For many, the idea that people should be rewarded in proportion to what they deserve is the very essence of distributive justice. However, while the notion of moral desert is otherwise widely accepted, Rawls rejects it entirely in his A Theory of Justice. Many authors have argued that Rawls’s claims about desert have serious and unappealing consequences for his conception of justice as fairness, and also that they deny the possibility of autonomous choice to the very agents whose decisions are (...) supposed to underlie Rawls’s approach to justice. In this paper, I analyze the arguments of those who believe that Rawls can be interpreted in a way that doesn’t in fact deny either desert or the possibility of autonomous action. I conclude by allowing for the interpretation that Rawls does not necessarily deny autonomous action, but I contend that he nevertheless finds the idea of preinstitutional desert entirely off the mark. The dispute over Socrates’ apparent endorsement of hedonism in the Protagoras has persisted for ages among scholars and students of Plato’s work. The solution to the query concerning the seriousness and sincerity of Socrates’ argument from hedonism established in the dialogue is of considerable importance for the interpretation of Plato’s overall moral theory, considering how blatantly irreconcilable the defense of this doctrine is with Plato’s other early dialogues. In his earlier works, Socrates puts supreme importance on virtue and perfection of (...) the soul, so the puzzle apparent in the Protagoras merits a thorough examination.Several scholars have argued that, since Socrates’ defense of hedonism in this work clashes significantly with his views on morality in other dialogues, Socrates must only have been defending hedonism ironically, or with the intention of “diagnosing” his opponent’s point of view. A discussion of Christine Korsgaard's The Sources of Normativity.

The notion that exploitation consists in taking wrongful advantage of another’s vulnerability is widespread in the philosophical literature. Considering the popularity of this view, it is disappointing to find that very few authors attempt to provide substantive accounts of characteristics they consider relevant vulnerabilities (i.e., those pertinent to exploitation), as well as of relevant features which make taking advantage of those vulnerabilities wrongful. In this paper, I analyze the few approaches (notably those presented by Ruth Sample and Robert Goodin) that (...) in fact provide such accounts, and I examine whether and how they pertain to exploitation in general, as well as to exploitation in more personal/intimate relationships. I conclude that these vulnerability-based accounts of exploitation are either too vague or too restrictive, since they tend to leave out many instances of exploitation (especially those within personal and intimate relationships), and are as such inadequate. Recent studies show that returning global health trainees often report having felt inadequately prepared to deal with ethical dilemmas they encountered during outreach clinical work. While global health training guidelines emphasize the importance of developing ethical and cultural competencies before embarking on fieldwork, their practical implementation is often lacking and consists mainly of recommendations regarding professional behavior and discussions of case studies. Evidence suggests that one of the most effective ways to teach certain skills in global health, including ethical and (...) cultural competencies, is through service learning. This approach combines community service with experiential learning. Unfortunately, this approach to global health ethics training is often unattainable due to a lack of supervision and resources available at host locations. This often means that trainees enter global health initiatives unprepared to deal with ethical dilemmas, which has the potential for adverse consequences for patients and host institutions, thus contributing to growing concerns about exploitation and “medical tourism.” From an educational perspective, exposure alone to such ethical dilemmas does not contribute to learning, due to lack of proper guidance. We propose that the tension between the benefits of service learning on the one hand and the respect for patients’ rights and well-being on the other could be resolved by the application of a simulation-based approach to global health ethics education. In a modern society arguably disenchanted with religion, numerous Western women are transfixing their reality by making God in their own image. This compelling phenomenon is known as ‘the Goddess Movement’: a non-centralised religious current of neo-pagan origin that reveres the Divine as feminine. The revival of Goddess worship in a vastly secular age which appears not to favour religious devotion is a peculiar occurrence and leads to the following question: Why are women returning to a previously defunct spiritual practice? (...) Building on the research scholars Paul Reid-Bowen and Janet L. Jacobs conducted on Western Goddess worship, as well as drawing on testimonies of Goddess followers, this article aims to elucidate the appeal the Goddess Movement holds for women. It argues that it represents a notable turn in female spirituality which demonstrates that images of feminine divinity offer women the opportunity to find meaningfulness, empowerment, and sexual or psychological healing. Using the Public Value Mapping framework, I address the values successes and failures of chemistry as compared to the emerging field of green chemistry, in which the promoters attempt to incorporate new and expanded values, such as health, safety, and environmental sustainability, to the processes of prioritizing and conducting chemistry research. I document how such values are becoming increasingly public. Moreover, analysis of the relations among the multiple values associated with green chemistry displays a greater internal coherence and logic than (...) for conventional chemistry. Although traditional chemistry research has successfully contributed to both economic and values gains, there have been public values failures due to imperfect values articulations, failure to take a longer-term view, and inertia within a system that places too much emphasis on science values. Green chemistry, if implemented effectively, has potential to remedy these failures. (shrink)

BackgroundMany of the important elements of a valid informed consent – comprehension, voluntariness, and capacity – can be compromised or unmet in the context of psychiatric research. The inability to protect their own interests puts mentally ill subjects at an increased likelihood of being wronged or harmed and makes them particularly vulnerable in the context of clinical research. Therefore, they are due extra protection. Sometimes, these additional safeguards can significantly limit the possibilities for research involving subjects deemed unable to consent (...) due to their mental illness. Montenegro, a middle-income country in Southern-Eastern Europe, goes so far in their policy to protect these subjects from harms of research, as to ban all biomedical research on mentally ill persons who are unable to provide consent.Main bodyMental health research is often neglected and very low on the list of health research priorities, especially in low- and middle-income countries. Despite the fact that mental health disorders are among leading causes of disability, the need for evidence-based services and interventions for those affected remains unmet.To exclude all members of a certain group of subjects seems extremely restrictive and unnecessary. Such a policy is discriminatory and unethical, because it inflicts further harms and exclusion of those patients from participation in society. This unjust exclusion policy obstructs research of certain psychiatric disorders and implies that new treatments for conditions that directly affect these incapacitated subjects will not be developed.ConclusionsScientific and clinical development must not be precluded by overly restrictive, discriminatory and unjust practices, such as the normative ban on research on decisionally-impaired mentally ill subjects. Rather, there should be a regulative framework that ensures that those who cannot consent for themselves are respected and protected in research, the anticipated benefits maximized, risks minimized, their autonomy recognized and extended. These patient-subjects must be appropriately included unless there is a clear and compelling rationale and justification that inclusion is inappropriate with respect to the health of the participants or the purpose of the research. Intermediate labour markets provide fixed-term work opportunities and coaching for people in disadvantaged positions in labour markets. We study 46 sequences from six audio-recorded recruitment interviews for an ILM job targetted at people who have been unemployed for a prolonged period. Using an ethnomethodological approach to identity, membership categorisation analysis and conversation analysis, we study how interviewers and candidates construct and negotiate who is fit for the ILM job. We present interactional moves through which the participants jointly construct the ‘fit (...) for the ILM job’ category and treat the candidate’s membership in it as a positive matter. Further, we demonstrate how the candidates are put in an interactionally difficult position in the interview as there are contradictory and ambiguous expectations about the ideal candidate. We discuss the results in relation to the interactional and institutional logics of a recruitment interview and suggest that enhancing the transparency might reinforce ethics of recruitment in ILMs. (shrink)

The relation between aisthesis and interiority manifests in Wittgenstein’s account of the subject and his private language argument. But it is also an overlooked leitmotif in Dostoevsky’s novels—one of Wittgenstein’s favorite authors, and in W.G. Sebald’s work—who was inspired by Wittgenstein’s philosophy. This book reflects on the role literature can play in answering the philosophical question of an adequate presentation of intention and pain.

In the study of innovation institutions, it is important to consider how different institutional models can affect a research organization in conducting or funding successful work. As an industry collaborative, Semiconductor Research Corporation provides an example of a privately funded institution that leverages the inputs of several member companies, along with federal funding, to accomplish innovation in its mission area. SRC has several component programs, all attempting to find innovative solutions to semiconductor problems, but on different time scales, and in (...) different technology areas. But how does SRC use its resources to ensure these goals? Through data gathered from semi-structured qualitative interviews and SRC documentation, this paper addresses that question. SRC has found a way to leverage industry money to motivate and develop a robust field of university research for over 30 years. SRC uses several mechanisms for maintaining an application focused, member-centered decision process, institutional flexibility, and strong ties between industry contributors and university researchers. SRC has continued to keep its members satisfied by training thousands of graduate students for employment in their member companies, by focusing on precompetitive research that addresses industry requirements, and doing so in a manner that operates leanly, with low overhead to its funders. Given these successes, we identify aspects of SRC operations, such as a focus on its member company needs, frequent interactions between funders and researchers, flexible funding mechanisms, and focus on workforce development, that may be diffusible to innovation institutions, including federal research efforts. Scholars criticize privileging aesthetics over social and ecological considerations in park design. I argue that the real culprit is not aesthetics, but aestheticism. Aestheticism treats aesthetic objects as if they were ontologically distinct from everyday objects. Aestheticism in park design—treating parks like artworks to be admired like paintings—dovetails into treating parks like representations of a romanticized wilderness: of pristine, untouched landscapes. I argue that aestheticism is a means of constructing an ontological distinction between the beholder and the beheld, for landscapes (...) are not truly pristine if they are sullied by human presence. As an alternative, and while drawing on the works of John Dewey and Yuriko Saito, I argue for a continuity between everyday objects and aesthetic objects. I also draw attention to the question of whose every day is privileged and propose to introduce Wittgenstein’s concept of multi-aspectivity in the analysis of everyday affordances. (shrink)

Wittgenstein and Dostoevsky both ridicule a hypostasizing and fetishizing picture of interiority: viewing sensations and intentions like discrete material objects. The symbols for this misleading view in their respective works are a beetle and a sachet containing thousand five hundred roubles. The beetle in the box passage in the Philosophical Investigations discredits a Cartesian picture of pain as akin to a thing-like entity. The sachet in Dostoevsky’s The Brothers Karamazov represents Dmitry’s intention to be honourable. Dostoevsky achieves a perspicuous view (...) of entangled webs of intentions, as opposed to labelling them like object-like entities. I show that Wittgenstein’ account of first-personal thought, including intentions, is not based on the Cartesian dualism of the inner and the outer, the mind and the body. To underscore my argumentation, I refer to The Brothers Karamazov, one of Wittgenstein’s favourite novels. I especially focus on Dmitry’s sachet, which inspired Wittgenstein’s beetle in the box example. I show parallels both in content and in form of Wittgenstein’s and Dostoevsky’s approach to intention as a species of first-personal thought. (shrink)

The genealogy of ethics starts in the polis. Plato and Aristotle had an optimistic view of polis life, even though Plato was born shortly after the plague of Athens, an experience that left a deep imprint in his society, and interestingly not a very good opinion of democracy. The idea of the polis as the ideal locus for human flourishing can be contested because we do not share the same face-to-face form of life with the ancient polis-dwellers. Contemporary megacities do (...) not harbor an agora in which citizens debate current affairs. Such debates have shifted to social media. It is worth investigating the value of face-to-face interaction even today. Despite the risk of spreading airborne lung diseases like the Corona virus, the possibility of face-to-face interactions allows the cultivation of attention necessary for ethics. Knowing your neighbor by acquaintance, seeing her face every day can make pedestrians better attuned to the need to protect her in times of the pandemic, by maintaining distance and wearing a mask. If this is indeed the case, then it has implications for urban design: urban density can be designed in a way that affords functional proximity and more humane neighborhoods. (shrink)

Technology extends human perception and it intervenes in relations to the environment. Life in cities is particularly affected by newest technological developments, and city dwellers are most shielded and disconnected from the natural world by these very same technologies. The term technology stems from the Greek techne, and it refers to an instrumental relation to the world—a manipulation and adaptation of the environment to human needs. However, by intervening in everyday life and modifying relations to the environment, technology also produces (...) new forms of life and is therefore also poetic in the sense of poiesis. It is clearly distinguished from literary works because it opens worlds of possibilities that are not fictional. This makes a reflection on its poeticity all the more urgent, because the large-scale advent of new technologies such as the industrialization or the digitization radically changes the modes of perception and relations to urban environments. Art works like literature absorb and articulate these changes and are therefore useful “strange tools” for putting on display the changing modes of experiencing cities. For instance, industrialization, explosive urban growth and the rapid modernization of cities overwhelmed the senses. In its very form and rhythm, modernist literature performs the fragmented and brisk-paced experience of modernity. The digital age ostensibly promises intelligibility and order, for digital technologies can survey and manage vast amounts of information. Smart cities are designed for this purpose and for offering tailored solutions to the inhabitants’ individual needs. However, data analytics cannot capture the phenomenological quality of lived experience. Art works can, and contemporary literary works put on display urban life-forms characterized by disembodiment and by exhaustive information on any subject that on its own does not translate into any sense of meaning or belonging. Book review of Christian Erbacher's Formen des Klärens, Literarisch-Philosophische Darstellungsmittel in Wittgensteins Schriften, Münster: mentis 2015. *** Christian Erbacher’s Formen des Klärens, Literarisch-Philosophische Darstellungsmittel in Wittgensteins Schriften, which I would translate as Forms of Elucidating, Literary-Philosophical Means of Presentation in Wittgenstein’s Works, comprises and critically analyzes the most important phases of almost a hundred years of both English and German speaking Wittgenstein scholarship on the form of his literary-philosophical presentation. Furthermore, Erbacher demonstrates a thorough first hand knowledge of Wittgenstein’s manuscripts (...) and manner of work, while at the same time offering an interpretation of the Tractatus logico-philosophicus, as well as later works, that is capable of comprehending both Wittgenstein’s serious and intense ethical and aesthetic preoccupations, as well as his significant contributions to logic and philosophy of language. Furthermore, despite its density, Erbacher’s slender book admirably achieves an elegant lucidity. Thus it performatively shows the unity of aesthetic-rhetorical form and philosophical content, as well as the ethical ideal of clarity at the core of Wittgenstein’s concerns. (shrink)

Regulation of transcriptional elongation is emerging as an important control mechanism for eukaryotic gene expression. In this essay, we review the basis of the current view of the regulation of elongation in the human c‐myc gene and discuss similarities in elongation control among the c‐myc, Drosophila hsp70 and the HIV‐1 genes. Based upon these similarities, we propose a model for control of expression of these genes at the elongation phase of transcription. This model suggests that distinct promoter elements direct the (...) assembly of RNA polymerase II transcription complexes which differ in their elongation efficiency. (shrink)

Potom se pojedini elementi Bloomove poetike sučeljavaju s ničeanskim naslijeđem prisutnim kod dvojice filozofa, Michela Foucaulta i Richarda Rortyja, da bi se ukazivanjem na sličnosti i razlike – ali i na stavove koje su o naznačenim pitanjima (...) zauzeli autori poput Gillesa Deleuza i Paula de Mana – potvrdilo kako Nietzscheovo djelo, pored ostalog i zahvaljujući mogućnostima različite interpretacije, posjeduje ona svojstva koja Bloom naziva »kanonskima «. How does the research performed by a government mission agency contribute to useable technologies for its constituents? Is it possible to incorporate science policy mechanisms for increasing benefits to users in the decision process? The United States National Institute of Standards & Technology (NIST) promises research directed towards industrial application. This paper considers the processes that produce science and technology at NIST. The institute’s policies for science provide robust examples for how effective science policies can contribute to the emergence of (...) useful technologies. To progress towards technologies that can be years away, the agency uses several means for integrating the needs of eventual information users into the prioritization process. To accomplish this, NIST units, such as the Materials Science and Engineering Laboratory, incorporate mechanisms for considering user need and project impact into different stages of its scientific decision processes. This, and other specific strategies that the agency utilizes for connecting the supply of science to information demand, provide lessons for generating useable science. (shrink)

Background:Psychological abuse of older people is difficult to recognise; specifically, nursing home residents have been documented to be at higher risk of psychological abuse during daily care, such as during feeding. Healthcare professionals adopt positive and negative verbal prompts to maintain residents’ eating independence; however, negative prompts’ purposes and implications have never been discussed to date.Research aims:To critically analyse negative verbal prompts given during mealtimes as forms of abuse of older individuals and violation of ethical principles.Research design:This is a secondary (...) analysis of three cases of negative prompts that emerged in a large descriptive study based upon focus group methodology and involving 13 nursing homes and 54 healthcare professionals.Participants and research context:This study included 3 out of 13 nursing homes caring for residents with moderate/severe functional dependence in self-feeding mainly due to dementia; in these nursing homes, we conducted three focus groups and 13 healthcare professionals participated.Ethical considerations:This study was conducted in accordance with the Human Subject Research Ethics Committee guidelines after being approved by the Review Board of the Trust.Findings:With the intent of maintaining self-feeding independence, negative verbal prompts have been reported as being used by nursing home teams. By critically analysing these negative prompts, it turned out they could trigger intimidation, depression and anxiety and thus could be considered as forms of abuse; moreover, negative prompts can threaten the ethical principles of autonomy using a paternalist approach, beneficence and non-maleficence as with the intent to act in the best interests of residents they are harmed in their dignity and justice, given that residents who received negative prompts are treated differently from those who received positive prompts.Discussion:Eating should be a pleasant experience with a positive impact on physiological, psychological and social well-being. However, negative prompting can lead to abuse and violation of basic ethical principles, destroying the healthcare professional resident and relative relationships strongly dependent on trust.Conclusion:Negative verbal prompting must be avoided. When America's Thomas Jefferson insists that work hard to perfect the work of the Framers, he exhorts us to carry forth the creative, revolutionary spirit ourselves. In Kevin Bleyer's Me the People: One Man's Selfless Quest to Rewrite the Constitution of the United States, Thomas Jefferson is a constant source of inspiration. Me the People doesn't remain at the level of theory. The chapter on the Judiciary, devoted to Bleyer's improbable lunch with Supreme Court Justice Antonin Scalia, the Justice most (...) closely associated with the controversial constitutional theory of originalism, is the clear climax of the book. Although Scalia a darling of the Tea Party and a conservative Catholic, evangelicalism does not permeate his legal reasoning. Sure Me the People is a fun book on American history, but it prods the reader comically, by exploiting the comedic value of the fact that so few Americans read the Constitution. (shrink)

She proposes an overarching hierarchical generative framework of processing events enabling us to make sense of the world around us and to interact with it in a competent manner.

This report analyzes the role Japanese women play in the traditional art of the tea ceremony and its meaning for their lives. It is based on data collected for a larger study which explored the ways in which a cultural art transmits its practice and values to Japanese and foreign learners, conducted in Tokyo, Kyoto, and Yokohama, Japan, from 1983 to 1985. Using the Urasenke school, which accounts for approximately 70 percent of all practitioners as a case study, this report (...) explores the impact of women's participation as professionals and students on the organizational structure and activities of the school. Interviews with 31 teachers and 55 students, professionals, and amateurs provided the data to explore the ways in which the art has accommodated women's interests. (shrink)

The article uses the 2010 political success of the Tea Party phenomenon as a jumping-off point to examine a number of ideological tropes and rhetorical devices in American politics. It argues that the political language of the Tea Party is not – as is often assumed – empty moralizing at the expense of intellectual depth, but rather draws on a wide variety of American political and intellectual themes and traditions. The article uses the campaign literature and polemic of key Tea (...) Party affiliates – Sarah Palin, Christine O’Donnell, Glenn Beck, Ron Paul – as entry points to discuss the movement’s political strategies and interpretation of the role of government, individual liberty, American exceptionalism, constitutionalism, the free market, and the common people. In placing these discussions in their historical and intellectual context, the article argues for taking the Tea Party’s political message seriously, not least as a reflection of prevalent democratic concerns and frustrations with the American political system in its current incarnation. This article aims to explore two different but interrelated problems. The first objective, the more abstract one, is to discuss the plausibility of fusionism as a theoretical project of bridging the philosophical gap between libertarianism and free-market conservatism. Our thesis is that while fusionism could succeed, as a strategic alliance, in promoting specific policies, the differences between libertarianism and conservatism are irreconcilable at the level of fundamental intellectual assumptions. More precisely, starting from Hayek’s objections to conservatism, we argue that the (...) crucial divide is that between two conceptions about the prerequisites for social order. The second objective is to show how the differences between the policy prescriptions endorsed by conservatives and libertarians within the Tea Party (mainly with regard to religion-related issues) are illustrative for the theoretical point defended in the first sections.
