Popular sovereignty is regarded here as one of the fundamental concepts of modern law. Indeed, the current literature is dominated by a kind of sociological perspective, which reduces this concept either to a motivational problem, or to a procedure. In contrast to this view, popular sovereignty can be justified as a legal philosophical answer to the normative question of the legitimacy of law. The first part of this study will address the question of possible functions of the concept of popular (...) sovereignty in law. In the second part, a historical/conceptual investigation of the concept of popular sovereignty will be developed on the basis of philosophical insights in the late Middle Ages and modern times. I show that in his De motu animalium Aristoteles proposes a teleology of the practical on the most general zoological level, i.e. on the level common to humans and self-moving animals. A teleology of the practical is a teleological account of the highest practical goals of animal and human self-motion. I argue that Aristotle conceives of such highest practical goals as goals that are contingently related to their realizations. In this text, I try to examine in sufficient detail what is the exact function that Aristotle ascribes to deliberation in the Nicomachean Ethics (NE). More specifically, I intend to evaluate, in the light of the arguments built along selected passages from books II, III and VI of that work, how and to what extent deliberation plays an important role in the achievement of virtuous actions and in the consolidation of the virtuous character. Proceeding from an argumentative analysis that intends (...) to elucidate how some of the central concepts of Aristotelian ethical reflection are articulated, I shall defend, in the last part of my exposition, the interpretation according to which the function of deliberation is to produce long-term purposes that determine courses of action and that, if implemented accordingly to the orthos logos by the moral agent endowed with phronēsis, achieve the end of virtue of character. Hans-Georg Gadamer é reconhecido como um dos mais importantes filósofos do famoso linguistic turn. Malgrado a aparente recepção de seus debates filosóficos no campo da hermenêutica jurídica e, mais recentemente, da ética do direito, o seu conceito de direito ou, mais precisamente, os fundamentos de uma possível filosofia do direito gadameriana nunca foram submetidos a uma investigação jusfilosófica mais detalhada. Em parte porque a maioria dos comentadores da obra de Gadamer continua a ler seus escritos com uma forte referência às (...) categorias ontológicas da sua obra magna, Verdade e Método. Neste ensaio, entretanto, propõe-se o estudo de alguns conceitos fundamentais da obra de Gadamer, em especial, os desenvolvidos em seus escritos posteriores, a fim de proporcionar uma visão mais adequada acerca dos fins, estrutura e fundamentos da sua ideia de direito. A tese principal deste estudo consiste em apresentar uma das possíveis interpretações do conceito aristotélico de phronesis como a principal fonte da contribuição de Gadamer para a filosofia prática e, por conseguinte, para o direito. Como consequência, será possível esclarecer, de forma não ontológica, os pontos básicos do projeto ético proposto por Gadamer e a fricção praxis-theoria presente no seu conceito de direito. (shrink)

In the Nicomachean Ethics, Aristotle makes the following claims: “the end cannot be a subject of deliberation, but only what contributes to the ends” (NE 1112b33-34) and “virtue makes the goal right, practical wisdom makes the things to- ward the goal right" (NE 1144a7-9). A problem arises from such claims: the ends as- sumed by a moral agent cannot be subject to rational choice. For deliberation, an intel- lectual procedure, is bound to deal with the things that contribute to the (...) ends, and the ends, in turn, fall within the realm of virtue of character, which is described by Aristotle as a virtue of the non-rational part of the soul. In order to understand how Aristotle sup- ports such thesis, this research investigates how virtue of character and practical wis- dom are related and their work to delimit the ends and the things that contribute to the ends in the moral actions. O objetivo dessa dissertação é discutir alguns conceitos que dizem respeito ao estatuto da eudaimonía, tendo como pressuposto que o texto da Ética a Nicômaco possa por si só esclarecer como ela é entendida por Aristóteles. Na minha hipótese, as discussões metodológicas estabelecidas no livro I servem como orientações suficientes para esclarecer a relação entre a realização da eudaimonía e o exercício das virtudes da alma, sem com isso haver a necessidade de que recorramos a outras obras de Aristóteles. Em (...) conseqüência dessa orientação, priorizei nessa pesquisa entender a afirmativa de Aristóteles de que a eudaimonía é um bem realizável pela ação do homem virtuoso, sendo um bem de caráter prático que consisti no exercício de um érgon, que é exclusivo ao homem; privilegiei então os conceitos relacionados à vida prática para o esclarecimento do que seja a eudaimonía, a relação entre as arētaí ēthikaí, a phrónesis e a sophía na sua realização, objetivando também, através dessa relação, entender as conexões entre lógos, práxis e páthos na realização do bem supremo do homem. Meu objetivo é pensar as relações entre a eudaimonía e as virtudes morais e intelectuais na Ética a Nicômaco; em conseqüência, compreender o lugar da vida prática e da vida teórica na realização da vida plena. O presente trabalho tem por finalidade analisar, a partir do livro V da obra Ethica Nicomachea, se a justiça poderia ser tomada como um meio que irá auxiliar os cidadãos a desenvolver plenamente as suas virtudes. Buscar-se-á fundamentar que é através da justiça que os bons cidadãos seriam formados, bem como o bom caráter seria cultivado. Analisar-se-á, também, ainda que minimamente, o que Aristóteles entende de fato por justiça, de que o justo seria dar a cada um o que lhe (...) é devido, o que merece, haja vista que essa afirmação traz consigo um peso muito grande, pois nos faz indagar sobre o que seria o devido de cada indivíduo, bem como quais seriam as bases relevantes do mérito. Isto é, se o justo é dar a cada um o que lhe é devido, cabe a nós nos perguntarmos de que forma e critério seria usado na distribuição. De certa forma, ao raciocinarmos sobre justiça e direitos, consequentemente temos de raciocinar sobre a finalidade, o objetivo, o telos das atividades que circundam a vida social na Pólis. Buscar-se-á discutir sobre os temas apresentados, porém não se tem por finalidade propor medidas para pôr um fim na discussão. (shrink)

Contrapondo-se às interpretações que sobrevalorizam o papel da razão nas escolhas dos fins morais, pretendo resgatar o papel positivo que a virtude do caráter, uma virtude não-racional, pode exercer em tais escolhas. Isto será feito levando em consideração a análise que Aristóteles faz da crise moral de Neoptólemo na tragédia Filoctetes.

In this paper, I put under scrutiny the arguments put forward by Aristotle in Nicomachean Ethics (NE) VI.9. The paper has two main parts. In the first, I examine the NE VI.9’s first part where Aristotle develops the concept of good deliberation, offering its definition in 1142b27-28. In the second, I examine the connection between good deliberation and phronesis, and, then, I discuss the vexata quæstio about if the lines 1142b31-33 might be read as introducing the claim that phronesis provides (...) moral ends.
