I examine Jacques Maritain's definition of art and what it contributes to debates on definitions of art in contemporary aesthetics. Of particular concern are the so-called ‘fine arts’. I make three claims; first, that Maritain's definition of art is superior to other traditional and contemporary theories in avoiding their pitfalls and accommodating key data to be met by definitions of art, such as the existence of avant-garde art. Second, I claim that in accommodating avant-garde art, in particular ‘conceptual art’, Maritain's (...) definition of art refutes the Wittgensteinian argument that art is an ‘open concept’ which cannot be defined. My final, resulting claim is that Maritain's definition deserves to be the pre-eminent definition of art today. This article consists of four sections. Section one provides some context of definitions of art and the data and conditions that have to be met by a viable definition. Section two provides the foundation and first pillar of Maritain's definition of art, what I identify as a cumulative ‘descriptive’ definition. Section three provides the second pillar of Maritain's definition of art, applicable specifically to the fine arts. I examine Jacques Maritain's views on the relationship between art and ethics or what is today called the ‘ethical criticism of art’, and examine what Maritain's thought can contribute to debates in contemporary aesthetics and wider society. In part I of the article, I approach Maritain's attempted reconciliation of artistic freedom and the demands of morality in three steps, first recalling Maritain's definition of art, second looking at Maritain's analysis of the extra-artistic concerns of the artist, and third offering a (...) critique of Maritain's views on why art is valued by the community and what justifiable moral claims of the community upon the artist might be—particularly regarding the method of production of artworks. Comparing Maritain's theories to those of contemporary writers in part II, I argue that Maritain's ethics of art can be used to complement Jacques Rancière's notions of the ‘distribution of the sensible’ and ‘artistic regimes’, and that, in the terminology of the ethical criticism of art, Maritain affirms a position which is a composite of ‘moderate moralism’ and ‘ethicism’—a position which is both explanatorily powerful in ascertaining how and why we recognise and value art, and flexible in accommodating changing artistic forms and practices. In his Philosophical Investigations , Wittgenstein introduces the notion of a ‘family resemblance’ to deal with certain problems. Talking of games and what they seem to have in common, he points out that there are no common features in virtue of which we call all games ‘games’. Instead there are, he claims, many different similarities and relationships; he says ‘we see a complicated network of similarities overlapping and criss-crossing: sometimes overall similarities, sometimes similarities of detail’. He then goes on to (...) add: ‘I can think of no better expression to characterise these similarities than “family resemblances”; for the various resemblances between members of a family: build, features, colour of eyes, gait, temperament, etc. etc. overlap and criss-cross in the same way,—And I shall say: “games form a family”.’ Wittgenstein also instances numbers as forming a ‘family’ in the same manner. This notion of a ‘family resemblance’ has come to be used by many philosophers to deal with a range of situations where there appears to be a difficulty in finding a single definite common property and yet there exists a desire to call some set of things by the same name. I myself have succumbed to this temptation. Perhaps the widest claim for the use of this device is that made by Mr Bambrough in an article entitled ‘Universals and Family Resemblances’ . This begins with the words ‘I believe that Wittgenstein solved what is known as “the problem of universals”’. (shrink)

“Public health legal preparedness” is a term born in the ferment, beginning in the late 1990s, that has led to unprecedented recognition of the essential role law plays in public health and, even more recently, in protecting the public from terrorism and other potentially catastrophic health threats.The initial articulation of public health has not kept pace with rapid evolution in the concept and in practical development of public health preparedness itself. This poses the risk that legal preparedness may fall behind (...) construction of general readiness in the public health system—and may, in fact, undercut achievement of comprehensive public health preparedness for massive threats to health in both the United States and world-wide. Even then there is a tendency to look upon him as an unsystematic thinker, as a ‘ philosophy ’ rather than as a genuine philosopher. His ideas are held to be interesting, but the connections between them are thought to be emotional rather than logical. Again, Émile is read by students (...) of education, but not by those studying philosophy. This is both because the ‘philosophy of education’ is thought not to be of great importance and again because of Rousseau's lack of logical rigour. Now it is true that Rousseau himself was an emotional figure, and from reading his Confessions it is easy to get the idea that there is no point in looking for interesting philosophical points in his works.
