This article explores and critiques Ronald Dworkin's arguments on the value of integrity in law. Dworkin presents integrity in both legislation and adjudication as holding inherent political value. I defend an alternative theory of the value of integrity, according to which integrity holds instrumental value as part of a legal framework that seeks to realise a particular set of basic values taken to underpin the legal system as a whole. It is argued that this instrumental-value theory explains the value of integrity more satisfactorily than Dworkin's inherent-value account. The article concludes with a discussion of Dworkin's 'one right answer thesis'. Although the proposed theory of integrity does not support a strong version of Dworkin's thesis, it does suggest that there will be a single correct answer to legal questions more often than for normative deliberation generally.

The demandingness of act consequentialism (AC) is well-known and has received much sophisticated treatment.1 Few have been content to defend AC’s demands. Much of the response has been to jettison AC in favor of a similar, though significantly less demanding view.2 The popularity of this response is easy to understand. Excessive demandingness appears to be a strong mark against any moral theory. And if excessive demandingness is a worry of this kind, AC’s goose appears cooked: attempts to show that AC is not particularly demanding are implausible at best. While it isn't clear that we are right to value integrity — or so I shall argue — most of us do. Persons of integrity merit respect. Compromising one's integrity — or failing completely to exhibit it — seems a serious flaw. Two influential accounts suggest why. For Bernard Williams, integrity is 'a person's sticking by what [she] regards as ethically necessary or worthwhile.'2 To this Cheshire Calhoun adds a helpful negative gloss:To lack integrity is to underrate both formulating and exemplifying one's own views. In this paper I will develop the argument that a cognitivist and virtue ethical approach to moral reasons is the only approach that can sustain a non-alienated relation to one’s character and ethical commitments. [Thomas, 2005] As a corollary of this claim, I will argue that moral reasons must be understood as reasonably partial. A view of this kind can, nevertheless, recognise the existence of general and positive obligations to humanity. Doing so does not undermine the view by leading to a highly demanding view of morality. Indeed, it offers a defence against the view that an analogy between obligations of immediate rescue to particular individuals and general and positive obligations to humanity leads to the conclusion that morality is highly demanding. The paper deals with a charge that is often made against consequentialist moral theories: that they are unacceptably demanding. This is called the Overdemandingness Objection. The paper first distinguishes three interpretations of the Objection as based on the three dimensions of moral demands: scope, content, and authority. It is then argued that neither the scope, nor the content-based understanding of the Objection is viable. Constraining the scope of consequentialism is neither helpful, nor justified, hence the pervasiveness of consequentialism cannot be the ground for the Objection. Although recent approaches interpret the Objection as a claim about the excessively demanding content of consequentialism, it is argued that the stringency of consequentialism is also unproblematic insofar as demandingness is concerned. These results show that the only way to put the Objection is by focusing on the inescapability of consequentialism. The Objection thus takes the following form: consequentialism is overdemanding because it requires us, with decisive force, to do things that we do not have decisive reason to perform. However, in the last part of the paper it is shown that defending this interpretation of the Objection is at best an open-ended and perilous enterprise. The paper concludes that the case for authority is weak: although this is the only defensible way to advocate the Objection, its successful defence depends on the truth of further substantial philosophical positions.

Consequentialism is often charged with demandingness objections which arise in response to the theory’s commitment to impartiality. It might be thought that the only way that consequentialists can avoid such demandingness objections is by dropping their commitment to impartialism. However, I outline and defend a framework within which all reasons for action are impartially grounded, yet which can avoid demandingness objections. I defend this framework against what might appear to be a strong objection, namely the claim that anyone who accepts the theory will be practically irrational.

Consequentialism, many philosophers have claimed, asks too much of us to be a plausible ethical theory. Indeed, the theory's severe demandingness is often claimed to be its chief flaw. My thesis is that as we come to better understand this objection, we see that, even if it signals or tracks the existence of a real problem for Consequentialism, it cannot itself be a fundamental problem with the view. The objection cannot itself provide good reason to break with Consequentialism, because it must presuppose prior and independent breaks with the view. The way the objection measures the demandingness of an ethical theory reflects rather than justifies being in the grip of key anti-Consequentialist conclusions. We should reject Consequentialism independently of the Objection or not at all. Thus, we can reduce by one the list of worrisome fundamental complaints against Consequentialism.

This paper’s first section invokes a relevant meta-ethical principle about what a moral theory needs in order to be plausible and superior to its rivals. In subsequent sections, I try to pinpoint exactly what the demandingness objection has been taken to be. I try to explain how the demandingness objection developed in reaction to impartial act-consequentialism’s requirement of beneficence toward strangers. In zeroing in on the demandingness objection, I distinguish it from other, more or less closely related, objections. In particular, I discuss arguments put forward by Bernard Williams concerning integrity, Samuel Scheffler on prerogatives, and Liam Murphy on fairness. The final part of the paper acknowledges some ways in which vagueness bedevils my own rule-consequentialism’s rules about doing good and preventing disasters.
