I argue that this conception is false, since the non-inferential propositions on which beliefs are ultimately founded may be forgotten or undermined in the course of enquiry.

The Law of Evidence has traditionally been perceived as a dry, highly technical, and mysterious subject. This book argues that problems of evidence in law are closely related to the handling of evidence in other kinds of practical decision-making and other academic disciplines, that it is closely related to common sense and that it is an interesting, lively and accessible subject. According to Williamson, your evidence consists of all and only what you know (E = K). According to his critics, it doesn’t. While E = K calls for revision, the revisions it calls for are minor. E = K gets this much right. Only true propositions can constitute evidence and anything you know non-inferentially is part of your evidence. In this paper, I defend these two theses about evidence and its possession from Williamson’s critics who think we should break more radically from E = K.
An experimental study is reported which investigates the differences in interpretation between content conditionals (of various pragmatic types) and inferential conditionals. In a content conditional, the antecedent represents a requirement for the consequent to become true. In an inferential conditional, the antecedent functions as a premise and the consequent as the inferred conclusion from that premise. The linguistic difference between content and inferential conditionals is often neglected in reasoning experiments. This turns out to be unjustified, since we adduced evidence on the basis of a quantitative and a qualitative analysis that this difference has a manifest psychological relevance. For the inferential conditionals, participants appear to retrieve the order of events of the original content conditional on which it was based, before they start reasoning with it. The implications of this finding for reasoning research and linguistics will be discussed.
Underdetermination is a relation between evidence and theory. More accurately, it is a relation between the propositions that express the (relevant) evidence and the propositions that constitute the theory. Evidence is said to underdetermine theory. This may mean two things. First, the evidence cannot prove the truth of the theory. Second, the evidence cannot render the theory probable. Let’s call the first deductive underdetermination, and the second inductive (or ampliative) underdetermination. Both kinds of claim are supposed to have a certain epistemic implication, viz., that belief in theory is never warranted by the evidence. This is the underdetermination thesis.
Timothy Williamson has argued that a person S ’s total evidence is constituted solely by propositions that S knows. This theory of evidence entails that a false belief can not be a part of S ’s evidence base for a conclusion. I argue by counterexample that this thesis (E = K for now) forces an implausible separation between what it means for a belief to be justified and rational from one’s perspective and what it means to base one’s beliefs on the evidence. Furthermore, I argue that E = K entails the implausible result that there are cases in which a well-evidenced belief necessarily can not serve as evidence for a further proposition.
Your evidence constrains your rational degrees of confidence both locally and globally. On the one hand, particular bits of evidence can boost or diminish your rational degree of confidence in various hypotheses, relative to your background information. On the other hand, epistemic rationality requires that, for any hypothesis h, your confidence in h is proportional to the support that h receives from your total evidence. Why is it that your evidence has these two epistemic powers? I argue that various proposed accounts of what it is for something to be an element of your evidence set cannot answer this question. : Evidence claims depend on fallible assumptions. This paper discusses inferential robustness as a strategy for justifying evidence claims in spite of this fallibility. I argue that robustness can be understood as a means of establishing the partial security of evidence claims. An evidence claim is secure relative to an epistemic situation if it remains true in all scenarios that are epistemically possible relative to that epistemic situation.
