It has been claimed that decisions reached democratically have the consent of those subject to them. It will be shown that arguments for this view rest on either a Kantian or a utilitarian conception of consent. When the distinct nature of these arguments is kept clearly in mind, it becomes apparent that little remains of any of them. Nothing remains of the argument based on the Kantian conception, at least in so far as it is used to support the view (...) that democratic government rests on the consent of the governed. Though something remains of the arguments based on the utilitarian conception, what remains is not what they often are thought to establish. The spurious plausibility of consent arguments for democracy is due to switches between the Kantian conception of consent and the utilitarian. (shrink)

This book discusses how Plato, one the fiercest legal critics in ancient Greece, became – in the longue durée – its most influential legislator. Making use of a vast scholarly literature, and offering original readings of a number of dialogues, it argues that the need for legal critique and the desire for legal permanence set the long arc of Plato’s corpus—from the Apology to the Laws. Modern philosophers and legal historians have tended to overlook the fact that Plato was the (...) most prolific legislator in ancient Greece. In the pages of his Republic and Laws, he drafted more than 700 statutes. This is more legal material than can be credited to the archetypal Greek legislators—Lycurgus, Draco, and Solon. The status of Plato’s laws is unique, since he composed them for purely hypothetical cities. The terms `endurance' and `perdurance' are commonly thought to denote distinct ways for an object to persist, but it is surprisingly hard to say what these are. The common approach, defining them in terms of temporal parts, is mistaken, because it does not lead to two coherent philosophical alternatives: endurance so understood becomes conceptually incoherent, while perdurance becomes not just true but a conceptual truth. Instead, we propose a different way to articulate the distinction, in terms of identity rather than (...) temporal parts: an object endures if its identity is determined at every moment at which it exists. We make precise what it means for the identity of an object to be determined at a moment. We also discuss what role the endurance / perdurance distinction, so understood, should play in the debates about time, material objects and personal identity. (shrink)

Traditional means of crime prevention, such as incarceration and psychological rehabilitation, are frequently ineffective. This collection considers how crime preventing neurointerventions could present a more humane alternative but, on the other hand, how neuroscientific developments and interventions may threaten fundamental human values.

We introduce the resurrection axioms, a new class of forcing axioms, and the uplifting cardinals, a new large cardinal notion, and prove that various instances of the resurrection axioms are equiconsistent over ZFC with the existence of an uplifting cardinal.

While COVID-19 spreads aggressively and rapidly across the globe, many societies have also witnessed the spread of other viral phenomena like misinformation, conspiracy theories, and general mass suspicions about what is really going on. This study investigates how exposure to and trust in information sources, and anxiety and depression, are associated with conspiracy and misinformation beliefs in eight countries/regions during the COVID-19 pandemic. Data were collected in an online survey fielded from May 29, 2020 to June 12, 2020, resulting in (...) a multinational representative sample of 8,806 adult respondents. Results indicate that greater exposure to traditional media is associated with lower conspiracy and misinformation beliefs, while exposure to politicians and digital media and personal contacts are associated with greater conspiracy and misinformation beliefs. Exposure to health experts is associated with lower conspiracy beliefs only. Higher feelings of depression are also associated with greater conspiracy and misinformation beliefs. We also found relevant group- and country differences. We discuss the implications of these results. (shrink)

Army Officers face increased moral pressure in modern warfare, where character judgement and ethical judgement are vital. This article reports the results of a study of 242 junior British Army officers using the Army Intermediate Concept Measure, comprising a series of professionally oriented moral dilemmas developed for the UK context. Results are suggestive of appropriate application of Army values to the dilemmas and of ethical reasoning aligning with Army excellence. The sample does slightly less well, however, for justification than for (...) action reasoning, and there are differences following initial training for infantry and artillery officers versus other branches of service. Dilemmas involving anti-torture methods and not covering up soldiers' failings generated best results compared to those requiring balance between compassion and mission, and negotiating personal relationships with military needs. Gender differences favouring women were less than those observed for other professional groups using similar measures. This research further develops a much-needed measure of ethical reasoning among junior Army officers, with potential for use among other ranks. Following Snyderman and Rothman, we surveyed expert opinions on the current state of intelligence research. This report examines expert opinions on causes of international differences in student assessment and psychometric IQ test results. Experts were surveyed about the importance of culture, genes, education, wealth, health, geography, climate, politics, modernization, sampling error, test knowledge, discrimination, test bias, and migration. The importance of these factors was evaluated for diverse countries, regions, and groups including Finland, East Asia, sub-Saharan Africa, Southern Europe, the Arabian-Muslim (...) world, Latin America, Israel, Jews in the West, Roma, and Muslim immigrants. Education was rated by N = 71 experts as the most important cause of international ability differences. Genes were rated as the second most relevant factor but also had the highest variability in ratings. Culture, health, wealth, modernization, and politics were the next most important factors, whereas other factors such as geography, climate, test bias, and sampling error were less important. The paper concludes with a discussion of limitations of the survey. (shrink)

We introduce the strongly uplifting cardinals, which are equivalently characterized, we prove, as the superstrongly unfoldable cardinals and also as the almost-hugely unfoldable cardinals, and we show that their existence is equiconsistent over ZFC with natural instances of the boldface resurrection axiom, such as the boldface resurrection axiom for proper forcing.

Surveillance in public health is the means by which people who are responsible for preventing or controlling threats to health get the timely, ongoing, and reliable information they need about the occurrence, antecedents, time course, geographic spread, consequences, and nature of these threats among the populations they serve. “Policy surveillance” is the ongoing, systematic collection, analysis, and dissemination of information about laws and other policies of health importance.

Karl Popper developed a theory of deductive logic in the late 1940s. In his approach, logic is a metalinguistic theory of deducibility relations that are based on certain purely structural rules. Logical constants are then characterized in terms of deducibility relations. Characterizations of this kind are also called inferential definitions by Popper. In this paper, we expound his theory and elaborate some of his ideas and results that in some cases were only sketched by him. Our focus is on Popper's (...) notion of duality, his theory of modalities, and his treatment of different kinds of negation. This allows us to show how his works on logic anticipate some later developments and discussions in philosophical logic, pertaining to trivializing connectives, the duality of logical constants, dual-intuitionistic logic, the conservativeness of language extensions, the existence of a bi-intuitionistic logic, the non-logicality of minimal negation, and to the problem of logicality in general. In the recent case of Nike v. Kasky both sides argued that their standard for distinguishing commercial speech from political speechwould create the better policy for ensuring accurate and complete disclosure of social information by corporations. Using insights frominformation economics, we argue that neither standard will achieve the policy goal of optimal truthful disclosure. Instead, we argue that the appropriate standard is one of optimal truthful disclosure—balancing the value of speech against the costs of misinformation. Specifically, we argue that an (...) SEC-sanctioned safe harbor available under a closely supervised system for social reporting will bring about optimal truthful disclosure. The scheme is intended to enhance stakeholder confidence in corporate social and political commentary, while at the same time encouraging corporations to provide accurate information in a fair playing field of public debate. Current psychological theories of human causal learning and judgment focus primarily on long-run predictions: two by estimating parameters of a causal Bayes nets, and a third through structural learning. This paper focuses on people’s short-run behavior by examining dynamical versions of these three theories, and comparing their predictions to a real-world dataset.

Oakeshott, Hayek and Schmitt are associated with a conservative reaction to the 'progressive' forces of the twentieth century. Each was an acute analyst of the juristic form of the modern state and the relationship of that form to the idea of liberty under a system of public, general law. Hayek had the highest regard for Schmitt's understanding of the rule of law state despite Schmitt's hostility to it, and he owed the distinction he drew in his own work between a (...) purpose-governed form of state and a law-governed form to Oakeshott. However, the three have until now rarely been considered together, something which will be ever more apparent as political theorists, lawyers and theorists of international relations turn to the foundational texts of twentieth-century thought at a time when debate about liberal democratic theory might appear to have run out of steam. In this paper, we considered several variants of the internal-external principle (IEP), and showed that each was susceptible to counterexamples. In the final section of the paper, we showed that our weakening of IEP has significant implications for the wrongness of interferences in the Practical Cases. We showed that on Conditionalized Autonomy Variant, many instances of the Practical Cases do not have special wrongness. Those who hold that interferences in these Practical Cases are particularly morally problematic even when the altered (...) desires are all-things-considered disvaluable should either provide a different explanation for the wrongness of these interferences, or give up the view that these interferences are in one respect more pro tanto wrong than the external frustration of the same desires. This paper is a companion to work of Feferman, Jäger, Glaß, and Strahm on the proof theory of the type two functionals μ and E1 in the context of Feferman-style applicative theories. In contrast to the previous work, we analyze these two functionals in the context of Schlüter's weakened applicative basis PRON which allows for an interpretation in the primitive recursive indices. The proof-theoretic strength of PRON augmented by μ and E1 is measured in terms of the two subsystems of (...) second order arithmetic, Π10-CA and Π11-CA, respectively. (shrink)

What is implied by "ethics of history"? The authors of this volume, internationally renowned philosophers and intellectual historians, address this question in all its novelty and ambiguity and develop varied perspectives on the place and nature of ethics in the philosophy, enterprise, and practice of history. Is the whole historical process--largely consisting of the actions and sufferings of persons and groups--subject to ethical constraint?
