This paper describes the nature of aesthetic judgments and the justifications that underpin these, with a particular focus on the theory of aesthetics set out by Kant in the Critique of Judgment. It argues that judgments of self often take the form of aesthetic judgments, that such judgments are prevalent in the psychotherapeutic discourse, and that this has major implications for the type of dialogue that is required in therapy. Such a dialogue shares many of the characteristics of art criticism, (...) but may be supported by scientific empiricism. Recent research on the interaction between emotion and cognition is reviewed and implications for therapeutic change are discussed. The paper concludes that aesthetic philosophy provides a common ground for emotion, cognition, ethics, and a sense of the meaningfulness of life. (shrink)

This book is aimed primarily at the practitioners of morals such as psychiatrists,lawyers and policy-makers. My professional background is clinical psychiatry It is divided into three parts. The first of these provides an overview of moral theory, morality in non-human species and recent developments in neuroscience that are of relevance to moral and legal responsibility. In the second part I offer a new paradigm of free action based on the overlaps between free will, moral value and art. In the overlap (...) between free will and moral value we find moral responsibility and moral autonomy. Free will and art share characteristics of originality, spontaneity and creativity. Art and moral value are related by way of the moral content of art and the formal similarities of moral and aesthetic judgments. In the overlap between art, free will and moral value we find religious belief, the creation of moral value and the creation of moral identity. In the third part, I discuss the application of these ideas to common clinical conditions such as eating disorders, addictions, personality disorders, post-traumatic stress disorder and the dissociative disorders. Wherever possible, I illustrate the points that are made with real-life clinical examples. I finish by considering how ideas of free will and responsibility are relevant to psychotherapy. (shrink)

This paper is published as part of special issue on the theme of ‘justice without retribution’. Any attempt to consider how justice may be achieved without retribution has to begin with a consideration of what we mean by justice. The most powerful pleas for justice usually come from those who feel that they have been harmed by the wrongful acts of others. This paper will explore this intuition about justice and will argue that it arises from the central importance of (...) reciprocity, in the form of equity, balance and fairness, in human relationships. This is expressed in our image of justice, one of whose core symbols is a set of scales. I will use a clinical case to illustrate what can happen when criminal harm is not followed by any form of restitution. In this case, the punitive impulse was internalised in the victim and turned against herself in the form of deliberate self harm and, ultimately, death by suicide. I will argue that human relationships largely consist of reciprocal acts of good or harm and that we constantly strive for a balanced reciprocity in our relationships with others. This theme has been played out throughout human history in personal relationships, social customs, legal systems, religion and culture. It is also seen in higher primates. When someone is a victim of wrongful harm, there is a need to take measures to restore the balance which has been lost. I will attempt to draw a distinction between retributivism as the term is usually understood and the application of the principle of reciprocity in criminal justice. This distinction is one that has found expression in what has become known as ‘restorative justice’ as opposed to conventional justice. There are two cardinal features of restorative justice in this context. The first is that it brings offender and victim into a relationship with the aim of repairing the harm that has been caused. The second is that it gives the offender the opportunity to give something back to his victim. I will conclude that our responses to criminal wrong-doing should be based on restorative principles and that punishment can sometimes be part of the process by which moral harm is made good. For much of this century, philosophers hoped that Einstein’s general theory of relativity would play the role of physician to philosophy. Its development would positively influence the philosophy of methodology and confirmation, and its ontology would answer many traditional philosophical debates—for example, the issue of spacetime substantivalism. In physics, by contrast, the attitude is increasingly that GTR itself needs a physician. The more we learn about GTR the more we discover how odd are the spacetimes that it allows. Not only (...) does GTR permit singularities, naked and clothed, but it allows time travel, topology change, and event and particle horizons, to name but a few of these oddities. Rather than revel in the riches of the theory, however, many physicists seek to rule out one or more of the above “pathologies” on the grounds that they are “physically unreasonable.” Thus contemporary researchers hawk various “cures” for the “illnesses” of GTR: among them, Chronology Protection to ensure against time travel, Cosmic Censorship for naked singularities, Inflation for horizons, and so on. The physics of these illnesses and cures, and the problems they engender, are the source of much controversy in the physics literature. Philosophers have largely neglected it. But clearly the subject needs philosophers of physics to determine whether the patient is genuinely ailing, and if so, to sift the real antidotes from the snake oil. (shrink)

Sadler Keywords aesthetics, psychiatry, psychotherapy, Sibley In his wide-ranging survey of how Kantian aesthetic theory is implicated in psychothera-py, John Callender has raised at least a dozen potentially profound and rewarding possibilities in applying aesthetic theory to psychiatry and psychotherapy. Although the idea of marrying aesthetic theory to psychiatry (...) and psychotherapy is not new, Callender's direction of the merger is distinctively novel. The mid-twentieth century had a distinct literature in applying psychoanalytic and psychiatric theory to aesthetic experience, summarized by the sizable bibliography by Norman Kiell, Psychiatry and Psychology in the Visual Arts and Aesthetics: A Bibliography (1965). This line of interdisciplinary work influenced a later generation of art historians and literary theorists in applying (particularly) psychoanalytic theory to interpretation and appreciation of the arts, contributions that are still being developed today, along with the emergence of complementary viewpoints from cognitive neuroscience (Peretz and Zatorre 2003; Rose 2004; Zeki 1999). Callender's project, however, is quite the converse—he wishes to show how philosophical aesthetics can contribute to psychiatry and clinical psychology. Exploring the aesthetics of psychiatry is the innovation.Before focusing my own comments on a few of Callender's points, I wish to call attention to the substantive questions he has directly raised or implied by his discussions. These questions are worthy of further development in this and other journals, and I hope that Callender will succeed in engaging the minds of his readers and inspire them to work in this exciting area in the philosophy of psychiatry. In his elegant review of Kant's key theoretical points of aesthetics, his discussion provokes us to consider the kinds of evaluations that patients make of themselves (moral? aesthetic? others?), as well as the kinds of evaluations clinicians make in their judgments of psychopathology. Evolutionists may wonder about the adaptive significance of aesthetic capacities (e.g., derivatives of grooming? mating displays?). In presenting Kant's notion of "disinterestedness" or contemplative judgment, readers may wonder about overlap with notions of therapist neutrality and unconditional positive regard. Should therapist relationships with patients be dominated by a similar aesthetic sensibility? What does the aesthetic posture have to do with the therapist posture?Importantly, Callender notes the connections and ambiguities between moral values and aesthetic values. This is borne out in his later discussions of clinical case material (considered again below). He focuses primarily on the duplication of aesthetic and moral values in the same terms of praise (honesty, integrity, originality), but there is no question that aesthetic experiences are had by viewers of art exhibiting perverse or depraved [End Page 307] imagery (consider, for instance, Francis Bacon's "3 Screaming Popes" or, even more extremely, the grotesque staged photographs of Joel-Peter Witkin). The implication here is that (as an example) to understand the aesthetics of sadomasochistic art may help us to understand the psychology of sadomasochistic people.By the time he introduces his case material, Callender has raised the issue of intersubjectivity in aesthetic experience, an experience that may be devoid of discursive cognitive content but may be profound with emotional content, thus challenging tenets of cognitive psychology and psychotherapy. His discussion of cases reflecting elements of Kant's components of aesthetic judgment point toward new ways of understanding psychopathology as disturbances in aesthetic self-appraisal.I would like to return to the problem of moral and aesthetic judgments in psychotherapy and in psychopathology. Dr. Callender presents three cases—a woman who has been traumatized by multiple instances of sexual abuse, a young girl with postpartum depression with fears of losing her child because of bad mothering, and a third patient with anorexia nervosa who demonstrates the typically distorted body self-image. I suggest that the aesthetic nature of these patients' self-judgments is not so clear cut as Callender suggests. His sexual abuse case summary certainly suggests a woman consumed by shame. Here we ask what justifies taking these approximations and show that time seems to sneak in when answering this question. Diversity is a fact of the social world; however, it can also be a problem if it leads to the valorisation of ethnic or racial identities. The social structures that inform the problems that arise from differences are based on historical, geographical, social, political, and economic stratifications; as well as on thought paradigms that either explicitly or implicitly promote the proliferation of binaries between “us and them”. We argue that an uncritical uptake of the African philosophy of ubuntu may inadvertently (...) support negative identity binaries. Particularly, we argue that a conception of ubuntu premised on unity is – paradoxically – in danger of fostering disunity between communities. In place of “unity”, we explore, and argue for, an interpretation of ubuntu premised on “relationality”. Specifically, we argue that “relationality” is capable of incorporating both identity and difference. (shrink)

Democratic theorists often place deliberative innovations such as citizen's panels, consensus conferences, planning cells, and deliberative polls at the center of their hopes for deliberative democratization. In light of experience to date, the authors chart the ways in which such mini-publics may have an impact in the “macro” world of politics. Impact may come in the form of actually making policy, being taken up in the policy process, informing public debates, market-testing of proposals, legitimation of public policies, building confidence and (...) constituencies for policies, popular oversight, and resisting co-option. The idea that technologies can change moral beliefs and practices is an old one. But how, exactly, does this happen? This paper builds on an emerging field of inquiry by developing a synoptic taxonomy of the mechanisms of techno-moral change. It argues that technology affects moral beliefs and practices in three main domains: decisional (how we make morally loaded decisions), relational (how we relate to others) and perceptual (how we perceive situations). It argues that across these three domains there are (...) six primary mechanisms of techno-moral change: (i) adding options; (ii) changing decision-making costs; (iii) enabling new relationships; (iv) changing the burdens and expectations within relationships; (v) changing the balance of power in relationships; and (vi) changing perception (information, mental models and metaphors). The central dogma of biology holds that genetic information normally flows from DNA to RNA to protein. As a consequence it has been generally assumed that genes generally code for proteins, and that proteins fulfil not only most structural and catalytic but also most regulatory functions, in all cells, from microbes to mammals. However, the latter may not be the case in complex organisms. A number of startling observations about the extent of non-protein-coding RNA (ncRNA) transcription in the higher eukaryotes (...) and the range of genetic and epigenetic phenomena that are RNA-directed suggests that the traditional view of the structure of genetic regulatory systems in animals and plants may be incorrect. ncRNA dominates the genomic output of the higher organisms and has been shown to control chromosome architecture, mRNA turnover and the developmental timing of protein expression, and may also regulate transcription and alternative splicing. This paper re-examines the available evidence and suggests a new framework for considering and understanding the genomic programming of biological complexity, autopoletic development and phenotypic variation. Developments in the democratic theory of representation and deliberation enable renewed consideration of the ancient controversy over the proper place of rhetoric in politics. Rhetoric facilitates the making and hearing of representation claims spanning subjects and audiences divided in their commitments and dispositions. Deliberative democracy requires a deliberative system with multiple components whose linkage often needs rhetoric. Appreciation of these aspects of democracy exposes the limitations of categorical tests for the admissibility of particular sorts of rhetoric. Prioritization of bridging over (...) bonding rhetoric is a step in the right direction, while sometimes producing misleading results. A better systemic test asks whether or not rhetoric promotes an effective deliberative system linking competent and reflective actors. (shrink)

The theory of deliberative democracy is here furthered in terms of three images that locate its essence in respectively a single forum, a deliberative system, and an encompassing polity featuring particular integrative norms. The first two are ubiquitous, though contested, the third is stated here. Deliberative theorists need to contemplate how practices that make sense in each image connect to the other two. Forums only make sense when linked in a system that can synthesize very different deliberative virtues. Any system’s (...) democratic qualities can only be evaluated in terms of the polity. While judgment in terms of the conditions of normative integration in the polity is therefore primary, particular forums can promote deliberative authenticity in a system, and systems enable inclusive application of deliberative ideals.
