I reply to Mark Friedman's response to my review of his book, 'Nozick's Libertarian Project.' I restate what I take to be the key mistakes in Friedman’s arguments for individual rights and the minimal state. I outline the explanation of the right to freedom in terms of the human capacity for critical rationality, and the explanation of the political authority of the state in rule-consequentialist terms which do not appeal to consent.

DERIVING RIGHTS TO LIBERTY2018 •
The rights to liberty championed by classical liberal and libertarian theorists may be supported as products of practical reason. The foundations for these rights rest initially on the idea that the separateness of persons is embedded in the circumstances of life that make justice a meaningful concept. We can discover the duties justice imposes on us through a procedure for identifying principles of justice based on the concept of reasonableness that supports a method for testing proposed principles for human interaction. This procedure, which I present as a contractualist method of ethical justification, vindicates principles that establish duties to others that also constitute rights to liberty and rule out some kinds of purported rights that cannot be justified through the proffered contractualist method.

A minarchist conception of government prohibits levying taxes to fund redistributive institutions and programs. This dissertation argues that due to ubiquitous preferences people hold for higher social status, no minarchist view is compatible with strong and uncompromising libertarian rights under an enduring social contract. Libertarians can embrace the redistributive state, or defend anarchy, but cannot justify the stable “minimal state.”
Libertarianism relies on a natural rights theory, which takes the idea of individual sovereignty as basic. The theory is flawed because it cannot ground an obligation for different sovereigns to respect each other's sovereignty.

Towards libertarian welfarism: protecting agency in the night-watchman state2013 •
One of the major debates within libertarian thought concerns the need for a centralized state structure to sustain the norms governing agents’ behaviour in society. Minarchists support state monopolies over the means of coercion to ensure that society abides by these norms, whereas free-market anarchists consider such monopolies damaging and unnecessary, with norms maintained by agents’ natural motivations. This article finds that the libertarian ‘pre-political’ principles which free-market anarchists adopt lack objectivity and plausible independence, creating a fundamental tension between the endorsement of a libertarian morality and anarchist commitments to pluralism of legal and political structures. It suggests that libertarians place a core, shared value on individual agency, but that this value can only be universalized through political processes of discussion and agreement, and sustained only in the presence of institutional sanction and coercion mechanisms. This article argues that libertarian commitments to agency require such mechanisms to be welfarist and minimally state-like, and proposes various ways in which the appropriate structures and policies could be realized, stressing the continuity of this novel form of libertarian welfarism with the aims and underlying values of both sides of the libertarian debate.

Hayek, Friedman, and Buchanan: On Public Life, Chile, and the Relationship between Liberty and Democracy2014 •
This article places recent evidence of Hayek’s public defense of the Pinochet regime in the context of the work of the other great 20th century classical liberals, Milton Friedman and James M. Buchanan. Hayek’s view that liberty was only instrumentally valuable is contrasted with Buchanan’s account of liberty situated in the notion of the inviolable individual. It is argued that Hayek’s theory left him with no basis on which to demarcate the legitimate actions of the state, so that conceivably any government action could be justified on consequentialist grounds. Furthermore, Friedman’s account of freedom and discretionary power undermines Hayek’s proposal that a transitional dictatorship could pave the way for a genuinely free society.
