The article discusses burden of proof rules in social criticism. By social criticism I mean an argumentative situation in which an opponent publicly argues against certain social practices; the examples I consider are discrimination on the basis of species and discrimination on the basis of one's nationality. I argue that burden of proof rules assumed by those who defend discrimination are somewhat dubious. In social criticism, there are no shared values which would uncontroversially determine what is the reasonable presumption and (...) who has the burden of proof, nor are there formal rules which would end the debate and determine the winner at a specific point. Perhaps the old man who drives the truck does not know that the turnip fell off, or perhaps he does not care. He values his time or his ease more than he values the I turnip. The question of who has the burden of proof is often important in practice. We must frequently make decisions and act on the basis not of conclusive evidence but of what is reasonable to presume true. Consequently, it happens that a given practical question must be solved by referring to principles that explicitly or implicitly determine, at least partly, where the burden of proof should rest. In this essay, I consider the role of the logic of the burden of proof (...) in a debate on global justice. In particular, I ask how the logic of the burden of proof is seen by those who defend conservative positions in a debate and deny our obligations to reduce poverty beyond borders. I argue that defenders of conservative positions tend to shift the burden of proof in an unjustified way. (shrink)

Quine's ethical views typify what might seem to be natural sympathies between empiricism and ethical noncognitivism. LikeAyer, he sees a case for noncognitivism rooted in an epistemic discontinuity between ethics and science. Quine argues that the absence of genuine moral observation sentences, and thus the absence of empirical checkpoints for the resolution of theoretical disputes, renders ethics, as he terms it, “methodologically infirm” However, recent papers in this journal make clear that Quine appears to be voicing mutually incompatible commitments to (...) both noncognitivism and cognitivism. Here I argue that Davidson's theory of interpretation offers promising ways to resolve these tensions. His constructive program fleshes out the implications of Quine's largely destructive critique of intensional semantics and contains a fairly well‐articulated account of evaluative semantics, one which seems to combine cognitivist and noncognitivist elements harmoniously. Moreover, it is argued that Davidson's long‐standing differences with Quine over the epistemological status Quine accords observation sentences with do not undermine Quine's metaethical critique.
