The claim is that some collective entities can be thought of as part of the moral realm by virtue of their status as objects of moral concern. Collectivities are defined in terms of irreducibly corporate action and distinctive conditions of persisting identity. Their lack of sentience does not preclude moral concern, and their raison d'être may render moral concern for them appropriate. Recent attempts by Pettit, McMahon, and Broome to limit the moral realm to individuals are considered. They are rebutted on the grounds that they rest heavily on pre-existing moral intuitions; they ascribe a stronger thesis than is necessary to the sponsors of the moral significance of non-individuals; and they wrongly assume that what has value for individuals must have value because it has value for individuals. Collectivities can have moral importance even if they lack the intrinsic moral importance attaching to human beings, and substantial consequences follow from that fact. In particular, routine appeals to the distinctness of persons become more problematic when collectivities, themselves composed entirely of persons, have independent moral significance which needs to be taken into account. That will affect both assessment of moral consequences and the process of moral decision-making.
The concept of the gesture is explored in relationship with its moral significance rather than, for example, its aesthetic significance. It is argued that the concept can be used in order to make clear how morality relates to the body. This is not to suggest that gestures can be neatly defined. On the contrary, they always seem to be ambivalent and somewhat nebular. However, it will be shown that some of their significance might well be related to popular concepts such as ‘transparency’, ‘authenticity’, ‘integrity’ and ‘responsibility’. In order to make this clear, the role of some particular gestures in politics and organizational life, most notably ‘apology’ and ‘trust’, will be discussed throughout the paper.
Although birth marks the entrance of a human being into the world and establishes the very possibility of experience the philosophical implications of this event have been largely ignored in the history of thought. This is particularly troubling in phenomenology in general and in the work of Martin Heidegger in particular. While Heidegger raises the issue of birth he drops it very quickly on the path to defining Dasein''s existence as constituted from the standpoint of death, as being-towards-death. In this paper I argue, contra Heidegger, that intentional existence can only be understood from the standpoint of birth. I begin by showing that intentionality inheres in a double difference that is fundamentally dependent on birth insofar as birth is an original differentiating from prenatal existence. I conclude with the argument that only a philosophy that regards Dasein from the standpoint of birth, as being-from-birth, can give an adequate account of humans as beings who live with others and who can initiate sense constitution and action.
Birth registration, the official recording of a child's birth by a government agency, is one of the most important events in a child's life. Birth registration establishes the existence of the child under law and provides the foundation for ensuring many of the child's rights. Although birth registration alone does not guarantee that a child will have access to adequate health care, receive an education, or be free from abuse or exploitation, its absence leaves a child at greater risk of a range of human rights violations. Despite the importance of birth registration, according to UNICEF, approximately 50 million newborn babies are not registered each year, accounting for over 40 percent of the children born annually. This short article examines the right to birth registration and the implications of birth registration for the child's civil, political, economic, social and cultural rights.
Art and Morality is a collection of groundbreaking new papers on the theme of aesthetics and ethics, and the link between the two subjects. A group of world-class contributors tackle the important question that arise when one thinks about the moral dimensions of art and the aesthetic dimension of moral life. The volume is a significant contribution to the philosophical literature, opening up unexplored questions and shedding new light on more traditional debates in aesthetics. The topics explored include the relation of aesthetic to ethical judgment; the relation of artistic experience to moral consciousness; the moral status of fiction; the concepts of sentimentality and decadence; the moral dimension of critical practice, pictorial art and music; the moral significance of tragedy; and the connections between artistic and moral issues elaborated in the writings of central figures in modern philosophy such as Kant, Schopenhauer and Nietzsche.
I provide an account of the moral status of pre-birth humans that integrates ideas from Charles Peirce, including: synechism, the idea that "all that exists is continuous"; the reality of "Seconds," independently existing individual entities; and Peirce's pragmatic conceptions of truth and reality. This account implies that destroying a pre-birth human is determinately moral very soon after conception and determinately immoral very late in pregnancy. But it also implies that during much of gestation, destroying a pre-birth human is of indeterminate moral status, neither determinately moral nor determinately immoral.
In a small portion of The Origin of German Tragic Drama, Walter Benjamin engages in a critique of Nietzsche’s understanding of tragedy in The Birth of Tragedy. He argues that Nietzsche’s account divests individuals of significance in the tragic worldview. The corrective to Nietzsche’s view, according to Benjamin, is a reflective, historical approach to the Greek social and literary phenomenon of tragic poetry. I argue that Benjamin’s approach to tragedy and to The Birth of Tragedy is inherently flawed. The paper has threesections: (1) a presentation of Benjamin’s critique of Nietzsche in The Origin of German Tragic Drama; (2) a refutation of that critique on the basis of a reading of The Birth of Tragedy; and (3) a rejection of Benjamin’s theory of tragedy on the basis of Nietzsche’sinsights into the relation to human significance of both tragedy and the science of history.
Does birth make a difference to the moral rights of the fetus/infant? Should it make a difference to its legal rights? Most contemporary philosophers believe that birth cannot make a difference to moral rights. If this is true, then it becomes difficult to justify either a moral or a legal distinction between late abortion and infanticide. I argue that the view that birth is irrelevant to moral rights rests upon two highly questionable assumptions about the theoretical foundations of moral rights. If we reject these assumptions, then we are free to take account of the contrasting biological and social relationships that make even relatively late abortion morally different from infanticide.
