Offering the first developed account of political liberal education, this book combines a thorough analysis of the theoretical groundwork of political liberal education with application-oriented approaches to contemporary educational challenges. Following in depth engagement with the shortcomings of Rawls’ theory and addressing some key objections to neutrality-based restrictions in education, the volume moves on to provide an insightful discussion of topics such as same-sex relations in sex-education, the position of migrant children and the rights of religious parents to determine the (...) education of their children. In this essay, I survey the different uses of the concept of the symbol at play in the philosophy of religion. Considering that historically theories of the symbol have frequently had significant religious presuppositions and implications, I suggest that one might expect that the symbol would play a significant role in current research. This is not the case, however, since the very specific metaphysical, linguistic and theological premises that have traditionally informed much theorisation of the symbol tend to be unpopular (...) today. The main exception is Peircean symbolics which has recently been re-appropriated by a variety of philosophical fields, including philosophy of religion. To open up further contexts for contemporary deployments of the symbol, I look to contemporary public and legal debates concerning the right to wear religious symbols as an area of research unjustly neglected by philosophers of religion: much of the inchoate conceptual work being done in the legal cases themselves would naturally feed into academic philosophical discussion of the symbol. Nursing, with its socially embedded theory and practice, inevitably operates in the realm of power and politics. One of these political sites is that of religion, which to varying degrees continues to shape beliefs about health and illness, the delivery of healthcare services and the nurse–patient encounter. In this paper, I attempt to complicate nursing's views on religion and politics in healthcare, with the intent of thinking critically and philosophically about questions that arise at the intersection of religion, politics and (...) nursing/healthcare. These questions include the following: What is the domain of religion and politics? How (non)religious are the contemporary societies in which nurses practice? What are the variations and implications of secularism? How is religion entangled with other intersecting social relations of power? The concept of governmentality has a textual and philosophical basis as well as being concerned with what might be called the practices of government. This article discusses and develops the governmentality argument with respect to the guru-led movements. It outlines the basics of Michel Foucault’s concept of governmentality, its analytical frame, the fact that governmentality moves beyond only the practices of the state and its nuances in a neoliberal frame of reference, drawing on Zygmunt Bauman and others. It then discusses (...) the governmentality of guru-led movements through: (1) the political acts and powers of the gurus; (2) the supplementary and complementary efforts to aid the state by the guru-led movements; (3) instances of resistance and taking on the state, and (4) the flipside of governmentality, which manifests as hegemony, Hindutva politics and Hindu nationalism. Through the governmentality argument, aspects of the surveillance, discipline, control, interactivity and competition of the guru-led movements emerge. What is discussed is a post-disciplinary model of governance which devolves power downwards from crumbling state institutions to new agencies of control, in this case, the gurus and their institutions. This devolution, however, is not without its tensions and the article also argues that guru governmentality betrays traces of hybridity and non-linearity. (shrink)

In this article, we scrutinize several arguments that are frequently used to legitimize a ban on religious symbols for civil servants. Most arguments, however, do not stand up to the test of Rawlsian political liberalism. One argument stands out as underpinning such a general ban: state neutrality. While this argument has the most potential, we argue why it is still not decisive for a ban on all religious symbols for all civil servants. We conclude that from a political liberal point (...) of view the discussion is inconclusive, and therefore advocate a context-sensitive and balanced approach to the matter of civil servants’ dress code with respect to religious symbols. By arguing that political liberalism is indecisive, our position is different from both ‘exclusive neutrality’ and ‘inclusive neutrality’. (shrink)

Egalitarian theories of religious freedom deny that religion is entitled to special treatment in law above and beyond that granted to comparable beliefs and practices. The most detailed and influential defense of such an approach is Christopher Eisgruber and Lawrence Sager's Religious Freedom and the Constitution (2007). In this essay I develop, elucidate, and show the limits of the strategy adopted by Eisgruber and Sager. The strategy requires that religion be analogized with other beliefs and practices according to a robust (...) metric of comparison. I argue that Eisgruber and Sager fail to develop a consistent and coherent metric and I further suggest that this failure is symptomatic of the broader difficulty encountered by liberal theory in fitting the concept of religious freedom into a broadly egalitarian framework. This paper argues that Kant’s distinction between “civil union” and “ethical community” can be of great value in dealing with a problem that causes considerable trouble in contemporary political and social philosophy, namely the question of the normative significance and role of religion in political and social life. The first part dwells upon the third part of Kant`s Religion within the Boundaries of Mere Reason with the intention of exposing the general features of ethical community. It highlights the fact that (...) Kant considers publicity, and indeed public authority, to be constitutive of the ethical community. The second part discusses his argument that we have a unique ethical duty to enter into an ethical community. This discussion clarifies the constitutive purpose of ethical community and sets forth why Kant thought that the ethical community should have a religious form. The third part presents an account of the constitutive purpose of the state in light of the Doctrine of Right. Throughout these steps, as is concluded, the essentials of a model for the relations between law, ethics, and religion emerge, which shows the way in which both religious and secularist worries can be met on a principled basis. This article defends the principle of non-establishment against 21st-century projects of political religion, constitutional theocracy and political theology. It is divided into two parts, which will appear in two consecutive issues of Philosophy & Social Criticism, 39(4–5) and 39(6). Part 1 proceeds by constructing an ideal type of political secularism, and then discussing the innovative American model of constitutional dualism regarding religion that combined constitutional protection for the freedom of religious conscience and exercise with the principle of non-establishment. The article (...) analyses the strengths and limits of the ‘separation– accommodation’ frame that became hegemonic in 1st amendment jurisprudence from the 1940s to the 1990s. It challenges the standard caricature of the American model as strictly separationist and privatizing. It then critically assesses two contemporary alternatives to that frame: the integrationist approach and the equal liberty approach. The first, disguised as a concern for pluralism and fairness, challenges ‘separation’ and political secularism in a subtle attack on the non-establishment principle, aimed at drastically narrowing its scope. Successes of this approach in recent Supreme Court jurisprudence and politics have triggered a response by liberal egalitarians. The author addresses this response – the equal liberty model – in part 2, which will appear in Philosophy & Social Criticism 39(6), arguing that although on the right track, it fails to find a middle ground between political secularism and integration. Does John Rawls’s political liberalism require the institutional separation between state and religion or does it allow space for moderate forms of religious establishment? In this paper I address this question by presenting and critically evaluating Cécile Laborde’s recent claim that political liberalism is ‘inconclusive about the public place of religion’ and ‘indeterminate about the symbolic dimensions of the public place of religion’. In response to Cécile Laborde, I argue that neither moderate separation nor moderate establishment, intended as regimes of (...) religious governance that fix specific interpretations of principles of social and economic justice, are compatible with Rawls’s political liberalism. Furthermore, I claim that a state can ensure that both its religious and non-religious citizens enjoy a sense of self-respect and identification with their polity by leaving issues of symbolic establishment and separation open to democratic debate. I conclude that Rawls’s political liberalism transcends the standard distinction between moderate establishment and moderate separation and leaves the public place of religion open to the democratic contestation of ordinary legislative politics. ABSTRACT:Singer has recently argued that questions related to corporate governance are beyond the reach of Rawls’s political conception of justice. This is because justice applies to the basic structure of society, understood as society’s legally coercive structures, and because corporate governance cannot be considered part of this structure in political liberalism. This commentary challenges the second part of the argument. First, it suggests that the criterion used to exclude corporate governance from the basic structure—whether employees can exit economic organizations—is not (...) conclusive for corporate governance, notably as institutionalized in corporate law. Second, even if the focus were on corporate governance, it would still be possible to argue that it legally coerces citizens, if not employees, in a relevant way. Thus, the argument is not successful in demonstrating that political liberalism goes beyond its legitimate boundaries when considering that aspects of corporate governance may be matters of justice. In this introduction, we provide a brief overview of the debate on religion in political philosophy. We present the main arguments defended by Cécile Laborde in Liberalism’s Religion and explain how these arguments contribute to the debate.

Over the last 30 years, the publicly visible “otherness” embodied by the Muslim population in the member states of the European Union has sparked movements of transnational public discussions mainly driven by the fear of the collapse of “national cohesion.” This paper engages theoretically with the idea that these debates have become an ordinary trap for European publics, France being the main illustration in the text. It is more specifically concerned with the discussions surrounding the recent ban on the wearing (...) of the full veil in French public space, asking: what does the omnipresence of public discussions about religious otherness reveal of the national culture of citizenship? What are the epistemological and political implications of the evaluation of daily individual experiences as criminal in secular contexts? The text develops some speculative readings of the public experience arising from the visibility of Islamic religious signs and the capital attached to their visibility. (shrink)

One of the challenges that liberal neutrality faces in diverse societies is how to maintain neutrality towards conception of the good life, when establishment of a particular conception of the good and exclusion of other conceptions is inevitable, as in the case of language regulation. A possible solution is to justify this establishment by appealing to universal reasons, thus refraining from endorsing the intrinsic value of the established conception. This paper argues that such a solution is limited, as it does (...) not cover all inevitable-establishment domains. This is because there is a distinction within inevitable-establishment domains: domains in which rival options can coexist, such as language policy, and domains in which options are mutually exclusive, such as land-use policy. The paper argues that language policy is a coexistence domain, since it allows for a degree of personal agency, and it can refrain from making value judgments about the language that is endorsed by the state. Spatial organization and land-use policy, on the other hand, must rest on value judgments about the good life and cannot accommodate neutral justifications. The distinction has important implications for the scope of neutrality: neutrality turns out to be applicable in coexistence domains, and inapplicable in mutually-exclusive domains. Ultimately, it may be the case that neutrality may not be applicable even in language policy, since language policy exhibits characteristics of a mutually-exclusive domain. (shrink)
