Despite liberalism's considerable internal heterogeneity, liberal approaches to the management of ethno‐cultural relations in diverse societies are unified in one respect: they revolve around the implicit assumption that there are three distinct approaches the state can take toward this issue, namely, domination by one cultural group, a politics of recognition, and state neutrality. This articles argues that in the context of an unequal distribution of societal power among ethno‐cultural groups there are, in fact, only two basic state approaches to the (...) management of diversity: privilege and recognition. The liberal idea of state neutrality, instead of representing a third alternative, falls squarely within the privilege approach. State neutrality is a cornerstone of currently predominant strands of liberalism. However, drawing on Walzer's distinction between the two types of liberalism, the article demonstrates that a politics of recognition is not necessarily irreconcilable with liberal tenets. (shrink)

While there has been renewed attention to racial justice in the United States and around the world recently, there is a long tradition among philosophers and other theorists of reflecting on the nature racial injustice and the remedies that it demands. This article discusses two prominent approaches to racial justice, liberal egalitarian theory and critical race theory, and focuses on four issue areas: reparations, affirmative action and race‐conscious policy, integration, and criminal justice. Although liberal and critical approaches to racial justice (...) are sometimes seen as in opposition to each other, it is argued here that there is often convergence as well. Despite their differing pedigrees, a shared commitment to racial equality and a shared recognition of the profound, structural nature of racial inequality often leads scholars from different starting points to similar, radical conclusions. This essay discusses the most recent manifestations of the debate of the law and literature movement. The essay traces the evolution of the Law and Literature schools and identifies some of their adherents and conclusions, shows how these schools have influenced the conceptual development and teaching of American law, presents connections between the Critical Legal Studies and Law and Economics movements in the U.S., and raises questions about the Law and Literature movement.

ABSTRACTThis article offers a Critical Discourse Analysis of an episode of the reality TV show Tia & Tamera. A symbolic interactionist frame provides a lens for focusing on how social interactions impact the ways in which meanings of race are constructed around the topic of biraciality, while critical race theory facilitates an understanding of this construction on a macro-level. Conversations between the biracial title characters and their family and friends comprise the data corpus considered for analysis. Three notable themes emerge (...) from the discourses observed: race talk is avoided; racial understanding varies in public and private contexts; and realities of racial self-concepts based upon past experiences shape expectations of future racial self-concepts. Each theme provides insight into how and why the title character engages in discourse work that serves to establish the racial identity of her yet unborn son within the context of a societal structure that leaves her without a range of choices for how to do so. Philosophers have little to lose in making practical proposals. If the proposals are enacted, the power of ideas to change the world is affirmed. If the proposals are rejected, there is new material for theoretical reflection. During the 1990s, I believed that broad public recognition of mixed race, particularly black and white mixed race, would contribute to an undoing of rigid and racist, socially constructed racial categories. I argued for such recognition in my first book, Race and Mixed Race (Zack (...) 1993), a follow-through anthology, American Mixed Race (Zack 1995), and numerous articles, especially the essay, ''Mixed Black and White Race and Public Policy," which appeared first in Hypatia in 1995. I aho delivered scores of public and academic lectures and presentations on this subject, all of which expressed the following in varied forms and formats: Race is an idea that lacks the biological foundation it is commonly assumed to have. There is need for broad education about this absence of foundation; mixed-race identities should be recognized, especially black-white identities. (shrink)

Critical Race Theory (C.R.T.) has developed out of a deep dissatisfaction that many black legal scholars in the U.S. felt with liberal civil rights discourse, a discourse premised upon the ideals of assimilation, ‘colour-blindness’ and integration. In addition, the emergence of the Critical Legal Studies movement provided Critical Race theorists with an innovative lexicon and practice which allowed them to develop a critique of traditional race analysis and U.S. law. Patricia Williams has played a key role in the formation of (...) the C.R.T. movement and is concerned with many of the C.R.T. themes: the understanding that traditional civil rights law has benefited whites more than blacks, the ‘call to context’, and the critique of liberalism by the assertion that racism is routine and not aberrational. Following the C.R.T. belief that form and substance are connected, Williams has also extended the boundaries of another C.R.T. theme by (largely) eschewing the conventional genre of legal writing in much of her work, including her two books, The Alchemy of Race and Rights and The Rooster's Egg. This was one of the issues Williams discussed in an interview that commenced when she visited Britain in 1997 to deliver the Reith Lectures. (shrink)

Amy Sonnie and James Tracy’sHillbilly Nationalists, Urban Race Rebels, and Black Power, Dan Berger’s anthologyThe Hidden 1970sand Jefferson Cowie’sStayin’ Alive, in different ways, articulate an understanding of the political ferment that gripped the United States in the late 1960s and 1970s and its complex legacy for those struggling to change the world today. While Cowie provides a broad-brush if ultimately flawed overview of labour’s declining influence during the 1970s, Sonnie and Tracy focus their attention on five radical organisations that challenged (...) deep divisions of race to condemn inequality and oppression, and Berger similarly encompasses contributions evaluating the impact of a variety of left organisations including the Puerto Rican nationalist movement, indigenous and Black nationalist quests to establish self-determination, and the extraordinary Sojourner Truth Organization. This review critically evaluates the strengths and weaknesses of the arguments made by Sonnie and Tracy, Berger and Cowie and suggests how they may be helpful for future struggle. (shrink)

The research aims to explore the changes of national identity among Chinese international students in the odd social context of the global pandemic. By conducting semi-structured interviews with 10 Chinese undergraduate and postgraduate students in a prestigious university located in London, UK, the study provides evidence of Western neo-racism against Chinese students and the rise of Chinese nationalism. More significantly, it is found that Western neo-racism and Chinese nationalism have a push and pull effect on the national identity enhancement of (...) Chinese international students. The participants revealed that bottom-up popular nationalism is more than a shadow of top-down state nationalism in China, and is more influential on students’ national identity formation. The research also discusses the implications of these findings, limitations and future research directions. (shrink)

Contributors were asked: What will political theory look and sound like in the next century and beyond? What claims might political theorists or their descendants be making in ten, twenty-five, fifty, a hundred years’ time? How might they vindicate those claims in their future contexts? How (...) will the consistent concerns of political theorists evolve into the questions critical for people decades or centuries from now? What new problems will engage the political theorists (or their rough equivalents) of the future? What forms might those take?
