This essay defends a novel interpretation of the term xìng 性 as it occurs in Chinese texts of the late Warring States period (roughly 320–221 BCE). The term played an important role both in the famous controversy over the goodness or badness of people’s xìng and elsewhere in the intellectual discourse of the period. Extending especially the work of A.C. Graham, the essay stresses the importance for understanding xìng of early Chinese assumptions about spontaneity, continuity, health, and (in the human (...) case) motivation. These assumptions make xìng fundamentally different from the contemporary nature concepts with which it is often equated. In particular, people’s xìng is not a near-equivalent of human nature or (in modern Chinese) of rénxìng 人性. (shrink)

As the Mohist doctrine of inclusive care (jian ai 兼愛) is usually understood, it is an affront to both human nature and commonsense morality.1 We are told that the Mohists rejected all particularist ties, especially to family, in the interests of a radically universalist ethic.2 But love for those close to us is deeply rooted in our natures, and few would deny that this love has moral significance. This article is a study of the Later Mohists' 'Lesser Selection (Xiaoqu)', which, more than any other early Chinese text, seems to engage in the study of logic. I focus on a procedure that the Mohists called mou . Arguments by mou are grounded in linguistic parallelism, implying perhaps that the Mohists were on the way to a formal analysis of argumentation. However, their main aim was to head off arguments by mou that targeted their own doctrines, and if their (...) argument succeeds then it entails that linguistic parallelism can never ground a cogent argument. In a way, this committed them to the view that formal logic cannot work, but the fact that they did not pursue this line of investigation was by no means inevitable. One consequence of this study is that the Later Mohists conducted their logical work by studying the behaviour of terms and verb phrases, and did not identify the sentence as a significant linguistic unit. This tends to confirm Chad Hansen's generalisation that early Chinese philosophers did not posit sentences or other sentence-like entities such as propositions, beliefs, or laws. Focusing on subsentential expressions did not stop the Mohists from addressing genuinely logical issues, but it may help explain the fact that they never developed a conception of logical structure. The Later Moists grounded our linguistic abilities in our ability to distinguish between kinds on the basis of manifest similarities and differences among things. Proper names, however, require a different treatment. According to the Moists, when we use a proper name, we borrow a word for one kind of thing and use it to refer to something else, as when we name dogs “crane.” This view probably responds in part to arguments that the possibility of using any word to refer (...) to any thing threatens the stability of language. Proper names may borrow from terms with existing uses, but arguably they do not thereby undermine those uses. (shrink)

The section of the Xunzi called "Xing e" 性惡 (xing is bad) prominently and repeatedly claims that people's xing is bad. However, no other text in the Xunzi makes this claim, and it is widely thought that the claim does not express Xunzi's fundamental ideas about human nature. This article addresses the issue in a somewhat indirect way, beginning with a detailed examination of the text of "Xing e": identifying a core text, removing a series of interpolations, analyzing the structure (...) of the core text, and distinguishing between three positions that are defended there. This analysis shows that the claim that people's xing is bad is not really central to "Xing e." More ambitiously, it supports the conclusion that Xunzi's ideas about people's xing changed over time. Though Xunzi did claim that people's xing is bad, he later abandoned the claim, and replaced it with an account of wei 偽 "artifice.". (shrink)

Governments considering marketing regulation must be cognizant of relevant legal constraints and be prepared to defend their policies against industry legal challenges.

Le XVIIe siècle est le siècle de l'induction et de la science expérimentale. Le siècle de Bacon, de Galilée et de Newton... Une erreur ou une distorsion de la réalité répétée mille fois devient vérité. Nous vivons sous un régime d'écriture cartésien. Recent EEG studies on the early postmortem interval that suggest the persistence of electrophysiological coherence and connectivity in the brain of animals and humans reinforce the need for further investigation of the relationship between the brain’s activity and the dying process. Neuroscience is now in a position to empirically evaluate the extended process of dying and, more specifically, to investigate the possibility of brain activity following the cessation of cardiac and respiratory function. Under the direction of the Center for Healthy (...) Minds at the University of Wisconsin-Madison, research was conducted in India on a postmortem meditative state cultivated by some Tibetan Buddhist practitioners in which decomposition is putatively delayed. For all healthy baseline and postmortem subjects presented here, we collected resting state electroencephalographic data, mismatch negativity, and auditory brainstem response. In this study, we present HB data to demonstrate the feasibility of a sparse electrode EEG configuration to capture well-defined ERP waveforms from living subjects under very challenging field conditions. While living subjects displayed well-defined MMN and ABR responses, no recognizable EEG waveforms were discernable in any of the tukdam cases. (shrink)

Cet article montre, à partir du cas des abeilles domestiques et du travail apicole et agricole, comment des êtres vivants participent à façonner des temporalités nocturnes. La nuit, du fait de l’absence de luminosité, les abeilles se rassemblent à l’intérieur de leur ruche et ne butinent plus. Ce comportement, issu de l’expérience que les abeilles ont des heures nocturnes, est mis à profit dans un ensemble de pratiques : d’une part, par les apiculteurs dans la réalisation de la transhumance des (...) abeilles, un travail de nuit exigeant lors duquel ces professionnels doivent se coordonner avec la temporalité nocturne de leurs abeilles ; d’autre part, par les agriculteurs dans l’utilisation des pesticides, encadrée juridiquement à partir d’une qualification de la nuit chez l’abeille. Au gré des contextes et de ces différentes pratiques relationnelles avec l’abeille, la nuit apparaît comme un moment vécu de multiples manières. Cultural transmission in non-literate societies (including that of Homer) is first discussed, partly to test some theories of Dan Sperber, and partly to consider thetheory of memes, which is sometimes held applicable to Homeric formulae, and is considered next. After discussing Sperber's criticism of memeticism, I turn toSperber's susceptibility theory of culture, and his discussions of religion and of music. Further examples drawn from Homeric religion are found to be in tension with aspects of this theory. Two diverse interpretations of (...) susceptibility present in Sperber's text are elicited and contrasted, of which one is criticised and the other welcomed as consistent with the role of reflection, artifice and rationality in the development of culture, activities that theories of culture cannot afford to disregard. La théorie du jugement était une des préoccupations de Husserl depuis la toute première période de sa carrière. Ses premières recherches dans ce domaine se trouvent dans deux manuscrits rédigés en 1893 et 1893-1894 et publiés dans le volume XL des Husserliana . Dans cet article, j’examinerai la théorie du jugement dans ces manuscrits en relation aux questions suivantes : 1) les jugements en relation aux représentations ; 2) les assomptions comme des actes qui se déroulent parallèlement aux jugements ; (...) 3) les jugements impropres en tant que distincts des jugements propres ; 4) les jugements objectifs ; 5) les états de choses en tant que corrélatifs des actes de juger. Nous verrons que, tandis que Husserl se libère à maints égards de la théorie du jugement de Brentano qu’il avait apprise à Vienne puis à Halle, ses positions sont en même temps tout à fait représentatives de la phénoménologie autrichienne dans la mesure où elles impliquent à la fois une psychologie descriptive et une théorie de l’objet, bien que sans aucune prétention d’établir une nouvelle méthode en philosophie.The theory of judgment was one of Husserl’s concerns from a very early period of his career onward. His early investigations in this area are to be found in two manuscripts which he wrote in 1893 and 1893/94, which have been published as Text Nr. 1 and Text Nr. 2 of Husserliana XL. In this paper I examine the theory of judgment in these manuscripts with regard to the issues of 1) judgments in relation to presentations, 2) assumptions as acts which run parallel to judgments, 3) improper judgments as distinct from improper ones, 4) objective judgments, and 5) states of affairs as correlatives of judging acts. While we see Husserl freeing himself in many respects from the Brentanian theory of judgment which he had learned in Vienna and again in Halle, it is at the same time seen that Husserl’s views are quite representative of Austrian phenomenology insofar as they involve both descriptive psychology and object-theory, though without any pretense of establishing a novel method of philosophy. La théorie comportementale vise à expliquer ces anomalies, en particulier celles relatives aux préférences sociales. L’objet de cet article est de montrer comment l’économie expérimentale a permis de mieux mesurer et de mieux caractériser ces préférences. La comparaison entre vieux-saxon (vsax), et vieil-anglais (va), deux langues germaniques historiquement et linguistiquement proches, concerne dans cet article le groupe nominal au sens de Jean Fourquet (1966, publié 2000 et 201), avec une détermination ∅ ou autre que ∅, ayant trait à Dieu. Les deux textes comparés datent du IXème siècle, le poème en vieil-anglais étant la traduction de la Genèse en vieux-saxon. De ces poèmes il ne reste que certains fragments, avec une partie commune de 25 vers allitérés. (...) A partir de ces 25 lignes communes, on essaiera de déterminer le système de détermination propre à chaque langue, qui se situe à la croisée entre un système ancien et un système nouveau. Une évolution est ainsi à l’œuvre, qu’il s’agit de reconnaître dans son caractère dynamique, à partir de la façon dont Dieu est désigné en vsax comme en va. Les appellations de Dieu sont comparables sur les plans morphologique, syntaxique, lexical. Des termes du domaine séculier sont utilisés dans le domaine religieux. La différence entre les deux textes renvoie à la façon dont chaque langue tire parti des mêmes procédés. (shrink)

There has been extensive discussion of testimonial epistemic injustice, the phenomenon whereby a speaker’s testimony is rejected due to prejudice regarding who they are. But people also have their testimony rejected or preempted due to prejudice regarding what they communicate. Here, the injustice is content focused. We describe several cases of content focused injustice, and we theoretically interrogate those cases by building up a general framework through which to understand them as a genuine form of epistemic injustice that stands in (...) intertwined relationships to other forms of epistemic injustice. The reclamation of slurs raises a host of important questions. Some are linguistic: What are the linguistic conventions governing the slur post-reclamation and how are they related to the conventions governing it pre-reclamation? What mechanisms engender the shift? Others bend toward the social: Why do a slur’s targets have a special privilege in initiating its reclamation? Is there a systematic explanation why prohibitions on out-group use of reclaimed slurs vary from slur to slur? And how does reclamation contribute to shaping (...) social identities and reversing oppressive social norms and stigma? Most analyses of slur reclamation advance a single model to answer these questions. The author argues that there are different varieties of reclamation. Two predominate, what she calls pride reclamation and insular reclamation. While many features unite pride and insular reclamation, they differ with respect to the purpose of the reclamatory act, the linguistic mechanisms reclaimers employ to execute the linguistic change, and the social and grammatical roles of the reclaimed slur. By distinguishing these two types of reclamation and offering a fine-grained characterization of their properties, the author argues that we gain deeper insight into the reasons why slurs may in principle only be ignited by the target group and why pride- but not insular-reclaimed slurs become available for use by out-group members. While many of the phenomenological currents in philosophy allegedly utilize a peculiar method, the type under consideration here is characterized by Franz Brentano s ambition to make philosophy scientific by adopting no other method but that of natural science. Brentano became particularly influential in teaching his students (such as Carl Stumpf, Anton Marty, Alexius Meinong, and Edmund Husserl) his descriptive psychology, which is concerned with mind as intentionally directed at objects. As Brentano and his students continued in their investigations in (...) descriptive psychology, another side of Austrian phenomenology, namely object theory, became more and more prominent. The philosophical orientation under consideration in this collection of essays is accordingly a two-sided discipline, concerned with both mind and objects, and applicable to various areas of philosophy such as epistemology, philosophy of language, value theory, and ontology.". This article analyses Adam Smith's and Sophie de Grouchy's accounts of sympathy to show how they arrive at strikingly different views on whether inequality is a threat to, or precondition of, social order. Where many scholars have recently sought to recover Smith's egalitarianism, I instead focus on how his account of sympathy in The Theory of Moral Sentiments naturalises socioeconomic inequalities, while also highlighting the wider inegalitarian implications of his analysis. I demonstrate that Grouchy was alert to these implications and (...) reveal how her own account of sympathy challenges the moral psychology underlying Smith's position on inequality. By reconstructing Grouchy's response to Smith, I illustrate how retrieving the insights of long‐overlooked thinkers can reorient the way we understand key debates in the history of philosophy, since Grouchy was far more concerned than Smith with exposing how economic inequality imperils the prospects of relating to one another as equals.
