    Einstein considered fallibilist methodology obvious and metaphysics the challenging heuristic of physics. This philosophy is a minority view in academic philosophy. Most commentators on Einstein reject it and either refuse to ascribe it to him or declare it an impediment to his researches, his own opinion to the contrary notwithstanding.

    This paper challenges the assumption that legal sociology should apply itself to the external or factual properties of the law and leave the internal and normative aspects of legal phenomena to doctrinal scholars and moral philosophers. It argues that legal sociology explores the normative contexts of the law and other social systems, but being restricted by its “scientific” mode of expression it describes and analyses them in sociological rather than moral terms.     Alfred Schutz's phenomenology provides a philosophical context in which the sociology of knowledge can find its locus and limits. Schutz's The Phenomenology of the Social World describes those structures which are essential to consciousness, intersubjective understanding, and the social world.     The scientist's decision of accepting a given proposition is assumed to be dependent on two factors: the scientist's 'private' information about the value of that statement and the proportion of colleagues who also accept it. This interdependence is modelled in an economic fashion, and it is shown that it may lead to multiple equilibria.     Circulation of ideas among philosophers is the core of Philosophy itself. The lack of this circulation can lead to obscurantism and cultural provincialism.     This paper attempts to formalize the differences between two methods of analysis used by judicial opinions in common law jurisdictions to contradict holdings posited by earlier opinions: “disagreeing” with the holdings of the earlier opinions and “attributing” holdings to the prior opinions.
