH) that there exists an external physical reality completely independent of us humans. I argue that with a sufficiently broad definition of mathematics, it implies the Mathematical Universe Hypothesis (MUH) that our physical world is an abstract mathematical structure. I discuss various implications of the ERH and MUH, ranging from standard physics topics like symmetries, irreducible representations, units, free parameters, randomness and initial conditions to broader issues like consciousness, parallel universes and (...) Gödel incompleteness. I hypothesize that only computable and decidable (in Gödel’s sense) structures exist, which alleviates the cosmological measure problem and may help explain why our physical laws appear so simple. I also comment on the intimate relation between mathematical structures, computations, simulations and physical systems. (shrink)

As we increasingly delegate decision-making to algorithms, whether directly or indirectly, important questions emerge in circumstances where those decisions have direct consequences for individual rights and personal opportunities, as well as for the collective good. A key problem for policymakers is that the social implications of these new methods can only be grasped if there is an adequate comprehension of their general technical underpinnings. The discussion here focuses primarily on the case of enforcement decisions in the criminal justice system, but (...) draws on similar situations emerging from other algorithms utilised in controlling access to opportunities, to explain how machine learning works and, as a result, how decisions are made by modern intelligent algorithms or 'classifiers'. It examines the key aspects of the performance of classifiers, including how classifiers learn, the fact that they operate on the basis of correlation rather than causation, and that the term 'bias' in machine learning has a different meaning to common usage. An example of a real world 'classifier', the Harm Assessment Risk Tool (HART), is examined, through identification of its technical features: the classification method, the training data and the test data, the features and the labels, validation and performance measures. Four normative benchmarks are then considered by reference to HART: (a) prediction accuracy (b) fairness and equality before the law (c) transparency and accountability (d) informational privacy and freedom of expression, in order to demonstrate how its technical features have important normative dimensions that bear directly on the extent to which the system can be regarded as a viable and legitimate support for, or even alternative to, existing human decision-makers. Vor dem Hintergrund der Phänomenologie Husserls und in kritisch distanzierender Würdigung der Kantischen Philosophie entwickelt Scheler die Grundlagen der Praktischen Philosophie, indem er die Fülle der menschlichen Wirklichkeit in all ihren Facetten ernst nimmt, um sie zugleich vor dem Hintergrund eines materialen Wertaprioris verständlich zu machen. Die Kritik an formalen Ethikentwürfen und (...) die Zurückweisung von utilitaristischen Ansätzen entwickelt sich vor dem Hintergrund einer subtilen Diskussion des Wertbegriffs, einer höchst differenzierten Analyse der Rangordnung von Werten und einer Phänomenologie der Person, die bis heute einschlägig und wirksam ist. Neben dem Gesamtentwurf besticht die Schelersche Schrift durch feingliedrige phänomenologische Analysen zu einzelnen Fragestellungen, die auch nach einem Jahrhundert nicht an Brisanz verloren haben. Hierzu zählen u.a. die Ausführungen zur Leiblichkeit, die Diskussion der Gefühle oder die Konzeption des Liebesbegriffs. How do people stretch their understanding of magnitude from the experiential range to the very large quantities and ranges important in science, geopolitics, and mathematics? This paper empirically evaluates how and whether people make use of numerical categories when estimating relative magnitudes of numbers across many orders of magnitude. We hypothesize that people use scale words—thousand, million, billion—to carve the large number line into categories, stretching linear responses across items within each category. If so, discontinuities in position and response time (...) are expected near the boundaries between categories. In contrast to previous work that suggested only that a minority of college undergraduates employed categorical boundaries, we find that discontinuities near category boundaries occur in most or all participants, but that accurate and inaccurate participants respond in opposite ways to category boundaries. Accurate participants highlight contrasts within a category, whereas inaccurate participants adjust their responses toward category centers. (shrink)
