: Many people have lamented the proliferation of human rights claims. The cure for this problem, it may be thought, would be to develop a theory that can distinguish ‘real’ from ‘supposed’ human rights. I argue, however, that the proliferation of human rights mirrors a deep problem in human rights theory itself. Contemporary theories of natural rights to welfare are historical descendants from a theory of rights to subsistence which was developed in twelfth-century Europe. According to this theory, each human (...) being has a special role to fulfil in God's plan and therefore has inalienable rights to subsist. Later theories have secularized this idea by claiming that human beings are purposive agents. Secularization, however, comes at a price. In the case of these theories, the price is a failure to provide satisfactory answers to the most basic questions we would expect of a theory of natural rights to answer. They have failed to provide a basis for ascribing these rights to all and only to human beings. They have not been able to generate a clear and viable criterion for ascribing duties correlative to these rights. And they cannot limit rights-claims in a non-arbitrary way. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). With regard to the problem of world poverty, libertarian theories of corrective justice emphasize negative duties and the idea of responsibility whereas utilitarian theories of help concentrate on positive duties based on the capacity of the helper. Thomas Pogge has developed a revised model of compensation that entails positive obligations that are generated by negative duties. He intends to show that the affluent are violating their negative duties to ensure that their conduct will not harm others: They are contributing to (...) and profiting from an unjust global order. But the claim that negative duty generated positive obligations are more acceptable than positive duties is contestable. I examine whether Henry Shue’s model that is integrating negative duties and positive duties is more convincing concerning the foundation of positive duties to protect others. I defend the idea that there are positive duties of justice. This approach can integrate an allocation of positive duties via responsibility and maintain the advantage of an independent foundation of positive duties. (shrink)

Der Beitrag entwickelt ein neues, machtbasiertes Verantwortungsmodell für die individuelle Verstrickung in globale strukturelle Ungerechtigkeiten. Er geht von dem Problem aus, dass die meisten Bedingungen für die Zuerkennung moralischer Haftbarkeitsverantwortung in Fällen der individuellen Verstrickung in globale strukturelle Übel nicht erfüllt sind: Wenn eine Person beispielsweise ein unter ausbeuterischen Bedingungen produziertes T-Shirt kauft, so ist diese Handlung für das Eintreten der strukturellen Ungerechtigkeit weder hinreichend noch notwendig, die Person hat die strukturell ungerechten Eff ekte ihrer Handlung häufi g nicht intendiert (...) und kann die Folgen ihrer Handlungen epistemisch nicht ausreichend gut überblicken. Nicht zuletzt ist ihre Partizipation an der kapitalistischen Weltwirtschaftsordnung unfreiwillig. Der Beitrag diskutiert, welche Lösung Iris Marion Young in ihrem Modell kollektiv geteilter Verantwortung für dieses Problem vorgeschlagen hat, und argumentiert, dass hier insbesondere in Hinblick auf das Kriterium der kausalen Relevanz Probleme bestehen bleiben. Davon ausgehend schlägt der Beitrag ein ergänzendes, machttheoretisch begründetes Modell der Zuerkennung moralischer Haftbarkeitsverantwortung vor: Verantwortung wird diesem zufolge nicht nur in Bezug auf einzelne Handlungen konzeptualisiert, sondern auch in Bezug auf die strukturell generierte und generalisierte Handlungsfähigkeit, die Personen aufgrund ihres Status in Regelsystemen gegenüber anderen Personen besitzen. In diesem Sinne wird einzelnen Personen Verantwortung nicht nur für die kausalen Eff ekte ihrer Handlungen, sondern bereits für die kausalen Eff ekte der Annahme ihrer sozialen Macht über andere übertragen. Ich argumentiere, dass Personen für ihre soziale Macht gegenüber anderen verantwortlich gemacht werden können, weil diese Macht die generalisierte Vorbedingung ihrer individuellen Handlungsfähigkeit darstellt und weil sie ihre sozial konstituierte Handlungsfähigkeit durch jegliches Handeln implizit annehmen. Soziale Macht wird Personen durch soziale Regeln übertragen: Auch dominierende Macht besitzt jemand, ohne dafür notwendigerweise etwas tun zu müssen. Sobald eine Person ausgehend von ihrer sozialen Macht handelt, reproduziert sie damit notwendigerweise die sozialen Konstitutionsbedingungen ihrer Macht über andere. Genauer stellt die Annahme ihrer sozialen Macht eine NESS-Bedingung in Hinblick auf die Reproduktion derjenigen strukturell ungerechten sozialen Regeln dar, die ihr Macht erst übertragen haben. Dabei können Personen meistens vorhersehen, dass die Annahme ihrer sozialen Macht, d.h. ihrer sozialen Statusfunktionen globale strukturelle Ungerechtigkeiten auf kausal relevante Art und Weise reproduziert. Obwohl die Annahme sozialer Statusfunktionen normalerweise unfreiwillig ist, kann Personen für diese kompensatorische Verantwortung übertragen werden, insofern sie die ungerechten Effekte dieser Annahme vorhersehen können. Da die Effekte unserer Statusannahme kausal und epistemisch kollektiv geteilt sind, schlage ich vor, diese Form der Verantwortung als eine kollektiv-geteilte zu verstehen. Um strukturellen Ungerechtigkeiten abzuhelfen, müssen Personen entsprechend dazu beitragen, handlungsfähige kollektive Akteure – d.h. gerechte politische Institutionen – zu bilden. (shrink)

A standard objection to socioeconomic human rights is that they are not claimable as human rights: their correlative duties are not owed to each human, independently of specific institutional arrangements, in an enforceable manner. I consider recent responses to this ‘claimability objection,’ and argue that none succeeds. There are no human rights to socioeconomic goods. But all is not lost: there are, I suggest, human rights to ‘socioeconomic consideration’. I propose a detailed structure for these rights and their correlative duties, (...) while remaining neutral on substantive moral debates. I argue that socioeconomic-consideration human rights are satisfactorily claimable and sufficiently practical. (shrink)

There is no lack of criticisms frequently levelled against the international pharmaceutical industry (Big Pharma): excessive profits, dubious or even dishonest practices, exploiting the sick and selective use of research data. Neither is there a shortage of examples used to support such opinions. A recent book by Brody (Hooked: Ethics, the Medical Profession and the Pharmaceutical Industry, 2008) provides a précis of the main areas of criticism, adopting a twofold strategy: (1) An assumption that the special nature and human need (...) for pharmaceutical medicines requires that such products should not be treated like other commodities and (2) A multilevel descriptive approach that facilitates an ethical analysis of relationships and practices. At the same time, Brody is fully aware of the nature of the fundamental dilemma: the apparent addiction to (and denial of) the widespread availability of gifts and financial support for conferences etc., but recognises that ‘Remove the industry and its products, and a considerable portion of scientific medicine’s power to help the patient vanishes’ (Brody 2008, p. 5). The paper explores some of the relevant issues, and argues that despite the identified shortcomings and a need for rigorous and perhaps enhanced regulation, and realistic price control, the commercially competitive pharmaceutical industry remains the best option for developing safer and more effective medicinal treatments. At the same time, adoption of a broader ethical basis for the industry’s activities, such as a triple bottom line policy, would register an important move in the right direction and go some way toward answering critics. This essay makes three suggestions: first, that it is attractive to conceive individualistic justification as one of the hallmarks - maybe even the one hallmark - of human rights; secondly, that combining this conception of human rights with standard worries about socioeconomic rights can tempt one to take the phrase "human rights" to refer to any individualistically justified weighty normative consideration (including considerations that are not rights); and thirdly, that reflections on the individuation of rights and rights' dynamic quality give (...) us some reason to resist this temptation - though this reason is interestingly inconclusive.
