Our aims in this paper are: (1) to indicate some of the many ways in which needs are an important part of the moral landscape, (2) to show that the dominant contemporary moral theories cannot adequately capture the moral significance of needs, indeed, that the dominant theories are inadequate to the extent that they cannot accommodate the insights which attention to needs yield, (3) to offer some sketches that should be helpful to future cartographers charting the domain of morally significant (...) needs, and (4) to consider some anticipated objections to our project and offer some replies. A recent resurgence of interest within analytical political philosophy in the status of ethnic and national minorities coincides with the re-emergence of national identity as a primary organizing principle of political conflict, and with an increasing attentiveness to identity and recognition as organizing principles of political struggle. The recent theoretical literature within political philosophy has focused very much on recognizing the importance of national identity, and allowing attention to national sentiment to inform the design of social institutions.In this paper I (...) shall state the case for a version of the position which Will Kymlicka has dubbed ‘benign neglect’ toward cultural identities. Benign neglect is the position that the state should, as far as possible, be neutral among the cultural sentiments of its citizens. The position is, I think, implicit in the theoretical work of many contemporary liberals, and also in much socialist theory and some socialist practice. But it is rarely defended explicitly. Liberal theory is generally developed on the unrealistic assumptions that the society to be regulated is closed and coincides with the membership of a single nation. (shrink)

The theory of needs has a political problem. Whilst contemporary theorists largely recognise that politics plays an important part in many of the processes surrounding our needs, they nevertheless hang onto the notion that our most important needs can be determined outside of the political. This article challenges that framing. It does so through a taxonomy and critique of the major contemporary approaches to needs. Considering the works of Len Doyal and Ian Gough, Martha Nussbaum, and Lawrence Hamilton, I divide (...) these into three strands: theories that attempt to avoid, solve, and improve the politics of need. Despite some major differences, these approaches share an understanding of the underlying challenges involved in discerning which needs matter. That framing, I argue, is responsible for certain intractable difficulties that leave needs theorists unable to provide the solutions they demand to the theoretical dilemma they posit. Moreover, in attempting to find those solutions, these theories end up ignoring their partisan implications. The conclusion I reach is that the political theory of needs is not very ‘political’ at all, and that this represents the root of the problem. I thus suggest an alternative, politically realist framing that conceptualises needs as constitutively political. (shrink)

This paper investigates one of Anderson’s (2007) objections to individually-allocating principles of distributive justice: that they are incompatible with the free market. I argue that Anderson’s objection applies only to the specific principle she discusses, associated with luck egalitarianism, and not to individually-allocating principles generally. I then discuss different individually-allocating principles, the precepts of justice, broached by Rawls (1971,1999) but never developed by him. The precepts determine people’s distributive entitlements based on their contributions, efforts, and needs. I offer an interpretation (...) of each precept, explain why its distributive standard is compelling, show how the precepts avoid Anderson’s objection, and address Rawls’s rationale for not using the precepts in his account of distributive justice. I conclude by comparing the precepts to the kind of principle that Anderson prefers, range-constraining rules, arguing that the precepts meet the key standard associated with those rules. (shrink)
