In this article I investigate the ways in which phenomenology could guide our views on the rights and/or wrongs of abortion. To my knowledge very few phenomenologists have directed their attention toward this issue, although quite a few have strived to better understand and articulate the strongly related themes of pregnancy and birth, most often in the context of feminist philosophy. After introducing the ethical and political contemporary debate concerning abortion, I introduce phenomenology in the context of medicine and the (...) way phenomenologists have understood the human body to be lived and experienced by its owner. I then turn to the issue of pregnancy and discuss how the embryo or foetus could appear for us, particularly from the perspective of the pregnant woman, and what such showing up may mean from an ethical perspective. The way medical technology has changed the experience of pregnancy—for the pregnant woman as well as for the father and/or other close ones—is discussed, particularly the implementation of early obstetric ultra-sound screening and blood tests for Down’s syndrome and other medical defects. I conclude the article by suggesting that phenomenology can help us to negotiate an upper time limit for legal abortion and, also, provide ways to determine what embryo–foetus defects to look for and in which cases these should be looked upon as good reasons for performing an abortion. This paper considers concepts of expectation and responsibility, and how these drive dialogic interactions between tutor and student in an age of marketised Higher Education. In thinking about such interactions in terms of different forms of exchange, the paper considers the philosophy of Martin Buber and Emmanuel Levinas on dialogic intersubjectivity, and an ethics of responsibility. This enables a richer understanding of the tutorial dialogue in particular, as both teaching and encounter. This has significant implications for education and for the (...) idea of the tutorial as a space for encounter with the other through language. The paper argues that the university tutorial, rather than being considered a place only for the meeting of expectations, might be envisioned as a space for encounter with the unexpected. In considering the nature of the educational encounter in relation to an example from the film adaptation of Alan Bennett’s ‘The History Boys’, the paper concludes that the tutorial opens up the possibility for a mutual encounter with otherness. This positions the tutorial as a space of educational otherness—a Foucauldian heterotopia which rejects the expectation-bound economy of exchange, and which offers instead the possibility of an education marked by an economy of excess. Recently, debate over whether health care providers should have a protected right to conscientiously refuse to offer legal health care services—such as abortion, elective sterilization, aid in dying, or treatments for transgender patients—has grown exponentially. I advance a modified compromise view that bases respect for claims of conscientious refusal to provide specific health care services on a publicly defensible rationale. This view requires health care providers who refuse such services to disclose their availability by other providers, as well as to (...) arrange for referrals or facilitate transfers of care. This requirement raises the question of whether providers are being forced to be complicit in the provision of services they deem to be morally objectionable. I conclude by showing how this modified compromise view answers the most significant objections mounted by critics of the right to conscientious refusal and safeguards providers from having to offer services that most directly threaten their moral integrity.
