This book deals with foundational issues in the history of the nature of action, the intentionality of action, the compatibility of freedom of action with determinism, and the explanation of action. Ginet's is a volitional view: that every action has as its core a "simple" mental action. He develops a sophisticated account of the individuation of actions and also propounds a challenging version of the view that freedom of action is incompatible with determinism.

Philosophers have advocated different kinds of freedom, but each has value and none should be neglected in a complete theory of freedom and responsibility. There are three kinds of freedom of preference and action that should be distinguished. A person S may fully prefer to do A at every level, and that is one kind of freedom. A person S may autonomously prefer to do A when S has the preference structure concerning doing A because S prefers to have that very preference structure, and that is a second kind of freedom. A person S may prefer to do A when S could have preferred otherwise, and that is a third kind of freedom. These forms of freedom may be combined, but they are valuable and essentially independent. They all involve the metamental ascendence of preference over desire, but it is autonomous preference that makes a person the author of his or her preference. The responsibility a person has for what he or she does out of a preference for doing it depends on the kinds of freedom of preference the person has and must be ranked in terms of them.

Corporate freedom is the freedom of a collective agent to perform a joint action. According to a reductive account, a collective or corporate agent is free exactly if the individuals who constitute the corporate agent are free. It is argued that individual freedoms are neither necessary nor sufficient for corporate freedom. The alternative account proposed here focuses on the performance of the joint action by the corporate agent itself. Subsequently, the analysis is applied to Cohen’s (1983) analysis of proletarian freedom. Cohen claims that proletarians are individually free but collectively unfree to leave the proletariat. I argue that, pace Cohen, such a contrast between individual and collective freedom can only exist if collective freedom is interpreted in terms of corporate freedom.

This paper considers the concept of freedom in behavioural terms, defining it in relation to freedom of action. This notion is applied to psychiatric abnormalities, and it is suggested that this new way of looking at the problem may go some way to surmount the philosophical difficulties normally attaching to the notion of freedom.

The thesis of "Freedom of Communicative Action" is that Jurgen Habermas's theory of communicative action illuminated the deep structure of the First Amendment freedom of speech. Haberams's theory takes speech act theory as its point of departure. Communicative action coordinates indivudal behavior through rational understanding. Communicative action is distinguished from strategic action--the use of communication to manipulate, deceive, or coerce. Part I offers an introduction. Part II outlines a hermeneutic approach to interpretation of the First Amendent. Part III explores and criticizes existing theories of the freedom of speech. Part IV explicates Habermas's theory of communicative action. Part V developes a theory of the freedom of expression based on Habermas's theory of communication. Part VI applies that theory to particular problems in free speech doctrine. Part VII draws some conclusions about the implications of this exercise for the development of doctrine and the theory of communicative action. "Freedom of Communicative Action" was published in 1989, and some of the views expressed in the article are no longer affirmed by the author.

This paper defends the possibility of doxastic freedom, arguing that doxastic freedom should be modelled not on freedom of action but on freedom of intention. Freedom of action is exercised by agents like us, I argue, through voluntary control. This involves two conditions, intentions-reactivity and reasons-reactivity, that are not met in the case of doxastic states. Freedom of intention is central to our agency and to our moral responsibility, but is not exercised through voluntary control. I develop and defend an account of freedom of intention, arguing that constitutive features of intention ensure that freedom of intention cannot require voluntary control. Then I show that an analogous argument can be applied to doxastic states. I argue that if we had voluntary control of intentions or of doxastic states, this would actually undermine our freedom.

Locke was a libertarian: he believed in human freedom. To be sure, his conception of freedom was different from that of many philosophers who call themselves libertarians. Some such philosophers maintain that an agent is free only if her action is uncaused; whereas Locke thought that all actions have causes, including the free ones. Some libertarians hold that no action is free unless it proceeds from a volition that is itself free; whereas Locke argued that free volition, as opposed to free action, is an impossibility. On the other hand, Locke agrees with the typical professed libertarian that free actions depend on volitions - or, as he often puts it, that an agent is free only with respect to the actions she wills, to those that are voluntary. And he also refuses to make voluntariness sufficient for freedom, whereby a free action is merely one that is willed. The free agent, Locke insists, must also be able or have been able to do something other than she does or did. Thus both Locke and the libertarian professor require indifference as well as spontaneity for freedom. But Locke’s freedom is not contra-causal; and he denies that it extends to volition. In this paper I want to focus on just this last component of Locke’s view of freedom: that freedom in willing, far from being required for free agency, is not even possible. I call this ‘the thesis of volitional determinism’. Locke presents an argument for this thesis in the Essay, but scholars have never paid much attention to it: I want to examine it.
