Would democratic theory in its empirical and normative guises be in a better position without the theory of the deliberative public sphere? In this paper I explore recent theories of agonistic democracy that have answered this question in the affirmative. I question their assertionthat the theory of the public sphere should be abandoned in favor of a model of democratic politics based on political contestation. Furthermore, I explore one of the fundamental assumptionsat work in the debate about the theory of the public spheres status, namely the assumed opposition between consensus and contestation. Questioning the rigid nature of the opposition, I go on to argue that the deliberative theory of the public sphere actually facilitates the development of the agonistic approach to democratic theory and practice. Jonathan Aldred shares our desire to promote a reconciliation between social choice theory and deliberative democracy in the interests of a more comprehensive and compelling account of democracy.1 His comments on some details of our analysis – specifically, our use of Arrow’s conditions of universal domain and independence of irrelevant alternatives – give us an opportunity to clarify our position. His discussion of the independence condition in particular identifies some ambiguity in our exposition, and as such is useful. We are less impressed by the way Aldred characterizes the overall terms of the reconciliation we propose. We believe that his argument on this matter should be resisted because it provides deliberative democrats with a bad excuse to dismiss social choice theory altogether, which is surely not what he intends.

(forthcoming) in Social and Ethical Implications of Nanotechnology edited by Fritz Allhoff, Patrick Lin, et. al. Nanotechnology offers society both great promise and potential peril. In order to ensure that we take reasonable steps to capitalise upon the former and yet avoid (or minimise the risk of ) the latter we must ensure that these new technologies are ethically regulated. In this paper I consider some of the diverse ethical and social concerns that arise with respect to nanotechnology from the perspective of the normative theory of deliberative democracy. Following the account of deliberative democracy advanced by Amy Gutmann and Dennis Thompson (1996, 2004) I argue that a second-order social analysis of nanotechnology is necessary. Such an analysis seeks not a win a philosophical argument among rival first-order moral theories, but rather it searches for ways of dealing with the claims of the conflicting first-order theories that arise in debates concerning nanotechnology.
The pragmatist view of politics is at its very heart epistemic, for it treats morals and politics as a kind of deliberation or inquiry, not terribly unlike other kinds of inquiry. With the exception of Richard Rorty, the pragmatists argue that morals and politics, like science, aim at the truth or at getting things right and that the best method for achieving this aim is a method they sometimes call the scientific method or the method of intelligence – what would now be termed deliberative democracy. Hence, the pragmatists offer an argument for democracy which appeals to the quality of the decisions supplied by democratic procedure. Why should we value decisions that are the products of voting after open debate over private decision-making and then voting, over bargaining, or over elimination of those who disagree with us? We should value them because the deliberative democratic method is more likely to give us true or right or justified answers to our questions. Rorty, of course, thinks that no inquiry aims at the truth and that nothing about pragmatism speaks in democracy’s favor. This paper will show how his brand of pragmatism betrays what is good and deeply interesting in the pragmatist tradition.
The two most influential traditions of contemporary theorizing about democracy, social choice theory and deliberative democracy, are generally thought to be at loggerheads, in that the former demonstrates the impossibility, instability or meaninglessness of the rational collective outcomes sought by the latter. We argue that the two traditions can be reconciled. After expounding the central Arrow and Gibbard-Satterthwaite impossibility results, we reassess their implications, identifying the conditions under which meaningful democratic decision making is possible. We argue that deliberation can promote these conditions, and hence that social choice theory suggests not that democratic decision making is impossible, but rather that democracy must have a deliberative aspect.
In recent work, Cheryl Misak has developed a novel justification of deliberative democracy rooted in Peircean epistemology. In this article, the author expands Misak's arguments to show that not only does Peircean pragmatism provide a justification for deliberative democracy that is more compelling than the justifications offered by competing liberal and discursivist views, but also fixes a specific conception of deliberative politics that is perfectionist rather than neutralist. The article concludes with a discussion of whether the `epistemic perfectionism' implied by the pragmatist argument could be endorsed by liberal democrats. Recent discussion in democratic theory has seen a revival of interest in pragmatism. Drawing on the work of C. S. Peirce, Cheryl Misak and Robert Talisse have argued that a form of deliberative democracy is justified as the means for citizens to assure themselves of the truth of their beliefs. In this article, I suggest that the Peircean account of deliberative democracy is conceived too narrowly. It takes its force from seeing citizens as intellectual inquirers, something that I argue is both problematic in itself and relies on a controversial understanding of truth and inquiry. The article goes on to propose reasons for favouring a Deweyan rather than a Peircean account of democracy, one in which deliberation is seen not simply as a matter of arriving at the truth, but as part of a broader view of human flourishing.
This paper offers two potential worries in Robert B. Talisse's A Pragmatist Philosophy of Democracy. The first worry is that is that the picture of democracy on offer is incomplete. While Talisse correctly argues that democracy is about more than elections, democracy is also about more than deliberation between citizens. Talisse's deliberative democracy is problematic to the degree its view of deliberation fails to account for democracy. The second worry we may have concerns the relationship between Talisse's Peircean pragmatism and deliberative democracy. If this pragmatism is always open to revision and change in light of future evidence, then no pragmatist should adhere to only one particular political system, such as democracy. When we claim that only one system can ever be justified, then we fail to honour our professed openness to revision and change in the future. If my analysis is correct, then I do not aim to demonstrate that Talisse's Peircean pragmatism is incorrect, only incomplete. Thus, the hope of this paper is to help develop this pragmatism further.
In this article I argue for a model of Deweyan 'critical pragmatism' as a therapeutic alternative to traditional models of deliberative democracy that have been crippled by their inheritance of the threadbare liberal/communitarian debate. By orienting my discussion here with respect to the most serious radical democratic challenges to deliberative democracy, I hope to show how Deweyan critical pragmatism may help us develop new approaches to the theory and practice of deliberation that are both more attuned to power relations than traditional models and make more inventive use of everyday life to pursue more meaningful deliberative opportunities for citizens.
