Definition of the problem: In Germany, clinical ethics is still in the state of development. Ethics consultation is very new and rare in the clinical setting in German university hospitals. Therefore this paper describes the clinical ethics activities at the Medical Center of Philipps University, Marburg, regard to ethics consultation in a case report. Clinical ethics rounds at the Surgical Intensive Care Unit are organized according to the theory and practice of the ethics consultation service at the Medical Center of (...) the University of Virginia, established by J.C. Over the past decade, clinical ethics has received growing attention in Germany as in most European countries. In the mid-1990s, most European countries made efforts to establish healthcare ethics committees and clinical ethics consultation services. The development of clinical ethics discourse and activities in Germany, however, was delayed and, consequently, is still in its natal phase. Until the end of the 1990s, the only institutionalized bodies of ethical reflection were the research ethics committees at university medical centers and at the (...) State Physician Chambers. In March 1997, the Catholic and Protestant hospital association in Germany recommended the implementation of HECs, modeled after the American HECs. Consequently, the establishment of clinical ethics consultation in the form of HECs started in Germany in denominational hospitals, followed by a small but increasing number of community hospitals. In the debate regarding the different possibilities for gene therapy, it is presupposed that the manipulations are limited to the nuclear genome (nDNA). Given recent advances in genetics, mitochondrial genome (mtDNA) and diseases must be considered as well. In this paper, we propose a three dimensional framework for the ethical debate of gene therapy where we add the genomic type (nDNA vs. mtDNA) as a third dimension to be considered beside the paradigmatic dimensions of target cell (somatic vs. germ-line) and (...) purpose (therapeutic vs. enhancement). Somatic gene therapy can be viewed today as generally accepted, and we review t he contemporary arguments surrounding it on the basis of bioethical-pragmatic, socio-political and deontological classifications. Many of the supposed ethical questions of somatic gene therapy today are not new; they are well-known issues of research ethics. We also critically summarize the different international perspectives and the German ethical discussion regarding manipulations of germ-line cells. (shrink)

This article gives an overview about the ethical dispute on preimplantation genetic diagnosis (PGD), its legal status and its practical usage in Europe. We provide a detailed description of the situation in Germany wherein prenatal diagnosis is routinely applied, but PGD is prohibited on the basis of the internationally unique embryo protection act (EPA) that was put into force in 1991. Both PGD and stem cell research were vigorously debated in Germany during the last four years. As regards the PGD (...) debate specifically, the voices of the ones directly affected were not adequately taken into consideration. We describe the predominant lines of argumentation in this debate and some essential results of our "bioethical field study" of opinions on and usage of PGD in Germany and their implications for the German legislation and ethical theory. The current practice of late termination of pregnancy in Germany has been criticized by the German Medical Association as well as several sociopolitical groups. The controversy has especially concerned the time limit for the termination of pregnancies and the counseling process prior to that intervention. The criticism, in part, originates from the reform of the German Abortion Law in 1995, and demands for change led to legislative initiatives in 2008.

Our programmatic article on Homo heuristicus (Gigerenzer & Brighton, 2009) included a methodological section specifying three minimum criteria for testing heuristics: competitive tests, individual-level tests, and tests of adaptive selection of heuristics. Using Richter and Späth’s (2006) study on the recognition heuristic, we illustrated how violations of these criteria can lead to unsupported conclusions. In their comment, Hilbig and Richter conduct a reanalysis, but again without competitive testing. They neither test nor specify the compensatory model of inference they (...) argue for. Instead, they test whether participants use the recognition heuristic in an unrealistic 100% (or 96%) of cases, report that only some people exhibit this level of consistency, and conclude that most people would follow a compensatory strategy. We know of no model of judgment that predicts 96% correctly. The curious methodological practice of adopting an unrealistic measure of success to argue against a competing model, and to interpret such a finding as a triumph for a preferred but unspecified model, can only hinder progress. Marewski, Gaissmaier, Schooler, Goldstein, and Gigerenzer (2010), in contrast, specified five compensatory models, compared them with the recognition heuristic, and found that the recognition heuristic predicted inferences most accurately. In responding to our paper, Matthew D. Bacchetta and Gerd Richter include several misinterpretations and misrepresentations of our IVONT protocol and structure for ethical debate. We actively invited scrutiny of our IVONT protocol; however, for us to seriously respond to criticisms of our publication, we suggest respectfully that those who critique the article critique the protocol that we proposed. First and foremost, we certainly do not have a regarding mitochondrial genetics.

In der modernen Hirnforschung wird die Frage nach der Herkunft des »Mentalen« erneut kontrovers diskutiert. Kann es z. B. »freie Handlungsentscheidungen« angesichts der kausal bedingten physischen Hirnvorgänge geben? Hier ist die Überzeugung zu prüfen, es könnten den physischen »Korrelaten« des Mentalen trotz eines Sinnverlustes die ausschlaggebenden Einsichten entnommen werden.Ewald Richter zeigt: Wird ohne nähere Begründung - ausgehend von sinnlichen Wahrnehmungen bis hin zur Erkenntnis und den ihr aufgestockten Bereichen - jede mögliche Erfahrung bereits als zugeschnitten auf ein objektivierendes Verhalten (...) aufgefaßt, dann unterbleibt eine alles entscheidende Rückfrage. Insbesondere wird der Blick verstellt sowohl für die Berechtigung verschiedener Seinsweisen als auch für die »Weise des Begegnens« von »Seiendem selbst«, welches kein »Abbilden« ist. Verfehlt wird nicht zuletzt die Frage nach der »Gründung« des »Selbst« in einem vorgängig offenen Bereich. (shrink)

The relevance of Wittgenstein for ethics depends on which Wittgenstein we mean. I argue that we should distinguish not only between Wittgenstein's personal opinions and his philosophy, but also, within his philosophical work, between broadly methodological remarks and what Wittgenstein might call genuinely philosophical remarks (which are not about philosophy but try to bring clarity to the mind bewitched by language). Wittgenstein's personal opinions will be considered irrelevant by most philosophers (although I try to show that they are not as (...) crazy as some people might think), and his philosophical remarks consist only of what he calls ?boring truisms?. It is to his methodology, therefore, that we might expect philosophers to look for ethical implications. If that methodology is well conceived, though, it should be ethically neutral. I argue that it is neutral in this way, that Wittgensteinian philosophy says nothing about ethics, but that its proper use will not likely leave our philosophical beliefs about ethics unscathed. The book gives an introduction to the new research field of Historical Pragmatics of Controversies and provides seven case studies (from 1609 to 1796) on controversies in the fields of astronomy/astrology, medicine, chemistry, philosophy, and theology. The protagonists of these controversies include both famous authors like Kepler, Hobbes and Leibniz and internationally less known authors like the German theologian A.H. Francke and the chemist F.A.C. Gren. The case studies examine the organizing principles of historical controversies, language use, moves and strategies, (...) topic management and text organisation, and the adherence to communication principles in these controversies. At the same time they analyse the use of different text types and media in the course of controversies, including pamphlets, journal articles, reviews, scientific handbooks and letters. In addition, the case studies demonstrate early modern writers' resources from disputation practice, dialectic, and rhetoric and show developments of the practice of polemical writing during this period. Geprägt von seinem subjektiven Schmerzerleben und seinen Leiderfahrungen als Soldat im Zweiten Weltkrieg in Russland formuliert Richter bereits 1948 – im Alter von 25 Jahren – die Grundgedanken seines wirkmächtigen philosophischen Hauptwerks Der Gotteskomplex (1979). In seinem »Antrag auf Zulassung zur Promotion« im Fach Philosophie schrieb Richter, die »philosophische Arbeit« stelle für ihn »eine zentrale Lebensfrage« dar. Obwohl er seine »Zukunft als Mediziner« sehe, (...) betrachte er die Philosophie »als Basis für die weitere Entfaltung meiner philosophischen Tätigkeit«. Die Einführung eines Fachkräfteeinwanderungssystem mit abgestuften Rechten für Arbeitsmigrant:innen sollte diese Entwicklung fördern. Die vorliegende Analyse zeigt, dass diese Reform des Einwanderungssystems die Gerichtspraxis nicht verändert hat.
