I defend a neo-republican account of the right to have political rights. Neo-republican freedom from domination is a sufficient condition for the extension of political rights not only for permanent residents, but also for temporary residents, unauthorized migrants, and some expatriates. I argue for the advantages of the neo-republican account over the social membership account, the affected-interest account, the stakeholder account, and accounts based on the justification of state coercion.

Temporary labor migration constitutes a significant trend of migration movements within the European Union, especially after the 2004 and 2007 EU enlargements. However, compared to other forms of TLM, intra-EU TLM has received scant attention from normative theorists. By drawing on Iris Marion Young's conception of structural injustice, this article analyzes the injustice of TLM within the EU. It argues that purely rights-based approaches are deficient and that a structural injustice approach is needed. The latter sheds light on the formal (...) and informal processes that place EU temporary migrants in a condition of vulnerability and reveals the multiple individual and collective agents participating in such processes. Moreover, such an approach offers important insights into the agency of migrants by showing how they themselves reinforce structural processes that put not only individual temporary migrants but also similarly positioned migrants and other members of the sending and receiving countries in a vulnerable position. A structural injustice approach does not deny that intra-EU temporary labor migrants should enjoy the rights and entitlements that they currently have in the host country as European citizens. Nor does it dispute that reducing the vulnerability of temporary migrants may require “special rights” accommodating the specific nature of their life plans. Instead, though such rights may be necessary, a structural injustice approach demonstrates how they are insufficient to tackle the injustice of intra-EU TLM and other forms of temporary labor migration more broadly. This article considers the implications of luck egalitarianism for a range of issues relating to international, South-North migration. More specifically, the implications of luck egalitarianism for the question of whether receiving societies are justified in extending to immigrants a less comprehensive set of rights than that enjoyed by other members of society are considered. First, are voluntary migrants responsible for their migration in such a way that receiving societies are justified in extending to them a less comprehensive set of rights (...) than if, say, they had been involuntary migrants, or citizens of the destination country? Since luck egalitarianism aims to redistribute only for inequalities for which individuals are not responsible, there is an issue of whether it will hold individuals responsible for their choice of migration in such a way that it may justify asymmetrical sets of rights between voluntary immigrants and other members of society. Second, it may be possible to allow access for a larger number of disadvantaged migrants if they are granted access to a less extensive package of rights when they reach the destination country than if they were granted access to a more extensive such package. If so, may not the less extensive package of rights turn out to have a greater positive impact on global equality? Both these arguments are critically discussed and it is concluded that neither justifies extending to immigrants a less comprehensive set of rights. (shrink)

The article argues that the ‘crisis of Europe’, triggered by market and governance dysfunctionalities (summarized as the Euro crisis), represents a ‘critical moment’ in the evolution of a European society. This society so far does not offer much resistance to such critical moments which is due to its incapacity to form a demos capable of acting together. The existing European society – and this is the basic claim – is nothing but the sum of individuals living in ‘sub-European’ (mainly national) (...) groups. The evolution triggered by this critical situation opens pathways to turn these peoples of Europe into something more than being a sum of peoples governed by supranational bureaucracies. To decipher such processes a model is presented using Hirschman’s idea of exit, voice and loyalty as mechanisms to generate social ties. Two points arise as crucial. The first is the observation that national societies which continue to provide foundational claims for people have turned into interest groups in the context of the European Union. This undermines not only the ontological nationalism still dominating the self-presentation of national societies in Europe, but it also offers evolutionary paths towards a society beyond national foundational claims in Europe. Yet it also provokes reactive processes such as the return to the self-contained nation (or even ethnic group). This is the core of the crisis of Europe. The systemic crises of the state and the market in Europe are speeding up an evolutionary process of people-making, the outcome of which could be either the regression to a people with foundational identities or to a people without foundational identities. The latter will be described as a postnational society, which would make an emerging European society the first really modern society. (shrink)

In this paper I will hold that it is desirable to ensure people be included within the borders and the political community both, but I will point out the potential incompatibility of the two. In an open-borders society, members of a polity would not be exclusively individuals who expect to stay in a country for a long time but also people who temporarily work and live there. Among this latter group would be individuals who would continuously migrate—call them hypermigrants. While (...) I agree that hypermigrants cannot be fully included in the decision making, excluding them is problematic because it justifies a hierarchical society. The case of hypermigrants points to the tension between treating people as equals by including them in a democratic system whose members do not simply support their own interests but strive for the common good and by including them in an open-borders society that acknowledges their life plans as of equal worth. To overcome these problems I will claim that it is possible to justify an account of a fluid demos that provides different levels of political inclusion and addresses the challenges of a hypermigration polity. In this account, citizenship and full political inclusion are granted to permanent members only but hypermigrants are partially included. This perspective recognises every member of the polity as equal and ensures that she has control over the relevant political decisions without undermining the idea that citizenship requires a sense of belonging to the political community and concern for its long-term interests. The political theory of migration has largely occurred within a paradigm of methodological nationalism and this has led to the neglect of morally salient agents and causes. This article draws on research from the social sciences on the transnationalism, globalization and migration systems theory to show how methodological nationalist assumptions have affected the views of political theorists on membership, culture and distributive justice. In particular, it is contended that methodological nationalism has prevented political theorists of migration from addressing the roles (...) of non-state agents and of transnational economic, social and political structures. These agents and structures contribute to the asymmetrical distribution of goods and opportunities and thus have important implications for debates about migration and distributive justice. (shrink)
