Die Idee des modernen Verfassungsstaats beruht auf dem Akt der freiheitlichen Selbstbestimmung aller Bürger*innen. Insofern bildet er die ethische Institution schlechthin. Denn wo das Volk die Parameter der Freiheit bestimmt, da gilt es, das Wesen der Freiheit selbst zu begreifen. Bleibt dieses Begreifen aus, wird der Gründungsakt zur gewesenen Freiheit und die Verwaltung des Staats zur Expert*innensache. Doch wo bleibt da die kreative Freiheit? Diese Frage macht eine Kritik der ethischen Institution notwendig. Dabei zeigt Thies Münchow in Anschluss an Kant (...) und Hegel den integralen Zusammenhang von Ethik und Politik auf und nimmt zuletzt eine Neubestimmung der politischen Theologie vor. (shrink)

Although the critique of reification is a core commitment of critical theories, there is no widely accepted account of its normative foundation. In Lukács’s original analysis, this foundation is provided by a strong concept of practice which is, however, not acceptable from a contemporary point of view. I argue that the systematic character of reification theory can only be upheld if this concept is replaced by a more intersubjective notion of normative practices. Reification can then be analysed as a second-order (...) pathology of social practices, as an inhibition of reflexivity by their normative shape. The normative justification of such critique, however, turns out to be more context-dependent than it is usually imagined. (shrink)

An important question one can ask of ethical theories is whether and how they aim to raise claims to universality. This refers to the subject area that they intend to describe or govern and also to the question whether they claim to be binding for all (moral) agents. This paper discusses the question of universality of Luciano Floridi’s information ethics (IE). This is done by introducing the theory and discussing its conceptual foundations and applications. The emphasis will be placed on (...) the ontological grounding of IE. IE’s claims to universality will be contrasted with those raised by discourse ethics. This comparison of two pertinent ethical theories allows for a critical discussion of areas where IE currently has room for elaboration and development. (shrink)

This article starts from the observation that in classical Athens the discovery of democracy as a normative model of politics has been from the beginning not only a political and a legal but at the same time a philosophical enterprise. Reflections on the concept of criminal law and on the meaning of punishment can greatly benefit from reflections on Athenian democracy as a germ for our contemporary debate on criminal justice in a democracy. Three main characteristics of the Athenian model (...) will be analysed: the self-instituting capacity of a democracy based on participatory and reflective citizenship, political power as the capacity of citizens for co-operating and co-acting with others, and the crime of hubris as one of the key issues in Athenian criminal law. These analyses will lead to the conclusion that one of the key issues of a democratic legal order lies in its capacity of recognizing the fragility of the human condition and of developing workable and effective standards of justice in that context. A relational conception of criminal law and punishment, based on proportionality, reflexivity, mutual respect and responsibility fits best with a democracy under the rule of law. (shrink)

Against the backdrop of contemporary debates about care ethics and care, this article undertakes a re-reading of Foucault’s analyses of the ancient care of the self. While the care of the self has so far been interpreted primarily in terms of an ethics and aesthetics of the self, it argues that the care of the self is constituted by the presence of the Other. This becomes clear as soon as one links the care of the self to parrhesia, which signifies (...) an act of truth-telling through which the individual constitutes herself as the subject of a discourse of truth by confronting the Other with the truth. It is through this connection that the care of the self and parrhesia unfold their critical potential, as can be seen in the examples of Sophocles’ Antigone or the whistleblower Edward Snowden. This makes it possible not only to detach the concept of care from its close entanglement with the private sphere and to reframe it in political terms but also to envisage a critical attitude that is based both on the care of the self and others and on a concern for truth. My aim in this paper is to make use of Edith Stein’s phenomenological analyses of empathy, emotion, and personhood to clarify and critically assess the recent suggestion by Axel Honneth that a basic form of recognition is affective in nature. I will begin by considering Honneth’s own presentation of this claim in his discussion of the role of affect in recognitive gestures, as well as in his notion of ‘elementary recognition,’ arguing that while his account contains much of value it (...) also generates problems. On the basis of this analysis, I will try to show that Stein’s account of empathy demarcates an elementary form of recognition in a less problematic fashion than does Honneth’s own treatment of this issue. I will then spell out the consequences of this move for the emotional recognition thesis, arguing that Stein’s treatment lends it further credence, before ending with some remarks on the connection between recognition and emotional personality. In phenomenology the body is often referred to as the lived body which makes the world familiar to me. In this paper, however, I discuss bodily self-consciousness in terms of self-distance. Self-distance is the suggestion that bodily self-consciousness consist in a reflective stance where you conceive of your body as a physical thing, an object in the world as well as the subject of bodily experiences. I argue that we are bodily self-conscious because we experience our own body in more (...) than one way and that these ways are not derivative of one another or hierarchically ordered. This latter claim conflicts with certain phenomenological readings of how the body is experienced, one of which I will refer to and discuss as the Familiarity Objection to my idea of self-distance. I end the paper with a discussion of why we need the conception of experienced objectification that is entailed in the notion of self-distance to account for both pathological and non-pathological bodily self-experiences. The notion of self-distance improves our understanding of how the body plays a central role in psychosis for the experience of distorted inter-subjective relations. (shrink)

Traditionelle Personenbegriffe der abendländischen Philosophie rekurrieren oft auf rationale Fähigkeiten wie Vernunft- bzw. Moralfähigkeit oder reflexives Selbstbewusstsein als Grundlage von individuellem moralischem Status bzw. der korrelierenden moralischen Verpflichtung. Dem steht die Erfahrung besonderer moralischer Verpflichtungen etwa gegenüber Kindern, Menschen mit besonderen Bedürfnissen oder Tieren entgegen, die durch ratiozentristische Engführungen aus dem Blick zu geraten drohen. Die gegenwärtigen Diskurse um die Begriffe der Vulnerabilität und Anerkennung sind deshalb eine wichtige Ergänzung, um einerseits die Selektivität klassischer moralphilosophischer Konzeptionen zu mindern, indem sie (...) auf eine universal geteilte Bedürftigkeit statt auf Kompetenzen als Anker der Moralität hinweisen, sowie andererseits auch positive Fürsorgepflichten für angewiesene Wesen zu begründen. Allerdings bedarf diese Ergänzung, wie argumentiert wird, ihrerseits einer Erweiterung, weil sie erstens von der kontingenten Anerkennung der Vulnerabilität in einem jeweiligen Ethos abhängt, ohne selbst hinreichende normative Kriterien an die Hand zu geben, zweitens von geteilten, jedoch nicht singulären Ansprüchen und Bedürfnissen ausgeht und drittens den Motivationsgrund der Verpflichtung nicht klärt, weil sie von Allokationsstrukturen und nicht von konkreten Begegnungen ausgeht. Eine Korrektur von der Phänomenologie der Leiblichkeit her, deren Implikationen für moraltheoretische Fragestellungen in den folgenden Ausführungen skizziert werden, scheint daher angezeigt. This article retraces and discusses the philosophical itinerary of Axel Honneth, from the groundbreaking book Struggle for Recognition up to the recent essays Freedom’s Right and The Idea of Socialism. In the first section, I examine Honneth’s programmatic concept of social pathology in relation to Ernst Cassirer’s idea of the secularisation of theodicy (i. e. the attribution of responsibility for human suffering to society) and to the enlightenment legacy of Jean-Jacques Rousseau. In the second section, after assessing Honneth’s position in (...) the tradition of critical theory, I analyse his philosophical views. I identify two different theoretical frameworks in Honneth’s work: on the one hand, the theory of the struggle for recognition; on the other hand, the recent theory of social freedom. While the first is grounded in a formal and allegedly universal anthropology, the second draws on the Hegelian doctrine of the ethical life and develops a historicist and internalist model of reconstructive social criticism. Finally, in the third section, I critically address the “divinisation of the social” entailed in Honneth’s project of social pathologies’ critique, and argue that Honneth’s trust in the normative power of intersubjectivity might be excessive. Classical philosophical Daoism as it is expressed in the Dao-De-Jing and the Zhuang-Zi is often interpreted as lacking a capacity for critique and resistance. Since these capacities are taken to be central components of Enlightenment reason and action, it would follow that Daoism is incompatible with Enlightenment. This interpretation is being refuted by way of developing a constructive dialogue between the enlightenment traditions of critical theory and recent philosophy of action from a Daoist perspective. Daoism's normative naturalism does neither rest (...) on a primitivist call for a return to the past, nor does it suggest future-directed activism. By way of reconstructing its descriptive, explanatory and emancipatory dimensions, it is shown that Daoism constitutes an alternative form of critical theory. In contrast to future-directed purposive action or blind rule-following, Daoism's key normative concept of "wu-wei" emphasizes effortless non-calculative responsiveness in the present. Drawing on recent insights in the philosophy of action, a reconstruction of wu-wei allows to conceive of a promising form of emancipatory agency. (shrink)

Are we really sure to correctly know what do we feel in front ofan artwork and to correctly verbalize it? How do we know what weappreciate and why we appreciate it? This paper deals with the problem ofintrospective opacity in aesthetics (that is, the unreliability of self-knowledge) in the light of traditional philosophical issues, but also of recentpsychological insights, according to which there are many instances ofmisleading intuition about one’s own mental processes, affective states orpreferences. Usually, it is assumed that (...) aesthetic statements are intuitivelyclear and self-evident. However, a long tradition in psychological researchhas called the idea of introspective transparency and the infallibility of self-knowledge into question (Wilson 2002). This topic has only recently beenrecognized as an interesting problem in aesthetics (Melchionne 2011, Irvin2014). In this paper I will discuss the main shortcomings in introspective self-knowledge, mostly referring to psychological findings. As a consequence, thedevelopment of a folk psychological account of aesthetic experience could beneeded, investigating how people develop intuitive and naïve theories abouttheir aesthetic reactions, taste, and feelings, distinct from a more objectiveand empirically grounded account of how judgment and preferences areactually formed in ourselves, even on a neurobiological level. However, itwill also be argued that bypassing the individual judgment and his expressedchoices in favor of allegedly more objective levels of description would notbe an innocent step to take. "Der Aufsatz zielt darauf, der Prozess der historischen Überlagerung, Substitution und Verbreitung des theoretischen Paradigmas der Depression gegenüber jenem der Melancholie darzustellen. Im ersten Teil wird versucht, einige der einschneidenden Eigenschaften der Thematisierungen der Melancholie in der Frühen Neuzeit anzugeben, auch im Verhältnis zum Geist des Kapitalismus. Nachdem eine Skizze der Entstehung der moderne Kategorie der Depression, geht es darum, den Verlauf nachzuzeichnen, der im 20. Jahrhundert zu ihrer Transformation in ein weitläufiges theoretisches Paradigma geführt hat, das schließlich jenes der (...) Melancholie ersetzt hat. Der zweite Teil stellt den Versuch dar, eine Zeitdiagnose umzureißen: An dieser Stelle ist die psychosoziale Bedeutung bestimmter sozioökonomischer und kultureller Mechanismen zu untersuchen, unter besonderem Hinweis auf das, was als »der neue Geist des Kapitalismus« bezeichnet worden ist, sowie auf neue Formen des Individualismus und ihre paradoxen Dynamiken. Abschließend wird eine Brücke geschlagen, zwischen der Geschichte der beiden bezeichneten Paradigmen und der zeitgenössischen psychosozialen Dynamiken, die mit dem als »depressive Epidemie« interpretierten Phänomen verbunden sind. -/- The essay aims to analyse the gradual historical process of the partial overlap, replacement and expansion of the theoretical paradigm of depression with respect to that of melancholy. The first part is devoted to analysing some of the central features of the multivalent thematizations of melancholy drawn up during modernity, also with relation to the spirit of capitalism (in its Weberian acceptation). This is followed by an overview of the birth of the modern category of depression, and the process that during the twentieth century led to its transformation into a theoretical and nosological paradigm which in the end replaced that of melancholy. The second part is the attempt to draw up a Zeitdiagnose: the aim is to assess the ‘depressive’ psychosocial impact exercised by particular socio-economic mechanisms and cultural trends, with particular reference to what has been defined as the ‘new spirit of capitalism’, as well as the new forms of individualism and their paradoxical dynamics. In conclusion, I will form a bridge between the history of the two aforesaid paradigms and the contemporary psychosocial dynamics correlated to the phenomenon today interpreted as a ‘depression epidemic’.".
