According to Newton, the goals of natural philosophy comprise quantitative generalizations and causal knowledge, the latter being paramount. Quantitative generalizations are sometimes explanatory, in psychology as elsewhere . However, in psychology, they are not explanatory when the human subject is considered qua bearer of psychological states , but only when she is considered qua physical system. In the former case quantitative generalizations are, rather, to be causally explained. In this sense, psychology may be closer to the Newtonian methodological mark than (...) contemporary physics. I claim that the revisions John Rawls made to his theory of justice—as seen in his political conception of justice as fairness in the revised edition of Political Liberalism and Justice as Fairness: A Restatement—result in him being able to secure justice for all persons even in their private lives. Thus, I defend his theory against common communitarian and feminist criticisms, viz the lack of moral community and inability to secure justice for individuals in the private domain. I demonstrate that (...) justice is secured from the categorical requirement that all associational life and moral doctrines must adhere to the constraints of justice, by (what Rawls terms) the indirect application of the first principle of justice. The implications of and necessity for this indirect application are precisely what I interrogate in this thesis. I suggest that this indirect application requires unconditional acknowledgement and internalisation of the values of liberty and equality (political values of the first principle) into all aspects of civil society. I claim that Rawls realised this necessity for the congruence between the moral powers of persons, the spheres of society, and the right and the good and, as such, developed a complementary relation between these three features. Coherence between these three aspects is essential; without coherence, citizens would have a split moral personality, the public and the non-public spheres would be in conflict, and the political values and the moral doctrines of individuals would undermine one another. The significance of this strict coherence is that it can ensure the adequate development of individuals’ capacity for citizenship during the three stages of moral development. This results in citizens being able to form bonds of civic friendship necessary for justice as reciprocity to be realised. Thus, in this thesis, I position my argument against theorists such as Nancy Rosenblum, who argue for a more relaxed congruence between political institutions and civil society, as according to her illiberal forms of associational life can help form the necessary bonds of love and care needed for mutual cooperation in a liberal society. In opposition to this, I claim that strict congruence is necessary; without it, a stable liberal society is not possible as the citizens would not be able to able to respect one another on free, equal, and mutually beneficial terms. I rely on Hochschild’s sociological evidence to demonstrate that civic friendship has not been developed, due to a lack of reciprocity, impacting the negative development of one’s sense of justice. I then illustrate how this lack of reciprocity is amplified by digital and artificial intelligence (AI) technologies. The significance of this thesis is that I claim, firstly, Rawls’s last revisions and works before his death demonstrate that justice is a collective non-comprehensive good that results by constraining individuals’ associational life and their partial comprehensive doctrines to Rawlsian demands of justice. Thus, Rawls takes seriously the feminist and communitarian critiques he received. Secondly, I claim that this interpretation of Rawls’s theory of justice cannot be conceptualised in terms of a binary presentation of the priority of the right versus the good debate and, instead, I argue for a reconceptualisation of the priority of the right versus the good as ranges on a continuum of structural relations between the right and the good. In this paper, I argue that AI literacy should be added to the list of primary goods developed by political philosopher John Rawls. Primary goods are the necessary resources all citizens need to exercise their two moral powers, namely their sense of justice and their sense of the good. These goods are advantageous for citizens since without them citizens will not be able to fully develop their moral powers. I claim the lack of AI literacy impacts citizens’ ability to exercise (...) their sense of justice and their sense of the good. Without citizens having the ability to understand how AI technology works – including being aware of the social and political implications and the limits and possibilities of this technology broadly speaking – this could impact their ability to participate in a free, equal and fair society and their ability to carry out their conception of the good. Thus this paper is a call for AI literacy to be regarded as a basic good in a liberal constitutional democracy in order for citizens to be able to exercise their freedom and equality. (shrink)

An ethical conflict arises when we must perform research in the interest of future patients, but that this may occasionally injure the interests of today''s patients. In the case of cognitively impaired persons, the question arises whether it is compatible with humane healthcare not only to treat, but also to use these patients for research purposes. Some bioethicists and theologians have formulated a general duty of solidarity, also pertaining to cognitively impaired persons, as a justification for research on these persons. (...) If one examines this thesis from the theory of justice according to John Rawls, it is revealed that such a duty of solidarity cannot necessarily be extrapolated from Rawls' conception of justice. This is at least true of Rawls' difference principle, because accordingto the difference principle only those measures are justifiable which serve the interest of the respective least well off. Those measures which would engender additional injury for the least well off could not be balanced by any utility according to Rawls. However, John Rawls' difference principle is subordinate to the first principle, which is that each person has an equal right to the most extensive basic liberty compatible with the same liberty for others. These primary goods are determined by the freedom and integrity of the person. This integrity of decisionally impaired persons would be in danger if one would abstain from research and thus forego the increase in knowledge related to their disease. Thus one could conclude, at least from Rawls' first principle, that society must take on a duty to guarantee the degrees of freedom for cognitively impaired persons and thus also support the efforts for their healing. This dissertation offers a critical discussion of the prioritisation of ‘the right’ in John Rawls’s theory of justice. Rawls’s theory of justice – ‘justice as fairness’ – is arguably one of the best illustrations of the prioritisation of ‘the right’ in current political literature. However, his theory has been criticised by a diversity of thinkers for its implied structural relation between ‘the right’ and ‘the good’. Some theorists argue that conceptually ‘the good’ can never be derived from ‘the right’; others (...) argue that, even if it were possible, the social implications of such a conceptualisation would devastating as it would result in a so-called “community of strangers” (Rorty 1988, 273). In this dissertation, I argue that be on the one hand, theories that prioritise ‘the right’– such as ‘justice as fairness’ – enable the attractive possibility of the multiple coexistence of ‘comprehensive goods’. This is attractive as it upholds the liberating ethos: ‘I have the freedom to determine my own ends’. This possibility is attributed to the fact of neutrality, which characterises the priority of ‘the right’. The claim of neutrality is embedded in the ideal that political principles can be developed prior to and independently of any content of ‘the good’. This is then supposed to justify the claim that political principles are non-reliant on comprehensive moral ideals. In this way, the prioritisation of ‘the right’, as evident in ‘justice as fairness’, supposedly enables citizens to construct impartial universal principles that govern their society. Yet, on the other hand, I question the degree of neutrality present in ‘justice as fairness’. I argue that ‘justice as fairness’, although its justification is independent of a singular moral truth, is not neutral concerning ‘the good’. In fact, the moral values encapsulated in the priority of ‘the right’, I argue, set the conditions of justification of all doctrines of ‘the good’ because any idea of ‘the good’ that embodies contradictory values to those encapsulated in the priority of ‘the right’ would necessarily be excluded from a Rawlsian society. Therefore, I argue that Rawls’s theory of justice cannot be said to take into account “a diversity of conflicting and irreconcilable yet reasonable comprehensive doctrines” (Rawls 2001, 34); as moral values are already implied in the prioritising of ‘the right’. In light of how Rawls’s theory of justice is simultaneously neutral and prescriptive regarding ‘the good’, I suggest a re-problematisation of the debate on the relationship between ‘the right’ and ‘the good’. The literature on theories that prioritise ‘the right’ or ‘the good’ seems to imply such theories either embody the one or the other methodological approach. I argue that this debate has been presented as a false dichotomy and, as such, the debate itself seems to be exhausted, because it creates a kind of natural impasse. Therefore, I suggest recasting the debate in terms of representing ‘the right’ and ‘the good’ as two methodological positions on a continuum, that are at the same time both more or less gradually similar and divergent from one another. The purpose of this continuum is to demonstrate that notions such as neutrality, objectivity and comprehensiveness are not clear-cut. (shrink)

The managerial and personal approaches to Business Ethics are inadequate to address the systemic problems facing ethical reflection in Africa. It is argued that the ethical guidance position that takes the least advantaged individuals or groups in society as reference points is a more suitable ethical approach. The philosophical version of this egalitarian view as set out by John Rawls is then shortly explained, after which a few implications for Business Ethics in Africa are drawn.

Beyond Rawls engages one of the most provocative and influential developments in contemporary political philosophy. Focusing on the idea- as opposed to a single conception- of purely 'political' liberalism, Shaun Young examines the work of a number of prominent political liberals, and concludes that as it presently manifests itself, the concept of political liberalism cannot achieve its stated goals.

Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. Recent scholarship has considered the requirements of justice and economic regimes in the work of John Rawls. This work has not delved into the requirements of justice and liberal socialism as deeply as the work that has been done on property-owning democracy. A thorough treatment of liberal socialism and the requirements of justice is needed. This paper seeks to begin to fill this gap. In particular, it needs to be shown if liberal socialism fully answers the requirements of justice better (...) than property-owning democracy. It will be argued that liberal socialism does significantly better in realizing the two principles. This paper has the following structure, first, an overview of Rawls' position on economic regimes, capitalism, and the requirements of justice will be presented. In particular, how the two principles work in tandem to meet the demands of distributive justice will be considered. Second, a review of property-owning democracy will be conducted. Finally, liberal socialism will be examined and discussed as an economic regime that answers the requirements of justice more fully. (shrink)

Rawls champions the cause of the poor because of his strong moral sentiments about the eradication of poverty. I present these sentiments, which he converts into normative elements of his theory of justice. However, the conceptual framework and intellectual resources that he uses to articulate these sentiments are inadequate. His sentiments against poverty cannot be accommodated neatly, simply, and coherently in his liberal theoretical framework. Also, I point out that his definition of the identification of poor people as the least (...) advantaged members of society is not adequate. Therefore, his theory is refashioned so that it can properly account for the fundamental interests of poor people. An alternative conception is presented, revising Rawlsian liberalism to enable it to adequately champion the cause of the poor. I provide an alternative definition of poverty and apply Mill’s analysis of the relation between justice and utility to Rawls’ theory of justice. (shrink)

In The Law of Peoples, John Rawls offers an idea of international public reason that governs the relationship between liberal and decent peoples. This article begins by considering the relationship between liberal peoples and the form of public reason that they would deem acceptable. It ultimately argues that there is an international public reason that is common to minimally just states that is different from what would be found in the law of peoples. The applicability and content of this version (...) of international public reason is governed by the possibility of states associating with one another in what I call an international friendship. Minimally just states would accept the importance of reasons for being attentive to how their actions can affect the just arrangements of other minimally just states. The reason of international friendship presents the possibility of competing international publics with their own form of reason. (shrink)

The original position contractarian model of ethical reasoning put forth by John Rawls has been examined as a basis for an environmental ethic on three previous occasions in this journal and in Peter Wenz’s Environmental Justice. In this article, I critically examine each of these treatments, analyzing the proposals offered and identifying their shortcomings. I find a total of seven different proposals in this literature for modifying Rawls’ theory to augment its adequacy or as a ground environmental ethics. The diverse (...) difficulties that arise in attempting to apply Rawls suggest the conclusion that Rawlsian ethics may not be a suitable foundation for an adequate long-term environmental ethics. In Political Liberalism John Rawls argues that “the reasonable” and “the rational” are “two distinct and independent” ideas. This differentiation is essential to the viability of Rawls' conception of political liberalism insofar as it facilitates the recognition and subsequent voluntary acceptance of the need for a public conception of justice that requires all individuals to forsake the unfettered pursuit of their personal ambitions. However, the soundness of Rawls' argument is premised upon a number of questionable claims that, in effect, render (...) his proposed distinction between the reasonable and the rational more chimerical than real, and in so doing critically undermine the ability of his conception of justice to secure the type of voluntary public consensus he deems necessary to establish and sustain a just and stable liberal democracy. It is concluded that the only way one can be assured of generating the sought after conditions is to develop a regulatory framework that publicly supports and protects the principles embodied in Rawls' conception of reasonableness, rather than relying upon the reasonableness of individuals to secure and nourish the required conditions. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work.Habermas's theory (...) of democracy has at least three features that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. On this account, the rights of the individual that are central to liberalism can be guaranteed only within a constitutional framework that at the same time fosters democratic rights of political participation through the public sphere. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies.These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. Over the last twenty years, John Rawls has developed an approach to political philosophy which appeals to the notion of reflective equilibrium. This notion has proven suggestive to those attracted to coherence approaches to justification, in ethics and in other domains as well. In this paper, I explore the question whether Rawls’s approach provides a model for a coherentist account of justification, concluding that although the discussion of reflective equilibrium has provided helpful insights it has not produced a coherentist model (...) of justification.
