The practices of speakers are analyzed using a pragmatist strategy, in order to show that one does not acquire the same commitments when attributing truth or attributing justification. The article discusses the sense in which the philosophical distinction between truth and justification is socially useful and, finally, shows that said distinction does not entail a mysterious metaphysics. La tesis central de este trabajo es que la tradicional tensión entre substancia y procedimiento socava las estabilidad de la justificación de la concepción liberal más extendida de la legitimidad (la Democracia Deliberativa). Dicha concepciones enfrentan problemas serios a la hora de articular de manera consistente dos dimensiones que parecen ir naturalmente asociadas a la idea de legitimidad: la dimensión procedimental, vinculada a la equidad del procedimiento, y la dimensión epistémica, asociada a la corrección de los resultados. En este trabajo (...) sostengo que a) esa tensión surge de la adopción de una concepción epistemológica social de tipo "veritativo-consecuencialista; b) es posible manejar dicha tensión mediante el remplazo de la epistemología subyacente por una concepción epistemológica social de tipo procedimentalista de orientación pragmatista y c) dicha operación orienta el diseño institucional en una dirección experimentalista. I argue that his famous distinction between objective and subjective truth is grounded in a unitary conception of truth as such: truth as self-coincidence. By explaining his use in this context of the term ‘redoubling’ [Fordoblelse], I show how Kierkegaard can intelligibly maintain that truth is neither one nor many, neither a simple unity nor a complex multiplicity. I further show how these points shed (...) much-needed light on the relationship between objective and subjective truth, conceived not as different kinds or species of truth but as different ways in which truth manifests itself as a standard of success across different contexts of inquiry. Although coherence has become one of the key concepts in contemporary legal theory, its meaning is taken almost universally to be elusive, complex and controversial. However, these difficulties are due just to the failure of commentators to distinguish the intension of the notion from other features of its (many) referents in extension. The oversight has caused qualities to be ascribed routinely to coherence that properly attach to various object(s) of which coherence is predicated, and which a theorist happens to have (...) in mind when bringing coherence into view. This conceptual error has significance for the substance of present claims made for the use of the notion in law. Freed from the entanglement, coherence emerges thinner and fitter, better able to be deployed with confidence in legal application. (shrink)

After a brief sketch of the history of philosophical pragmatism generally, and of legal pragmatism specifically (section 1), this paper develops a new, neo-classical legal pragmatism: a theory of law drawing in part on Holmes, but also on ideas from the classical pragmatist tradition in philosophy. Main themes are the "pluralistic universe" of law (section 2); the evolution of legal systems (section 3); the place of logic in the law (section 4); and the relation of law and morality (section 5).

In this paper, I characterize Susan Haack’s so called passes-for fallacy, analyze both what makes this inference compelling and why it is illegitimate, and finally explain why reflecting on the passes-for fallacy—and others like it—should become part of critical thinking pedagogy for humanities students. The analysis proceeds by examining a case of the passes-for fallacy identified by Haack in the work of Ruth Bleier. A charitable reconstruction of Bleier’s reasoning shows that it is enlightening to regard the passes-for fallacy as (...) an abuse of the application conditions of the concept of bias, rather than as an egregious case of Hasty Generalization. This paper aims to show that truth is neutral with respect to metaphysics and epistemology. In other words, the paper states that in order to make an analysis about our daily use of truth discourse, it is not necessary to refer to neither the nature of the world nor the nature of our epistemic capacities. The text is composed by three sections. In the first one, it makes explicit the common-sense intuitions which seem to bring truth to either metaphysics or (...) epistemology. In the second one, the text analyzes the role of the predicate «is true» in our natural languages. In the third section, the intuitions aforementioned are considered with the purpose of examining its intuitive status and its alleged relationship with both metaphysics and epistemology. (shrink)

Pluralism about truth is the view that there are many properties, not just one, in virtue of which things are true. Pluralists hope to dodge the objections that face traditional monistic substantive views of truth, as well as those facing deflationary theories of truth. More specifically, pluralists hope to advance an explanatorily potent understanding of truth that can capture the subtleties of various realist and anti-realist domains of discourse, all while avoiding the scope problem. I offer a new objection to (...) pluralism that challenges its fundamental commitment to there being a set of alethic properties in virtue of which claims are true. In its place I offer an alternative view that merges standard truthmaker theory with a primitivist conception of truth. This combination of views satisfies the theoretical desires that pluralists claim for themselves, but without taking on pluralism's host of challenges and problems. (shrink)

The book offers a proposal on how to define truth in all its complexity, without reductionism, showing at the same time which questions a theory of truth has to answer and which questions, although related to truth, do not belong within the scope of such a theory. Just like any other theory, a theory of truth has its structure and limits. The semantic core of the position is that truth-ascriptions are pro-forms, i.e. natural language propositional variables. The book also offers (...) an explanation of the syntactic behaviour of truth-terms, and the pragmatic roles of truth-acts. The theory of truth we present is a technical proposal, relatively uncontaminated by radical philosophical discussion. It makes indeed philosophical points, but it is intended to be a conceptual analysis, as neutral as possible, of the aspects that may serve as a point of departure for more philosophically-laden destinations. Like the Fregean account of quantifiers, which is prior to and, to a large extent, independent of the metaphysical debate about existence and its forms, or the Kaplanian view on demonstratives, that is neutral regarding the debate about individuals and the possibilities we have to actually “reach” them in a referring act, we intend our proposal about truth to be a sophisticated and explicative setting that helps to situate other debates about truth accurately, far from the distorted and sometimes strongly ideological discussions that have turned the topic into a paradigm of philosophical impasse. In this paper, we offer a brief, critical survey of contemporary work on truth. We begin by reflecting on the distinction between substantivist and deflationary truth theories. We then turn to three new kinds of truth theory—Kevin Scharp's replacement theory, John MacFarlane's relativism, and the alethic pluralism pioneered by Michael Lynch and Crispin Wright. We argue that despite their considerable differences, these theories exhibit a common "pluralizing tendency" with respect to truth. In the final section, we look at the underinvestigated (...) interface between metaphysical and formal truth theories, pointing to several promising questions that arise here. (shrink)

This thesis comprises three main chapters—each comprising one relatively standalone paper. The unifying theme is fragmentalism about truth, which is the view that the predicate “true” either expresses distinct concepts or expresses distinct properties. -/- In Chapter 1, I provide a formal development of alethic pluralism. Pluralism is the view that there are distinct truth properties associated with distinct domains of subject matter, where a truth property satisfies certain truth-characterizing principles. On behalf of pluralists, I propose an account of logic (...) and semantics that shows how they can answer central conceptual and logical challenges for their view. -/- In Chapter 2, I motivate and develop a modal account of propositions on the basis of an iterative conception of propositions, where the modality is logico-mathematical. The modal account of propositions takes the conception to motivate an inherently potential hierarchy of propositions. I show that the account helps provide satisfying solutions to the intensional paradoxes of Russell-Myhill, Kaplan, and Prior. -/- In Chapter 3, I propose that “true” is polysemous. I suggest that “true” is initially polysemous between correspondence truth and disquotational truth, and further polysemous between the meanings corresponding to the subconcepts of the concept truth generated by the indefinite extensibility of that concept. I show that the proposal provides satisfying solutions to the semantic paradoxes. (shrink)
