It is a widespread opinion that toleration, as a political practice, has merely instrumental value. The aim of this paper is to defend, on the contrary, that toleration has political value in itself. In more specific terms, I will claim that it is valuable in itself in virtue of its intrinsic relationship with democracy. Toleration is a constituent of democracy inasmuch as it is necessary for the existence of a democratic administration of political power. I will show that that relation (...) of constitution holds because toleration, through the protection of spaces of contestation to the political power, contributes to solving democracy’s inner tension resulting from its practical implementation. -/- Es una opinión extendida que la tolerancia, en cuanto práctica política, tiene valor meramente instrumental. Contemporary philosophical debates surrounding toleration have revolved around three issues: What is toleration? Should we tolerate and, if so, why? What should be tolerated? These questions are of central importance to social and political thought.

Se consideran dos objeciones que dependen de cómo describimos los conflictos políticos y, en particular, los de tolerancia. Se presenta una teoría de descripciones políticas y cómo con ella podemos responder, de una ma-nera políticamente satisfactoria, a las dos objeciones que se plantean en el artículo. La idea subyacente es que la tolerancia es incompatible con el respeto que nos debemos como iguales en una democracia. En este artículo argumentamos que la noción de respeto que motiva tal movimiento es inadecuada políticamente, dados los profundos desacuerdos de nuestras sociedades. On the standard view, pessimism is a philosophically intractable topic. Against the standard view, I hold that pessimism is a stance, or compound of attitudes, commitments and intentions. This stance is marked by certain beliefs—first and foremost, that the bad prevails over the good—which are subject to an important qualifying condition: they are always about outcomes and states of affairs in which one is personally invested. This serves to distinguish pessimism from other views with which it is routinely conflated— including (...) skepticism and nihilism—and to allow for the extent to which pessimism necessarily involves more than the intellectual endorsement of a doctrine. This paper examines and criticizes the defence of toleration due to John Rawls in Political Liberalism, and similar strategies mobilized in defence of toleration. It argues that the notion of the burdens of judgement, used by Rawls to defend his doctrine of reasonable pluralism, faces incoherence: schematically, either disagreement succumbs to reason, or vice versa. On similar grounds, reasonable disagreement defences of neutrality fail because of a double-mindedness about the relation between private judgements and public reason. This problem arises, it (...) is argued, from an attempt to make private judgements determinative in the formation of political and legal outcomes, even while subjecting the latter’s justification to norms of public reason. Deference to private judgements in political justification tends to countenance sedition, and this applies also to modern liberal attempts such as Rawls’s to ground toleration in private judgements. This article deals with modus vivendi, toleration and power. On the face of it toleration and modus vivendi are in tension with each other, because of the power condition on toleration: that an agent is tolerant only if they have the power to engage in an alternative, non- or intolerant form of behaviour, and this seems to be absent in modus vivendi. The article argues that the scope of the power condition is unclear, but might be thought much more extensive (...) than usually supposed. This becomes clear when the agent’s thoughts are subjected to a counterfactual test, concerning what would occur in their ideal world. However it is in the nature of ideals that they cannot usually be subject to a counterfactual variation here, since they determine the ideal world’s content. The article concludes that only a commitment to the other party’s freedom for its own sake proves robust in the face of counterfactual idealisation, but that it is questionable whether the dispositions that characterise toleration should be subject to so demanding a test. This article challenges two dominant views of religious and cultural toleration, namely, that it is modern and that it is Western. It claims instead that both medieval Latin thought and many non-Western traditions embraced a position that coherently defends tolerance beliefs and practices. Specifically, the article identifies four approaches that clearly favour toleration: scepticism, functionalism, nationalism and mysticism.

The philosophical tradition of liberal political thought has come to see tolerance as a crucial element of a liberal political order. However, while much has been made of the value of toleration, little work has been done on individual-level motivations for tolerant behavior. In this article, we seek to develop an account of the rational motivations for toleration and of where the limits of toleration lie. We first present a very simple model of rational motivations for toleration. Key to this (...) model is an application of David Ricardo’s model of trade to thinking about toleration. This model supports the claim that we always have reasons to be as tolerant as possible. We then explore why we do not always see tolerant attitudes in the actual world, and point to some potential preconditions for toleration that the initial model does not capture. Subsequently, we examine a more detailed model that allows us to investigate more carefully the conditions under which tolerant behavior can be rewarded. We conclude by arguing that a consideration of self-interested motivations for toleration is essential to the success of a robust theory of toleration for a diverse society, but that even this approach has its limitations. Based on 2010 to 2019 Chinese outward foreign direct investment panel data from 39 host countries, this paper studies the relationships between host country cultural characteristics and Chinese OFDI. The OLS regression results show that the cultural tolerance and trust in the host countries are significantly positively correlated with Chinese OFDI, which are robust according to the system GMM tests. Further analysis reveals that cultural tolerance is more positively related to Chinese OFDI in host countries with higher legislation and economic (...) freedom, while cultural trust is positively associated with Chinese OFDI in host countries with lower legislation and economic freedom. In addition, higher cultural tolerance and trust promote Chinese OFDI in countries with greater cultural distance. Unlike traditional studies based on cultural distance in international trade, using more representative cultural characteristics, this paper provides references to Chinese OFDI decision-making based on the root characteristics associated with heterogeneous cultural influences. The paper investigates whether states can sensibly be described as tolerant or respectful in ways theoretically relevantly similar to the standard analyses. This is a descriptive question about the applicability of concepts rather than a normative question about whether, when and why states should (...) be tolerant or respectful. The problem of institutional application is that institutions in general and the state in particular arguably cannot have attitudes of the required kind. This problem is distinct from, and broader than, well-known problems about whether political toleration is normatively legitimate. To make sense of political toleration or respect, the paper proposes that the analysis of institutional toleration and respect should not be solely agent-centred or patient-centred. The analysis should also include features about the relation itself. We can describe institutions as tolerant or respectful in a sense relevantly similar to the standard analyses if we focus on the public features of the relation between institutions and citizens or groups, without ascribing attitudes in the problematic sense. Die Idee der Toleranz führt in unserer liberalen Gesellschaft eine Art Doppelleben. Einerseits gibt es einen breiten öffentlichen Konsens darüber, dass Toleranz eine gute Sache ist. Andererseits haben die begrifflichen und normativen Paradoxien, die dem Toleranzkonzept offenbar inhärent sind, in der politischen Philosophie für Verwirrung gesorgt. In dieser Abhandlung verteidige und spezifiziere ich die Auffassung, dass Toleranz eine Kombination aus Ablehnung und Akzeptanz beinhaltet. Ich fokussiere mich vor allem auf die Akzeptanzkomponente, die bislang vernachlässigt worden ist. Diese Vernachlässigung erklärt einen (...) Großteil der Verwirrung, für die das Konzept der Toleranz gesorgt hat. Wenn wir einsehen, dass Akzeptanz den Verzicht auf besonders grausame oder gemeine Arten der Intervention meint, sollte klar sein, warum Toleranz moralisch geboten ist. Toleration is typically defined as follows: an agent (A), for some reason, objects to certain actions or practices of someone else (B), but has outweighing other reasons to accept these actions or practices nonetheless and, thus, refrains from interfering with or preventing B from acting accordingly, although A has the power to interfere. So understood, (mutual) toleration is taken to allow for peaceful coexistence and ideally even cooperation amongst people who disagree with each other on crucial questions on how to (...) live and what to value, which is why it has traditionally been regarded as an important part of political liberalism. An explicitly value-neutral liberal state then avoids taking sides when it comes to different and competing ways of life. However, following this idea of liberal neutrality, it has been questioned whether a value-neutral liberal state still needs toleration or is even compatible with it, for apparently neutrality leaves no more room for the objection component of toleration to take hold. In this paper, I take up this question and argue that there is, indeed, conceptual and practical room left for a value-neutral liberal state to be tolerant. Drawing on the interplay between four kinds of reasons (pragmatic, ethical, moral, and political), pragmatic and political reasons may still provide the needed evaluative and normative ground upon which the combination of objection and outweighing acceptance can be made sense of. However, the possible scope of toleration for a value-neutral liberal state is considerably limited. (shrink)

The article considers whether tolerance, in the classical liberal sense, should be promoted in public education. The most substantial counter-argument is that it is problematic to uphold the ?objection condition,? explained below, which is an integral part of classical tolerance, while maintaining tolerance as a virtue. As a response to this, I first discuss an alternative interpretation of tolerance ? ?tolerance as being open-minded, unprejudiced and positive towards difference.? I contend that this understanding is not the preferable one in public (...) education, because it lacks sufficient distinctiveness and threatens to marginalize or exclude the classical concept of tolerance. I instead propose a modified version of classical tolerance to be promoted in public education, whereby permissible objections are restricted so as not to disrespect persons. This version allows, however, for pupils to have a wide range of objections while still being candidates for being called tolerant, with the result that promoting tolerance may clash with other important educational objectives. I argue that promoting tolerance is still needed as part of a robust educational approach to plurality in modern democratic states, but that we must be willing to accept that promoting tolerance sometimes assumes the place of a second-best educational alternative. Toleration is one of the fundamental principles that inform the design of a democratic and liberal society. Unfortunately, its adoption seems inconsistent with the adoption of paternalistically benevolent policies, which represent a valuable mechanism to improve individuals’ well-being. In this paper, I refer to this tension as the dilemma of toleration. The dilemma is not new. It arises when an agent A would like to be tolerant and respectful towards another agent B’s choices but, at the same time, A is (...) altruistically concerned that a particular course of action would harm, or at least not improve, B’s well-being, so A would also like to be helpful and seeks to ensure that B does not pursue such course of action, for B’s sake and even against B’s consent. In the article, I clarify the specific nature of the dilemma and show that several forms of paternalism, including those based on ethics by design and structural nudging, may not be suitable to resolve it. I then argue that one form of paternalism, based on pro-ethical design, can be compatible with toleration and hence with the respect for B’s choices, by operating only at the informational and not at the structural level of a choice architecture. This provides a successful resolution of the dilemma, showing that tolerant paternalism is not an oxymoron but a viable approach to the design of a democratic and liberal society. (shrink)

In situations where we ought to tolerate what we morally disapprove of we are faced with the following moral conflict: we ought to interfere with X, we ought to tolerate X, we can do either, but we cannot do both. And the aim of this paper is to clarify the relationship between toleration as a value commitment and value pluralist and value monist approaches to moral conflict. Firstly, value monists side-step the moral conflict at the heart of toleration. Nonetheless, secondly, (...) it is not the case that toleration as a value commitment is entailed by value pluralism. Rather, the value pluralist line of argument that can be defended is that toleration is simply one value among others, that there is no general rule showing that it has priority over other values, but also that it cannot be excluded altogether as a value. Cet article explore les conséquences pour le libéralisme politique de considérer l’existence d’un pluralisme raisonnable au sujet des différentes conceptions du juste. Comment une conception publique de la justice peut se développer malgré un désaccord raisonnable et profond sur les termes mêmes de cette justice ? En comparant le libertarisme, la justice comme équité et l’égalitarisme strict, il sera montré que les concepts fondamentaux de ces conceptions du juste sont essentiellement contestés. Two normative principles of toleration are offered, one individual-regarding, the other group-regarding. The first is John Stuart Mill’s harm principle; the other is “Principle T,” meant to be the harm principle writ large. It is argued that the state should tolerate autonomous sacrifices of autonomy, including instances where an individual rationally chooses to be enslaved, lobotomized, or killed. Consistent with that, it is argued that the state should tolerate internal restrictions within minority groups even where these prevent autonomy promotion of (...) members of the group. The purpose of this paper is to shed light on what liberal states should tolerate outside their borders. This requires definitions of `liberalism, ́ `toleration, ́ and `state. ́ In the first section of this paper, I briefly indicate how I use those and other terms necessary to the discussion and introduce the normative principle I take liberals to be committed to. In the second section, I continue clearing the path for the rest of my discussion. In the rest of (...) the paper, I draw conclusions about what liberals should tolerate outside their state that I believe follow from the proffered definitions and principles. I limit myself to interference aimed at providing humanitarian aid, but do so in a way that is meant to provide resources for thinking about other sorts of interventions. In the third section, I consider humanitarian interventions done with the permis- sion of the other state and will point toward a toleration-based view; here we are really talking about non-toleration of suffering. In the fourth section, I consider humanitarian interventions done without the permission of the other state; here we are talking about non-toleration of a state that harms its residents. Some claim that liberalism’s neutrality toward the Good encourages anomie, thereby disallowing social confirmation of beliefs, leaving the individual with an uncertainty about judgments that is opposed to confidence and self-respect. This is the “anomie challenge.” I begin by discussing toleration and neutrality and motivating the problem. I then look at responses to the challenge by liberal pluralists and liberalism’s critics. After dismissing both, I argue that the right to choose is the good to be advocated and that it allows (...) for supportive, but voluntary, social structures. For many liberal democrats toleration has become a sort of pet-concept, to which appeal is made in the face of a myriad issues related to the treatment of minorities. Against the inflationary use of toleration, whether understood positively as recognition or negatively as forbearance, I argue that toleration may not provide the conceptual and normative tools to understand and address the claims for accommodation raised by at least one kind of significant minority: democratic dissenting minorities. These are individuals, or aggregates (...) of them, who oppose, on principled grounds, the outcomes of the majoritarian decision-making process. I argue that democratic dissenting minorities' claims are better understood as calls for respect for a person's capacity for self-legislation. I view respect as the cornerstone of justice in a liberal democracy: all norms resulting in a constraint on a person's conduct should be appropriately justified to her. I argue that the reconciliation of democratic dissenting minorities' claims requires an enhancement of the justificatory strategies of democratic decisions by enhancing in turn citizens' rights to political participation. This should be done both during decision making and after a provision is enacted by also securing space for contestation through such forms of illegal protest as civil disobedience and conscientious objection. In this article, we engage critically with the understanding of majority-minority relations in a liberal democracy as relations of toleration. We make two main claims: first, that appeals to toleration are unable to capture the procedural problems concerning the unequal socio-political participation of minorities, and, second, that they do not offer any critical tool to establish what judgements the majority is entitled to consider valid reasons for action with respect to some minority. We suggest supplementing the reference to toleration with (...) a specific interpretation of respect for persons; all persons should be treated equally as self-legislators and as if they were opaque to our judgement as regards their agential abilities, on which their capacity for self-legislation supervenes. Minorities are disrespected in this sense whenever are treated merely as the addressees of the rules constraining the formulation and pursuit of their life-plans, rather than as their co-authors on an equal footing with the majority, and whenever their treatment in politics and society is considered as legitimately influenced by the majority's judgement of their agential abilities, either directly or by indirect inference from the evaluation of the content of their beliefs and practices. In this paper, I revise the circumstances in which someone has the power to tolerate. I argue that the answer must incorporate both metaphysical and practical considerations. Specifically, I argue that someone has the power to tolerate when her properties ground that power in the practical situation in which the person finds themselves, characterized by her (...) practical interests. In doing so, I criticize Glen Newey’s analysis of this power. Resumen: La tolerancia es un privilegio de los poderosos. Una persona puede tolerar sólo si tiene el poder para interferir con aquello que objeta. En este artículo analizaré las circunstancias en las que alguien tiene el poder para tolerar. Específicamente, defenderé que alguien tiene el poder para tolerar cuando sus propiedades fundan tal poder en la situación práctica en que ella se encuentra, según es caracterizada por sus intereses prácticos. In the literature on toleration, epistemic arguments are commonly equated with John Stuart Mill's fallibilism according to which toleration of opinions is a necessary means to the attainment of truth. This conflation does not capture the variety of those arguments and it results from the fact that a proper analysis of epistemic arguments for religious toleration and a systematic account of their different types are still lacking. The purpose of this article is to provide such an analysis and to argue (...) that those arguments come in four different types, which I name fallibilism, religious belief-forming process, epistemic parity, and differentiated access to religious truth or divine message. I also offer a mapping of those different types of arguments using the standard epistemic notions of justification, truth, and belief coupled with a distinction of focus in the epistemological approach – whether individually or socially focused. Following Andrew Jason Cohen, Lucia Rafanelli construes toleration to consist in not merely limiting one’s interference with others’ behaviour, but doing so because of a principled commitment to respecting others’ independent choices. I argue that this conflates toleration with distinctly liberal ideals such as freedom of conscience or autonomy. This conflation not only impoverishes our conceptual vocabulary by using ‘toleration’ to label concepts or phenomena for which there are already perfectly good words, it also renders non-liberal conceptions or theories of (...) toleration nonsensical by definitional fiat. This in turn risks making the historical emergence of theories and practices of toleration on purely prudential grounds – namely, reasons of state – unintelligible. Even though this does not, I think, compromise Rafanelli’s substantive normative conclusions about interference, it does raise important questions about the proper relation between contemporary political theory and the history of political thought. More than ever before, being able to draw a distinction between the tolerable and the intolerable is necessary. Unfortunately the traditional understanding, as identified with the Enlightenment view first articulated by John Locke, presents merely formalistic criteria. Lacking substantive criteria, our contemporary understanding of toleration is inadequate to our needs.

This paper gives an overview of Pierre Bayle’s theory of toleration and derives a normative principle of toleration from it that is meant to compete with other normative principles of toleration such as the Harm principle.

A response to critical commentaries. Crookston begins her commentary by noting that my book would have been better with answers to “the following three questions: (1) Why is the harm principle the right principle upon which to base a theory of toleration? (2) How is Cohen thinking of the concept of volenti? (p. x ) Is interference (i.e., the abandonment of toleration) ever morally required by the harm principle?” (p. x ). She is right, and I address these questions below (...) in Sections 2, 3, and 4. That is the bulk of this essay. I then turn to Kelley's issues in Sections 6, 7, and 8; these have to do with “the link between toleration and relativism,” the way I distinguish “the concepts of toleration and endurance,” and a “question about moral toleration” (p. x ). This article takes a close look at the discussion of singularity in Jean-Luc Nancy’s Inoperative Community and Being Singular Plural with the aim to comment on subject-object dichotomy and create a new context for its relationship with resistance. The philosophy of singularity is critical of humanism and the individualist model of subjectivity it advocates. By placing a challenging scenario of antihumanism against the humanist sense of responsibility, the philosophy of singularity questions whether it is possible to do philosophy without saying (...) ‘I’. This antihumanist stance, which replaces the ‘I’/‘other’ differentiation with Nancy’s ‘the other of another,’ chooses to strengthen the link between ontology and resistance in the notion of coexistence; beyond traditional hypotheses on immanence and transcendence. To discuss the merits and limits of this coexistence, the article digs under the notion of individualistic subjectivity and proceeds to ground Nancy’s ‘ekstasis’ on the Freudian theory of drives. Against this theoretical background, the values of modesty and responsibility come to formulate an alternative moral consciousness, which no longer relies on the humanist jargon to work toward the common ground between 'I' and 'we'. This dissertation defends a “non-ideal theory” of justice: a systematic theory of how to respond justly to injustice. Chapter 1 argues that contemporary political philosophy lacks a non-ideal theory of justice, and defends a variation of John Rawls’ famous original position – a Non-Ideal Original Position – as a method with which to construct such a theory. Chapter 1 then uses the Non-Ideal Original Position to argue for a Fundamental Principle of Non-Ideal Theory: a principle that requires injustices to be (...) dealt with in whichever way will best satisfy the preferences of all relevant individuals, provided those individuals are all rational, adequately informed, broadly moral, and accept the correct “ideal theory” of fully just conditions. Chapter 2 then argues for the Principle of Application – an epistemic principle that represents the Fundamental Principle’s satisfaction conditions in terms of the aims of actual or hypothetical reformist groups. Chapters 3-5 then use these two principles to argue for substantive views regarding global/international justice. Chapter 3 argues that the two principles establish a higher-order human right for all other human rights to promoted and protected in accordance with the two principles of non-ideal theory. Chapter 4 argues that the two principles defeasibly require the international community to tolerate unjust societies, provided those societies respect the most basic rights of individuals. Finally, Chapter 5 argues that the two principles imply a duty of the international community to ameliorate the most severe forms of global poverty, as well as a duty to pursue “fair trade” in international economics. All of a sudden, religious awareness has started to regain a relevance it had lost among Europeans. It is not that it had disappeared from European societies, but rather that it existed at a discreet secondary level. However, Europe is less secular and more post-secular than many would like to admit. The liberal model of freedom of conscience, it is, the separation between justice, the norms of political and institutional coexistence, and the whole model of toleration is being questioned from (...) all sides, and this essay will focus on one of these questions. If we take the political liberalism of Rawls as the paradigm of the liberal model, we can see that it gives rise to variations posing challenges that are more profound than they initially appear. This essay will look at one of these variations, raised by Martha Nussbaum, which is based on the demand for equality for believers underpinned by the idea of respect, which in her view is more desirable than toleration alone. Political philosophy has seen vibrant debate over the connection, if any, between liberalism and pluralism. Some philosophers, following Isaiah Berlin, reckon a close connection between the two concepts. Others--most notably John Gray--believe that liberalism and pluralism are incompatible. In this essay, I argue that the puzzle can be solved by distinguishing the responsibilities of liberal states to their peoples from the responsibilities of liberal states to other states. There is an entailment from pluralism to liberalism, and it in turn implies (...) that while liberal states must tolerate "illiberal" lifestyles within their borders, liberal states must not tolerate illiberal states. The fact of liberal intolerance, however, does not justify unreasonably aggressive intervention by liberal states, nor does it mean that illiberal states deserve to be punished. (shrink)

Issues relating to diversity and pluralism continue to permeate both social and political discourse. Of particular contemporary importance and relevance are those issues raised when the demands associated with forms of pluralism clash with those of the liberal state. These forms of pluralism can be divided into two subcategories: thin and thick pluralism. Thin pluralism refers to forms of pluralism that can be accommodated by the existing liberal framework, whereas thick pluralism challenges this liberal framework. -/- This thesis is an (...) examination of four forms of political association that may be able to accommodate and support the demands of pluralism. These four models are Rawls’ political liberalism, Crowder’s value pluralism, Rorty’s post-foundational liberalism, and Mouffe’s radical democratic project. What unites these four forms of political association is their capacity to avoid the exclusionary effects of a form of liberalism that I, following Gaus, refer to as Enlightenment liberalism. As the name suggests, this conception of liberalism is anchored in the Enlightenment, and in particular with what may be considered as the Enlightenment view of reason. As such, therefore, Enlightenment liberalism is both universal and perfectionist. In this context, I argue that Enlightenment liberalism is a species of what Berlin refers to as ‘moral monism’. -/- These four forms of political association are ordered in such a way as to chart an intellectual trajectory. Rawls and Crowder are both situated firmly within the liberal tradition, whereas Rorty and Mouffe move beyond this, and embrace a form of post-foundational politics. It is in this trajectory that the second theme of this thesis emerges. This is centred on a paradox: in order to avoid the exclusionary effect of Enlightenment liberalism and embrace a form of political association that meets the demands of pluralism and diversity, the models examined still promote autonomy as the dominant virtue. It has been suggested that to overcome the challenges facing the UK’s National Health Service (NHS) of an ageing population and reduced available funding, the NHS should be transformed into a more informationally mature and heterogeneous organisation, reliant on data-based and algorithmically-driven interactions between human, artificial, and hybrid (semi-artificial) agents. This transformation process would offer significant benefit to patients, clinicians, and the overall system, but it would also rely on a fundamental transformation of the healthcare system in a way that (...) poses significant governance challenges. In this article, we argue that a fruitful way to overcome these challenges is by adopting a pro-ethical approach to design that analyses the system as a whole, keeps society-in-the-loop throughout the process, and distributes responsibility evenly across all nodes in the system.
