Artificial intelligence systems advising healthcare professionals will be widely introduced into healthcare settings within the next 5–10 years. This paper considers how this will sit with tort/negligence based legal approaches to compensation for medical error. It argues that the introduction of AI systems will provide an additional argument pointing towards no-fault compensation as the better legal solution to compensation for medical error in modern health care systems. The paper falls into four parts. The first part rehearses the main arguments for (...) and against no-fault compensation. The second explains why it is likely that AI systems will be widely introduced. The third part analyses why it is difficult to fit AI systems into fault-based compensation systems while the final part suggests how no-fault compensation could provide a possible solution to such challenges. The thesis of this article is that an attitude akin to pragmatism is internal to the scientific enterprise itself, and as a result many scientists will make the same types of non-essentialistic interpretations of their subject matter that are made by pragmatists. This is demonstrably true with respect to those scientists who study the biological basis of emotion such as Panksepp, LeDoux, and Damasio. Even though these scientists are also influenced by what cognitive psychologists call the essentialist bias, their research (...) programs are coherent with Peter Zachar?s rejection of natural kinds in favor of practical kinds. When the confrontation with complexity leads a scientist to offer non-essentialist interpretations, two popular options are to go eliminativist or go nominalist. Pragmatists prefer the nominalistic option, and we provide reasons for suggesting that scientists should as well. (shrink)

A theory of human origins that is one-half Charles Darwin and one-half Cain and Abel is bound to entail a lot of rethinking of traditional themes. Rene Girard's thesis of original human violence and the Bible's power to reveal it has been around for more than a generation, but its consequences for Christian theology are still only slowly being unpacked. Anthony Bartlett's book makes a signal contribution, representing an astonishing leap forward in understanding what a biblical disclosure of founding (...) violence means for Christian thought and life. If human language arose directly out of the primal experience of murder, then semiotics becomes a core area for theological examination. Tracing the discipline of semiotics through postmodern thinkers, then back through its birth in the Latin era, Bartlett shows how Girard's thought is itself a semiotic emergence, beyond standard Christian metaphysics. This book presents translations of three dialogues Xenophon devoted to the life and thought of his teacher, Socrates. Each is accompanied by notes and an interpretative essay that will introduce new readers to Xenophon and foster further reflection in those familiar with his writing. "Apology of Socrates to the Jury" shows how Socrates conducted himself when he was tried on the capital charge of not believing in the city's gods and corrupting the young. Although Socrates did not secure his own (...) acquittal, he profoundly impressed some listeners who then helped to shape the public perception of philosophy as a noble, if highly idiosyncratic, way of life. In "Oeconomicus," Xenophon relates the conversation Socrates had on the day he turned from the study of natural philosophy to that of moral and political matters. "Oeconomicus" is concerned most directly with the character and purpose of Socrates' political philosophy. Xenophon provides entertaining portraits of Socrates' circle of friends in the "Symposium." Hundreds of evaluative studies of psychotherapy still leave the issue of its effectiveness unsettled. The author argues that such studies have ignored the major determinant of therapeutic effectiveness, the role of a patient’s belief in the successful outcome in therapy. Psychiatrist Thomas Szasz, one of the foremost critics of psychiatry, wrote of this paper: "It is one of the best, if not the best, that I have read on this subject.” It makes little sense to claim that a certain therapy (...) is effective or ineffective in itself; rather, there is a relation of mutual interaction among three terms: a patient’s ability to learn in a psychological context, a therapist’s ability to teach, and the capacity of an approach to therapy to engender in the patient the necessary belief in its effectiveness. -/- The paper is followed by a 4-page 2014 Afterword. Currently, there is no consensus guideline as to the type or degree of donor steatosis considered acceptable for liver transplantation, and little is known about local practices in this area. The aim of this survey (...) was to evaluate current clinical practices amongst liver transplant surgeons in Australia and New Zealand in the evaluation and use of steatotic donor livers in LT.Methods: An anonymous online twelve-question survey was emailed to all practicing LT surgeons in ANZ in January 2010.Results: The response rate was 83%. Estimated prevalence of steatosis in donor livers was between 40% and 60%. In determining suitability for LT, 90% of respondents reported rejecting organs with "severe" steatosis based on visual and palpation grounds alone. A total of 68% sought further histological assessment if the donor liver looked bad and there were risk factors for steatosis. The majority of respondents performed only one biopsy of the liver, using hematoxylin and eosin staining for fat assessment. There was wide variation in the upper limit of steatosis considered to be acceptable for LT. A total of 21% of respondents still considered microvesicular steatosis a risk factor for primary graft nonfunction.Conclusion: This survey highlights the significant variation in the appraisal and use of steatotic grafts by LT surgeons in ANZ. The twisting paths revealed by these may one day be found to unite into a broad road, but most of them have as yet been insufficiently explored. Certainly problems in the psychology of temporal perception seem to lie in many different directions, according to the ways in which (...) they are approached. It would be possible, for instance, to take the mass of experimental work, always patient, sometimes brilliant, which has had a fairly continuous history since Czermak, in 1857, building upon Weber's researches into space perception, planned and began to carry out a programme for an investigation of the estimation of short time intervals. We contend that Noë and Thompson's arguments leave both the minimal substrate thesis and the (considerably stronger) matching-content doctrine unscathed. We construe their arguments as each having the form of a modus tollens as follows: (1) If the matching-content doctrine is true, then Q; (2) It is not the case that Q; therefore, (3) The matching-content doctrine is false. We show that in each case, Noë and Thompson fail to cite any Q such that both premises are true.

Background More than one in 10 of all prisoners in England and Wales are Foreign Nationals. This article discusses whether the research applications to one London prison are aimed at understanding a prisoner population characterised by significant multinational and multilingual complexity. Methods We studied all accessible documents relating to research undertaken at a women's prison between 2005 and 2009 to assess the involvement of Foreign National prisoners and women with limited English. The source of information was prison research applications and (...) protocols. We also looked at available final research reports and journal articles. Results Two key findings emerged from this study. First, studies at this prison frequently excluded Foreign National prisoners and women with limited English. Second, Foreign National prisoners were often clustered as a homogeneous category in the research reports reviewed. This is despite their diverse cultural backgrounds, their variable immigration status and their differing competence in English, all of which affect their lives. Conclusions The failure to include and/or identify social subgroups of the population can undermine the value of research, including, in the case of the study prison, funded health research. This can compromise associated needs assessments and service delivery, particularly important in already disadvantaged populations; this may encourage and/or perpetuate a range of health inequalities. There is a pressing need to examine cultural exclusion in other health and criminal justice settings, to assess the ways in which—and the extent to which—such exclusion may compromise the merit of proposed and completed health and social research. There has been considerable recent interest in the consequences of closed timelike curves (CTCs) for the dynamics of quantum mechanical systems. A vast majority of research into this area makes use of the dynamical equations developed by Deutsch, which were developed from a consistency condition that assumes that mixed quantum states uniquely describe the physical state of a system. We criticize this choice of consistency condition from an epistemic perspective, i.e., a perspective in which the quantum state represents a state (...) of knowledge about a system. We demonstrate that directly applying Deutsch’s condition when mixed states are treated as representing an observer’s knowledge of a system can conceal time travel paradoxes from the observer, rather than resolving them. To shed further light on the appropriate dynamics for quantum systems traversing CTCs, we make use of a toy epistemic theory with a strictly classical ontology due to Spekkens and show that, in contrast to the results of Deutsch, many of the traditional paradoxical effects of time travel are present. Normality Does Not Equal Mental Health: The Need to Look Elsewhere for Standards of Good Mental Health is the first book to question the equation of psychological normality and mental health. We are perpetually confined within the horizons of our conceptual structure. When this structure grows or expands, the breadth of our comprehensions enlarges, but we are forever barred from the wished-for glimpse beyond its boundaries, no matter how hard we try, no matter how much credence we invest in the substance of our learning and mist of speculation. -/- (...) The limitations in view here are not due to the mere finitude of our understanding of ourselves and of the world in which we live. They are limitations that come automatically and necessarily with any form of understanding. They are, as we shall see, part and parcel of any organization or ordering of data that we call information. -/- The consequences of these limitations are varied: As a result of them, hermeneutics cannot help but be hermetic; scientific theories of necessity are circumscribed by the boundaries of the ideas that define them; formal systems must choose between consistency and comprehensiveness; philosophical study, because it includes itself within its own proper subject matter, is forced to be reflexive in its self-enclosure. Michael Burroughs and Deborah Tollefsen (2016) claim that children are subject to widespread testimonial injustice. They argue that empirical data shows that children are prejudicially accorded less epistemic credibility in forensic contexts, and that this in turn shows that the same is true in broader contexts. While I agree that there is indeed testimonial injustice against children, I argue that Burroughs and Tollefsen exaggerate its severity and extent, by exaggerating children’s testimonial reliability. Firstly, the empirical data do not quite support (...) their claim about children’s performance in forensic contexts. Secondly, while they advocate a relational conception of children’s agency which emphasizes the role of adults in realizing their testimonial abilities, Burroughs and Tollefsen miss the full implications of such a conception for our evaluation of children’s credibility, and for our behavior towards them in testimonial contexts. Thirdly, they underestimate the significance of children’s limited general knowledge. (shrink)

Philosophers have not resisted temptation to transgress against the logic of their own conceptual structures. Self-undermining position-taking is an occupational hazard. Philosophy stands in need of conceptual therapy. The author describes three conceptions of philosophy: the narcissistic, disputatious, and therapeutic. (i) Narcissistic philosophy is hermetic, believing itself to contain all evidence that can possibly be relevant to it. Philosophy undertaken in this spirit has led to defensive, monadically isolated positions. (ii) Disputatious philosophies are fundamentally question-begging, animated by assumptions that philosophical (...) adversaries reject. (iii) The intention of therapeutic philosophy is to study philosophical positions from the standpoint of their internal consistency, or lack of it. In particular, its interest is in positions that either compel assent, because they cannot be rejected without self-referential inconsistency, or self-destruct because self-referential inconsistency cannot be avoided. The article's focus is on the latter. Several examples of self-undermining positions are drawn from the history of philosophy, exemplifying two main varieties of self-referential inconsistency: pragmatical and projective. (shrink)

Several recent authors have argued that children are subject to testimonial injustice in the same way as are women, Blacks, and several other social identity groups. Testimonial injustice is standardly conceptualized, following Miranda Fricker’s seminal account, as a wrongful credibility deficit. I argue that this concept of testimonial injustice is too narrow to capture testimonial injustice against children. There is good reason to think that children are less reliable testifiers than adults, so it is not necessarily wrong to assign a (...) credibility deficit to a child speaker, in the way it is wrong in the case of a female or black speaker. However, I argue that children are nevertheless subjected to testimonial injustice. Testimonial injustice against children is constituted primarily by a failure to actively inquire into assertions by children — that is, by a failure to patiently and reflectively engage in discourse with the child to discover what they may know. A short paper presented before the Fellows of the Center for the Study of Democratic Institutions during the academic year 1969-70, with an Introductory Note written nearly 50 years later. The paper describes the author's enduring personal philosophical precept; it is also an implicit encomium to individuals whose psychology establishes a dependable bridge between their rational convictions and their conduct.

This paper marks a juncture between the author’s studies in phenomenology and the transition he made to a study of what he has called a “metalogic of reference.” Published in 1974 in Polish translation, followed by its publication in English in 1975, “Phenomenology of the Implicit” describes the author’s “translation schema” that permits certain of the central goals of Husserlian transcendental philosophy to be transposed to a framework that studies the preconditions of valid reference. The result of this translation was (...) the development of the author’s “de-projective” approach to phenomenology, which he later dissociated from phenomenology in the form of a pure metalogic of reference. -/- The paper examines the phenomenological understanding of pre‐reflective awareness, of reflection, and of their interrelation. To this end, attention is paid to preconditions of reference that are entailed by the phenomenological distinction between implicit experience and explicit reflection. (shrink)

This essay discusses Nock’s theory of American education and finds that certain of these assumptions stand greatly in need of the support of evidence.
