The title of the following essay echoes one of Bobbio’s most famous books, and emphasizes one of its main issues: that of providing a “foundation” for the idea of rights. This essay summarizes what Bobbio means by “the age of rights” and presents his principal criticisms of any supposedly “absolute foundation” for rights. In exploring the notion of an age of rights without foundations Bobbio raised a number of crucial issues that effectively anticipated the contemporary debate around problems concerning the (...) historical transformation of rights and the origin of these rights in specific social processes, the deontological status of rights and the connection between rights and duties, the contrast between universalism and relativism, the relationship between different “generations of rights” and social rights, and the international protection of rights in relation to the idea of “institutional pacificism.” To pursue further reflection and enquiry along these lines would be a way of remaining faithful to the spirit of Bobbio’s teaching. But in order to do so it would also be necessary to question some of the methodological assumptions of Bobbio’s work: normativism in the area of jurisprudence, neopositivism in the field of epistemology, and the analytical approach in the history of ideas. This paper offers a critical analysis of two central issues in Luigi Ferrajoli’s Principia iuris , and more generally of his theory of rights. One is the way in which ‘expectations’ play a crucial role in his deontic theory by establishing the logical basis for his guarantee-based conception of law and rights. The axiomatic way in which Ferrajoli arrives at his conception of fundamental rights is questioned, for it fails to give a full account of the nature of subjective rights. (...) The other issues discussed here is Ferrajoli’s own defence of the universality of fundamental rights, and how this is made to depend on a ‘normative technique’ that one can associate with legal discourse and modern law in Western societies. This, however, poses the problem of how this formal universalism can be reconciled with the intercultural dialogue that Ferrajoli also advocates. (shrink)

We reexamine some of the classic problems connected with the use of cardinal utility functions in decision theory, and discuss Patrick Suppes's contributions to this field in light of a reinterpretation we propose for these problems. We analytically decompose the doctrine of ordinalism, which only accepts ordinal utility functions, and distinguish between several doctrines of cardinalism, depending on what components of ordinalism they specifically reject. We identify Suppes's doctrine with the major deviation from ordinalism that conceives of utility functions as (...) representing preference differences, while being non- etheless empirically related to choices. We highlight the originality, promises and limits of this choice-based cardinalism. (shrink)

This book examines phenomenal conservatism, one of the most influential and promising internalist conceptions of non-inferential justification debated in current epistemology and philosophy of mind. It also explores the significance of the findings of this examination for the general debate on epistemic justification. According to phenomenal conservatism, non-inferential justification rests on seemings or appearances, conceived of as experiences provided with propositional content. Phenomenal conservatism states that if it appears to S that P, in the absence of defeaters, S thereby has (...) some justification for believing that P. This view provides the basis for foundationalism and many ordinary epistemic practices. This book sheds new light on phenomenal conservatism by assessing objections to it and examining epistemological merits and advantages attributed to it. In a nutshell, phenomenal conservatism is actually compatible with Bayesian reasoning, and it is unaffected by bootstrapping problems and challenges that appeal to the cognitive penetrability of perception. Nevertheless, appearance-based justification proves unstable or elusive and its antisceptical bite is more limited than expected. These difficulties could be surmounted if phenomenal conservatism were integrated with a theory of inferential justification. The book appeals to scholars and postgraduates in the field of epistemology and philosophy of mind who are interested in the rational roles of appearances. (shrink)

In this paper we focus on transmission and failure of transmission of warrant. We identify three individually necessary and jointly sufficient conditions for transmission of warrant, and we show that their satisfaction grounds a number of interesting epistemic phenomena that have not been sufficiently appreciated in the literature. We then scrutinise Wright’s analysis of transmission failure and improve on extant readings of it. Nonetheless, we present a Bayesian counterexample that shows that Wright’s analysis is partially incoherent with our analysis of (...) warrant transmission and prima facie defective. We conclude exploring three alternative lines of reply: developing a more satisfactory account of transmission failure, which we outline; dismissing the Bayesian counterexample by rejecting some of its assumptions; reinterpreting Wright’s analysis to make it immune to the counterexample. This open access book investigates the role played by identity of proofs in proof-theoretic semantics. It develops a conception of proof-theoretic semantics as primarily concerned with the relationship between proofs (understood as abstract entities) and derivations (the linguistic representations of proofs). It demonstrates that identity of proof is a key both to clarify some —still not wholly understood— notions at the core of proof-theoretic semantics, such as harmony; and to broaden the range of the phenomena which can be analyzed using (...) the tools of this semantic paradigm, so as to include for instance paradoxes. The volume covers topics such as the philosophical significance of different criteria of identity of proofs, and adequacy conditions for an intensional account of the notion of harmony. The author also examines the Prawitz-Tennant analysis of paradoxes by investigating on the one hand the prospects of turning it into a theory of meaning for paradoxical languages, and on the other hand two distinct kinds of phenomena, first observed by Crabbe and Ekman, showing that the Tennant-Prawitz criterion for paradoxicality overgenerates. This chapter has two main sections. In the first section I briefly sketch Immanuel Kant’s moral theory as laid out in his Groundwork of the Metaphysics of Morals (1785). I explain Kant’s claim that morality must be grounded on what he calls a categorical imperative and examine his three formulations of this categorical imperative. In the second section I explain the distinction between “deontological” and “teleological” ethical theories. Kantian ethics is often presented as the paradigm example of a deontological ethical (...) theory, but I question whether Kant’s ethics should be understood as purely deontological. (shrink)

The assumption that coercion is largely responsible for our legal systems’ efficacy is a common one. I argue that this assumption is false. But I do so indirectly, by objecting to a thesis I call “(Compliance)”, which holds that most citizens comply with most legal mandates most of the time at least partly in virtue of being motivated by legal systems’ threats of sanctions and other unwelcome consequences. The relationship between (Compliance) and the efficacy of legal systems is explained in (...) section 1. There I also show that (Compliance) must be rejected for it relies on unsubstantiated empirical assumptions. In section 2, I claim that an alternative, and more refined, formulation of (Compliance) also lacks adequate support. I conclude with a few general remarks about the centrality of coercion in our thought and talk about legal systems. (shrink)

Supra-Bayesianism is the Bayesian response to learning the opinions of others. Probability pooling constitutes an alternative response. One natural question is whether there are cases where probability pooling gives the supra-Bayesian result. This has been called the problem of Bayes-compatibility for pooling functions. It is known that in a common prior setting, under standard assumptions, linear pooling cannot be nontrivially Bayes-compatible. We show by contrast that geometric pooling can be nontrivially Bayes-compatible. Indeed, we show that, under certain assumptions, geometric and (...) Bayes-compatible pooling are equivalent. Granting supra-Bayesianism its usual normative status, one upshot of our study is thus that, in a certain class of epistemic contexts, geometric pooling enjoys a normative advantage over linear pooling as a social learning mechanism. We discuss the philosophical ramifications of this advantage, which we show to be robust to variations in our statement of the Bayes-compatibility problem. (shrink)

In this paper, I present an interpretation of Wittgenstein's remarks on the experience of wonder at the existence of the world. According to this interpretation, Wittgenstein's feeling of wonder stems from perceiving the existence of the world as an absolute miracle, that is, as a fact that is in principle beyond explanation. Based on this analysis, I will suggest that Wittgenstein's experience is akin to what has been described by other authors such as Coleridge, Pessoa, Heidegger, Scheler, Sartre, and Hadot, (...) among many others. Through a comparison between Wittgenstein and Coleridge on the experience of existence, I shall highlight some core features of this experience, chief among them the use of the notion of nothingness in clarifying what is understood in the experience, the role of intuition, and the presence of a specific pathos. As a whole, this paper aims to provide a contribution to the project of a phenomenology of the experience of existence and intends to create a bridge for a dialogue between Wittgenstein and the phenomenological tradition on the enigma of existence. Transmission of justification across inference is a valuable and indeed ubiquitous epistemic phenomenon in everyday life and science. It is thanks to the phenomenon of epistemic transmission that inferential reasoning is a means for substantiating predictions of future events and, more generally, for expanding the sphere of our justified beliefs or reinforcing the justification of beliefs that we already entertain. However, transmission of justification is not without exceptions. As a few epistemologists have come to realise, more or less trivial forms (...) of circularity can prevent justification from transmitting from p to q even if one has justification for p and one is aware of the inferential link from p to q. In interesting cases this happens because one can acquire justification for p only if one has independent justification for q. In this case the justification for q cannot depend on the justification for p and the inferential link from p to q, as genuine transmission would require. The phenomenon of transmission failure seems to shed light on philosophical puzzles, such as Moore's proof of a material world and McKinsey's paradox, and it plays a central role in various philosophical debates. For this reason it is being granted continued and increasing attention. (shrink)

This book explores the diverse understandings of the archaeological record in both historical and contemporary perspective, while also serving as a guide to reassessing current views. Gavin Lucas argues that archaeological theory has become both too fragmented and disconnected from the particular nature of archaeological evidence. The book examines three ways of understanding the archaeological record - as historical sources, through formation theory, and as material culture - then reveals ways to connect these three domains through a reconsideration of archaeological (...) entities and archaeological practice. Phenomenal conservatism (PC) is the internalist view that non-inferential justification rests on appearances. PC’s advocates have recently argued that seemings are also required to explain inferential justification. The most general and developed view to this effect is Huemer (2016)’s theory of inferential seemings (ToIS). Moretti (2018) has shown that PC is affected by the problem of reflective awareness, which makes PC open to sceptical challenges. In this paper I argue that ToIS is afflicted by a version of the same problem (...) and it is thus hostage to inferential scepticism. I also suggest a possible response on behalf of ToIS’s advocates. The Sure-Thing Principle famously appears in Savage’s axiomatization of Subjective Expected Utility. Yet Savage introduces it only as an informal, overarching dominance condition motivating his separability postulate P2 and his state-independence postulate P3. Once these axioms are introduced, by and large, he does not discuss the principle any more. In this note, we pick up the analysis of the Sure-Thing Principle where Savage left it. In particular, we show that each of P2 and P3 is equivalent to a dominance condition; (...) that they strengthen in different directions a common, basic dominance axiom; and that they can be explicitly combined in a unified dominance condition that is a candidate formal statement for the Sure-Thing Principle. Based on elementary proofs, our results shed light on some of the most fundamental properties of rational choice under uncertainty. In particular they imply, as corollaries, potential simplifications for Savage’s and the Anscombe- Aumann axiomatizations of Subjective Expected Utility. Most surprisingly perhaps, they reveal that in Savage’s axiomatization, P3 can be weakened to a natural strengthening of so-called Obvious Dominance. (shrink)

I examine the once popular claim according to which interpersonal comparisons of welfare are necessary for social choice. I side with current social choice theorists in emphasizing that, on a narrow construal, this necessity claim is refuted beyond appeal. However, I depart from the opinion presently prevailing in social choice theory in highlighting that on a broader construal, this claim proves not only compatible with, but even comforted by, the current state of the field. I submit that all in all, (...) the most accurate philosophical assessment consists not in flatly rejecting this necessity claim, but in accepting it in a suitably revised form. (shrink)

This paper intends to address social robotics from the Actor-network theory (ANT) perspective. Starting from the critique of Seibt’s approach and the distinction between anthropomorphing and sociomorphing, the paper proposes a new methodological approach based on ANT and negotiation concepts. This approach allows us to: a) assume a more symmetrical ontology in which robots are considered as social agents, like humans; b) consider all the interactional elements as of equal importance; and c) overcome the dualistic limit that is often imposed (...) on social robotics studies, i.e., the tendency to consider only the one-to-one relationship, one man-one robot, inside the laboratory. Anthropomorphing and sociomorphing are the results of a negotiation process that cannot be reduced to a series of degrees of simulation, but must be understood as a complex interactional process between many agents and material mediations. Psychopaths have emotional and rational impairments that can be expressed in persistent criminal behaviour. UK and US law has not traditionally excused disordered individuals for their crimes citing these impairments as a cause for their criminal behaviour. Until now, the discussion of whether psychopaths are morally responsible for their behaviour has usually taken place in the realm of philosophy. However, in recent years, this debate has been informed by scientific and psychiatric advancements, fundamentally so with the development of Robert Hare's (...) diagnostic tool, the Psychopathy Checklist. Responsibility and Psychopathy explores the moral responsibility of psychopaths. It engages with problems at the interface between law, psychiatry, and philosophy, and is divided into three parts offering relevant interdisciplinary background information to address this main problem. The first part discusses the public policy and legal responses to psychopathy. It offers an introduction to the central practical issue of how public policy should respond to psychopathy, providing insights for those arguing about the responsibility of psychopaths. The second part introduces recent scientific advancements in the classification, description, explanation, and treatment of psychopathy. The central idea behind this paper is the claim that Kant's moral idea of a realm of ends is modeled on the category of community examined in his theoretical works, and that understanding Kant's account of the category of community helps us understand certain features of the idea of a realm of ends, and in particular the fact that a member of a realm of ends must be an autonomous agent. For Kant the idea of a community is essentially the (...) idea of a multitude of individuals in interaction and in this paper I will attempt to show why Kant believes that only autonomous individuals can interact. The representational theory of measurement has long been the central paradigm in the philosophy of measurement. Such is not the case anymore, partly under the influence of the critique according to which RTM offers too poor descriptions of the measurement procedures actually followed in science. This can be called the metrological critique of RTM. I claim that the critique is partly irrelevant. This is because, in general, RTM is not in the business of describing measurement procedures, be it in idealized (...) form. To support this claim, I present various cases where RTM can be said to investigate measurement without providing any measurement procedure. Such limit cases lead to a better understanding of the RTM project. They also illustrate some of the questions which the philosophy of measurement can explore, when it is ready to go beyond the metrological viewpoint. (shrink)

This paper explores the perversion of reality in the context of advanced technologies, such as AI, VR, and AR, through the lens of Jean Baudrillard’s theory of hyperreality and the precession of simulacra. By examining the transformative effects of these technologies on our perception of reality, with a particular focus on the usage of digital avatars, the paper highlights the blurred distinction between the real and the simulated, where the copy becomes more ‘real’ than the original. Drawing on Baudrillard’s concept (...) of hyperreality, the paper delves into the perversion of reality as individuals seek refuge in virtual pleasure paradises and embrace artificial pleasures through their digital avatars, disconnecting from genuine human experiences. The convergence of AI, VR, and AR technologies amplifies this hyperreal condition, where digital avatars mimic or surpass the depth of human relationships, challenging our understanding of what is real. In line with Baudrillard’s theory, the paper explores the objectification and commodification of reality within digital spaces, specifically examining the digital avatars’ role in the erosion of genuine human connections. It explores the implications of these avatars in terms of consent, exploitation, and loss of authenticity, echoing Baudrillard’s concerns about the distortion of reality in contemporary society. Recognizing the implications of these technologies, the paper calls for a critical reflection on their transformative power. It emphasizes the need for a nuanced understanding of the hyperreal condition and ethical responsibility in engaging with AI, VR, and AR, particularly in relation to the usage of digital avatars. By resisting the seductive allure of digital escapism and preserving genuine human connections, we can navigate the perversion of reality and cultivate empathy, compassion, and meaningful interactions that transcend the simulated experiences offered by technology. This paper contributes to the debate on the question of whether a systematic connection obtains between one’s commitment to realism or antirealism and one’s attitude towards the possibility of radical theoretical novelty, namely, theory change affecting our best, most successful theories (see, e.g., Stanford in Synthese 196:3915–3932, 2019; Dellsén in Stud Hist Philos Sci 76:30–38, 2019). We argue that it is not allegiance to realism or antirealism as such that primarily dictates one’s response to the possibility of radical theoretical novelty: (...) what matters the most is, rather, the proposed alternative’s promise to realize one’s favored cognitive aim(s). Our argument tells not only against Stanford’s account of how adherence to realism or antirealism orients how one responds to possible radical theoretical novelty, but also against what we call the “natural pairing thesis.” According to such a thesis, which has kept resurfacing in the history of the philosophy of science, one-to-one pairings obtain between realism/antirealism, on the one hand, and theoretical conservatism/openness to radical theoretical novelty, on the other hand. As our argument suggests, however, when faced with the possibility of radical theoretical novelty, realists can respond either in a conservative way or by being open to theory change, not unlike antirealists. In Richard Bradley’s book, Decision Theory with a Human Face, we have selected two themes for discussion. The first is the Bolker-Jeffrey theory of decision, which the book uses throughout as a tool to reorganize the whole field of decision theory, and in particular to evaluate the extent to which expected utility theories may be normatively too demanding. The second theme is the redefinition strategy that can be used to defend EU theories against the Allais and Ellsberg paradoxes, a strategy (...) that the book by and large endorses, and even develops in an original way concerning the Ellsberg paradox. We argue that the BJ theory is too specific to fulfil Bradley’s foundational project and that the redefinition strategy fails in both the Allais and Ellsberg cases. Although we share Bradley’s conclusion that EU theories do not state universal rationality requirements, we reach it not by a comparison with BJ theory, but by a comparison with the non-EU theories that the paradoxes have heuristically suggested. This paper examines the preference-based approach to the identification of beliefs. It focuses on the main problem to which this approach is exposed, namely that of state-dependent utility. First, the problem is illustrated in full detail. Four types of state-dependent utility issues are distinguished. Second, a comprehensive strategy for identifying beliefs under state-dependent utility is presented and discussed. For the problem to be solved following this strategy, however, preferences need to extend beyond choices. We claim that this a necessary feature (...) of any complete solution to the problem of state-dependent utility. We also argue that this is the main conceptual lesson to draw from it. We show that this lesson is of interest to both economists and philosophers. (shrink)

Deflationists about truth hold that the function of the truth predicate is to enable us to make certain assertions we could not otherwise make. Pragmatists claim that the utility of negation lies in its role in registering incompatibility. The pragmatist insight about negation has been successfully incorporated into bilateral theories of content, which take the meaning of negation to be inferentially explained in terms of the speech act of rejection. We implement the deflationist insight in a bilateral theory by taking (...) the meaning of the truth predicate to be explained by its inferential relation to assertion. We combine this account of the meaning of the truth predicate with a new diagnosis of the liar paradox: its derivation requires the truth rules to preserve evidence, but these rules only preserve commitment. The result is a novel inferential deflationist theory of truth, which solves the liar paradox in a principled manner. We end by showing that our theory and simple extensions thereof have the resources to axiomatize the internal logic of several supervaluational hierarchies, including Cantini’s. This solves open problems of Halbach (2011) and Horsten (2011). (shrink)

In this chapter I shall address the question as to whether there exists a universal and atemporal justification for the claims made by a community that adopts a particular style of reasoning. I shall present a case study in which a claim made in the laboratory style of reasoning has no universal and atemporal justification. As I shall explain, Hacking justifies his belief that unobservable entities exist on the ground that they can be regularly manipulated by experimenters in order to (...) find out and produce various phenomena (experimental realism); he also maintains that no belief that our theories are true is required in order to be realist about unobservable entities. I shall argue that his justification is relative to the laboratory style of reasoning. Ultimately, from this case study I shall draw the important conclusion that the styles of reasoning project implies epistemic relativism. In the first part of this chapter, I shall analyse Hacking’s experimental realism in the light of the styles of reasoning project. I shall start by making these points: Hacking’s theory anti-realism denies the possibility of ranking styles of reasoning in terms of their capacity to explain phenomena; furthermore, Hacking is not successful in showing that his entity realism is justified for a community that does not adopt the laboratory style of reasoning. It will follow that the styles of reasoning project is in conflict with the claim that we know about unobservable entities. (shrink)

The basic axioms or formal conditions of decision theory, especially the ordering condition put on preferences and the axioms underlying the expected utility formula, are subject to a number of counter-examples, some of which can be endowed with normative value and thus fall within the ambit of a philosophical reflection on practical rationality. Against such counter-examples, a defensive strategy has been developed which consists in redescribing the outcomes of the available options in such a way that the threatened axioms or (...) conditions continue to hold. We examine how this strategy performs in three major cases: Sen's counterexamples to the binariness property of preferences, the Allais paradox of EU theory under risk, and the Ellsberg paradox of EU theory under uncertainty. We find that the strategy typically proves to be lacking in several major respects, suffering from logical triviality, incompleteness, and theoretical insularity. To give the strategy more structure, philosophers have developed “principles of individuation”; but we observe that these do not address the aforementioned defects. Instead, we propose the method of checking whether the strategy can overcome its typical defects once it is given a proper theoretical expansion. We find that the strategy passes the test imperfectly in Sen's case and not at all in Allais's. In Ellsberg's case, however, it comes close to meeting our requirement. But even the analysis of this more promising application suggests that the strategy ought to address the decision problem as a whole, rather than just the outcomes, and that it should extend its revision process to the very statements it is meant to protect. Thus, by and large, the same cautionary tale against redescription practices runs through the analysis of all three cases. A more general lesson, simply put, is that there is no easy way out from the paradoxes of decision theory. (shrink)

Aiming to answer the need for a more systematic investigation, the articles here collected approach Christian readings of the Stagirite|s works from different perspectives. Setting aside abstract discussions about |degrees of orthodoxy|, they address a few specific questions: which |images| of Aristotle were offered by Medieval and Renaissance interpreters, and in particular how (...) did some of them argue that - far from being a pagan or even an impious thinker - he did not contradict the truths revealed by Holy Scripture? It is widely held that under ordinal utility, utility differences are ill-defined. Allegedly, for these to be well-defined (without turning to choice under risk or the like), one should adopt as a new kind of primitive quaternary relations, instead of the traditional binary relations underlying ordinal utility functions. Correlatively, it is also widely held that the key structural properties of quaternary relations are entirely arbitrary from an ordinal point of view. These properties would be, in a nutshell, the hallmark of (...) cardinal utility. While much is obviously true in these two tenets, this note explains why, as stated, they should be abandoned. Any ordinal utility function induces a rich quaternary relation. There is such a thing as ordinal utility differences. Furthermore, this induced quaternary relation respects, apart from completeness, the most standard structural properties of quaternary relations. These properties are, from an ordinal point of view, anything but arbitrary; from a quaternary perspective only completeness should be considered the hallmark—if any—of cardinal utility. These facts are explained to be especially relevant to the critical appreciation of the ordinalist methodology. (shrink)

A young Canadian mathematician and philosopher, Winthrop Bell, who was Edmund Husserl's first doctoral student from North America, taught as a postdoc at Harvard in the 1920s, where he took a complete set of notes in the first class at Harvard taught by Alfred North Whitehead during the 1924-1925 academic year. These notes, missing for over 80 years, have recently been found. The notes transform scholarship concerning the early development of Whitehead's mature metaphysical views, while the note-taker's own career illuminates (...) a remarkable collaboration between the pragmatists in the U. S. and Canada and the early phenomenology movement in Europe, an intellectual exchange that was shattered during the tumultuous events of World War I and its aftermath. (shrink)

This paper develops a hermeneutic technology assessment of quantum technologies. It offers a “vision assessment” of quantum technologies that can eventually lead to socio-ethical analysis. Section 2 describes this methodological approach and in particular the concept of the hermeneutic circle applied to technology. Section 3 gives a generic overview of quantum technologies and their impacts. Sections 4 and 5 apply the hermeneutic technology assessment approach to the study of quantum technologies. Section 5 proposes distinguishing three levels in the analysis of (...) the creation and communication of social meanings to quantum technologies: (a) fictions, (b) popularization, and (c) scientific journalism. Section 6 analyzes the results and defines some lines of action to increase social acceptance and trust in quantum technologies. The aim of this paper is to contribute to the debate on quantum technologies by enhancing the reflection on them and their potential, as well as illustrating the complexity of technological innovation and the need to shape it. Lo studio della personalità umana ha impegnato, per lungo tempo, la riflessione di Habermas non solo perché egli interessato a indagare l’apporto delle funzioni soggettive al processo di riproduzione simbolica delle altre componenti del mondo vitale e, viceversa, come queste forniscano il contesto socio-culturale dell’ontogenesi. Il confronto con l’epistemologia genetica di Piaget, Kohlberg e Selman, la psicologia sociale di Mead e la psicoanalisi freudiana dischiude, soprattutto, l’orizzonte interpretativo all’interno dal quale Habermas ricercava un modello per la configurazione metodologica delle scienze (...) sociali in una prospettiva ricostruttiva. Questa è la ragione fondamentale per cui è opportuno interessarsi al tentativo habermasiano di applicare il modello ricostruttivo nel campo della teoria della socializzazione. (shrink)
