This new book takes an innovative and novel approach to the study of jurisprudence. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

In this paper I take issue with and argue against a certain subordination of the political to the legal that, I argue, is advanced under theories or ‘republican constitutionalism’ and undertake a defense of the political as ‘reflexive’. In republican constitutionalism one discerns an ‘imperialistic’ legal move to set the terms of political discourse, as political conflicts in order to be legally resolved are forced to meet criteria of legal relevance: in the process much that is vital to political action, (...) its understanding and undertaking, is suppressed, elided or appropriated. I argue against the purported ‘containment’ of politics in law and for a ‘reflexivity’ that is constitutive of politics, re-introducing contingency and selfreference (‘what is political can only be a political question’) at the heart of what it means to act politically. The introduction looks at the constitutional situation in Chile since the demand for a new Constitution erupted in demonstrations all across the country, and argues that the notion of ‘constitutional moment’ is inadequate to capture the radicality of the popular mobilisation that is sweeping the country as a pure expression of constituent power.

International Mindedness (IM) has become an underpinning philosophy of the International Baccalaureate and schools which adopt its programmes. However, the concept of IM is relevant to any school that offers international education given its potential and importance to drive the school’s mindset and mission. The international school market has grown significantly in terms of the number of schools and their diversity. Increasing in popularity are schools that follow the British-based International General Certificate of Secondary Education (IGCSE) and A-level programmes. Moreover, (...) the dgreatest expansion of international schools is now occurring in local markets, in which students are no longer predominantly expatriates but come from the host countries. This study explores the concept of international mindedness in six international schools in Cyprus. Based on data collected from headteachers and teachers, we argue that international mindedness is applicable in various contexts of international schooling and that factors other than the curriculum can affect its development within a school. This volume is devoted to exploring a subject which, on the surface, might appear to be just a trending topic. In fact, it is much more than a trend. It relates to an ancient, permanent issue which directly connects with people's life and basic needs: the recognition and protection of individuals' dignity, in particular the inherent worthiness of the most vulnerable human beings. The content of this book is described well enough by its title: 'Human Dignity of the Vulnerable in (...) the Age of Rights'. Certainly, we do not claim that only the human dignity of vulnerable people should be recognized and protected. We rather argue that, since vulnerability is part of the human condition, human vulnerability is not at odds with human dignity. To put it simply, human dignity is compatible with vulnerability. A concept of human dignity which discards or denies the dignity of the vulnerable and weak is at odds with the real human condition. Even those individuals who might seem more skilled and talented are fragile, vulnerable and limited. We need to realize that human condition is not limitless. It is crucial to re-discover a sense of moderation regarding ourselves, a sense of reality concerning our own nature. Some lines of thought take the opposite view. It is sometimes argued that humankind is - or is called to be - powerful, and that the time will come when there will be no vulnerability, no fragility, no limits at all. Human beings will become like God (or what believers might think God to be). This perspective rejects human vulnerability as in intrinsic evil. Those who are frail or weak, who are not autonomous or not able to care for themselves, do not possess dignity. In this volume it is claimed that vulnerability is an inherent part of human condition, and because human dignity belongs to all individuals, laws are called to recognize and protect the rights of all of them, particularly of those who might appear to be more vulnerable and fragile. Empirical studies have revealed a disturbing prevalence of research misconduct in a wide variety of disciplines, although not, to date, in the areas of ethics and philosophy. This study aims to provide empirical evidence on perceptions of how serious a problem research misconduct is in these two disciplines in Spain, particularly regarding the effects that the model used to evaluate academics’ research performance may have on their ethical behaviour. The methodological triangulation applied in the study combines a questionnaire, a debate (...) at the annual meeting of scientific association, and in-depth interviews. Of the 541 questionnaires sent out, 201 responses were obtained, with a significant difference in the participation of researchers in philosophy and in ethics ; 26 researchers took part in the debate and 14 interviews were conducted. The questionnaire results reveal that 91.5% of the respondents considered research misconduct to be on the rise; 63.2% considered at least three of the fraudulent practices referred to in the study to be commonplace, and 84.1% identified two or more such practices. The researchers perceived a high prevalence of duplicate publication and self-plagiarism, use of personal influence and citation manipulation, in contrast to a low perceived incidence of data falsification or fabrication. The debate and the interviews corroborated these data. Researchers associated the spread of these misconducts with the research evaluation model applied in Spain. (shrink)

In the city of Elche, every year, on the 14th and 15th of August, a sacred musical play about the death, the Assumption and the Coronation of the Virgin Mary is held. This event, known as the “Misterio de Elche”, is unique in the world. Since the middle of the 15th century it has been performed in the Basilica of Santa Maria and in the streets of the ancient city of Elche, located in the Valencian Community. In this work, classified (...) as a UNESCO World Heritage Site, the interior of the temple is transformed into 2 main stages, the scaffold, located in the lower part, and the aerial stage, located in the dome at a height of 27 m. The structure and the traction mechanisms located on the aerial stage allow the aerial devices that take part in the play, “El Araceli”, “La Mangrana” and “La Santísima Trinidad”, to be raised and lowered. It should be noted that between 2 and 5 singing actors are embarked on these devices. This article describes the main characteristics of the aerial stage structure, the 3 apparatus and the mechanical systems used. In addition, the age and modifications of “El Araceli” are analysed, as well as the results of a non-destructive test carried out on this device. (shrink)

What are the Early Memoranda?1 When were they written? What are their sources? What is their purpose and their relation to Hume's works? These questions, usually addressed separately, are in fact tightly interwoven: they require an articulated response that embraces them all. Our response could be summarised as follows: far from being current reading notes, or even less the exhaustive diary of Hume's intellectual experience, the Early Memoranda are most likely second-tier texts, or—as James Harris recently conjectured—"notes taken from notes."2 (...) Tracing the notion of 'the gift' in Nietzsche's Thus Spoke Zarathustra Emilio Corriero provides a new interpretation of this essential text, alongside 'the gift's' evolution as a key concept in the history of western philosophy and Christianity. The last phase of Nietzsche's thought, including his writings on the death of God, The Will to Power, the Overman, and eternal recurrence are analysed anew in Corriero's reading of Thus Spoke Zarathustra. From Nietzsche's Prologue, in which Zarathustra presents the idea of the (...) Overman as a gift of love and wisdom, up to the fourth and final book, in which the theme of hospitality and sacrifice are inextricably linked to the concept of donation, highlighting the novelty and exceptionality of Zarathustra's gift. Building on these ideas, this book reveals how the gift of Zarathustra put forward by Nietzsche rethinks the relationships between individuals based on Christian doctrine, enabling new forms of coexistence and sociality to thrive. Using key 20th century writings on 'the gift' from Derrida, Benveniste, and Esposito, Corriero traverses themes of sacrifice and hospitality, the idea of friend and foe, compassionate love and affirmative love, to present Zarathustra as Nietzsche's ultimate gift, as well as cementing the centrality of 'the gift' to the history of sociality and philosophy. Post‐translational modifications regulate each step of DNA replication to ensure the faithful transmission of genetic information. In this context, we recently showed that deubiquitination of SUMO2/3 and SUMOylated proteins by USP7 helps to create a SUMO‐rich and ubiquitin‐low environment around replisomes that is necessary to maintain the activity of replication forks and for new origin firing. We propose that a two‐flag system mediates the collective concentration of factors at sites of DNA replication, whereby SUMO and Ubiquitinated‐SUMO would constitute “stay” or (...) “go” signals respectively for replisome and accessory factors. We here discuss the findings that led to this model, which have implications for the potential use of USP7 inhibitors as anticancer agents. (shrink)

Stakeholder engagement and dialogue have a central role in defining the relations between organisations and their internal and external interlocutors. Drawing upon the analysis of dialogic motifs, power–conflict dynamics and sociopolitical perspectives, and based on a set of interviews with the stakeholders of a consumer-owned cooperative, the research explores the dialogic potential of stakeholder engagement. The analysis revealed a fragmented picture where the co-design and co-implementation aspects were mainly related to the non-business areas of cooperative life, while business logic dominated (...) the most central aspects. Stakeholder engagement was mainly related to consensus building, while dialogic engagement based on a pluralistic understanding was only partially considered and then neglected. The social capital in the local area, the growing size of the organisation and the related power structure embrace stakeholder engagement, influencing the orientation of the dialogic dynamic. The analysis indicates that a dialogic exchange is a relative concept which depends on the interests involved and the topics discussed. It also reveals that the key factors in the democratisation of stakeholder engagement are a mutual understanding and long-term opportunities. Common sociopolitical aspects are also important, but they do not necessarily guarantee the creation of dialogism paths. The research contributes to the critical dialogic literature in revealing whether and how stakeholder engagement has been implemented in a specific setting. It also shows the limitations of voluntarist stakeholder engagement initiatives. (shrink)
