Most accounts of Jeremy Bentham deal with him as a prophet of either utilitarianism or of liberal democracy. This book discusses a less familiar but very important aspect of his political thought: his theory of how government institutions should be organised in order to function as efficient and yet responsive guardians of the community's interests. It thus focuses on his programme for he executive and judicial branches of government rather than for the legislature and the electorate. Dr Hume suggests (...) that eighteenth-century political thought was richer in ideas about government that has usually been allowed, but that Bentham's special qualities of mind enabled him to widen and deepen those ideas much further than his contemporaries could have foreseen. This paper critically examines a formal argument against deducing ‘ought’-judgments from ‘is’-judgments, an argument suggested by a literal reading of a famous passage in Hume'sTreatise of Human Nature. According to this argument, judgments of the two kinds have different logical structures (i.e., their subjects are differently related to their predicates) and this difference disallows cross-categorical deductive inferences. I draw on Fregean accounts of the ‘is’- copula and on syntactical interpretations of ‘ought’-judgments that have become standard in deontic logic to (...) argue that twentieth century work in philosophical grammar and logic casts doubt on all three of the argument's premises. There is a discussion of a priori and a posteriori knowledge as well as a section on the problems of induction and solipsism. Chapter III outlines the attempts of contemporary empiricists to eschew Hume's skepticism by envisioning the world as a construct of our sensory experiences. To avoid the solipsism still implicit in the latter position, a re-evaluation of Hume's theory of perception is offered. Wittgenstein and Strawson are briefly treated in this section. Chapter IV explains the pragmatist's attempt to reduce to the same untenable position the rationalist and empiricist views of the a priori. Chapter V concentrates on the pragmatic theory of justification and includes a treatment of N. Goodman's "new riddle of induction." The bulk of this book is the second series of John Dewey Lectures, delivered by Professor Ayer in April 1970. To this, Ayer has added a criticism of Roy Harred’s purported refutation of Hume and a chapter about "non-truth-functional" conditionals that rounds out the lectures. Leaving Harred aside, this book provides an elegant, concise, and up-to-date introduction to the problem of induction and related issues concerning probability. Hume is here vindicated. Beginning by giving what may be the best, (...) updated paraphrase of Hume’s negative argument about causal judgments, Ayer explicates the subsumed atomicity, the denial of natural necessity, and the claimed vacuity or circularity of introducing the "uniformity of nature." Ayer goes on to distinguish a priori or logical probabilities, statistical or frequency judgments, and credibility or ground floor inductive judgments, and he summarily argues that the admissibility of the first two forms of judgment, properly understood, provides no real justification for credibility judgments, which, though not defined as subjective, turn out to need some support from our decision to project and therefore entrench certain predicates, or take as lawlike certain generalizations, rather than others. Ayer here includes a very clear explication and criticism of Carnap’s way out in the Logical Concept of Probability, and elsewhere. Ayer acutely summarizes and discusses the Hempel and Goodman paradoxes, taking a position substantially in agreement with Quine and Goodman, and welds this discussion into a Humean conclusion: "In a certain sense cases are what we choose them to be. We do not decide what facts habitually go together but we do decide what combinations are to be imaginatively projected. The despised savages who beat gongs at solar eclipses to summon back the sun are not making any factual error. It is a true generalization that whenever they beat the gongs the sun does shine again, and if they always keep up the ceremony, it is also a true generalization that the sun comes out again only when they beat the gongs. If we despise them, it is because they tell a fictional story about what would happen if they did not beat the gongs, which we do not accept. They see what goes on as well as we do; it is just that we have a different and, we think, a better idea of the way the world works." To say all this is just, of course, to summarize and refurbish Hume’s position on causality. But to do that has two very real values now: 1) It underlines and exposes the epistemic basis of the position taken by Hume’s heirs; 2) It makes clear what are the departures required if one is to differ in substance from Hume and Ayer.—J. Un grand nombre de problèmes dont traite aujourd'hui la théorie de la décision reposent sur des problématiques qui appartiennent à des approches philosophiques, méthodologiques et théoriques fort différentes et dont l'auteur deChoix rationnel et vie publiquedéplore à juste titre l'absence d'unité intrinsèque. En effet, les racines de la théorie contemporaine du choix rationnel ont des ramifications dans trois traditions philosophiques qui ont été maintenues sans entretenir de contacts: théories philosophiques de l'action d'Aristote à Hume, à Kant et à la (...) philosophie analytique de l'action de Davidson; la théorie du conflit de Hobbes à David Gauthier; la théorie de la justice (d'inspiration utilitariste qui a profondément marqué la pensée économique du XXesiècle). Ces branches ont entretenu des interactions sporadiques, mais ces relations n'ont jamais été exploitées systématiquement. Hume’s empiricist reason for rejecting “school metaphysics” makes it natural to assume that Hume rejects all metaphysics. A.J. Ayer certainly reads Hume this way. The natural assumption is wrong, however. Hume only rejects the aprioricity of metaphysics, and not the science itself. I will argue that his empirical science of human nature supports three basic metaphysical principles. (1) The Contradiction Principle: The clearly conceivable implies no contradiction. (2) The Conceivability Principle: The clearly conceivable is possible. (3) (...) The Conceptual Separability Principle: Things are different if and only if distinguishable, and distinguishable if and only if separable in conception. On these principles the rest of Hume’s metaphysics is based, including his atomistic ontology and his denial of necessary connection. And so, for Hume metaphysics is an empirical science. (shrink)

If, as we are told, Hume's essay on Miracles was an irrelevant insertion in his Enquiry to gain it the notoriety which the Treatise had missed, the artifice has certainly been successful. Hume's thesis has been hotly debated from that day to this. Neither side it seems can claim complete victory, for both make important concessions. Green, his mostly adverse critic, agrees with Mill and L. Stephen that the argument against miracles is “irrefragable” in itself, though not consonant, (...) he thinks, with Hume's own principles: on the other hand, Huxley whilst declaring it on the historical side “irrefragable,” demurs at least to the presentation of the formal side. His was a single vocation — one involving the expression of deep thought through beautiful writing.2 This vocation did not come naturally or easily to Hume. After one has read for a while in the history of Western thought, one becomes cognizant of how many great intellects, believers and non-believers alike, have presented compelling examinations of Christian theism. And until recently, religious skeptics, following in the wake of David Hume, assumed that the ship of Christian philosophy of religion was too damaged to sail again. However, something unexpectedly emerged recently from the weathered ship, even after many pilots advised cautious hugging the shores, especially in light (...) of the ‘death of God’ storms of the 1960’s. Many abandoned the ancient mother ship, some escaping on rafts, lifeboats, or flotsam, transferring to modern vessels, such as SS Darwin, Freud, Marx, or Nietzsche. In Wrong Medicine, Lawrence J. Schneiderman, M.D., and Nancy S. Jecker, Ph.D., address issues that have occupied the media and the courts since the time of Karen Ann Quinlan. The authors examine the ethics of cases in which medical treatment is offered--or mandated--even if a patient lacks the capacity to appreciate its benefit or if the treatment will still leave a patient totally dependent on intensive medical care. In exploring these timely issues Schneiderman and Jecker reexamine the doctor-patient relationship and (...) call for a restoration of common sense and reality to what we expect from medicine. They discuss economic, historical, and demographic factors that affect medical care and offer clear definitions of what constitutes futile medical treatment. And they address such topics as the limits on unwanted treatment, the shift from the "Age of Physician Paternalism" to the "Age of Patient Autonomy," health care rationing, and the adoption of new ethical standards. Experience and reason, it has been claimed, provide the bases of religious belief. The first and fourth groups of selections in Mr. Yandell’s collection of readings probe this claim. In these sections, as in the two intervening ones primary sources are followed by critical analyses and appraisals. Thus, when religious experience is being considered selections from the Upanishads and Bhagavad Gita, Buddhist scriptures, and the Old and New Testaments are followed by commentaries drawn from writers such as William James, Rudolf (...) Otto, and John Baillie. Generally, primary materials are selected from "traditional" thinkers, while analyses are drawn from more contemporary ones. For example, the problem of evil is set by Hume, Leibniz, and Kant, and discussed by J. L. Mackie, Alvin Plantinga, and Dewey Hoitenga. Those authors who are included are readable, and the readings mesh well. (shrink)

Health care services increasingly face patient populations with high levels of ethnic and cultural diversity. Cultures are associated with distinctive ways of life; concepts of personhood; value systems; and visions of the good that affect illness experience, help seeking, and clinical decision-making. Cultural differences may impede access to health care, accurate diagnosis, and effective treatment. The clinical encounter, therefore, must recognize relevant cultural differences, negotiate common ground in terms of problem definition and potential solutions, accommodate differences that are associated with (...) good clinical outcomes, and manage irresolvable differences. Clinical attention to and respect for cultural difference (a) can provide experiences of recognition that increase trust in and commitment to the institutions of the larger society, (b) can help sustain a cultural community through recognition of its distinct language, knowledge, values, and healing practices, and (c) to the extent that it is institutionalized, can contribute to building a pluralistic civil society. Recent policy developments in the area of livestock husbandry have suggested that, from the perspective of optimizing animal welfare, new animal husbandry systems should be developed that provide opportunities for livestock animals to be raised in environments where they are permitted to engage in “natural behavior.” It is not known whether consumers regard animal husbandry issues as important, and whether they differentiate between animal husbandry and other animal welfare issues. The responsibility for the development of such systems is allocated jointly (...) between farmers, regulators, different actors in the food chain, and consumers. This research focuses on understanding consumer attitudes and preferences regarding the development and introduction of such systems, to ensure that they are acceptable to consumers as well as producers, regulators, and scientists. Consumer perceptions of animal welfare and animal husbandry practices were evaluated using quantitative consumer survey, which focused on two animal husbandry issues – farmed pigs and farmed fish. Following pilot work, 1000 representative Dutch consumers were sampled about their attitudes to either pig or fish husbandry. The results indicated that consumers think about animal welfare in terms of two broad categories related to their health and living environment, but do not think about welfare issues at a more detailed level. Greater concern was expressed about the welfare of pigs compared to fish. Consumer trust in labeling also emerged as an important issue, since consumers need to trust different food chain actors with responsibility for promoting animal welfare, and are reluctant to consider the details of animal husbandry systems. As a consequence, a transparent, enforceable, and traceable monitoring system for animal welfare friendly products is likely to be important for consumers. (shrink)

Worin besteht Mills Argument für den Utilitarismus? Im psychologischen Teil des Arguments plädiert Mill für eine aggregierte Beschreibung unserer hedonistischen Werte ("Das allgemeine Glück ist ein Gut für die Gesamtheit aller Personen"). Von hier aus steuert er im normativen Teil des Arguments auf eine aggregierte Bewertung zu ("Das allgemeine Glück ist ein Gut"). Mills Übergang von Beschreibung zu Wertung beruht auf zwei versteckten Annahmen: Die erste sagt (gegen den Nihilisten), dass es Werte gibt; die zweite sagt (gegen Wert-Metaphysiker), dass die (...) Antwort auf die Frage nach Werten nicht völlig unabhängig von dem sein kann, was wir alle de facto für wert erachten. Diese beiden Voraussetzungen scheinen keine inhaltlichen Aussagen zur Moral zu enthalten. Doch wer sie teilt, wird von Mills Argument überraschend weit in die Gefilde der Moral getrieben. Background Informed consent is an integral component of good medical practice. Many researchers have investigated measures to improve the quality of informed consent, but it is not clear which techniques work best and why. To address this problem, we propose developing a core outcome set to evaluate interventions designed to improve the consent process for surgery in adult patients with capacity. Part of this process involves reviewing existing research that has reported what is important to patients and doctors in the (...) informed consent process. Methods This qualitative synthesis comprises four phases: identification of published papers and determining their relevance; appraisal of the quality of the papers; identification and summary of the key findings from each paper while determining the definitiveness of each finding against the primary data; comparison of key themes between papers such that findings are linked across studies. Results Searches of bibliographic databases returned 11,073 titles. Of these, 16 studies met the inclusion criteria. Studies were published between 1996 and 2016 and included a total of 367 patients and 74 health care providers. Thirteen studies collected data using in-depth interviews and constant comparison was the most common means of qualitative analysis. A total of 94 findings were extracted from the primary papers and divided into 17 categories and ultimately 6 synthesised findings related to: patient characteristics, knowledge, communication, the model patient, trust and decision making. Conclusions This qualitative meta-aggregation is the first to examine the issue of informed consent for surgery. It has revealed several outcomes deemed important to capture by patients and clinicians when evaluating the quality of a consent process. Some of these outcomes have not been examined previously in research comparing methods for informed consent. This review is an important step in the development of a COS to evaluate interventions designed to improve the consent process for surgery.
