Procedural standards for governmental actions: Case studies on privatizations of state-owned enterprises in thailand (มาตรฐานการดำเนินการของรัฐ – กรณีศึกษาการแปรรูปรัฐวิสาหกิจของไทย)
| Abstract | This article is aimed at analyzing two problematic cases of privatizations of the Electricity Generating Authority of Thailand (EGAT) and Petroleum Authority of Thailand (PTT) in order to point out those allegedly tremendous damages caused by government negligence in compliance with procedural standards of governmental actions. The procedural standards of government actions have been incorporated in many of Thai modern laws. Today the government is seeking to push economic reform which follows by tremendous monetary concerns; however, the principle of procedural standards of governmental actions has been applied to maintain balances against the government. The government has to strictly take new standards and risks into account. This article is divided into 3 parts: the first two parts explain briefly on law and economics and applications in legal contexts, the third part analyzes procedural standards of governmental actions of those two cases. | |||||||||
