Cryopreservation of human embryos remains, in many jurisdictions, a critical component of the use of the technology of in vitro fertilisation in assisted reproduction. However, although the reasons for the freezing of reproductive material—such as cost effectiveness and reducing risks of IVF—are a constant across jurisdictions, the desirable length of storage remains subject to ongoing regulatory debate. Internationally embryo storage limits are variable. This article features data from a recent Australian research project which explores individual attitudes, desires and understandings of (...) law of IVF patients who had or who have embryos in storage. This article uses interviews from the study to argue that storage limits, like any apparently neutral regulatory tool, apply unequally causing unintended physical, mental and emotional harm—particularly to women. This analysis of storage limits exposes the interaction of time, science and law to create, apply and enforce norms and practices of ‘natural’ embryo storage, suggesting that the imposition of inflexible legislative restrictions upon embryo storage are socially contingent and value laden rather than ‘natural’ or ‘scientific’. This outcome has relevance to wider debates over assisted reproduction policies, suggesting that legal frameworks should adopt more flexibility in application to the patients who use this technology. Feyerabend is infamous for his defense of pluralism, which he extends to every topic he discusses. Disagreement, a by-product of this pluralism, becomes a sign of flourishing critical communities. In Feyerabend’s political works, he extends this pluralism from science to democratic societies and incorporates his earlier work on scientific methodology into a procedure for designing just policy. However, a description and analysis of Feyerabend’s conception of disagreement is lacking. In this paper, I reconstruct and assess Feyerabend’s conception of disagreement, with (...) a particular emphasis on the role of experts, and its role in the formation of science policy. I go on to assess this argument in light of recent literature on manufactured disagreement on politically contentious science policy. I conclude by suggesting some prospects and problems for de-idealizing Feyerabend’s position on disagreement to see whether it may be plausibly implemented. (shrink)

This essay introduces a collection of articles gathered under the theme of “law, science, and constitutions of life.” Together, they explore how revolutions in notions of what biological life is are eliciting correspondingly revolutionary imaginations of how life should be governed. The central theoretical contribution of the collection is to further elaborate the concept of bioconstitutionalism, which draws attention to especially consequential forms of coproduction at the law–life nexus. This introduction offers a theoretical discussion of bioconstitutionalism. It explores the constitutional (...) significance of interplay between scientific and technological power over life and a given political community’s shared imaginary of what modes of reasoning, judgment, and rule are proper and legitimate in a well-ordered state. It argues that knowing what life is for purposes of governance does not follow from scientific knowledge alone. Rather, such knowledge is refracted through culturally distinctive imaginaries that commit societies to particular understandings of what life means and what should be done to encourage its flourishing. This critical essay evaluates the potential integration of distinct kinds of expertise in policymaking, especially during situations of critical emergencies, such as the COVID-19 pandemic. This article relies on two case studies: herd immunity and restricted access to ventilators for disabled people. These case studies are discussed as examples of experts’ recommendations that have not been widely accepted, though they were made within the boundaries of expert epistemic authority. While the fundamental contribution of biomedical experts in devising public health policies (...) during the COVID-19 pandemic is fully recognized, this paper intends to discuss potential issues and limitations that may arise when adopting a strict expert-based approach. By drawing attention to the interests of minorities, the paper also claims a broader notion of “relevant expertise.” This critical essay thus calls for the necessity of wider inclusiveness and representativeness in the process underlying public health policymaking. Starting from the seminal experience of James Prescott Joule, this paper aims to debate the possibility of “making” science outside universities and academies. Joule himself studied as an autodidact and did not make his own discoveries while following an academic path; on the contrary, at first, the associations and academic societies of the time tended not to recognize his works officially. All of this happened throughout the nineteenth century during the period of the first relevant tendency to science popularization. For (...) example, looking at the second half of the England of the 1800s, we can refer to Michael Faraday’s open lessons for children like The Chemical History of a Candle. Following this perspective from a historical view, this paper explores the Italian attempts to communicate science—from the ‘50s to the ‘70s—to a larger public via television and other media, also considering the political and social backgrounds behind this choice. In particular, this paper also deals with Lucio Lombardo Radice’s work on TV programs and writings in social-political journals and daily newspapers, as a mathematician and pedagogist engaged on the importance of what he specifically called “Scientific mediation”, as a “method” to teach and popularize science to a larger public. Amartya Sen’s comparative approach to justice makes clear that notions of justice are shaped by human agency and experience, and both his focus on the ‘internal view’ of well-being that emphasizes suffering as a central feature of illness and his recognition that social and cultural factors shape perceived injustice are critical to this approach. However, Sen questionably depicts the contributions of anthropological research to this project as limited to ‘the sensory dimension of ill-health.’ Focusing on mental health in the context (...) of global justice, I argue that Sen’s treatise on justice can be refined through an ethnographic method that synchronizes attention to (1) cultural knowledge and social relations in ecological settings; (2) fundamental human needs; and (3) levels of analytic specificity involving situations, categories, and events. This method integrates analysis of internal phenomenology and external constraints of political economy and ideology. To demonstrate I discuss three cases involving students and violence in Rio de Janeiro, women and witchcraft in Ghana, and historical migration and war trauma among Vietnamese immigrants in which external conditions of insecurity and inequality contributed to deteriorating mental health conditions including depression, trauma, and debilitating anxiety. La formulación de las políticas de investigación y desarrollo está siendo transformada de manera novedosa en los documentos más recientes que se elaboran en Europa. Una de las peculiaridades es que los patrones de investigación transitan hacia prácticas científico-tecnológicas más interactivas entre los distintos actores de la sociedad. Así, como respuesta a la naturaleza compleja de la investigación las primeras medidas se revelan en aquellas estrategias para la promoción de actitudes emprendedoras y colaborativas entre los actores académico-empresariales de la investigación (...) y el desarrollo. A estas iniciativas se superponen otros planteamientos que trascienden el objetivo primariamente economicista de la colaboración e integran los aspectos sociales y éticos en la investigación y el desarrollo. Sin embargo, estas transformaciones también están sujetas a diversas tensiones de base y a objetivos concurrentes. El artículo dilucida estas dinámicas de apertura-y-cierre y manifiesta que algunas de las relaciones y demandas se muestran más resistentes al cambio. (shrink)

When one wants to use citizen input to inform policy, what should the standards of informedness on the part of the citizens be? While there are moral reasons to allow every citizen to participate and have a voice on every issue, regardless of education and involvement, designers of participatory assessments have to make decisions about how to structure deliberations as well as how much background information and deliberation time to provide to participants. After assessing different frameworks for the relationship between (...) science and society, we use Philip Kitcher's framework of Well-Ordered Science to propose an epistemic standard on how citizen deliberations should be structured. We explore what potential standards follow from this epistemic framework focusing on significance versus scientific and engineering expertise. We argue that citizens should be tutored on the historical context of why scientific questions became significant and deemed scientifically and socially valuable, and if citizens report that they are capable of weighing in on an issue then they should be able to do so. We explore what this standard can mean by looking at actual citizen deliberations tied to the 2014 NASA ECAST Asteroid Initiative Citizen forums. We code different vignettes of citizens debating alternative approaches for Mars exploration based upon what level of information seemed to be sufficient for them to feel comfortable in making a policy position. The analysis provides recommendations on how to design and assess future citizen assessments grounded in properly conveying the historical value context surrounding a scientific issue and trusting citizens to seek out sufficient information to deliberate. The ever-increasing application of algorithms to decision-making in a range of social contexts has prompted demands for algorithmic accountability. Accountable decision-makers must provide their decision-subjects with justifications for their automated system’s outputs, but what kinds of broader principles should we expect such justifications to appeal to? Drawing from political philosophy, I present an account of algorithmic accountability in terms of the democratic ideal of ‘public reason’. I argue that situating demands for algorithmic accountability within this justificatory framework enables us to (...) better articulate their purpose and assess the adequacy of efforts toward them. Law is often linked to ethics and morality. Regulations of genetically modified organisms ensue from a discussion on how well the law is composed to accommodate ethical considerations. The precautionary principle and biotechnology have undeniable moral connotations. Besides, the principle has socio-economic implications. The application of the precautionary principle in plant breeding should be legally justified on the basis of the best available evidence. On the other hand, scientific information cannot provide all the necessary information on which a risk management (...) decision should be based. This article addresses the issue of gap between science, ethics, and socio-economic considerations related to the cultivation and authorisation of GM crops. (shrink)

When government actors seek to restrict the sale of hazardous substances, industry actors tend to intervene, deploying coordinated strategies aimed at delaying, preventing or weakening attempts to regulate their products. In many cases, this has involved deliberate efforts to obfuscate science, mislead the public and manipulate political actors in order to ensure desired policy outcomes. Strategies of regulatory obstructionism have resulted in the prolonged dispersal of harmful chemical substances with tangible impacts on public health. This article proposes that this behavior (...) should be interpreted as a form of violence. Examining the regulatory histories of lead, benzene, asbestos and PCBs, the article demonstrates how regulatory obstructionism and violence have become intractable characteristics of the chemical industry.
